Applications may be inspected free of charge at the Office of the Traffic Commissioner in Leeds by any person who carries written authorisation to act in that capacity. Objections against published applications may be made in writing by a Chief Officer of Police, a local authority, a planning authority or a prescribed trade union or association within 21 days of the date on which notice of an application is published in Applications and Decisions. Objections must be made either on the grounds that any of the requirements listed in Section 13 of the Goods Vehicles (Licensing of Operators) Act 1995 are not met and/or that a nominated operating centre will be unsuitable for use as such. A copy of the objection must be sent by the objector to the applicant at the same time that it is sent to the Traffic Commissioner. The onus of proof in terms of the grounds on which an objection is lodged lies with the objector. You may fax a copy of your objection to 0113 2488521 but please note that you must send the original signed document through the post. Classification of Operator Licences – There are three classes of licence: A Restricted (R) licence authorises the use of a goods vehicle on public roads in Great Britain for the carriage of the licence holder’s own goods in the course of his trade or business. The licence holder cannot carry goods for other people for hire or reward; A Standard National (SN) licence allows the licence holder to carry both his own goods and goods for other people for hire or reward, on public roads in Great Britain. He can also carry his own goods on journeys abroad; A Standard International (SI) licence allows the licence holder to carry both his own goods and goods for other people for hire or reward. These activities can be undertaken both in Great Britain and on international journeys. It was discussed that the Council told the CC that 3.1m was the minimum width needed for a cycle path. All discussed pictures CCllr WP had previously provided showing cycle lanes in Denmark which are 3ft wide. Concerns continue to be raised also around Heatherlea Junction/Sandwick Junction. There has been no further communication from Robina Barton. An email from Bo Hickey, Information Officer, Sustrans was received 3rd June asking for more information from WCC about our priorities for routes. Clerk forwarded letter written by WP. Awaiting reply. Policing Concerns Clerk to email Angela Manson asking if another officer has been confirmed to attend 4th night with her. AP discussed that SIC Community support wardens attended Yelloween, in Yell this year.

School House Road – Sections of road have now been reinstated and tarred. North Voe Road – Email received from roads department – stating that the road is subsiding around the ditch. Roads department to reassess and repair section if it gets worse. Clerk to email regarding this. Policing Concerns Clerk to compile list of upcoming public events and forward this to Police. Concerns raised about event which took place on the ferry involving two 16-year olds and drugs.

The Western Isles has recently conducted a similar exercise, and lessons will be learned from their experience. Consultants will be required to spend time in Shetland and conduct a public engagement exercise. A first step will be to bring together relevant strategy documents, and gain an idea of the kinds of financial contributions across Shetland that could be used to match fund future projects. The possibility of a cycle path from Huxter to the school was mooted if funding could be secured through the Active Travel Project. CCllrs highlighted the issue over the lack of a continuous footpath at the North Voe to the North Park, to the attending PC’s.

OVERVIEW 1.1.1 Viking Energy Wind Farm LLP (“the Applicant”) has applied for a variation1 of the consent for the proposed Viking Wind Farm, on Mainland Shetland. On 4 April 2012 development consents for the construction and operation of the Viking Wind Farm (103 turbines) were granted by the Scottish Ministers under Section 36 of the Electricity Act 1989. By letter dated 29 March 2017, the Scottish Ministers extended the period for commencement of development up to 4 April 2020.     Viking Wind Farm Technical Appendix 4.1 Section 36 Variation Application Criteria for Landscape and Visual Appraisal TECHNICAL APPENDIX 4.1: CRITERIA FOR LANDSCAPE AND VISUAL APPRAISAL 1.1 Introduction 1.1.1 This technical appendix details the various criteria and definitions which have been used for Landscape and Visual Appraisal (LVA) of the consented Viking Wind Farm and proposed varied development (comprising the variation of 10 m increase in turbine tip height and increased rotor diameter of up to 120 m). Assessment Guidance 1.1.2 The LVAs have been carried out in accordance with best practice guidance, Guidelines for Landscape and Visual Assessment (Third Edition) (GLVIA3). 1.1.3 Whilst criteria are provided, the allocation of these to various landscape areas and visual receptors and application of potential effect ratings has been undertaken using professional judgement. All criteria given should be considered as points on a continuum. 1.2 Landscape Appraisal Landscape Value 1.2.1 The relative value of the landscape is an important consideration in informing judgement of the significance of effects. Value concerns the perceived importance of the landscape, when considered as a whole and within the context of the study area. Landscape Value is established through consideration of the following factors: • Presence of landscape designations, other inventory or registered landscapes/landscape features or identified planning constraints; • The scenic quality of the landscape; • Perceptual aspects such as wildness or tranquillity; • Conservation interests such as cultural heritage features or associations, or if the landscape supports notable habitats or species; • Recreational value; and • Rarity, either in the national or local context, or if it is considered to be a particularly important example of a specific landscape type.
