Columbia University Graduate School of Arts and Sciences Human Rights Studies Master of Arts Program Silencing “Breaking the Silence”: The Israeli government’s agenda respecting human rights NGOs activism since 2009 Ido Dembin Thesis Adviser: Prof. Yinon Cohen Submitted in partial fulfillment of the requirements for the degree of Master of Arts 12 September, 2018 Abstract This research examines a key aspect in the deterioration of Israeli democracy between 2009-2018. Mainly, it looks at Prime Minister Benjamin Netanyahu's Right-wing governments utilization of legislative procedure to limit the right to free speech. The aspects of the right to free speech discussed here pertain to dissenting and critical activism against these government’s policies. The suppression of said right is manifested in the marginalization, delegitimization and ultimately silencing of its expression in Human Rights NGOs activism. To demonstrate this, the research presents a case study of one such NGO – “Breaking the Silence” – and the legal and political actions designed to cause its eventual ousting from mainstream Israeli discourse. The research focuses on the importance and uniqueness of this NGO, as well as the ways in which the government perceives and acts against it. First, it analyzes the NGO’s history, modus operandi and goals, emphasizing the uniqueness that makes it a particularly fascinating case. Then, it researches the government’s specific interest in crippling and limiting its influence. Finally, it highlights the government’s toolbox and utilization thereof against it. By shining a light on this case, the research seeks to show the process of watering down of a fundamental right within Israeli democracy – which is instrumental to understanding the state’s risk of decline towards illiberal democracy. -

Adalah’s Newsletter, Volume 63, August 2009 The New Israeli Land Reform August 2009 Background On 3 August 2009, the Knesset (Israeli parliament) passed the Israel Land Administration (ILA) Law (hereinafter the “Land Reform Law”), with 61 Members of Knesset (MKs) voting in favor of the law and 45 MKs voting against it. The new land reform law is wide ranging in scope: it institutes broad land privatization; permits land exchanges between the State and the Jewish National Fund (Keren Kayemet Le-Israel) (hereinafter - the “JNF”), the land of which is exclusively reserved for the Jewish people; allows lands to be allocated in accordance with "admissions committee" mechanisms and only to candidates approved by Zionist institutions working solely on behalf of the Jewish people; and grants decisive weight to JNF representatives in a new Land Authority Council, which would replace the Israel Land Administration (ILA). The land privatization aspects of the new law also affect extremely prejudicially properties confiscated by the state from Palestinian Arab citizens of Israel; Palestinian refugee property classified as “absentee” property; and properties in the occupied Golan Heights and in East Jerusalem. Land Privatization Policy The law stipulates that 800,000 dunams of land currently under state-control will be privatized, enabling private individuals to acquire ownership rights in them. The reform will lead to the transfer of ownership in leased properties and land governed by outline plans enabling the issuance of building permits throughout the State of Israel in the urban, rural and agricultural sectors. Change in the organizational structure of the Israel Lands Administration The reform further stipulates a broad organizational re-structuring of the ILA. -

ISRAEL 2015 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY Israel is a multiparty parliamentary democracy. Although it has no constitution, the parliament, the unicameral 120-member Knesset, has enacted a series of “Basic Laws” that enumerate fundamental rights. Certain fundamental laws, orders, and regulations legally depend on the existence of a “state of emergency,” which has been in effect since 1948. Under the Basic Laws, the Knesset has the power to dissolve the government and mandate elections. The nationwide Knesset elections in March, considered free and fair, resulted in a coalition government led by Prime Minister Benjamin Netanyahu. Civilian authorities maintained effective control over the security services. (An annex to this report covers human rights in the occupied territories. This report deals with human rights in Israel and the Israeli- occupied Golan Heights.) During the year according to Israeli Security Agency (ISA, also known as Shabak) statistics, Palestinians committed 47 terror attacks (including stabbings, assaults, shootings, projectile and rocket attacks, and attacks by improvised explosive devices (IED) within the Green Line that led to the deaths of five Israelis and one Eritrean, and two stabbing terror attacks committed by Jewish Israelis within the Green Line and not including Jerusalem. According to the ISA, Hamas, Hezbollah, and other militant groups fired 22 rockets into Israel and in 11 other incidents either planted IEDs or carried out shooting or projectile attacks into Israel and the Golan Heights. Neoliberal Settlement as Violent State Project: West Bank Settlement Homes and Real Estate Occupation Yael Allweil Faculty of Architecture and Town Planning, Technion and Israel Institute for Advanced Studies [email protected] Abstract Intense ideological debates over the legal status of West Bank settlements and political campaigns objecting to or demanding their removal largely neglect the underlying capitalist processes that construct these settlements. Building upon the rich scholarship on the interrelations of militarism and capitalism, this study explores the relationship between capitalist and militarist occupation through housing development. Pointing to neoliberalism as central to the ways in which militarism and capitalism have played out in Israeli settlement dynamics since 1967, this paper unpacks the mutual dependency of the Israeli settlement project on real estate capitalism and neoliberal governance. Through historical study of the planning, financing, construction, and architecture of settlement dwellings as real estate, as well as interviews and analysis of settler-produced historiographies, this paper identifies the Occupied Territories (OT) as Israel’s testing ground for neoliberal governance and political economy. It presents a complementary historiography for the settlement project, identifying three distinct periods of settlement as the product of housing real estate: neoliberal experimentation (1967-1994), housing militarization (1994-2005), and “real-estate-ization” (2005-present).
