145. APOLOGIES FOR ABSENCE

Apologies for absence were received from Councillors A M Day, J A Hale, J E C Harris, D H James, C E Lloyd, D Phillips, C L Philpott, J C Richards, G J Tanner and C Thomas.

146. DISCLOSURES OF PERSONAL AND PREJUDICIAL INTEREST

The Deputy Head of Legal, Democratic Services and Procurement gave advice regarding any potential personal and prejudicial interests that Councillors may have on the agenda.

The Deputy Head of Democratic Services reminded Councillors that the yellow “Disclosures of Councillors Personal / Prejudicial Interests” sheet should only be completed if the Councillor actually had an interest to declare. Nil returns were not required. Councillors were also informed that any declarable interest must be made orally and in writing on the sheet.

In accordance with the provisions of the Code of Conduct adopted by the City and County of Swansea the following interests were declared:

1) Councillor J E Burtonshaw declared a personal interest in Minute 153 “Care and Social Services Inspectorate (CSSIW) Annual Council Performance Evaluation Report 2011- 2012 on Social Services in Swansea” and stated that she had a dispensation from the Standards Committee to remain, speak and vote on any item relating to general staff employment, on budget matters and on any other matters that directly affect her sister’s grand daughter by specific reference to her post;

2) Councillor M Thomas declared a personal interest in Minute 153 “Care and Social Services Inspectorate Wales (CSSIW) Annual Council Performance Evaluation Report 2011-2012 on Social Services in Swansea” and stated that he had a dispensation from the Standards Committee to remain, speak but not vote on any item relating to general staff employment, on budget matters and on any other matters that directly affect his wife by specific reference to her post;

3) Councillors N J Davies, C A Holley, B Hopkins, D H Hopkins, A J Jones, P Lloyd and N M Ronconi-Woollard declared a personal interest in Minute 153 “Care and Social Services Inspectorate Wales (CSSIW) Annual Council Performance Evaluation Report 2011-2012 on Social Services in Swansea;

4) Councillors A C S Colburn and C M R W D Thomas declared a personal interest in Minute 154 “Adoption of the Council Tax Reduction Scheme”.

RESOLVED that the Minutes of the:

1) Ordinary Meeting of Council held on 20 December 2012 be approved and signed as a correct record.

148. ANNOUNCEMENTS OF THE CHAIR OF COUNCIL

1) ASH Wales – Tobacco Control Excellence Awards

The Chair of Council referred to the between the Authority and the Voluntary Sector which had recently received the Tobacco Control Excellence Award for their work with the community of Bonymaen in trying to reduce smoking.

He stated that the work of the partnership had led to the development of a “Smoke Free Home” DVD. He congratulated the partnership on their excellent work and for being awarded the ASH Wales award.

2) New Year Honours

The Chair of Council congratulated the following citizens of the City and County of Swansea who had received awards in the New Year Honours. He stated that the Lord Mayor would be writing to each of the citizens congratulating them on their awards.

a) Order of the British Empire (OBE)

i) Eleanor Mary Simmonds (OBE) of the Maritime Quarter for services to Paralympic Sport.

b) Member of the British Empire (MBE)

i) Robert Croft (MBE) of Pontarddulais for services to ;

ii) Phillip Gyles Hodge (MBE) of Morriston for services to Reducing Transport Fraud;

iii) Virginia Prifti (MBE) of Llanmadog for services to Charitable Services in the UK and Southern Africa (founder of Lawrence’s Roundabout Well Appeal);

iv) Dr Eleanor Williams (MBE) of Mumbles for services to Healthcare and for Charitable Services in South Wales and Overseas.

3) Amendments / Corrections to the Council Summons

The Chair of Council stated that an “Amendments / Corrections to the Council Summons” sheet had been circulated at the meeting. The amendments / corrections being as follows:

a) Item 8a) “Membership of Committees”

An amended report has been circulated following additional changes put forward by the Political Groups.

b) Item 10a) “Adoption of the Council Tax Reduction Scheme”

Delete reference to “Mumbles” and “Morriston”. Replace with “Penderry” and “Townhill”.

c) Item 11a). “Amendments to the Council Constitution – Council Procedure Rules”

Page 63. Paragraph 17.12 b). Delete reference to “of the Council”.

d) Item 11b). “Member Champions”

Page 78. Paragraph 1.5 a). Delete reference to “asses”. Replace with “assess”.

e) Item 12) “Written Responses to Questions asked at the last Ordinary Meeting of Council” – Question 4

Delete all of the words from and including “Swansea Stadium Management Company” on top of Page 88 to “This was signed off by Officers, under delegations after having established that it represented best consideration” on middle of Page 89.

In addition to the Amendments / Corrections to the Council Summons” sheet, the following were raised at the meeting:

f) Item 10a) “Adoption of the Council Tax Reduction Scheme”

The Chair of Council stated that this report was being withdrawn due to the Welsh Government amending the regulations.

149. ANNOUNCEMENTS OF THE LEADER OF THE COUINCIL

There were no announcements made by the Leader of the Council.

150. PUBLIC QUESTIONS

A number of questions were asked by members of the public. The relevant Cabinet Member responded accordingly. Those questions requiring a written response are listed below:

1) Lis Davies asked the relevant Cabinet Member questions in relation to Minute 157 “Written Responses to Questions asked at the last Ordinary Meeting of Council” – Question 2

i) “National Pool - Page 83. The answers provided records an additional income of £491,000, which was not listed in the previous agenda and in Expenditure, additional costs of £575,400, which had not previously been disclosed.

Would you be so kind as to supply me with a detailed breakdown of costs relating to the additional income and additional expenditure of both respective companies?

ii) Waterfront Museum – Page 84. The response identifies an additional income of £164,940 and an incurred additional cost / expenditure of £483,189 (previously not disclosed).

Would you be so kind as to supply me with a detailed breakdown of costs relating to the additional income & additional expenditure of both respective companies?

iii) LC – Page 87. In 2011-2012 it states the total funding awarded to the LC was £793,000 (management fee), £150,000 sinking fund for any major maintenance and £115,000 in respect of Insurance charges and lease costs. (Total £1,058,000).

a) What was the 2012/2013 management fee?

b) How much is currently held by the City and County of Swansea re: the Councils annual sinking fund contribution?

c) Breakdown of any maintenance outlay from the sinking fund?

d) Is the £115,000 an annual payment?

e) Breakdown of how the £115,000 is divided between - Insurance charges and lease costs?

151. PUBLIC PRESENTATION

No Public Presentations were received.

152. MEMBERSHIP OF COMMITTEES

The Citizen, Community Engagement and Democracy Cabinet Member submitted a report which outlined for information the nomination changes which the Leader of the Council had made to the Authority’s Outside Bodies. Councillors were reminded that an amended report had been tabled at the meeting.

a) Abertawe Bro Morgannwg University (ABMU) Community Health Council Remove Councillor W J F Davies. Add Councillor J A Hale.

b) Joint Resilience Committee Remove Councillor J E Burtonshaw. Add Councillor T J Hennegan.

153. CARE AND SOCIAL SERVICES INSPECTORATE WALES (CSSIW) ANNUAL COUNCIL PERFORMANCE EVALUATION REPORT 2011- 2012 ON SOCIAL SERVICES IN SWANSEA

The Wellbeing Cabinet Member presented a report which gave Council an opportunity to consider and scrutinise the CSSIW Annual Council Performance Evaluation Report 2011-2012 on Social Services in the City and County of Swansea.

RESOLVED that Council notes the progress made within the Social Services Directorate and instructs officers to take action to respond and improve the “Areas for Future Development and Risks Areas”.

154. ADOPTION OF THE COUNCIL TAX REDUCTION SCHEME

This item was withdrawn.

155. AMENDMENTS TO THE COUNCIL CONSTITUTION

The Chair of Council, Constitution Working Group and Monitoring Officer jointly submitted a report which sought to make amendments in order to simplify, improve and / or add to the Council Constitution.

The amendments / additions were in relation to Council Procedure Rules specifically Rules of Debate, Notice of Motion, Other Motions, Debates on the Budget and Accounts, Councillors Questions and Public Presentations and Question Time.

RESOLVED that the changes outlined in Appendix A to the report be adopted.

156. MEMBER CHAMPIONS

The Chair of Council, Constitution Working Group and Monitoring Officer jointly submitted a report which outlined the purpose of Member Champions and name those appointed by the Leader of the Council and provide them with a Job Description and Person Specification.

RESOLVED that the Job Description(s) and Person Specification(s) outlined in the Appendices to the report be adopted and placed within the Councillors Handbook.

157. WRITTEN RESPONSES TO QUESTIONS ASKED AT THE LAST ORDINARY MEETING OF COUNCIL

The Head of Legal, Democratic Services and Procurement submitted an information report setting out the written responses to questions asked at the last Ordinary Meeting of Council.

158. COUNCILLORS’ QUESTIONS

1) Part A “Supplementary Questions”

Six (6) Part A “Supplementary Questions” were submitted. The relevant Cabinet Member(s) responded by way of written answers contained within the Council Summons.

2) Part B “Questions Not Requiring Supplementary Questions”

No Part B “Questions Not Requiring Supplementary Questions” were submitted.

159. COMMON SEAL

RESOLVED that the Common Seal be affixed to any document necessary to bring into effect any decisions passed or confirmed at the meeting.
