Completed in 1940, the Project’s Pensacola Dam is the longest multi-arched dam in the world. The Pensacola Dam impounds the waters of the Grand River to form the Grand Lake O’ The Cherokees (Grand Lake). Grand Lake encompasses approximately 46,500 surface acres of water and 1,300 miles of shoreline. The Project boundary is located in close proximity to the shoreline and privately owned land is generally found mere feet from the water’s edge. Since its creation, Grand Lake has been a popular recreational and residential destination. During its history, Grand Lake has hosted the National Governor’s Conference and several nationally recognized fishing tournaments. It is the home of the nation’s oldest long distance regatta on an inland lake and the oldest yacht club in Oklahoma. Current uses of the shoreline include residential and commercial development, agriculture, and wildlife management areas. Grand Lake also has considerable value as an environmental resource. It contains significant aquatic and terrestrial habitat for a host of species. Additionally, the shoreline serves an important function in the local ecology.

Grand River Dam Authority Project No. 1494-453 ORDER ADDRESSING ARGUMENTS RAISED ON REHEARING (Issued September 17, 2020) On April 29, 2020, Commission staff issued a letter order (April 29 Letter Order) finding that Grand River Dam Authority (GRDA), the licensee for the Pensacola Hydroelectric Project No. 1494 (Pensacola Project), is not in violation of Article 5 of the project license. On May 29, 2020, the City of Miami, Oklahoma (City of Miami) timely filed a request for rehearing of the April 29 Letter Order. Pursuant to Allegheny Def. Project v. FERC,1 the rehearing request filed in this proceeding may be deemed denied by operation of law. As permitted by section 313(a) of the Federal Power Act (FPA),2 however, we are modifying the discussion in the April 29 Letter Order and continue to reach the same result in this proceeding, as discussed below.3 I. Public Power: An American Tradition s Grand River Dam Authority Chief Executive Officer and a member of the American Public Power Association (APPA) board of directors, it is a privilege to share with you about “Public APower Week 2007” and the advantages provided by cost-of-service electric utilities, owned by the customers they serve. Each year, the APPA and its 2,000-plus members set aside a week in October to celebrate the American tradition of public power. Producing 14 percent of the nation’s electricity (at not-for-profit and cost-of- service rates), public power touches the lives of nearly 43 million people in every state but Hawaii. Here in Oklahoma, GRDA is proud to partner with towns, cities and other power suppliers to form the state’s public power team. The beneficial partnerships GRDA has with most of its municipal customers are over half a century old, and the growth and development of GRDA over the years Kevin A. Easley is a direct result of a customer desire to always have abundant, low-cost, reliable electricity. From Chief Executive Officer its first four decades as a small hydroelectric supplier to the last 20 years as a major electric supplier for the region, the chief goal of GRDA has never changed: to supply its customers with the power to grow Oklahoma.
