Whitlam As Internationalist: a Centenary Reflection
WHITLAM AS INTERNATIONALIST: A CENTENARY REFLECTION T HE HON MICHAEL KIRBY AC CMG* Edward Gough Whitlam, the 21st Prime Minister of Australia, was born in July 1916. This year is the centenary of his birth. It follows closely on his death in October 2014 when his achievements, including in the law, were widely debated. In this article, the author reviews Whitlam’s particular interest in international law and relations. It outlines the many treaties that were ratified by the Whitlam government, following a long period of comparative disengagement by Australia from international treaty law. The range, variety and significance of the treaties are noted as is Whitlam’s attraction to treaties as a potential source of constitutional power for the enactment of federal laws by the Australian Parliament. This article also reviews Whitlam’s role in the conduct of international relations with Australia’s neighbours, notably the People’s Republic of China, Papua New Guinea, Indonesia and Indochina. The reconfiguration of geopolitical arrangements is noted as is the close engagement with the United Nations, its agencies and multilateralism. Whilst mistakes by Whitlam and his government are acknowledged, his strong emphasis on international law, and treaty law in particular, was timely. It became a signature theme of his government and life. Declan Clausen [email protected] I was privileged to have recently attended the 13th annual Science Meets Parliament conference (SmP) held in Canberra as the recipient of a generous APESMA Scholarship. SmP is organised by scientific lobby group Science and Technology Australia, brings together more than 150 of Australia’s preeminent industrial and research scientists and engineers. The goal of SmP is to allow participants to discuss science with other scientists, the media, influential public servants and parliamentarians. I currently study Environmental Engineering full time at the University of Newcastle, and work part time at the Hunter Water Corporation as an Industry Scholar. Outside of University and work, I am incredibly passionate about politics and policy creation, making SmP a near perfect match for my current skills, qualifications and interest. The first day of SmP began with members of the delegation working in small groups to put together a web outlining the influences on science, politics and public policy. The remainder of the first day was spent discussing these contributing influences including discussions with a media panel, a budget officer from the Commonwealth Treasury, the Deputy Secretary of the Department of Innovation, and with a team from the Centre for Public Awareness who specialise in social media and demonstrated how the new media influences science. These activities provided a detailed insight which would provide participants with knowledge that would set the scene for the rest of the conference. The first day of SmP ended in a spectacular fashion with a formal dinner held in the Great Hall of Parliament House. -

1 Australia and the origins of ASEAN (1967–1975) The origins of the Association of Southeast Asian Nations (ASEAN) and of Australia’s relations with it are bound up in the period of the Cold War in East Asia from the late 1940s, and the serious internal and inter-state conflicts that developed in Southeast Asia in the 1950s and early 1960s. Vietnam and Laos were engulfed in internal wars with external involvement, and conflict ultimately spread to Cambodia. Further conflicts revolved around Indonesia’s unstable internal political order and its opposition to Britain’s efforts to secure the positions of its colonial territories in the region by fostering a federation that could include Malaya, Singapore and the states of North Borneo. The Federation of Malaysia was inaugurated in September 1963, but Singapore was forced to depart in August 1965 and became a separate state. ASEAN was established in August 1967 in an effort to ameliorate the serious tensions among the states that formed it, and to make a contribution towards a more stable regional environment. Australia was intensely interested in all these developments. To discuss these issues, this chapter covers in turn the background to the emergence of interest in regional cooperation in Southeast Asia after the Second World War, the period of Indonesia’s Konfrontasi of Malaysia, the formation of ASEAN and the inauguration of multilateral relations with ASEAN in 1974 by Gough Whitlam’s government, and Australia’s early interactions with ASEAN in the period 1974‒75. 7 ENGAGING THE NEIGHBOURS The Cold War era and early approaches towards regional cooperation The conception of ‘Southeast Asia’ as a distinct region in which states might wish to engage in regional cooperation emerged in an environment of international conflict and the end of the era of Western colonialism.1 Extensive communication and interactions developed in the pre-colonial era, but these were disrupted thoroughly by the arrival of Western powers. -

In the past 20 years Paul Keating, Kim Beazley, Simon Crean, Mark Latham, Beazley again, John Howard, Brendan Nelson, Malcolm Turnbull, Kevin Rudd, Julia Gillard, Rudd again, and now Tony Abbott have all been felled, a procession of change, on average, every 20 months, for 20 years. It shows no sign of slowing. In this context, the Canning by-election could have been called the Cunning by- election. It gave a clear, vindicating victory for Malcolm Turnbull's brazen, lightning coup. So now the vultures will soon be hovering over the obvious loser, Bill Shorten, who made a serious blunder last week that puts him on carrion watch. Having hovered over Abbott for months, the vultures will be riding the political thermals and circling in the sky, watching for Shorten to falter. He just became much more vulnerable. He has never been popular in the opinion polls. He has rarely been impressive in parliament. He was especially unimpressive in the three sitting days leading up to the Canning by-election. Reforming Public Enterprises: Australia REFORMING PUBLIC ENTERPRISES -- CASE STUDIES AUSTRALIA by John Marsden, Marsden, Jacob and Associates Overview of Public Enterprise Prior to Reform 1. Government business enterprises (GBEs) were a dominant part of Australian life until the late 1980s. At that time, GBEs accounted for almost 10 per cent of gross domestic product, and 16 per cent of net capital stock and were the sole suppliers of electricity, water, gas and communication services for most Australians. In addition, all State and territory governments were involved in banking, finance and transport. While the Commonwealth owned and operated Australia Post, Telecom and two airlines, the majority of GBEs were then, and remain now, under State and territory government ownership and management. 2. Distinguishing features of State and territory GBEs were their limitation to within State boundaries, and specialisation within sectors. 3. GBE reform in Australia was essentially a private and individual matter for each government until 1990 when Prime Minister Hawke and New South Wales Premier Greiner combined to establish the Special Premier’s Conference (SPC) process. Prior to 1990, each government had adopted and pursued their own agenda of reform and there was little or no interchange or discussion between the various governments. The assembling of all Australian governments to address issues of micro-economic policy under the SPCs and the subsequent meetings of the Council of Australian Government (COAG) has co- ordinated, extended and documented GBE reform. However, observations of key events and drivers in the process of GBE reform prior to 1990 are necessarily personal and selective. Figure 1.1. -

What will a Labor Government mean for Defence Industry in Australia? Hon Greg Combet AM Opinion polls suggest a change of government in the Australian Federal election in (expected) May 2019. An incoming Labor Government led by Bill Shorten will likely feature Richard Marles as Minister for Defence and Mike Kelly as Assisting Minister for Defence Industry and Support. Jason Clare, a former Minister for Defence Matériel, would likely have influence upon the defence industry portfolio in his potential role as Minister for Trade and Investment. Under a Labor Government, it is possible Shorten would appoint a new Minister for Defence Matériel (as has been an established practice for many years) given the magnitude of expenditure and complexity of the portfolio. Shorten and Marles have been associates since university and have been closely aligned during their trade union and political careers. With extensive practical experience of the Australian industry, Shorten and Marles have a record of working constructively with business leadership. Both have a sound understanding of the role and the significance of defence industry in Australia. Marles, in particular, has a greater interest in national security and strategic issues and would likely concentrate on these in the portfolio and delegate aspects of defence industry to a ministerial colleague. Labor’s defence industry policy was reviewed and adopted during the December 2018 Party National Conference. The policy is consistent with Labor’s approach when it was last in government, reiterating support for: • an Australian defence industry that provides the Australian Defence Force with the necessary capabilities; • sovereign industrial capability where required, specifically identifying naval shipbuilding; • an export focus; • the maximisation of the participation of small-to-medium enterprises (SMEs) in defence projects; and • initiatives to develop workforce skills. -
