For the most part, it is a quiet community, a typical college town with its share of stores, clubs, and services devoted to serving the campus population and the surrounding area. The evening of May 3, 2000 was different. Around 11 PM, a large crowd gathers on the commons area in front of Taylor Hall in the central area of the older campus. The gathering, estimated at five to ten thousand persons, consists of individuals from near and far. The sound of soft guitar music wafts through the night air and the strains of "We Shall Overcome" grow in intensity as the crowd grows in number with each passing moment. Each person walks past the victory bell that is situated on the east side of the commons, picking up a lit candle as they move past. At the front of the march are survivors and family members of the victims of the Kent State shootings of May 4, 1970. A silent procession begins, moving from the commons area on a mile long trek around campus, culminating at the Prentice Hall parking lot on the north side of Taylor Hall. It was on this spot some thirty years earlier that students encountered the loaded rifles of Ohio National Guardsmen given the task ofrestoring order to what some saw as a campus -in turmoil.

    The Kent State Shootings after Nearly 50 Years One Lawyer’s Remembrance Sanford Jay roSen Sanford Jay Rosen was the lead attorney for the dead and wounded students of the May 4, 1970, shootings at Kent State. Rosen came to the case in 1977 as lead counsel for the appeal following the victims’ loss of their cases in federal district court in Ohio. After he won the appeal, the cases were sent back to the district court for retrial. Rosen continues to practice law in San Francisco and is a founding partner at the San Francisco law firm Rosen, Bien, Galvan & Grunfeld, LLP. This piece was written in 2019. To understand my involvement in the Kent State cases, we begin with my father’s mother long before I was born in December 1937. Aida Grudsky was born in the late 1860s in Kiev, Ukraine. In 1905, she fled to America with her husband and two sons from Czarist Russia’s latest oppression of Jews. Neither son survived the journey. Her eldest, born in the United States, also died as a child. Perhaps because of her unspeakable suffering, Aida had an innate sense of injustice, which she passed on to me. My late wife Catherine was born in January 1940, just three weeks af- ter she was smuggled into the United States in her mother’s belly. Pregnant Jewish women were not allowed into the United States on visitors’ visas dur- ing World War II. The Nazis murdered Cathy’s maternal grandmother and that branch of Cathy’s family, except my mother-in-law.

Still others thought that the costs to American society were too high. College students formed a large and vocal group of protesters. Many opposed the draft, which required young men to serve in the military. In protests nationwide, young men burned their draft cards. About 50,000 people staged such a protest in front of the Pentagon on October 21, 1967. Opponents of the draft pointed out its unfairness.

Bills Writing in the mid-1980s, historian Bradley Smith observed that the formative years of the cold war had “proven unusually resistant to the smoothing arts of historical study.” The era had not taken on a “coherent and composed historical persona. ” “The forties,” Smith noted, “have tended to remain more segmented, more controversial, and more intertwined with present events and current political controversies than most other recent historical epoches....”1 Much the same can be and has been said about the 1960s: a time of great motion and passion, yet a time that seems curiously distant from the pliant present and oddly fragmented in terms of imagery and theme. Kent State University was a hotbed of activity in the week prior to the shootings, with students upset by President Richard Nixon's April 30 announcement of the Vietnam War's expansion into Cambodia. The May 4 protest was the culmination of four days and nights of events, including riots in downtown Kent on May 1 and the burning of the Reserve Officer Training Corps (ROTC) building on May 2.
