The mandate provided very limited time for the group to deliberate and did not allow the complete perimeter to be addressed in the necessary depth. The IEG therefore decided to make sure it covered areas where short-term advice actions were potentially needed and where its own expertise could contribute. Nevertheless the IEG was also able to review the entire spectrum of aviation RDT&E infrastructure (identifying several additional areas as potential "strategic RDT&E capabilities", ranging from aero-engine testing and ATM, E-infrastructures and large scale demonstrators to production technology capabilities) and to recommend further work on these and other topics that it considered necessary to provide a complete and in depth review in the longer term. -

Dear Human Rights Defender, I’m writing to you because I think you understand that securing basic human rights has always hinged on the success of daily battles for civil liberties and human dignity. I think you would also agree that human rights and civil liberties are only truly present when they are available to all people, especially the most vulnerable among us. I founded the Human Rights Defense Center and our monthly magazine, Prison Legal News, on these principles, and as a result the organization has focused its efforts on responding to the constant flow of injustices stemming from America’s jails and prisons. As the Russian novelist Fyodor Dostoevsky said, “The degree of civilization in a society can be judged by entering its prisons.” That doesn’t bode well for this country, where we have 5% of the world’s population and 25% of the world’s prisoners. With more than 2.4 million people in U.S. prisons, jails and other detention facilities, and approximately another 5 million on probation or parole, this country has been faced with an unprecedented rate of mass incarceration, the likes of which the world has never seen. It is what some have called a Fill out the attached slip to receive a sample issue of PLN! “Nation Inside”— others have called it “The New Jim Crow.” More than 60 percent of prisoners in the Nation Inside identify as African American or Latino men, despite those demographics making up only 15 percent of the male population in the U.S. It is difficult to overstate the impact of institutional racism and classism in the criminal justice system. -

The complainant alleged fraud, waste, and mismanagement at the Housing Authority in the areas of: · procurement, · use of Comprehensive Improvement Assistance Program (CIAP) grant funds, · travel, · the award of Section 8 Vouchers and Mutual Help homes, · calculation of payments for Mutual Help homes, and · maintenance of Mutual Help homes. We did not substantiate the allegations in the complaint relating to procurement, use of CIAP grant funds, and travel. However, we determined that the allegations relating to the award of a Section 8 Voucher and a Mutual Help home, calculation of payments for Mutual Help homes, and maintenance of Mutual Help homes were valid. As provided in HUD Handbook 2000.6 REV-2, within 60 days, please provide us, for each recommendation in this report, a status report on: (1) the corrective action 98-SE-207-1001 taken; (2) the proposed corrective action and the date to be completed; or (3) why action is considered unnecessary. Also, please furnish us copies of any correspondence or directives issued because of this review. A copy of this report has been provided to the Housing Authority and the office of Congressman Jack Metcalf. -
Explaining the Differing U.S. and Eu Positions on the Boeing/Mcdonnell-Douglas Merger: Avoiding Another Near-Miss Ericj
EXPLAINING THE DIFFERING U.S. AND EU POSITIONS ON THE BOEING/MCDONNELL-DOUGLAS MERGER: AVOIDING ANOTHER NEAR-MISS ERICJ. STOCK* 1. BACKGROUND Given the way that the controversy over the Boeing/McDonnell-Douglas merger was portrayed in the media, one might conclude that the dispute was solely about U.S. and EU authorities attempting to protect their national interests and their own "national champion" aircraft manufacturer. As has been previously pointed out,' however, the Boeing/McDonnell- Douglas merger raised a number of controversial economic and legal questions, and the differing conclusions reached on opposite sides of the Atlantic can also be explained by fundamental differences in the legal philosophies and economic assumptions of the U.S. and European merger-review authorities. This article attempts to identify and elaborate on some of these differences as manifested in the opposing conclusions in the Boeing/McDonnell-Douglas case. Without attempting to resolve which enforcement body's approach is preferable, the article identifies various limitations and questionable economic assumptions underlying each body's analysis and concludes that both sides of the Atlantic could benefit from a more balanced and comprehensive approach. The article begins, in Section 1, by providing the background for the dispute over the Boeing/McDonnell-Douglas merger, including: (1) identifying the U.S. and EU bodies responsible for * J.D., Harvard Law School, magna cum laude, 1998. Evans, the Ninth Circuit held that the International Whaling Commission (“IWC”) Schedule’s approval of a quota to hunt whales for the Native American Makah Tribe (“Makahs”) violated the Marine Mammal Protection Act. The implications of this holding were troubling: despite the U.S. government and the IWC approving, on domestic and international levels, the Makahs’ whaling proposal in the 1990s, the Makahs were still unable to hunt whales legally. The Makahs’ right to whale stemmed from the 1855 Neah Bay Treaty, an agreement between the Makahs and the U.S. government in which the government promised the Makahs the right to whale. However, the enactment of a domestic law called the Whaling Convention Act in 1949 superseded the treaty, rendering it void. -

NOTE THE BOEING/MCDONNELL DOUGLAS MERGER REVIEW: A SERIOUS STRETCH OF EUROPEAN COMPETITION POWERS I. INTRODUCTION In 1990, just before the long-awaited Merger Regulation1 promulgated by the then-titled European Economic Community was to take effect, a leading scholar on European competition law, Barry Hawk, predicted that the European Commission's (EC) "broad remedial powers under the Regulation may raise jurisdictional and comity issues if the EC attempts to invoke them in transactions involving non-Community firms."2 Today, this prediction has become a stark reality, most recently evi- denced by the heated controversy surrounding the EC's review of the merger between Boeing and McDonnell Douglas, two U.S. aircraft manufacturing giants. The EC, as part of a remedial condition of its approval of the merger under the Merger Regulation, insisted that Boeing relinquish "exclusive supply" contracts that the manufacturer had sealed with three U.S.
