  • Cinema Industry Market Update Spring 2020
CINEMA INDUSTRY Houlihan Lokey Theatrical Exhibition Market Update Dear Client, There has been much concern and speculation over the future prospects of the theatrical business globally, due to COVID-19 closures. While we remain optimistic about the strength and importance of the theatrical window and expect pent-up demand for cinematic experiences as well as pent-up supply from the major studios by the time the business resumes to normal, the potential for lingering impacts from stay-at-home orders and social distancing on theatrical exhibition is still unclear. Additionally, the ongoing high-profile dispute between a leading theatrical operator AMC and Universal Pictures further highlights the uncertainties surrounding the current windowing model. The past several weeks have taken a major toll on theatrical exhibition. With a few exceptions, cinema locations have been closed worldwide. To date, the biggest box office losses have been recorded in Asia, with China, Japan, and South Korea ending the first quarter of 2020 down 88%, 64%, and 53% over the same period last year, respectively. French and Spanish box office results have been hardest hit in Europe, down 31% and 21% in the first quarter of 2020. Domestic box office was down 25.4%, totaling $1.8 billion in the first quarter of 2020 versus $2.4 billion for the same period last year. In the absence of domestic theatrical window, some studios have opted to release their titles straight to premium video-on-demand (PVOD). Universal Pictures’ Trolls World Tour has been the first big- budget film released as a $19.99 PVOD-exclusive title on April 10.

  • Oklahoma Movie Theaters Sources: Comscore
SAVE OUR SCREENS OKLAHOMA Oklahoma movie theater owners and operators thank our lawmakers for their leadership throughout the COVID-19 crisis. The state’s movie theaters are among the hardest-hit industries and need help to ensure they will continue operations, rehire workers, and return to profitability (and pay taxes on those profits) after the public health crisis abates. Please support financial relief for struggling movie theaters of all sizes in Oklahoma. With your help, our cinemas will play an important role in rebuilding the state’s economy and continue to bring the shared cultural experience of moviegoing to our communities. ___________________ Economic and Cultural Engines. From Main Street to the state’s urban centers, cinemas are business anchors and economic multipliers in the communities they serve. Cinemas (1) invigorate and revitalize neighborhoods, (2) drive foot traffic to local small businesses, (3) foster cultural vibrancy, and (4) create employment opportunities in communities across Oklahoma where jobs can be few and far between. Unprecedented Industry Disruption. Prior to the pandemic, Oklahoma had a robust movie theater market that generated more than $150 million in revenue each year. Capacity limitations combined with a lack of new movie releases, however, have caused cinema revenues to plunge by 80 percent industrywide. Cinemas Need Help. There are approximately 50 cinema companies operating more than 530 screens at over 85 locations across the state. Each passing day without help, however, is another day closer to more cinema owners in Oklahoma reaching their breaking point. Grant and Tax Relief Programs. A grant program of up to $5.5 million and tax relief would provide critical lifelines to help movie theaters bridge the pandemic and contribute to the state’s broader economic recovery when new movies return to our screens later this year.

  • Harkins Theatres to Department of Justice Antitrust Division (“DOJ”) with Respect to Paramount Decrees
Comments from Harkins Theatres to Department of Justice Antitrust Division (“DOJ”) With Respect to Paramount Decrees INTRODUCTION Harkins Theatres (“Harkins”) is an independent movie theater company headquartered in Scottsdale, Arizona. Harkins submits the following in response to DOJ’s request for comments regarding potential termination or modification of the Paramount Decrees that have applied to prevent certain anticompetitive practices challenged by DOJ in critical movie industry antitrust litigation cases. Harkins is aware of separate comments in this matter submitted by Marcus Theatres and endorses those comments. Harkins also is aware of comments submitted by the National Association of Theatre Owners (“ NATO”) and supports those comments. The key legal principles on which the Paramount Decrees are based arise from Supreme Court case law1 that has been cited and relied upon extensively in private movie industry antitrust litigation since that time. Litigation of these Supreme Court cases also led to consent decrees with leading movie industry companies Paramount Pictures, Inc., Twentieth Century- Fox Corporation, Columbia Pictures Corporation (Sony), Universal Pictures, United Artists, Warner Brothers Pictures, and Loew’s (MGM) (“Decrees”). These Decrees established a federal court supervised process for enforcing certain standards designed to prevent anticompetitive conduct in the business of licensing movies for play in theaters. The Decrees of course did not overrule, replace, or modify the related Supreme Court case law. The issue now being explored by DOJ, and the related questions being asked involve the issue of whether the Decrees continue to serve any useful purpose in the movie distribution and 1 See, e.g., United States v. Paramount, 334 U.S.
