LAND OF THE RED GIANTS OF IXTLAN Chapter 19 - Anna Mae & Leonard: "In video-theatre 'FREE PELTIER'" The funniest thing I ever saw was a little old lady laughing so hard at my play that she fell off her folding chair and was actually rolling around on the floor choking. The situation was nearly tragic, about like the play, as her sons or granddaughters frantically pounded her on the back to get her breathing again, while we on stage had to stop our own crazy antics for a minute to watch the performance in the audience. Reality blurred until I never did know when we were doing the play and when I was living it out on the streets, or in the Oyate Community Center in the Lakota Homes ghetto where we had set up our improvised excuse for theatre. Just when they had gotten the old Lakota Gramma back to some form of normalcy and back in her chair, Jay Hart, a handsome Mohawk woman who was playing Custer in a grotesque mask with long blonde hair, stepped across the borders between art and gender and snuck around behind the Gramma and whispered, "Are you dead yet, Ciye?" Upon which the poor old lady really lost it and screamed and fell off her chair again! Chaos erupted, as all of us poured off the commedia dell'arte platform and chased the evil whiteman around the room and out into the street. Kids and dogs chased after us and we just kept going with it, running around the parking lot as the audience ran after us, and passing cars stopped to gape in wonder at the surreal scene of clowns and devils in fantastic costumes screaming, falling down, throwing confetti-bullets like Jerry Lewis or Harpo Marx wrecking the fabric of society.

  • The American Indian Movement's Strategic Choices
The American Indian Movement’s Strategic Choices: Environmental Limitations and Organizational Outcomes Timothy Baylor Lock Haven University of Pennsylvania The roots of modern Indian protest reach backward in history and forward into the future. Modern protest developed out of specific historical contingencies. For many protesters, the immediate concerns of housing shortages, police brutality, poverty, unemployment, and similar issues existed along side other issues such as identity and status within the American mosaic. Did Indians represent just another ethnic group bound to be assimilated by American society, or did Indians embody something different and far more significant – nations? As modern Indian protest escalated, the question increased in salience. Nancy Lurie explained that “Indian distinctiveness ... stressed culturally and historically” included an “emphasis on treaties rather than judicial recourse in obtaining perceived rights of Indians,” “an attitude that all other Americans are ‘immigrants,’” and that Indians as the “‘First Americans’ deserve special consideration (1972:308). In this sense, Native Americans were different than Blacks and other ethnic minority groups; they were the only ethnic group the U.S. Supreme Court had defined as “domestic dependent nations” in Cherokee Nation v. Georgia (1831). Just what this meant and the degree of tribal sovereignty this status conveys has continued to be a matter of political and judicial wrangling. Regardless of the Indians’ status as “domestic dependent nations,” the overall American policy was one of assimilation in which reservations were seen as a temporary necessity until Indians had gained the necessary cultural, educational, and technical levels of competence necessary to participate in American life. Central to accomplishing this end was the boarding school system.

New Republic Calls for Death and Torture of Arundhati Roy and Stan Goff 6. Graham Defense Update, Feb. 2, 2005 7. Did September 11 Cause a Constitutional Paradigm Shift? Introduction A media frenzy has developed surrounding a 2001 Ward Churchill article entitled "Some People Push Back: On the Justice Of Roosting Chickens," in which Dr. Churchill compares the World Trade Center victims to nazis, and suggests that if there was any better way to punish them for their complicity in the 1991 gulf war, he’d like to hear about it. This was indeed a foolish and unscholarly theme for an essay, dismissing the distinction between civilians and combatants set out in the Geneva Conventions half a century ago. By Churchill’s logic, his own death in such an attack would be justified. But that’s beside the point. Churchill’s article was obviously intended to be offensive. What’s amazing is the ability of Bill O’Reilly to pull this scandal out of the dustbin. It must have been a slow news day at Fox for Mr O’Reilly to have seized on this three year old article. O’Reilly is an expert character assassin, and should be held accountable in a court of law for the death threats and other harms Churchill has suffered.

UNITED STATES DISTRICT COURT FOR THE DISTRICT OF SOUTH DAKOTA WESTERN DIVISION UNITED STATES OF AMERICA, Plaintiff, Case No. CR 08-50079 vs. JOHN GRAHAM, a.k.a. DEFENDANT MARSHALL’S JOHN BOY PATTON, and MEMORANDUM OF LAW VINE RICHARD MARSHALL, a.k.a. IN SUPPORT OF RICHARD VINE MARSHALL, a.k.a. MOTION TO SEVER TRIALS DICK MARSHALL, Defendants. In this case, the government seeks to prove that in December 1975, co-defendant Graham, along with cooperating witness Arlo Looking Cloud and unindicted coconspirator Theda Clark, abducted and kidnaped Anna Mae Aquash in Denver, Colorado, and drove her to Rapid City; that Graham raped Aquash in Rapid City; that the three took Aquash to Rosebud, South Dakota, and out to the Badlands near Wanblee, where John Graham, assisted by Clark and Looking Cloud, shot and killed her. As to Richard Marshall, the government’s theory is that Graham, Looking Cloud, and Theda Clark, along with Aquash, stopped at the home of Richard Marshall in Allen, South Dakota, after they left Rapid City, and asked Marshall to keep Aquash there at his home and that Marshall refused. The government’s entire prosecution against Richard Marshall is based on Looking Cloud’s claim, which he evidently made for the first time in 2008, that he saw Richard Marshall gave Theda Clark a handgun and a box of shells in the presence of John Graham. 1 The government’s theory is that Graham, Looking Cloud, and Clark murdered Aquash because they and other members of AIM suspected that Aquash was a government informant.

DEFENDANT MARSHALL’S JOHN BOY PATTON, and NOTICE OF INTENT TO OFFER VINE RICHARD MARSHALL, a.k.a. STATEMENTS BY U.S. ATTORNEY AS RICHARD VINE MARSHALL, a.k.a. ADMISSIONS BY A PARTY-OPPONENT DICK MARSHALL, AND MEMORANDUM OF LAW Defendants. Defendant Richard Marshall, by and through undersigned counsel, hereby gives notice to the government of his intent to offer into evidence statements made by the United States Attorney in the trial of USA v. Arlo Looking Cloud, CR 03-50020, and in the appeal of that case to the United States Court of Appeals for the Eighth Circuit, No.04-2173, as admissions by a party-opponent under Rule 801(d)(2)(B)(C) and (D) of the Federal Rules of Evidence (FRE). This memorandum of law will set forth the evidentiary basis for the admission of such statements. Factual Background In 2003, the government indicted Arlo Looking Cloud and co-defendant John Graham, charging them with first degree murder in the killing of Anna Mae Aquash in December 1975. In 2004, the government convicted Arlo Looking Cloud of murder in a jury trial. This Court imposed a mandatory life sentence. Looking Cloud appealed his conviction to the Court of Appeals for the Eighth Circuit. In 2005, that Court affirmed his conviction in United States v. Looking Cloud, 419 F.3d 781 (8th Cir. 2005). In 2008, Arlo Looking Cloud agreed to cooperate with the government and testified before the grand jury.

http://www.aberdeennews.com/mld/aberdeennews/news/11978267.htm Published on Fri, Jun. 24, 2005 in Aberdeen News Much unresolved 30 years after FBI agents, AIM member killed by CARSON WALKER Associated Press OGLALA, S.D. - Calvin Jumping Bull was away at college when the names Stuntz, Coler and Williams were added as casualties of the 1970s battles between the American Indian Movement and federal government. Jumping Bull, 75, now lives on the family ranch where 30 years ago, tension between the two camps escalated when FBI agents Ronald Williams and Jack Coler were shot in the head at point-blank range after being injured in a shootout. They had come here to serve arrest warrants. AIM member Joseph Stuntz also was shot that day, June 26, 1975, on the southwest corner of the Pine Ridge Indian Reservation. The Justice Department concluded an FBI sniper killed Stuntz, who was clad in Coler's FBI jacket when his body was found. "This is the place he was found," Jumping Bull said of a spot now green from a recent rain. Stuntz' gravesite at a nearby cemetery reads: "Incident at Oglala Warrior, American Indian Movement Patriot." Two AIM members, Robert Robideau and Dino Butler, were acquitted of killing Coler and Williams. Robideau now is a spokesman for another AIM member, Leonard Peltier, who was convicted of the agents' deaths in 1977 in Fargo, N.D., and sentenced to life in prison. Peltier, 60, has maintained his innocence. His lawyer and others have said the FBI framed Peltier. The agency denies the allegation.
