Public Law 101-336; 42 U.S.C. §12101. 40 41 Section J: Knox County Board of Education Students Descriptor Term: Descriptor Code: Issued: Equal Educational J-110 7/95 Reviewed: Revised: Opportunities 2/20 4/20 1 2 All students shall have the same opportunities with regard to programs and activities regardless of race, 3 color, creed, religion, national origin, sex or disabilities.1 4 5 The Board of Education fully supports the rights of all students to be free from discrimination based on 6 discrimination as discussed herein, and will seek to investigate and as applicable, remedy any such 7 discrimination within the Knox County Schools. 8 9 Students may submit complaints when they believe they have been discriminated against because of race, 10 color, creed, religion, national origin, sex or disabilities. 11 12 COORDINATOR 13 14 The Director of Schools or the Director’s designated representative (Coordinator, Ombudsman) shall be 15 responsible for coordinating the system's efforts to comply with non-discrimination laws. 16 17 The Ombudsman may be contacted in person at the Knox County Schools administrative offices at 912 18 S. Gay Street, Knoxville, TN 37902 or by telephone at 865-594-1192. 19 20 PROCEDURES 21 22 All complaints may be presented to a student’s teacher, and/or the building level administrator (Principal), 23 and/or directly to the Ombudsman. If satisfactory resolution of the problem cannot be reached after ample 24 opportunity for consideration of the matter, the complainant may discuss the matter with the Director of 25 Schools. After review of the case, the Director of Schools shall take such action as the Director deems 26 appropriate and shall notify all parties concerned of the decision. The complainant may appeal the 27 Director’s decision to the Board. Attendance is a key 3 factor in student achievement; therefore, students are expected to be present each day that school is in 4 session. Parents have both a legal obligation and a moral responsibility to see that children are present 5 every day that school is in session. 6 7 The Director of Schools shall establish and maintain an attendance program designed to ensure all school- 8 age children attend school and that alternative program options are available for students who do not meet 9 minimum attendance requirements. This program shall be designed to address and adhere to all statutory 10 and regulatory requirements established by the State of Tennessee. School administrators and faculties 11 are expected to develop programs and practices to achieve or exceed student attendance goals established 12 by the State Board of Education. For these reasons, the Knox County Board of Education has adopted 13 the following policy regarding student absences. 14 15 The attendance supervisor/designee shall oversee the entire attendance program which shall include the 16 following:1 17 18 1. Adhering to all accounting and reporting procedures and their dissemination; 19 20 2. Providing alternative program options for students who severely fail to meet minimum attendance 21 requirements; 22 23 3. Ensuring that all school-age children attend school; 24 25 4. Providing documentation of enrollment status upon request for students applying for new or 26 reinstatement of driver’s permit or license; and 27 28 5. Notifying the Department of Safety whenever a student with a driver’s permit or license 29 withdraws from school.2 30 31 Student attendance records shall be given the same level of confidentiality as other student records. Only 32 authorized school officials with legitimate educational purposes may have access to student information 33 without the consent of the student or parent(s)/guardians(s).3 34 35 Absences shall be classified as either excused or unexcused as determined by the school leader or his/her 36 designee. Excused absences shall include:4 37 38 1. Personal illness; 39 40 2. Illness of immediate family member; 41 42 3. Death in the family; 43 J-120 1 4. Extreme weather conditions; 2 3 5. Religious observances;5 4 5 6. College visits; 6 7 7. Pregnancy; 8 9 8. School sponsored or school endorsed activities;6 10 11 9. Military active duty/deployment (as outlined below);7 12 13 a) An excused absence for one (1) day when the member is deployed; 14 b) An excused absence for one (1) day when the service member returns from deployment; and 15 c) Excused absences for up to ten (10) days for visitation when the member is granted rest and 16 recuperation leave and is stationed out of the country. 17 18 10. Summons, subpoena, or court order; or 19 20 11. Circumstances which in the judgment of the school leader create emergencies over which the 21 student has no control. 22 23 Any absence not complying with the above reasons for excused absences will be considered as unexcused. 24 Examples of unexcused absences are (a) family vacations taken during the school year and (b) Senior 25 Skip Day. 26 27 The principal or designee shall be responsible for ensuring that:8 28 29 1. Attendance is checked and reported daily for each class; 30 31 2. Daily absentee sheets contain sign-in/sign-out sheets and indicate students present or absent for 32 the majority of the day; 33 34 3. All student absences are verified; 35 36 4. Written excuses are submitted for absences and tardiness; 37 38 5. If necessary, verification is required from an official or other source to justify absences; 39 40 6. System-wide procedures for accounting and reporting are to be followed; 41 42 7. Out-of-school suspensions (OSS) are not reported as an unexcused absence and are not a 43 chargeable offense for truancy in Juvenile Court; and 44 45 8. Students in a homebound program are not marked absent from school. Attendance for homebound 46 students is recorded by the homebound teacher. 47 48 ABSENCE DUE TO ISOLATION OR QUARANTINE ORDER 16 49 50 For the 2021/2022 school year only, students who participate in Remote Instruction during a temporary 51 COVID-19 Isolation or Quarantine Period may be counted as present if daily student attendance is Page 2 of 6 J-120 1 taken and includes daily periodic visual, verbal, and/or written confirmation of student participation in 2 six and one-half (6 ½) hours of instructional time per day for grades one (1) through twelve (12) and 3 four (4) hours of instructional time per day for Kindergarten, using multiple methods of confirming 4 student attendance. 5 6 Two or more of the following methods of monitoring attendance must apply for a student to be counted 7 present: 8 1. Students participate in a phone call with a teacher, with parent or legal guardian support as 9 appropriate for the age of the student; 10 2. Students participate in synchronous virtual instruction; 11 3. Students complete work via the Canvas learning management system; 12 4. Students submit work via hard-copy or virtual formats; 13 5. For more information, refer to SCHOOL AND STUDENT HEALTH SERVICES 14 CHAPTER 0520-01-13 (Rule 0520-01-13-.01) April, 2021 (Revised) 15 16 GRADES K-12 17 18 Annually, the Director of Schools/designee will provide written notice to parent(s)/guardian(s) that 19 attendance at school is required. Students shall be present at least fifty percent (50%) of the scheduled 20 school day in order to be counted present. Students may attend part-time days, alternating days, or for a 21 specific amount of time as indicated in their Individualized Education Plan or 504 Plan and shall be 22 considered present for school attendance purposes.9 If a student is required to participate in a remedial 23 instruction program outside of the regular school day where there is no cost to the parent(s)/guardian(s) 24 and the school system provides transportation, unexcused absences from these programs shall be reported 25 in the same manner.10 26 27 Excuses for absences must be made in writing to the principal or administrative designee by a parent or 28 guardian and must be submitted within five (5) days of the student's return to school.

    Walk-To-School Prioritization Analysis for the schools of Knox County, Tennessee Prepared for the Knox County Dept. of Engineering & Public Works by January 2014 The objective of this study is to identify the locations in Knox County having the greatest amount of potential and realized pedestrian activity associated with the walk-to-school trip type. With knowl- edge about where the greatest pedestrian demand exists, capital planners can focus efforts toward the determination of specific pedestrian infrastructure needs across the county. The Knox County school walking trip estimates were developed using RPM’s non-motorized trip modeling process. The process uses a combination of local and national data to produce walk-to- school trip estimates for all 86 public schools in Knox County. In the model, every student repre- sents one trip made to school, with the potential for this to be a walking trip increasing as the trip length decreases. The student’s home address is geo-coded as his/her origin and the student’s school is geo-coded as his/her destination. The student data was obtained from Knox County Schools for all 59,276 students in the school system using school year 2013-2014 enrollment data. With the origin and destination of all travel-to-school trips mapped, a unique trip assignment for all 59,276 trips to school was performed using current open-source mapping. This process results in the travel-to-school distance assuming that the existing street network is used to make the trip. The event is open to the public. The State of the Schools Report and Address will provide an overview of academic progress in the Knox County Schools toward the goals outlined in its district-wide Strategic Plan. The Knox County Board of Education approved the plan, entitled Excellence for All Children, in 2009. The report will also highlight the additional work necessary to provide our students with an excellent education in today’s increasingly competitive global environment. As far back as the 1970s, the federal government recognized the importance of protecting the data of minor children, specifically related to school records. Congress passed the Family Educational Rights and Privacy Act of 1974 (FERPA). FERPA gave parents control over the disclosure of information from their minor children’s records.
