EXECUTIVE SUMMARY 1. PMO is implementing the Pehur High Level Canal Extension Project with the financial assistance from Asian Development Bank (ADB). The project aims to increase agriculture productivity and farm income through bringing rain-fed land under sustainable regular canal irrigation system and to improve the capacity of beneficiaries for efficient use of water and agriculture. The project has been divided into three lots for construction purposes; therefore, three (3) separate LARPs (lot-wise) were prepared and approved by ADB in April and May 2019. 2. Implementation of LAPRs is monitored internally by the PMO and semi-annual Internal Monitoring Reports are shared with ADB. This semi-annual internal monitoring report covering LARP implementation progress for the period from Jan 2021 to June 2021 of PHLCE project. The LARP implementation and monitoring constraints faced due to Covid-19 pandemic and frequent strikes by the land revenue department staff which caused delays in retrieval of compensation payment record and sluggish progress in issuance of corrigendum under various Section of the Land Acquisition Act in various mouzas/ villages by the respective land acquisition collector/ District Land Revenue Officer. In spite of encountered hurdles, exhaustive efforts have been continued by the PMO and PIC staff, who approached the remaining unpaid APs/ DPs, facilitated DPs in resolution of impediments as well as in processing of claims and documented the statements for DPs having legal and administrative impediments. The detail of unpaid DPs having impediments with scanned copies of documents recorded are available with this report as at Appendix-1, 2 & 3, while some sample copies are annexed at end of the report. 3. The field staff of PMO and PIC thoroughly supported the revenue department staff to expedite the disbursement of compensation to the APs/ DPs. The field data for LARP 1, 2 & 3 are collected by PMO/ PIC field staff and prepared all the requisite documents about legal impediments of unpaid APs/ DPs. To accelerate the progress of disbursement of compensation, PMO and PIC staff conducted consultation meetings and awareness campaign repeatedly to outreach the APs/DPs and local communities in all affected mouzas and such consultation meetings were recorded as activity reports. A scanned copy of such activity report is added as Annex-4. Announcement in each village masjid were made for disbursement of all sorts of compensation amounts. In the Jumma prayers announcements were repeated. Banners were displayed at prominent places in the village/ mouzas. Advertisements on radio were transmitted advising APs/ DPs for receiving compensation amount from the concern tehsil revenue department. Since issuance of the corrigendum notification under various provisions of LAA in certain mouzas is a time consuming job, therefore, in the previous MTR mission of ADB it was decided that this semi-annual monitoring report for January-June 2021 is prepared for confirming full implementation of LARP1 implementation and seek further clearance of sections in the mouzas/ structures not effected by the pending corrigendum. The mouza, structure and RD wise compensation payment details with status of LARP implementation shown as linear map have been given at Annexure-1 for all three lots. 4. By end of June, 2021 an amount of PKR 1004.28 million (62.66%) of total amount of land compensation payable PKR 1,602.85 million has been disbursed to 12,855 (49.67 %) out of total

25,882 APs (principal acquaintance roll and inheritance mutation so far) for land compensation of 219 (62.83 %) out of total 348.56 acres in all the 25 mouzas (villages) of PHLCE project. Similarly, 655 (63.84%) out of the total 1026 APs received 18.46 (71.1%) out of total 25.97 million crop compensation amount of 219.78 acres crop land in the entire mouzas of the project. Accordingly, 40 (35.40%) out of total 113 APs (so far) have received an amount of 1.47 (47.73%) out of total 3.08 million of trees compensation. The structure compensation amount have also been received by 9 (56 %) out of total 16 DPs amounting 5.4 (77.2%) out of total 6.95 million in the affected mouzas of project. Overall status of disbursement of LARP (land and non-land assets compensation and allowances) lot, mouza/ village and structure wise detail have been given at Annexure-2 for lot-1, 2 and 3 respectively. 5. The PMO is committed to complete the implementation process of LARP in the entire project. On the basis of LARP implementation progress achieved in the reporting period the PMO requested the ERM to validate the compensation and allowances of those paid to APs/ DPs and showing in green RDs (mouza and structure wise) and documented all exhausted efforts to outreach unpaid APs/ DPs having legal and administrative impediments in all three lots till June 2021. The following summarized table ES-1map shows, mouza wise sections/ Running Distances (RDs) in grey colour which had been cleared and allowed for construction based on ERM validation in 1st EMR; the sections/ RDs shown in green colour where LARP implementation has been completed during the monitoring period; and the sections/ RDs in red colour are those where corrigendum notifications are still pending. The sections/ RDs shown in green in Table ES-1 below for each lot are requested for clearance, while the RDs shown in red with pending corrigendum notifications under LAA 1894 will remain on hold until land acquisition process under law is completed and full implementation of Updated or Addendum LARP (if so needed) is confirmed.

The findings of the IMR revealed that compensation payments of 2,628 unpaid APs/ DPs in lot-1, 4,370 APs/ DPs in lot-2 and 4,266 APs/ DPs in lot-3 are impeded due to various reasons like dispute/ court cases, APs working abroad, APs out of city but working in Pakistan, inheritance mutation issue, meager amount compensation, APs out of city and untraceable, APs Juvenile/ lacking of CNIC, APs name need correction (Fard-e-Badar) and APs mentally retarded. Detail lot wise scan copies of impediments are provided as at Appendix- 1, 2 and 3. While some sample copies of recorded documents for APs having legal/administrative impediments are attached as

Based on achieved LARP implementation progress it is confirmed that the all payable DPs are fully compensated and there is no unpaid DPs in section shown as grey and green in above table ES-1 except those having valid legal and administrative impediments. 7. The safeguard management set-up at PMO is responsible for regular coordination meeting, approaching concerned tehsils offices of district Swabi to accelerate LARP implementation progress for disbursement of payment of land and non-land assets, issuances of pending corrigendum, ensuring availability of LARP fund at the district treasury, close liaison with unpaid APs/ DPs, resolving of grievances of APs/ DPs, maintaining all sorts of LARP related record and preparation and submission of regular reports to ADB. The SM team headed by Director Social & Environment responsible for implementation of LARP supported are Deputy Director Environment, Deputy Director Resettlement, Deputy Collector Revenue/ land acquisition, Monitoring and Evaluation Specialist, Zilladar revenue/ land acquisition, Patwaris and team of social organizers. 8. In order to expedite the LARP implementation process, Project Management Office (PMO) has disseminated LARP related information to all concerned APs/ DPs which include but not limited to; Installation of banners at public offices such as DC office, Tehsildar’s offices, Nazim offices and other public places like Masjid’s and Hujra’s of notable’s in the project area. Under exhaustive efforts, the PMO produced information related to LARP implementation through print media i.e. local and national newspapers for awareness of public to receive their compensation. PMO has made a latest attempt to inform the APs/DPs to receive their compensations through installation of around 16 Bill Boards, 25 banners covering each mouza, posters are displayed at main mosques of the targeted mouza’s and concerned tehsil offices. Moreover, the PMO has ensured announcements through loud speakers on regular basis for the information of APs/ DPs regarding their compensations on their door steps. Awareness among the APs/ DPs regarding LARP has been made through television and radio Pakistan. Project Director (PD) PHLCE and DC Swabi, recorded their interviews with radio Pakistan which were broadcasted. PMO, SM team along with the revenue department staff is regularly visiting all the mouza’s under Lot-1, 2 and 3 for the purpose of disbursements. All such consultation visits/activities are recorded that include the attendees list and key issues/concerns discussed and actions taken and/or suggested for follow-up. Further, to facilitate the APs/ DPs and revenue department in processing and payment of compensation, PMO and PIC staff intimate/ provides acquaintance roll serial number to APs in advance and assist them to get requisite claim processing documents and opening of bank accounts even to help expeditious disbursement. The attendance sheets and daily meeting minutes with APs/ DPs attached at Annexure-4. 9. For smooth implementation of project activities, the PHLCE Project Steering Committee meeting under the chairmanship of Additional Chief Secretary, Khyber Pakhtunkhwa was held on 21-12-2020 and Deputy Commissioner Swabi, was directed to ensure disbursement of land compensation on fast tracking by issuing the pending corrigendum and disburse the meager compensation amount to the unpaid APs/ DPs. The minutes of meeting and attendance sheet of PSC, DC Swabi/ ADC and district administration has given at Annexure-5. 10. Similarly, PMO is responsible for payments of allowances such as additional crop, severity, vulnerability and livelihood etc. An allowances disbursement committee has been constituted at PMO under the chairmanship of Director social and environment. The committee members keenly examine every single case with assistance of PMO field staff in order to ascertain the required

The PMO staff after completing all the verifications out in the field, submit its report to the committee and then the vouchers are accordingly signed. As soon as the committee completes its review and signed the cases, cheques are issued to the eligible APs/ DPs for onward payment. The notification of the committee for allowances attached at Annexure-6. 11. For institutional arrangement the project GRM is fully operational, notification attached at Annexure 7. All the APs/ DPs and local community are fully informed on project based GRC available to them through individual meetings and regular community consultation meetings in each mouzas of lot. At present, total 53 complaints/ application have been received and recorded so far. The complaints included demands for adjustment in design alignment, provision of outlets and crossing facilities and concerns related to land acquisition issues and compensation awarded. Nature of complaints and their status are tabulated in tables 5.4 in chapter 5 of the report. Almost all the complaints have been responded by the GRC. Out of 53 recorded complaints 29 were about awarded land compensation, which have been referred to the referee court through district revenue offices. Other, 9 applications are actually demands for providing water for their lands which are not command able from the canal system due to its elevation/ location. These were referred to consultants’ design team for on ground verification who reported and clarified to the applicants that their land are uncommendable due higher elevation from the canal infrastructure which is designed at gravity flow system. Another 19 complaints were regarding adjustment of design alignment of canals traversing through their lands and dividing their land parcels, of which 18 applicants were satisfied with the technical clarification and explanation shared with them during site visit and discussions by the technical staff of the PMO and PIC. The only unresolved one complaint is one of Mr. Farman, who has approached OSPF as well. The OSPF team engaged the complainant and after multiple meetings and consultation a MOU had been drafted and shared with the complainant for signoff by the OSPF, but despite repeated follow-up visits of ADB’s OSPF and project team, the complainant is disinclined to accept and signoff the MOU. Nonetheless coordinated efforts have been ensured by the PMO and ADB’s OSPF but this particular complaint is still resolved mainly due to changing demands and stubborn attitude of the complaint. During reporting period, close liaison was maintained with the complainants and they were informed with the updated status of their complaints. GRC meeting minutes copy attached at Annexure-8.

1 INTRODUCTION 1.1 Project Background

1. Islamic Republic of Pakistan has received a loan for “Pehur High Level Canal Extension Project”, from Asian Development Bank (ADB) loan No. 3470 PAK with the cost of US$ 96.61 including counterpart fund of 10.20 Million for construction. The project is executed by Government of Khyber Pakhtunkhwa, Irrigation Department (GoKPID). This is the semi-annual internal monitoring report on LARP Implementation for the period from January 1st 2021 to 30th June 2021 of PHLCE Project. The progress of disbursement of land and non-land compensation etc. remain low due to Covid-19 pandemic, frequent strikes of revenue department staff and non-issuance of corrigendum and u/s-4 of land acquisitions in various mouzas, yet exhaustive efforts have been made by the PMO and PIC staff and approached the remaining unpaid APs/ DPs and documented accordingly. Additionally, since issuing of the corrigendum and u/s-4 of LAA in certain mouzas is a time consuming job, therefore, the MTR mission of ADB agreed (Para No. 4 of Aide Memoire issued of MTR Nov-Dec 2020) to consider IMR for further clearance in the remaining mouzas/ structures. Furthermore, the ADB's mission visited to Swabi in the case of complainant Mr. Farman on March 12, 2021, where the issue was discussed in-depth and the decision regarding IMR submission reflected in the MTR mission Aide Memoire was endorsed. 2. The Khyber Pakhtunkhwa Irrigation Department (KPID) is the executing agency (EA) and implementing agency (IA) for the construction of canal infrastructure i.e., PHLCE output-1. The other IA is the Provincial Agriculture Department (KPAD)/ Director General On-Farm Water Management (OFWM) for their respective component output-2 of the project. The project management office (PMO) was established in June 2017 at Irrigation House Gohati, Swabi to manage all the project activities associated with LARP. The PMO is headed by a Project Director responsible for execution and implementation of LARP and also to ensure the availability of funds for LARP’s implementation. The Project Director PMO, with the assistance of Director Social & Environment, Deputy Director Resettlement and other staff is responsible for the timely updating, implementation and monitoring of LAR activities.

3. PHLCE Project is classified as category “A” because the involuntary resettlement impact of ADB supported project are considered significant as more than 200 persons are experiencing major impact i.e., losing 10 % or more of their productive assets. 1.2 Project Objectives

4. The Project aims to increase farm and non-farm incomes of households engaged in agriculture mainly in of Khyber Pakhtunkhwa Province. The indicative outcome of the investment project is to increase agriculture productivity and farm incomes. The project will create a new irrigation system to enhance agricultural production in 7,930 hectors in Swabi district of Khyber Pakhtunkhwa Province. The project will also enhance the crop intensity by 166%, improve crop yield and increase farm-related income and directly benefited over 15,000 rural poor people. The Project has the following two major objectives to achieve:

 Bring rain-fed areas of Janda Boka and Indus Ambar under sustainable regular canal irrigation system; and,

 Improve the capacity of beneficiaries to efficiently use water and agriculture.

1.3 Project Description

5. The Project is an extension to the command area of PHLC off taking from the Tunnel which conveys irrigation water from Tarbela Reservoir. Provision of water allocation for the areas of Janda Boka, Indus and Ambar Lift Irrigation Scheme were made in the design of PHLC. But for multiple reasons these lift irrigation schemes could not be constructed at that time. Now with increase in minimum operating level of Turbela dam from 402 m to 422 m irrigation of these high contour areas become possible through gravity flow hence PHLCE Project is taken in hand. The project has been divided into three lots for construction purpose; therefore, three (3) separate LARPs (lot-wise) were prepared and approved by ADB in April and May 2019. More information on the project lots, mouzas, RD wise structures length, acquired land and number of APs/ DPs has been summarized below in Table 1.1. 1.3.1 Lot-01: Janda Boka Pressure Pipeline and Irrigation System 6. The LARP was prepared based on approved project design and alignment of the canal network and pressure pipeline and associated structures. Lot-1 of the project comprises of Pressure Pipe, Main Canal and three (03) Minors canal with cumulated length 14.73 km. Janda Boka Pressure Pipe originates from Gandaf tunnel. Main canal and Minor canal 1 off takes from the Pressure Pipe while minor canals 2 & 3 off take from the Main Canal. According to final detailed engineering design lot-1 covers Command area of 1,413 ha (3,492 acres). A land of 592.85 kanal has been acquired for the irrigation infrastructure of Lot-1. It is pertinent to mentioned that as per approved LARP the actual quantum of land to be acquired for lot-1 was 498.30. While the land collector under section-11 has awarded 592.85 kanal against the requirements. The issue was taken up with the land collector who demanded establishment of boundary pillars on the entire alignment of structures. In January 2020 these boundary pillars were established and the revenue staff accordingly corrected their record. The additional amount paid for the additional area will be adjusted on decisions of appeals made to district land collector against the price and nature of land in various Mouzas. Hence, the LAR impacts remain unchanged. Location map of the Janda Boka area (Lot-1) is annexed as Figure 1.1. 1.3.2 Lot-02: Indus Ambar Pressure Pipeline 7. Pressure Pipeline for Indus and Ambar area is the largest component of the Project representing as Lot-2. It originates from Gandaf tunnel at RD 0+000 mouza Maini Sharqi and terminates at mouza Shah Mansoor, RD 24+800. The entire lot-2 comprises 25.6 km pressure pipeline in length and comprise main Indus Ambar and Mian Dheri pressure pipeline. The entire Indus Ambar pressure pipe is a steel pipe designed for the requisite pressure. This pressure pipe is enclave in 1 ft. thick RCC as an additional protection. A land of 1015.31 kanal has been acquired for the construction of pressure pipe of lot-2. The land quantum to be acquired as per LARP-2 was 917 kanals. The action taken on the issue is similar to that of LARP-1 elaborated in para 6. The pressure pipe crosses main roads like Swabi road and Topi Swabi road beside a number of local roads. The pressure pipe also crosses a number of nullah and canals including Kundal and Badrai khwars beside many water course crossings. The depth of pressure pipe at these crossing is increased and surface is protected by rip-rap stone pitching to safeguard against scour potential at RD 15+570 km of the pressure pipe an outlet is provided to irrigate 265 ha of rain-fed lands of Mian Dheri. Location map of Indus Ambar Pressure Pipeline (lot-2) is annexes at Figure 1.2. 1.3.3 Lot-03: Indus and Ambar Irrigation System 8. Lot-3 comprises of a Main Canal, 2 Distributaries and 7 Minors canal having a cumulated length of 37.4 km. Main canal emanate from the out fall structure of Indus Ambar pressure pipe in mouza Shah Mansoor RD 0+000 crosses different mouzas and ends at mouza Shah Mansoor RD 37+430. Main Canal-01, Minor canal-01 and two distributaries canals are off-taking directly from the outlet-2 pond, whereas the minor canals 2 to 7 are off-taking from the main and distributaries canals. All the canals are gated control from the outlet pond. Similarly, the minor canals from distributaries are also gated control. A land of 1180.30 kanal has been acquired for irrigation infrastructure of lot-3 under the award notification. The land quantum quoted in LARP-3 is 1178.57 kanals. The action taken on the issue is similar to that of LARP-I elaborated in para 6. Location map of Indus and Ambar Irrigation System (Lot-3) is presented as annexes at Figure 1.3.

2 NEED FOR INTERNAL MONITORING REPORT OF LARP IMPLEMENTATION 2.1 Internal Monitoring Requirements of LARPs

9. LARP implementation activities under the Project are subject to both internal and external monitoring. PMO (KPID), with the assistance of PIC, is responsible for internal monitoring of resettlement activities. Internal monitoring is conducted on quarterly basis and this is semi-annual internal monitoring report of LARP implementation for the period from 1st January 2021 to 30th June 2021 of PHLCE project. The progress of disbursement of land and non-land compensation etc. remain low due to Covid-19 pandemic, frequent strikes of revenue department staff and non-issuance of corrigendum and u/s-4 of land acquisitions in various mouzas, yet exhaustive efforts have been made by the PMO and PIC staff and approached the remaining unpaid APs/ DPs and documented accordingly. PMO (KPID) has engaged the services of an External Resettlement Monitor (ERM) through PIC for external monitoring of PHLCE project. On the validation of ERM on QIMR No. 5 (Jan-June 2020) ADB issued NOC for NTP to contractors for about 57 % of length of canal system in October 2020. In this IMR further clearance of canal lengths is being sought for the remaining sections of mouzas in all the three lots (see at Annexure-1). 2.2 Objectives of the Internal Monitoring Report

11. This internal monitoring report presents the safeguards management progress achieved, coordination and consultations efforts carried out to mobilize and assist the APs/ DPs for receiving payment of compensation and redress their grievances. It summarizes the progress on following aspects:

 Delivery of compensation for assets and entitled allowances.  Collection of APs data and preparation of LAR database.  LAR issues and progress.  Activities and actions for the compensation of payment to the APs/ DPs with which efforts were implemented by recording additional documentation as required under ADB’s guidance notes of handling of compensation cases with legal and administrative impediments.  Community consultation and information dissemination activities performed for compensation disbursement and assessment on achievement of LARP objectives.  Updates on recording, and handling of grievances; and  Employment data of APs and local community who got opportunity in the construction work. 2.3 Monitoring Indicators

12. Specific monitoring benchmarks are based on the approved LARP and cover the following: . Mouza (village)/ area wise disbursement of compensation and status of land acquisition in all three lots of PHLCE project;

. Information campaign and consultation with APs; . Status of land acquisition and payments on land compensation; . Status of crop, trees, structures compensation; . Status of payment for all admissible allowances; . Income restoration activities; and . Ensure gender mitigation measures (complaints/grievances) in the LARP are adhered during the quarterly monitoring and reporting process.

3 LARP Implementation Status as of January 2021-June 2021 13. As per LARP, the compensation for land and above land assets awarded under LAA 1894 was deposited in district treasury at disposal of land acquisition collector (LAC) assigned by the Land Revenue Department in the District for completing land acquisition process and disbursement of awarded compensation. While assessed amount for delivery of entitled allowances was provided in project account for its disbursement by the PMO, PHLCP directly. Disbursement of land and non- land compensation awarded under law commenced in October 2019 by the land acquisition collector in district revenue department. While all the allowances mentioned to be paid by PMO were dependent upon the disbursement of land compensation by district revenue staff, so it followed the land compensation payment by the LAC. Over 98 % of allowances have been disbursed by EA to the APs/ DPs who have received land compensation from LAC office, however the land compensation is received by 50% DPs so for because remaining unpaid DPs are not showing-up with valid claim due to recorded legal and administrative impediments including, pending inheritance mutations, juvenile or lunatics unable to delineate the acquired land, absentee land owner DPs not living in the project area and DPs disinterested to collect meager compensation amounts. 3.1 LARP implementation and Monitoring Set-up 14. Nonetheless, the safeguards management set-up placed in the PMO PHLCP as responsible entity for timely and smooth implementation of LARP for PHLCP. under supervision of the Director Social & Environment kept a close liaison with the LAC, district land revenue offices and the DPs to facilitate them in processing of compensation claims and deliver compensation at door steps of the displaced person. The safeguards set-up of PMO headed by Director Social & Environment include Deputy Director Environment and Resettlement, Resettlement Specialist, Deputy Collector Revenue Monitoring and Evaluation Specialist, Zilladar revenue with a team of Patwaris and social organizers. In addition, the Land Acquisition Collector from District Land Revenue Department with land revenue staff is supporting PMO in land acquisition and payment of awarded compensation under LAA 1894. Meanwhile for improved coordination among line departments Project Steering committee is established and functional at P&D level. 15. At project level, the compensation disbursement committee and grievance redress committees are operationalized for disbursement of entitled allowance and redressing grievances of affected communities. The LARP implementation is internally monitored by the safeguards unit in PMO and an External Monitor is engaged to review and validate the monitoring progress and deliver external monitoring reports semi-annually. The sub-section below summarizes LARP implementation and sites handing over approach followed and compensation payment progress achieved for all three lots during the extended monitoring period (i.e. January 2021-June 2021), while the subsequent chapter 4 illustrate lot wise implementation details separately. 3.2 Section wise LARP implementation and handing over of sites 16. The PMO, in consultation with ADB project team adopted section wise LARP implementation approach to facilitate handing over of sections/sites for construction where full implementation of LARP is completed and validated by the External Monitor in parallel with implementation of LARP in other sections/sites. So, the project canal system was segmented RD wise and Mouza wise for LARP implementation and handing over of sites. Accordingly, resources were focused to complete disbursement of compensation and documenting all unpaid DPs having impediments to confirm implementation of LARP in selected sections. This approach helped to clear and hand over many sections in each lot to the contractor based on validation of full implementation of LARP by the external monitor in his 1st Exetrnal Monitoring Report accepted /cleared by ADB in October 2020.

3.3 Overall summary of LARP implementation in all three lots. 17. Since the disbursement of compensation for land and assets by LAC of revenue department progressed slowly due to disinclination of the unpaid DPs to show-up after resolving their issues and issuance of corrigendum notifications under LAA by District Land Revenue Department remained stuck, therefore, all concerned offices including Project Steering Committee have regularly been approached by PMO for expediting LARP implementation during the reporting period. Despite ensured and successive follow-up efforts, the progress on disbursements of land compensation etc. remained very slow due to legal and administrative impediments faced by unpaid APs/DPs, however, the PMO and PIC staff succeeded to document and record statements for most2 of the unpaid APs/DPs having impediments as required under ADB’s guidance note on the unpaid compensation for DP having legal and administrative impediments. Meanwhile due to Covid-19 pandemic out break and frequent strikes by the revenue department staff caused delays in retrieval of compensation payment data and issuance required corrigendum notification under various sections of LAA 1894 for some land parcels in different mouzas/villages. Since issuance of the corrigendum notifications under various sections of LAA to complete land acquisition is a time consuming job. Accordingly this IMR is prepared for the period from January 2021 to June 2021 for confirming full implementation of LARP3 and seek further clearance of sections in the remaining mouzas/ structures not effected by the pending corrigendum. The mouza, structure and RD wise compensation payment details with status of LARP implementation shown as linear map have been included as Annexure-1 for all three lots while lot specific break down of progress and linear maps are presented in chapter 4 of the report. 18. The table below indicates that by end of June, 2021 an amount of PKR 1004.28 million (62.66%) of total amount of land compensation payable PKR 1,602.85 million has been disbursed to 12,855 (49.67 %) out of total 25,882 APs (principal acquaintance roll and inheritance mutation so far) for land compensation of 219 (62.83 %) out of total 348.56 acres in 25 out of total 25 mouzas (villages) in three lots of PHLCE project. Similarly, 655 (63.84%) out of the total 1026 APs received 18.46 (71.1%) out of total 25.97 million crop compensation amount of 219.78 acres crop land in the entire mouzas of the project. Accordingly, 40 (35.40%) out of total 113 APs (so far) have been received an amount of 1.47 (47.73%) out of total 3.08 million of trees compensation. The structure compensation amount have also been received by 9 (56 %) out of total 16 DPs amounting 5.4 (77.2%) out of total 6.95 million in the affected mouzas of project. Overall status of disbursement of LARP (land and non- land assets compensation and allowances) lot, mouza/ village and structure wise detail have been given at Annexure-2 for lot-1, 2 and 3 respectively. While more details on compensation and allowances disbursement have been provided in section 4 of this report for each lot separately. For comparative analysis lot wise summary of compensation, disbursement and LAR impacts, (land, Crops, Trees & Structures) progress of payments during reporting period (1st January 2021- 30th June 2021) are presented in the below Table 3.1, 3.2, 3.3, 3.4 & 3.5.

LARP Implementation progress on disbursements of land compensation etc. remained very slow particularly because of unpaid APs/DPs having legal and administrative impediments are unenthusiastic to resolve their issues and show-up with valid claim documents for payment of compensation. Further ongoing Covid-19 pandemic coupled with frequent strikes by revenue department staff also contributed to sluggish progress in compensation payment and issuance of corrigendum notifications under various sections of Land Acquisition Act 1894 for a few sections of Lot-1, Lot-2 and Lot-3 in different mouzas. Despite encountered constraints, exhaustive efforts have been made by the PMO and PIC staff (Director Social and Environment, Social Safeguard Team including social mobilizers, deputy collector and revenue staff) to approach the remaining unpaid APs/ DPs to facilitate them in resolving their issues, processing of their claims and documenting additional statements following templates provided in ADB’s guidance notes for handling of compensation cases with legal and administrative impediment from January to June 2021. The field staff of PMO and PIC thoroughly supported the revenue department staff to expedite the disbursement of compensation to the APs/ DPs. The field data for LARP 1, 2 & 3 are collected by PMO/ PIC field staff and prepared all the requisite legal impediments of unpaid APs/ DPs. To accelerate the progress of disbursement of compensation PMO and PIC staff conducted consultation meetings and awareness campaign in all affected mouzas/ community level for APs/ DPs. Announcement in each village masjid were made to collect all sorts of compensation amounts. In the Jumma prayers these announcements were repeated. Banners were displayed in the village/ mouzas prominent places. Advertisements on radio were made for receiving compensation amount from the concern tehsil revenue department. 20. Meanwhile, the district land revenue department and the BOR KPK authorities were pursued for issuing the corrigendum notification under various sections of the LAA 1894 to complete land acquisition process for identified linear section/ RDs (highlighted red in annex -1 and linear maps provide for each lot) different canal structures in lot-1, lot-2 and lot-3. Since, issuance of corrigendum and completing land acquisition by the district land revenue department is a cumbersome and time consuming activity beyond PMO’s control, therefore, no much progress was made to that extent. Accordingly, this IMR is finalized to show achieved progress about efforts exhausted, compensation paid to all payable and additional documents recorded for unpaid DPs having legal/administrative impediments and to request clearance of sections in the mouzas/ structures presented as green on linear maps devised for each lot and in the Annexure-1 provided at the end of the report. 21. The PMO and PIC staff during reporting period (January-June 2021), conducted continuous exhaustive efforts accomplished through the utilization of all sources to inform and mobilize all the unpaid APs/ DPs in the entire project affected villages to get compensation of their acquired land etc., and resolve their issue related to land etc. The overall compensation payment details are summarized in previous section, while the lot wise detail of disbursement of compensation and allowances during reporting period are presented as under. 4.2 Lot-1: Janda Boka Pressure Pipeline and Irrigation System

22. Under the land award of section-11 of LAA 1894 acquaintance roll has been prepared for all the four (4) mouzas Maini Sharqi, Maini Gharbi, Malikabad and Pabaini of lot-1 by the LAC of land

revenue department of district Swabi. According to “land award” a total of 592.85 kanals (74.11 acres) of land of 4,934 APs/ DPs has been acquired for Lot-1: Janda Boka Pressure Pipeline and Irrigation System of the project. All the “awarded amount” compensation of land, crops, trees and built-up areas has been deposited in the district treasury department by the Khyber Pakhtunkhwa Irrigation Department (KPID). Mouza wise detail of awarded compensation amount for land, crops, trees, built- up area and number of APs/ DPs are presented in below Table 4.1. 4.2.1 Disbursement of Land Compensation in Lot-1 23. According to the available acquaintance rolls of lot-1, the number of APs/ DPs of all the four (4) mouzas Maini Sharqi, Maini Gharbi, Malik Abad and Pabini are 4,934 (4,371 APs as of principal acquaintance roll and 563 as per mutation cases so far). The increase in no. of AP/ DPs in principal acquaintance rolls is due to affected inheritance mutation of land owned by deceased APs/DPs and inclusion of names of their legal heirs as additional APs/DPs for same awarded amount and quantum of acquired land by the revenue department. Till June 2021 the disbursement of awarded land compensation in the entire mouza/ villages of lot-1, an amount of PKR 180.43 (62.87 %) out of total 286.98 million has been disbursed to 2,137 (43.31%) out of total 4,934 APs/ DPs entitled for land compensation, while 42.95 (58 %) acres of land out of total 74.11 acres acquired in all 4 mouzas (villages) of lot-1 has been compensated to respective payable APs. Nonetheless, the left over APs having legal and administrative impediments have been documented and informed to show up with valid compensation claim documents, but physical disbursement of compensation was not feasible until the APs/DPs submit their claims after resolving their issues. So the entitled compensation amount has been secured in the district treasury to ensure the APs could be paid as and when they approach with valid claims after resolving their issues. Mouza/ village wise detail of disbursement of paid awarded land parcel, (see at Annexure-2 for lot-1) while, the gender wise payment status for land compensation along with its percentage is presented in Table 4.2 below. 4.2.2 Pending Payment of Land Compensation in Lot-1 24. The findings of the IMR revealed that left over land payments are impeded due to the following legal and administrative impediments for which required additional documents are recorded following templates provided in the ADB’s guidance notes on handling of compensation cases having legal and administrative impediments. The additional documents recorded for unpaid DPs having impediments in Lot-01 are provided as appendix-1 while sample copies are added at the end of report as Annex -3.

 Stay Order by Civil Court: The land owners/ APs (29 APs having PKR 1.78 million amounts identified so far) have filed their reference and title disputes in the courts that have not been resolved yet and. The compensation could not be paid to them until land compensation and /title issues are resolved/ decided by the competent revenue authorities/ courts. Mouza wise detail of unpaid litigating APs/ DPs in lot-1 is presented in Table 4.3 below and detailed list is available at Appendix-1 of lot-1.

 APs working Abroad/ outside country: As per LAA 1894, APs have to submit their claims supported with valid title documents and receive compensation voucher/ cheque in person after due verification of their documents and record. The staff of PMO regularly contacted their relatives to pursue them for advising the AP to come and get the compensation or nominating his attorney by issuing a valid power of attorney to collect awarded compensation amount on behalf of the unpaid AP. Currently, total of 22 APs having land compensation amount PKR 1.18 million are identified who have been working abroad. Mouza wise unpaid APs/ DPs of Lot-1 living/ working abroad is presented in Table 4.3 below and documents recorded and maintained for DPs living abroad are available in Appendix-1 of lot-1.

 APs out of City but Working in Pakistan: As per available acquaintance roll 34 APs identified having land compensation amount PKR 1.33 million have been out of city but working in Pakistan. Even though they all were informed by their relatives regarding to collect due share amount. Mouza wise out of city unpaid APs/ DPs of lot-1 is presented in Table 4.3 below and documents record and maintained for such APs can be seen in Appendix-1 of lot-1.

 Inheritance mutation issues: The land owners (132 APs amounting PKR 13.86 million so far identified) have passed away which requires mutation of land to the legal heirs. Payments of compensation to legal heirs will be made after mutation of land is affected by the district revenue authority. For this purpose, PMO staff thoroughly supporting the revenue staffs and mobilizing known legal heirs to speed up the mutation process for APs. After inheritance mutation in land record, all heirs of deceased APs will receive entitled compensation as per their inherited share. However, the cases of APs with pending mutation have been documented for entire lot-1 of project following the template provided in ADB’s guidance note. Mouza wise inheritance mutation APs/ DPs of lot-1 is presented in Table 4.3 below and recorded statement from known heirs are available in Appendix-1 of lot-1.

 Awarded Meager4 Compensation Amount: A total 1,457 unpaid APs are entitled to awarded compensation amount less than PKR 5000 (more or less USD 30). Total sum of meager compensation amount is PKR 2.21 million that have not yet been disbursed because APs are not inclined to get valid title documents and submit claims. As procedural requirement, APs have to get the land title documents from land record office, open bank account and appear in person before the LAC and District Accounts Office for verification and receive compensation vouchers and cheques. Due to cumbersome procedural requirements for receiving such a small amount of compensation, APs are reluctant to open bank account as the amount required for opening of bank account is much more than the entitled compensation amount. To facilitate such APs, PMO and PIC staff approached U-bank and Meezan bank as they are opening a bank account for APs irrespective of their compensation amount either with no or nominal prior deposit amounting PKR 500/only. The representatives of U-bank and Meezan bank agreed to open bank account for all such APs having meager amount. The PIC and PMO staff conveyed the message among the APs/ DPs having meager amount of compensation to open her/ his account in the U-bank or Meezan bank. Additionally, through the DC Office, the District Accounts Office has been contacted for provision of open cheques to APs with meagre amounts. The APs/DPs with meager amounts have been completely facilitated through revenue department. Following personnel were nominated by DC Swabi to disburse the meager amount through open vouchers via National Bank of Pakistan. a. Tehsildar of the concern Tehsil/ Lot. b. Patwari of the Mouza c. Representative of Treasury d. Deputy Collector of PHLCE e. Social Organizer

Similarly, those APs/ DPs having meager amount are informed prior a day of the visit of the team at the already marked station. All verification is done on spot and vouchers are issued. The same voucher is presented to the National Bank of Pakistan for onward cash payment to APs/ DPs.

Mouza wise unpaid meager compensation amount of land, and total no. of unpaid APs/ DPs of meager amount of lot-1 is presented in Table 4.3 below and maintained record about documented unpaid APs with meager amount is available in Appendix-1 of lot-1.

 APs Juvenile: Currently a total of 16 APs having compensation amount PKR 0.04 million are juvenile and lack Computerized National Identity Card (CNIC) in lot-1. Such Juvenile APs/DPs can be paid either through their guardian, provided guardianship certificate issued by a competent court is produced or when the juvenile APs gets his CNIN after becoming 18 years old. During reporting period all such APs (juvenile) and their natural guardians have been approached and informed about the process. Accordingly, statements of natural guardians are documented in accordance with given template in ADB’s guidance note. Mouza wise unpaid juvenile APs/ DPs of lot-1 are presented in Table 4.3 below and documented statements of their natural guardians are available in Appendix-1 of lot-1.

 APs informed and committed to receive Compensation: A total of 938 APs/ land owners entitled to compensation amount PKR 59.29 million for Lot-1 have been approached and informed repeatedly by the PMO safeguards staff for processing of their claims receiving compensation amount. During consultation meetings, the unpaid APs/ DPs participating consultation meetings agree to receive compensation of their land etc., but later on under influence of other affected joint owners or family members they do not show-up with valid claims for processing and payment of compensation. In fact the APs have joint ownership of acquired family land and there is disagreement among family members about compensation awarded and its apportionment so as an “entire family” they don’t agree to the compensation rate / amount. In each consultation meeting such group of APs were advised to approach the quarter concerned for challenging awarded compensation, but for unknown reasons they are not lodging the references and appeal etc., against awarded compensation of their respective land. Every time they are approached, they ask for “a time” for taking decision internally by family, but after lapse of time they remain undecided. Mouza wise unpaid informed APs/ DPs of lot-1 is presented in in Table 4.3 below and consultation meetings record (with attendance list of DPs and activity report) held to inform and facilitate payable DPs are included in Appendix-1 and sample copy of one such report is attached as Annex-4. .

4.2.3 Disbursement of Crop Compensation in Lot-1 25. During reporting period (January-June 2021), so far PKR 3.69 (87.09 %) out of total 4.24 million compensation amount of crops has been disbursed to 137 (76.54 %) out of total 179 APs/ DPs in entire lot-1 (see at Annexure-2). Mouza wise crop compensation amount, no. of APs, progress of disbursement and its percentage of lot-1 is presented below in Table 4.4. Remaining undisbursed compensation amount is due for the Unpaid DPs having legal and administrative impediments, which is secured in the treasury account to ensure payment as and when unpaid DPs will show-up with valid claim documents after resolving their issues. In the reporting period (January-June 2021), till now PKR 1.16 (49.62 %) out of total 2.34 million compensation amount of trees has been disbursed to 24 out of total 56 APs/ DPs in entire lot- 1 (see at Annexure-2). Mouza Maini Sharqi and Gharbi of Lot-2 included in the compensation amount of trees and no separate trees acquaintance roll has been prepared by revenue department. The slow progress of tress compensation amount disbursement is due to non-availability of the APs to receive trees compensation amount. Mouza wise awarded trees compensation amount, no. of APs, progress of disbursement and its percentage of lot-1 is presented below in Table 4.5. Remaining

4.2.5 Disbursement of Structure Compensation in Lot-1 27. A total of one small structure has been affected in the entire lot-1 (see at Annexure-2) and no AP/ DPs have to be displaced. Similarly, 1 AP’s structures have been affected according to the C & W department acquaintance roll and but due to pending inheritance mutation the eligible APs has not received their structure compensation amount albeit they have been informed by Revenue, PMO and PIC staff thoroughly. The Mouza wise awarded structure compensation amount, no. of APs, progress of disbursement and its percentage of lot-1 is presented below in Table 4.6. The compensation amount is secured in the treasury account (escrow account) to ensure payment as and when unpaid APS will show-up with valid claim documents after inheritance mutation is affected. 28. During reporting Period (January-June 2021), 100 % additional crop allowance has been disbursed to 38 out of total 38 APs/ DPs in lot-1 (see at Annexure-2). The additional crop allowance is directly interlinked with crop compensation of APs of the affected mouza of irrigated land. 4.2.6.3 Vulnerability Allowance in Lot-1

30. In the reporting period (January-June 2021), 97.4 % vulnerability allowance has been disbursed to the 74 out of 76 vulnerable affected APs/ DPs in lot-1 (see at Annexure-2). 4.2.7 Physical Displacement of APs in Lot-1 31. No physical displacement of housing or relocation will occur during LARP implementation in entire lot-1 of the PHLCE project. However, small portion of built-up area of 1 APs will be affected and compensated according to the assessment of C & W Department. 4.2.8 Mouza, Structure and RD wise Linear Map of Lot-1 32. The PMO is committed to complete the implementation process of LARP in the entire project. On the basis of LARP implementation progress achieved in the reporting period the PMO confirms that all payable APs/DPs have been fully paid as per LARP provision and there is no unpaid AP/DP left without a valid legal and administrative impediment. The undisbursed compensation amount for acquired land is already deposited and secured in district treasure (escrow account) for payment to the unpaid DPs having legal/administrative impediment as and when they will show-up with valid claim documents after resolving their issues/impediments. Therefore, it is confirmed that the LARP is fully implemented except in the small sections where land acquisition process is not yet completed due to non-issuance of corrigendum notifications under LAA 1894. Based on achieved progress LARP implementation status is presented at glance in table 4.10 (with Muza and RD wise highlighted sections) and linear map i.e, figure 4(a) below presents sections wise implementation status in grey, green and red colours. 33. The sections presented in grey colour have been handed over to contractor for construction based on ERM’s validation of full implementation of LARP in his 1st EMR. The sections shown in green are those where LARP implementation has been completed during this reporting period. Accordingly, the PMO has requested the External Resettlement Monitor (ERM) to review and validate that the compensation and allowances for all payable APs/ DPs in sections/ RDs (mouza and

While the section where land acquisition is not yet completed due to pending corrigendum notification under LAA 1894 are presented in red colour. 34. Further the PMO confirms that unpaid compensation is secured in district treasury and unpaid APs/ DPs having legal/administrative impediments have been full informed about processing and payment of their claims as and when they show-up, therefor it is understood that there will be no risks for complaints and/or litigation because of non-provision of entitled compensation before handing over the sections to the contractor. The PMO assures that section shown in red, where land acquisition is yet not completed due to pending corrigendum notifications, will remain on hold until land acquisition process is full completed and full implementation of ADB accepted Updated/ Addendum LARP is confirmed and validated through ERM. 4.3 Lot-2: Indus Ambar Pressure Pipeline

35. According to the “land award” under section-11 of LAA 1894 for lot-2 of project acquire a total of 1,015.3 kanal (126.91 acre) of land of 9,360 APs/ DPs in total of 9 mouzas (villages) of Tehsil Topi and Swabil of District Swabi. The land acquaintance rolls have been prepared for all 9 mouzas by the LACs of land revenue department of district Sawabi. All the “awarded amount” i.e. compensation of land, crops, trees and built-up areas has been deposited in the district treasury by the Khyber Pakhtunkhwa Irrigation Department (KPID). Mouza wise detail of awarded compensation amount for land, crops, trees, built-up area and number of APs/ DPs are presented in below Table 4.11. 4.3.1 Disbursement of Land Compensation in Lot-2 36. According to the available acquaintance rolls of lot-2, the numbers of APs/ DPs of all the nine (9) mouzas are 9,360 (7,523 APs as of principal acquaintance roll and 1,837 as per mutation cases included so far). The increase in no. of AP/ DPs in principal acquaintance rolls is due to recorded inheritance mutation of land owned by deceased APs/DPs and inclusion of names of recorded legal heirs as APs/DPs for the same awarded amount and quantum of acquired land by the revenue department. Till June 2021 the disbursement of awarded land compensation in the entire mouza/ villages of lot-2, an amount of PKR 458.40 (62.80 %) out of total 729.92 million has been disbursed to 4,541 (48.51%) out of total 9,360 APs/ DPs for land compensation of 86.1 (67.84%) acres out of total acquired 126.91 acres in all 9 mouzas (villages) of lot-2. The left over APs having legal and administrative impediments have been documented and informed to show up with valid compensation claim documents, but physical disbursement of compensation was not feasible until the APs/DPs submit their claims after resolving their issues. So the entitled compensation amount has been secured in the district treasury to ensure the APs could be paid as and when they approach

with valid claims after resolving their issues. Mouza/ village wise detail of disbursement of paid awarded land parcel, (see at Anneuxre-2 for lot-2), while gender wise payment status for land compensation amount along with percentage is presented in Table 4.12 below. The findings of the IMR revealed that left over land payments are impeded due to the following legal and administrative impediments faced by the unpaid APs/DPs in in lot-2. As per templates provided in the ADB’s guidance notes on handling of compensation cases having legal and administrative impediments, additional documents have been recorded for unpaid APs/DPs having impediments which are provided as appendix-2 while few sample copies of recorded documents for lot-02 are added at the end of report as Annex -3.

 Stay Order by Civil Court: The land owners/ APs (394 APs having PKR 38.52 million amounts identified so far) have pending title disputes that have not been resolved. The compensation could not be paid to them until land title issues are resolved/ decided by the competent revenue authorities/ courts. Mouza wise detail of unpaid litigating APs/ DPs of lot-2 is presented in Table 4.13 below and detailed list is available in Appendix-2 of lot- 2.

 APs Working Abroad: As per LAA 1894, APs have to submit their claims supported with valid title documents and receive compensation voucher/ cheque in person or through

their attorney after due verification of their documents and record. To facilitate disbursement of compensation for APs/DPs living/working overseas, the staff of PMO regularly contacted their relatives for pursuing them to approach the AP/DP for their nomination as attorney and after producing valid power of attorney collect awarded compensation amount on behalf of the AP/DP. Currently, total of 73 APs having land compensation amount PKR 8.46 million have been living/working abroad. Mouza wise numbers of unpaid APs/ DPs of lot-02 who are living/working abroad are presented in Table 4.13 below and recorded documents for this category of DPs is available at Appendix-2 of lot-2.

 APs Out of City & Working in Pakistan: As per available acquaintance roll 16 APs identified having land compensation amount PKR 0.66 million have been migrated to other cities in Pakistan for better work opportunities. Even though they all were informed by their relatives regarding to collect due share of compensation amount but neither they are showing up in person nor nominating attorneys for collecting compensation on their behalf. Mouza wise out of city unpaid APs/ DPs of lot-2 are numbered in Table 4.13 below and documents record and maintained for those are available at Appendix-2 of lot-2.

 APs Out of City & Untraceable: As per available acquaintance roll so far 731 APs identified having land compensation amount PKR 71.87 million in lot-2, who were neither known by their respective mouza inhabitants and revenue staff nor their whereabouts are known so these DPs and their current places of residence are untraceable. Mouza wise numbers of untraceable unpaid APs/ DPs of lot-2 are presented in Table 4.13 below and additional recorded documents are available in Appendix-2 of lot-2.

 APs Died and Inheritance Mutation Process not yet completed: The land owners/ APs 536 having land compensation amount PKR 77.48 million have been died and requires transfer of land to their legal heirs. Payments of compensation to legal heirs could be made after land is mutated to the names of legal heirs by the district revenue authority. For this purpose, PMO’s staff is regularly communicating with the revenue staffs to speed up the mutation process meanwhile known heirs for APs have been approached and mobilized for mutation of land and processing of their claims with valid title documents to clear all their outstanding compensation. After inheritance mutation in land record, all heirs of deceased APs will receive entitled compensation as per their inherited share in acquired land. The cases with pending mutation in lot-02 have been documented as per template provided in the ADB’s guidance notes on handling of compensation cases with legal and administrative impediments. Mouza wise numbers of APs/DPs with pending inheritance mutation in lot-2 are presented in Table 4.13 below and recorded documents are included and available in Appendix-2 of lot-2.

 APs not receive compensation amount due to Meager Amount: A total of 1,196 APs are entitled to awarded compensation amount less than PKR 5000 (approximately USD 30). Total Sum of such meager compensation amount is PKR 2.39 million in lot-2. As procedural requirement, APs have to get the land title documents from land record office, open bank account and appear in person before the LAC / District Accounts Office for verification and receive compensation vouchers/ cheques. Due to cumbersome procedural requirements to receive such small amount of compensation, APs are reluctant

to open bank account as the deposit amount required for opening a bank account is more than the entitled compensation amount. To facilitate payment of compensation to such APs/DPs, the PMO and PIC staff approached U-bank and Meezan bank as they are opening a bank account for APs irrespective of their compensation amount either with no or nominal prior deposit PKR 500/only. The representatives of U-bank and Meezan bank agreed to open bank account for all such APs having meager amount. The PIC and PMO staff conveyed the message among the APs/ DPs having meager amount of compensation to open her/ his account in the U-bank or Meezan bank. Additionally, through the DC Office, the District Accounts Office has been contacted for provision of open cheques to APs with meagre amounts. The APs/DPs with meager amounts have been completely facilitated through the revenue department. Following personnel were nominated by DC Swabi to disburse the meager amount through open vouchers via National Bank of Pakistan. a. Tehsildar of the concern Tehsil/ Lot. b. Patwari of the Mouza c. Representative of Treasury d. Deputy Collector of PHLCE e. Social Organizer

Similarly, those APs/ DPs having meager amount are informed prior a day of the visit of the team at the already marked station. All verification is done on spot and vouchers are issued. The same voucher is presented to the National Bank of Pakistan for onward cash payment to APs/ DPs. Mouza wise unpaid meager compensation amount of land, and total no. of unpaid APs/ DPs of meager amount of lot-2 is presented in Table 4.13 below and documented record about for unpaid DPs with meager amount is included and available in Appendix-2 of lot- 2.

 APs Juvenile (under the age of 18): Currently a total of 16 APs having compensation amount PKR 0.50 million are juvenile and lack CNIC due to which their compensation cannot be paid. They can get their compensation after becoming to the age of 18 when their CNIC will be issued or through guardians they are living with by producing guardianship certificate issued by a competent court. During reporting period all Such APs (juvenile) and their natural guardians have been approached and informed about the process, accordingly statements of natural guardians are documented in accordance with given template in ADB’s guidance note. Mouza wise unpaid juvenile APs/ DPs of lot-2 is presented in below Table 4.13 and more detail available of unpaid DPs at Appendix-2 of lot-2.

 APs informed and committed to receive Compensation: A total of 1389 APs/ land owners entitled to compensation amount PKR 67.16 million in lot-2. These APs have been approached and informed repeatedly by the PMO safeguards staff for processing of their claims with valid title documents to receive compensation amount. In consultation meetings, these unpaid APs/ DPs agree to receive compensation of their land and assets etc., but later on under influence of other affected joint owners or family members they do not show-up with valid claims for processing and payment of compensation. In fact, these APs being joint owners of acquired family land are unable to decide in isolation as an “entire family” don’t agree to the awarded compensation rate/ amount and disagreement

among joint owners about their shares in acquired land and compensation amount. During consultation meetings, they were advised to approach the quarter concerned i.e., the LAC and respective courts for challenging the awarded or resolution of their other issues, but for unknown reasons they are not lodging the reference and appeals etc., against awarded and their respective shares in entitled compensation for acquired land. Every time they are approached, they ask for “a time” for taking decision in the family, but after lapse of time they remain undecided. Mouza wise numbers of unpaid but informed APs/ DPs of lot-2 are presented in Table 4.13 below and record of consultation meetings (including attendance list of DPs and meeting report) held to inform and facilitate unpaid DPs is well maintained and included in Appendix-2 of lot-2, while sample copy of consultation meeting record is attached as Annex-4.

 APs Name need correction (Fard-e-Badar): Similarly, 18 APs/ land owners having PKR 3.01 million amount of land compensation needs name correction in the revenue record and after such correction they will be able to receive compensation amount. Mouza wise unpaid APs/ DPs due to fard-e-badar of lot-2 is presented in Table 4.13 below.

 APs Mentally Retarded: One AP having PKR 0.32 million amount of land compensation cannot receive his share amount due to mental abnormality because under law payment to such persons is restricted. The AP with mental disability can be paid through a legal guardian appointed by a court after production of valid guardian’s certificate. The relatives of such APs have been advised about compensation process to be followed and compensation amount secured in district treasury for disbursement as and when thy will produce valid claim documents with guardianship certificate issued by the competent court. Mouza wise unpaid mentally retarded APs/ DPs of lot-2 is presented in Table 4.13 below and their detail is available at Appendix-2 of lot-2.

4.3.3 Disbursement of Crop Compensation in Lot-2 38. During reporting Period (January-June 2021), 5.96 (56.21 %) out of total PKR 10.61 million compensation amounts of crops has been disbursed to 239 (50 %) out of total 479 Aps/ DPs in lot- 2 (see at Annexure-2 for lot-2). Mouza wise awarded crop compensation amount, no. of APs, progress of disbursement and its percentage of lot-2 is presented below in Table 4.14. Remaining undisbursed compensation amount is due for the Unpaid DPs having legal and administrative impediments, which is secured in the treasury account to ensure payment as and when unpaid DPs will show-up with valid claim documents after resolving their issues. 41. During reporting quarter (January-June 2021), 100 % additional crop allowance has been disbursed to 119 out of total 119 APs/ DPs in lot-2 (see at Annexure-2 for lot-2). The additional crop allowance directly interlinked with crop compensation of APs of the affected mouza of irrigated land. The mouza wise additional crop allowance progress of disbursement and no. of APs of lot-2 is presented below in Table 4.17.

44. A limited number of business structures will be affected (see at Annexure-2 for lot-2) in 5 mouza/ villages of lot-2. The remaining DPs will be paid soon after the payment by revenue department of their structure compensation. 4.3.6.5 Income Disturbance Allowance in Lot-2

45. During reporting period 83.3 % income disturbance allowance has been disbursed to 5 out of the 6 DPs in lot-2 of the project against their business structures affected (see at Annexure-2 for lot-2). APs/ DPs have been entitled for income disturbance allowance (PKR 50,000/ month for six month) whose business/ commercial structure have been affected due to project ROW. Mouza wise progress of disbursement of income disturbance allowance, no. of APs, and its percentage is presented below in Table 4.21. Remaining undisbursed Allowance amount is because entitled APs/DPs due to legal and administrative impediments have not yet collected his land/assets compensation. The compensation amount is secured in project account to ensure payment as and when unpaid DPs show-up with valid claim documents for getting his land/asset compensation. 4.3.6.6 Shifting Allowance in Lot-2

46. During reporting period 58.3 % shifting allowance has been disbursed to 7 out of 12 DPs in lot-2 of the project against their structure affected (see at Annexure-2 for lot-2). APs/ DPs have been entitled for shifting allowance (PKR 30,000/ lump sum) whose structure have been affected due to project. Mouza wise progress of disbursement of shifting allowance, no. of APs, and its percentage is presented below in Table 4.22. Remaining undisbursed allowance amount is merely because entitled APs/DPs due to legal and administrative impediments have not yet collected his land/assets compensation. 4.3.6.7 Mouza, Structure and RD wise Linear Map of Lot-2

47. PMO is committed to complete the implementation process of LARP in the entire project. On the basis of LARP implementation progress achieved in the reporting period the PMO confirms that all payable APs/DPs have been fully paid as per LARP provision and there is no unpaid AP/DP left without a valid legal and administrative impediment. The undisbursed compensation amount for acquired land is already deposited and secured in district treasure (escrow account) for payment to the unpaid DPs having legal/administrative impediment as and when they will show-up with valid claim documents after resolving their issues/impediments. Therefore, it is confirmed that the LARP is fully implemented except in the small sections where land acquisition process is not yet completed due to non-issuance of corrigendum notifications under LAA 1894. Based on achieved progress LARP implementation status is presented at glance in table 4.23 (with Muza and RD wise highlighted sections) and linear map i.e, figure 4(b) below presents sections wise implementation status in grey, green and red colours. 48. The sections presented in grey are those which were handed over to contractor for construction based on ERM’s validation of full implementation of LARP in his 1st EMR. The sections shown in green are those where LARP implementation has been completed during this reporting period. Accordingly, the PMO has requested the ERM to review and validate that the compensation and allowances for all payable APs/ DPs in sections/ RDs (mouza and structure wise) showing in green have been fully paid; unpaid APs/ DPs having legal and administrative impediments have been adequately documented following templates provided in ADB’s guidance notes; and diligent efforts were exhausted to outreach and facilitate unpaid APs/ DPs in lot-2 till June 2021. While, the section where land acquisition is not yet completed due to pending corrigendum notification under LAA 1894 are presented in red colour. 49. Further the PMO confirms that unpaid compensation is secured in district treasury and unpaid APs/DPs having legal/administrative impediments have been full informed about processing and payment of their claims as and when they show-up, therefor it is understood that there will be no risks for complaints and/or litigation because of non-provision of entitled compensation before handing over the sections to the contractor. The PMO assures that section shown in red, where land acquisition is yet not completed due to pending corrigendum notifications, will remain on hold until land acquisition process is full completed and full implementation of ADB accepted Updated/Addendum LARP is confirmed and validated through ERM. 4.4 Lot-3: Indus and Ambar Irrigation System

According to the land award under section-11 of LAA 1894 for lot-3 of project acquire a total of 1180.3 kanal (147.54 acre) of land of 11,588 APs/ DPs in total of 12 mouzas (villages) of Tehsil Topi and Swabil of District Swabi. 4.4.1 Disbursement of Land Compensation in Lot-3 51. According to the land award under section-11 of LAA 1894 for lot-3 of project acquires a total of 1,180.3 kanal (147.54 acres) of land of 11,588 APs/ DPs (8,452 APs as of principal acquaintance roll and 3,136 as per mutation cases included so far). The increase in no. of AP/ DPs in principal acquaintance rolls due to recorded inheritance mutation of land owned by deceased APs/DPs and inclusion of names of recorded legal heirs of deceased APs for same awarded amount and quantum of acquired land for the project by the revenue department in total of 12 mouzas (villages) of Tehsil Swabil and Lahor of District Swabi. Till June 2021, an amount of PKR 365.45 (62.37 %) out of total 585.95 million has been disbursed to 6,177 (53.31 %) out of total 11,588 APs/ DPs for land compensation of 89.95 (60.97 %) acres land out of total acquired 147.54 acres land in all 12 mouzas (villages) of lot-3. The left over unpaid APs having legal and administrative impediments have been documented and informed to show up with valid compensation claim documents, but physical disbursement of compensation was not feasible until the APs/DPs submit their claims after resolving their issues. So the entitled compensation amount has been secured in the district treasury to ensure the APs could be paid as and when they approach with valid claim documents after resolving their issues. The findings of the IMR revealed that the remaining land payment is restricted due to legal and administrative impediments faced by the unpaid APs/ DPs in in lot-3. As per templates provided in the ADB’s guidance notes on handling of compensation cases having legal and administrative impediments, additional documents have been recorded for unpaid APs/DPs having impediments which are provided as Appendix-3 while few sample copies of recorded documents for lot-03 are added at the end of report as Annex -3.

 Stay Order by Civil Court: The land owners/ APs (214 APs having PKR 12.82 million amounts identified so far) in lot-3 have pending title disputes that have not been resolved. The compensation could not be paid to them until land title issues are resolved/ decided by the competent revenue authorities/ courts. Mouza wise detail unpaid litigating APs/ DPs of lot-3 is presented below in Table 4.26 and detailed list is available in Appendix-3 of lot-3.

 APs Working Abroad: As per LAA 1894, APs have to submit their claims supported with valid title documents and receive compensation voucher/ cheque in person or through his nominated attorney after due verification of their documents and record. To facilitate disbursement of compensation for APs/DPs living/working overseas, the staff

of PMO regularly contacted their relatives for pursuing them to approach the AP/DP and become nominated attorney to collect awarded compensation amount on behalf of the AP/DP after producing valid power of attorney. Currently, total of 68 APs in lot-3 having land compensation amount PKR 4.45 million have been living/working abroad. Mouza wise numbers of unpaid APs/ DPs living/ working abroad of lot-3 are presented below in Table 4.26 and recorded documents for this category of DPs are available in Appendix-3 of lot-3.

 APs out of City & Working in Pakistan: As per available acquaintance roll 159 APs having land compensation amount PKR 5.34 million have been residing in other cities in Pakistan because of better work opportunities. Even though they all were informed by their relatives about collection of their due share compensation amount but neither they are showing up in person nor nominating attorneys for collecting compensation on their behalf. Mouza wise number of unpaid APs/ DPs of lot-3 living in other cities in Pakistan is presented below in Table 4.26 and recorded documents for this category of APs/DPs are available in Appendix-3 of lot-3.

 APs Out of City & Untraceable: As per available acquaintance roll so far 828 APs identified having land compensation amount PKR 41.05 million in lot-3, who were neither known by the local community including inhabitants of respective mouza and local land revenue staff nor their current residential address are known and traceable so these DPs are termed as untraceable. Mouza wise number of untraceable APs/ DPs of lot-3 is presented below in Table 4.26 and recorded efforts to identify and locate them are available in Appendix-3 of lot-3.

 APs Inheritance Mutation under Process: The land owners/ APs 781 having land compensation amount PKR 93.55 million have been died and requires mutation of land to the legal heirs of deceased AP/DP. Payments of compensation to legal heirs will be made after mutation of land to their name by by the district revenue authority. For this purpose, PMO staff has been regularly liaising and communicating with the land revenue staffs to speed up the mutation process as well as approaching and mobilizing the known heirs of the recorded APs to get the land mutated and receive their respective share of compensation amount. After inheritance mutation in land record, all heirs of deceased APs will receive entitled compensation as per their inherited share. Mouza wise number of pending inheritance mutation cases of deceased APs/ DPs of lot-3 are presented below in Table 4.26 and recorded statement from known heirs are available in Appendix-3 of lot-3.

 APs with Meager Amount: A total of 1,602 APs are entitled to awarded compensation amount less than PKR 5000 (more or less USD 30). Total sum of awarded meager compensation amount PKR 2.66 million in lot-3. As procedural requirement, APs have to get the land title documents from land record office, open bank account and appear in person before the LAC and District Accounts Office for verification and receiving compensation vouchers and cheques. Due to cumbersome procedural requirements for receiving such small amount of compensation, APs are reluctant to open bank account as the deposit amount required for opening bank account is more that the entitled compensation amount. To facilitate such APs, PMO and PIC staff approached

U-bank and Meezan bank for opening a bank account of APs irrespective of their compensation amount either with no or nominal prior deposit upto PKR 500/-. The representatives of U-bank and Meezan bank agreed to open bank account for all such APs having meager amount. The PIC and PMO staff has conveyed the message among the APs/ DPs having meager amount and now pursuing them for opening their account in the U-bank or Meezan bank for further processing of compensation claims subsequently. Additionally, through the DC Office, the District Accounts Office has been contacted for provision of open cheques to APs with meagre amounts. The APs/DPs with meager amounts have been completely facilitated through the revenue department. Following personnel were nominated by DC Swabi to disburse the meager amount through open vouchers via National Bank of Pakistan. a. Tehsildar of the concern Tehsil/ Lot. b. Patwari of the Mouza c. Representative of Treasury d. Deputy Collector of PHLCE e. Social Organizer

Similarly, those APs/ DPs having meager amount are informed prior a day of the visit of the team at the already marked station. All verification is done on spot and vouchers are issued. The same voucher is presented to the National Bank of Pakistan for onward cash payment to APs/ DPs. Mouza wise unpaid meager compensation amount of land, and total no. of unpaid APs/ DPs of meager amount of lot-3 are presented below in Table 4.26 and documentation record maintained for unpaid APs/DPs in meager amount category is available in Appendix-3 of lot-3.

 APs Juvenile (under the age of 18): Currently a total of 9 APs having compensation amount PKR 0.25 million are juvenile who don’t have CNIC due to which their compensation cannot be paid. The APs in juvenile category can get their compensation after becoming to the age of 18 years when their CNIC will be issued or through their legal guardians by producing guardianship certificate issued by a competent court. During reporting period all such APs (juvenile) and their natural guardians have been approached and informed about the process, accordingly statements of natural guardians are documented in accordance with given template in ADB’s guidance note. Mouza wise numbers of unpaid juvenile APs/ DPs of lot-3 are presented below in Table 4.26 and recorded and maintained statements are available in Appendix-3 of lot-3.

 APs informed and committed to receive Compensation: A total of 581 APs/ land owners entitled to compensation amount PKR 26.03 million in lot-2 have been approached and informed repeatedly by the PMO safeguards staff for processing of their claims with valid title documents to receive compensation amount. In consultation meetings, these unpaid APs/ DPs agrees to receive compensation of their land etc., but but later on under influence of other affected joint owners or family members they do not show-up with valid claims for processing and payment of compensation. In fact, these APs being joint owners of acquired family land are unable to decide in isolation as “entire family” don’t agree to the awarded compensation rate/ amount and concerns of joint owners about family division of the acquired land parcels. They were advised to

approach the quarter concerned r i.e., the LAC and respective courts for challenging the awarded or resolution of their other issues, but for unknown reasons they are not lodging their references and appeal etc., against awarded compensation and apportionment of compensation respective to their share in acquired land. Every time they are approached, they ask for “a time” to take decision in the family, but after lapse of that time they remain undecided. Mouza wise number of unpaid informed APs/ DPs of lot-3 are presented below in Table 4.26 and record of consultation meetings (including attendance list of DPs and meeting report) held to inform and facilitate unpaid DPs is well maintained and included Appendix-3 of lot-3, while a sample copy of consultation meeting record is attached as Annex-4.

 APs Name need correction (Fard-e-Badar): Similarly, 23 APs/ land owners having PKR 1.79 million amount of land compensation needs name correction in the revenue record and after such correction they will be able to receive compensation amount. Mouza wise unpaid APs/ DPs due to fard-e-badar of lot-3 is presented below in Table 4.26.

 APs Mentally Retarded: One AP having PKR 0.18 million amount of land compensation cannot receive his share amount due to mental abnormality because under law payment to such persons is restricted and they can only be paid through a legal guardian appointed by a court. The relatives of such lunatic APs have been advised about compensation process to be followed and compensation amount secured in district treasury for disbursement as and when thy will produce valid claim documents with guardianship certificate issued by the competent court. Mouza wise unpaid mentally retarded AP/ DP of lot-3 is presented below in Table 4.26 and its detail is available in Appendix-3 of lot-3.

4.4.6.4 Mouza, Structure and RD wise Linear Map of Lot-3

59. PMO is committed to complete the implementation process of LARP in the entire project. On the basis of LARP implementation progress achieved in the reporting period the PMO confirms that all payable APs/DPs have been fully paid as per LARP provision and there is no unpaid AP/DP left without a valid legal and administrative impediment. The undisbursed compensation amount for acquired land is already deposited and secured in district treasure (escrow account) for payment to the unpaid DPs having legal/administrative impediment as and when they will show-up with valid claim documents after resolving their issues/impediments. Therefore, it is confirmed that the LARP is fully implemented except in the small sections where land acquisition process is not yet completed due to non-issuance of corrigendum notifications under LAA 1894. Based on achieved progress LARP implementation status is presented at glance in table 4.31 (with Muza and RD wise highlighted sections) and linear map i.e, figure 4(c) below presents sections wise implementation status in grey, green and red colours. 60. The sections presented in grey are those which were handed over to contractor for construction based on ERM’s validation of full implementation of LARP in his 1st EMR. The sections shown in green are those where LARP implementation has been completed during this reporting period. Accordingly, the PMO has requested the ERM to review and validate that the compensation and allowances for all payable APs/ DPs in sections/ RDs (mouza/ structure wise) shown in green

colour have been fully paid; unpaid APs/ DPs having legal and administrative impediments have been adequately documented following templates provided in ADB’s guidance notes; and diligent efforts were exhausted to outreach and facilitate unpaid APs/ DPs in lot-3 till June 2021. While, the section where land acquisition is not yet completed due to pending corrigendum notification under LAA 1894 are presented in red colour. 61. Further the PMO confirms that unpaid compensation is secured in district treasury and unpaid APs/DPs having legal/administrative impediments have been full informed about processing and payment of their claims as and when they show-up, therefor it is understood that there will be no risks for complaints and/or litigation because of non-provision of entitled compensation before handing over the sections to the contractor. The PMO assures that section shown in red, where land acquisition is yet not completed due to pending corrigendum notifications, will remain on hold until land acquisition process is full completed and full implementation of ADB accepted Updated/Addendum LARP is confirmed and validated through ERM. 5 LARP IMPLEMENTATION MONITORING SET-UP, EXHAUSTIVE EFFORTS, CONSULTATIONS, PARTICIPATION AND INFORMATION DISCLOSURE 5.1 LARP Implementation Monitoring Set-up and Exhaustive Efforts

62. Project Management Office (PMO) has been established for implementation of Pehur high level canal extension project (PHLCE) at District Swabi. The PMO is headed by the Project Director (PD) who is responsible for execution and implementation of PHLCE project. The PHLCE project is categorized by Asian Development Bank (ADB) in light of Safeguard Policy Statement (SPS 2009) as category-A project as far as involuntary resettlement is concerned. Based on the quantum of land acquisition and involuntary resettlement impacts, PHLCE project three separate land acquisition and resettlement plans (LARPs) for respective lots were prepared and endorsed by the government and approved by the ADB before award of civil works contract. Implementation and monitoring of LARP in manner consistent with the project loan covenants and ADB’s SPS 2009 provision is the key requirement for handing over of the sites to contractor and to proceeds on physical works at site. 63. Therefore, for smooth and efficient implementation of LARPs, a Safeguard management set-up at PMO was put in place as a focal unit for LARP implementation; maintaining updated LARP database about APs/DPs with respect to compensation entitlements and payment record, facilitate consultation meetings with stakeholders including APs, project executors and district land revenue authorities; track and monitor day to day implementation progress and prepare periodic monitoring reports; maintain a log of complaints received and redressed and facilitate project grievance redress committees to in review and resolving the complainants etc. The safeguards set-up is headed by the Director Social & Environment who is supported by a team of experts and filed staff including, Deputy Director Environment, Deputy Director Resettlement, Deputy Collector Revenue/ land acquisition, Monitoring and Evaluation Specialist, Zilladar revenue/ land acquisition, Patwaris and social organizers. 64. Since, start of LARP implementation in October 2019, the PMO PHLCEP through its safeguards management set-up, is closely coordinating with the land acquisition collector and the district land revenue offices to facilitate them in timely completion of land acquisition process, processing and payment of compensation to the APs and ensure LARP is fully implemented before handing over of the sites to contractor for construction. Meanwhile the safeguards team headed by the Director Environments has maintained a close liaison with the affected person and local communities in the project affected villages to disclose LARP related information and facilitate APs in accessing requisite valid claim documents i.e. getting their land titled documents from land revenue offices and CNICs issued, opening of bank accounts etc. and processing and payment of compensation at their door steps. With coordinated efforts the land compensation has reached to a reasonably good percentage in all three lots of the PHLCE project by the office of the land acquisition collector. 65. No doubt LARP implementation is a long, time consuming and challenging process, yet all possible exhaustive efforts to expedite the LARP implementation process has been taken by the concerned project staff. Based on achieved compensation payment progress explained in previous sections, it is perceived and confirmed that all payable DPs have been compensated for their acquired land and assets while the left over unpaid APs are those who have valid legal/administrative impediments. All such APs/ DPs have been approached and informed that the

compensation amount has been secured in the district treasury account (escrow account) for payment to them as and when they will show-up with valid claim documents after resolving their issues. In addition to above, following templates provided in the ADB guidance note on handling of compensation cases having legal and administrative impediment, all accessible APs/DPs were approached and additional documents as needed have been recorded and maintained during the monitoring period by the safeguards team on PMO, PHLCEP. The efforts ensured by the PMO safeguards staff for information dissemination and ensure participation of affected communities and in line government departments in smooth implementation of LARP is summarized in sub- sections below. 5.2 Community Consultations/ Meetings

66. In order to expedite the LARP implementation process, PMO along with PIC staff has undertaken various consultation meetings with APs/DPs in entire project area. 5.3 Coordination Meetings with Deputy Commissioner/ District Revenue Officials

68. To pursue issuance of pending corrigendum with revenue staff/ DC office district Swabi, was regularly visited. There is no proceedings on the longer awaited/ pending issuance of corrigendum/ addendum and its subsequent updation in the acquaintance roll. Despite regular pursuance with DC office Swabi, no way has been worked out by DC office for disbursement of meager amount of compensation of APs/ DPs. All these issues have adversely been affecting the LARP implementation by the DC office of Swabi. A summary of meetings conducted with DC, ADC

69. In order to expedite the LARP implementation process, Project Management Office (PMO) has disseminated LARP related information to all concerned APs/ DPs which include but not limited to; Installation of banners at public offices such as DC office, Tehsildar’s offices, Nazim Offices and other public places like Masjid’s and Hujra’s of notable’s in the project area. During the exhaustive efforts, the PMO produced information related to LARP implementation through print media i.e. local and national newspapers for awareness of public to receive their compensation. Various posters and flip charts have been displayed showing salient features of PHLCE Project. Moreover, PMO has made announcements through loud speakers on regular basis for the information of APs/ DPs regarding their compensations and that again on their door steps. Awareness among the APs/ DPs regarding LARP has been created through television and Radio Pakistan. Project Director (PD) PHLCEP recorded his interview with radio Pakistan which was then broadcasted. PMO along with the revenue department staff is frequently visiting all of the mouza’s

under Lot-1, 2 and 3 for the purpose of disbursements. To facilitate the APs/ DPs and revenue staff, PMO and PIC staff intimate/ provide serial number of APs in the respective acquaintance roll in advance to help expeditious disbursement. PMO has mobilized various teams to accompany the revenue staff during preparation of required documents and disbursement process to achieve the targeted goal. However, after thorough consultation and documentation of unpaid APs/ DPs are those who were personally contacted and during meetings they agrees to receive compensation of their land etc., but in fact they as an “entire family” don’t agree to the compensation rate/ amount. They were advised to approach the quarter concerned for the rate, but for unknown reasons they are not lodging the appeal etc., against the price of their respective land. Every time they are approached, they ask for “a time” to take decision, but after lapse of that time they remain undecided. 5.5 Disbursement of Allowances by PMO

70. PMO is responsible for payments of allowances such as additional crop, severity, vulnerability and livelihood etc. An allowances disbursement committee has been constituted at PMO (Annexure-6) under the chairmanship of Director social and environment. The committee members keenly examine every single case with assistance of PMO field staff in order to ascertain required information for considering any individual for a particular allowance. The PMO staff after completing all the verifications out in the field, submit its report to the committee and then the vouchers are accordingly signed. As soon as the committee completes its review and signed the cases, cheques are issued to the eligible APs (photographs at Annexure-9). The project has also taken an additional step in assisting the APs/DPs in making minor cards through NADRA and family trees of the APs/DPs to assure that the required share is given to the family members (females). Case studies have been developed through interviewing the APs/ DPs and recording their statement in respect of land acquisition and increased agriculture productivity of the command area under the project. 71. Based on the acquaintance rolls, the PMO has worked out lists of individuals in different mouza’s for different types of allowances to be paid. For severity allowance the PMO again requires fard-e-malkiat of APs as pre-requisite to be attached with each voucher. For this purpose revenue staffs is being approached for the required documentation. Till June 2021, 98 % of the allowances have been paid to the eligible APs/ DPs by PMO in the entire project. 5.6 Project impact on Women Mobility and Privacy

72. At this stage, there is no major impact recorded regarding women mobility and privacy in the project area due to project activities. During the information dissemination PIC social team disseminate the project information among the affected household and communities in each lots and also communicated information regarding opening of bank account, preparation of valid CNIC etc., for receiving compensation smoothly against their affected assets. 5.6.1 Gender Issues/ analysis in LARP Implementation 73. At the movement, there is no major impact recorded regarding gender issues particularly regarding women’s in disbursement of compensation and allowances. The LARP also identified the women DPs in terms of the loss of their assets. Like, male DPs the women are also receiving their payment, the PMO and PIC staff thoroughly facilitating the women in resolving their issues related to compensation/ allowances payment. meetings with the women DPs to keep them update about the project, their compensation payment, payment schedule, and addressing their issue if arise during the meeting. 5.7 Grievance Redress Mechanism and Complaints Handling 5.7.1 Grievance Redress Mechanism 74. The GRM aims to mediate conflicts and response to complaints related to environment and social performance of the project. GRM also provide a forum to general public/ community who might believe that they are adversely affected by the project. Field level GRC is the first level for registering and resolving complaints. The detailed GRM has been developed for the project. The PMO has notified a Grievance Redress Committee (GRC) at project level with the following composition: (notification attached at Annexure-7). i. 75. A complaint register is maintained at site with the Contractor as well as in the office of the Project Director. The placing of the complaint register at contractor’s camp is well publicized. Detailed Grievance Redress Mechanism (GRM) is affixed on sign board installed at Resident Engineer’s office to guide complainant. The office of the Resident Engineer of the PIC is the first level to register and resolve the complaint if it is not addressed by the Contractor. The Resident Engineer will deliver his decision within one week of registration of the case, if no understanding or amicable solution can be reached, or if the affected person does not receive a response from the Resident Engineer office within one week of the registry of the complaint, he/she can appeal to the GRC in writing to the office of the Project Director PHLCE. The Committee at the PMO level will address the complaint on priority and is fully responsible to satisfy the complainant in terms of resolving his complaint. 76. A series of meetings were held during the reporting period, however it was decided by the GRC member that meeting will be held on need basis for smooth implementation of project activities and best interest of complainants as well. A total of 53 no. of complaints/ application have been received so far. Nature of complaints and their status are tabulated in tables 5.4 below. Almost all the complaints have been responded by the GRC. 29 out of 53 complaints are regarding the price of land compensation, which have been refer to the referee court through district revenue offices. 9 no. of applications are actually demands of water for their lands which are not command able from the canal system due to its elevation/ location. These were referred to consultant for on ground verification and reported uncommendable from gravity system. 19 complaints were regarding alignment of canals traversing their lands and dividing their land. 18 out of 19 applications have expressed their satisfaction after on ground visit and discussion of our technical staff. The only unresolved complaint is the one Mr. Farman, who has approached OSPF and despite several visits of ADB’s social team, have been unable to resolve it mainly due to changing demands attitude
