The originating law, Chapter 30, Article 38 of the West Virginia Code is titled the “West Virginia Real Estate Appraiser Licensing and Certification Act.” A second law, Chapter 30, Article 38A of the West Virginia Code, the “West Virginia Appraisal Management Companies Registration Act,” was passed in 2013 to register and regulate appraisal management companies. Subsequent to passage of the Chapter 30, Article 38A, the Board’s mission includes protecting the public interest by assuring that all consumers of real estate appraisal services receive such services from appraisers who are fully qualified in accordance with both Federal and State law and from appraisal management services from appraisal management companies who are fully compliant with State law. The Board was established as a result of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (FIRREA). FIRREA is considered the most important banking law since the Great Depression, when the FDIC was created. FIRREA was the beginning of statutory attempts to re-regulate the banking and savings and loan industry. For real estate appraisal, Title XI of FIRREA established the Appraisal Subcommittee (ASC) as a sub-committee of the Federal Financial Institutions Examination Council. Title XI’s purpose is to provide that Federal financial and public policy interests in real estate transactions would be protected by requiring that real estate appraisals utilized in connection with federally related transactions were performed in writing, in accordance with uniform standards, by individuals whose competency was demonstrated and whose professional conduct was subject to effective supervision. The Appraisal Subcommittee monitors the West Virginia Real Estate Licensing and Certification Board, as well as the licensing and certification programs for real estate appraisers in each State to determine whether the State’s policies, practices and procedures are consistent with Title XI and enforcing the requirements of Title XI. The ASC has adopted formal Policy Statements Regarding State Certification and Licensing of Real Estate Appraisers. These Policy Statements interpret Title XI and reflect the general framework that the ASC uses when it reviews State appraiser regulatory programs for compliance with Title XI. A copy of the 2013 Appraisal Subcommittee Policy Statements is included with this report. 001 WV Real Estate Appraiser Licensing and Certification Board Members Chapter 30-38-6 of the West Virginia Code specifies the composition of the West Virginia Real Estate Appraiser Licensing and Certification Board. The Board consists of nine members appointed by the governor with the advice and consent of the Senate: Each member shall be a resident of the state of West Virginia, except the appraisal management company representative is not required to be a resident of West Virginia. Four members shall be certified real estate appraisers having at least five years’ experience in appraisal as a principal line of work immediately preceding their appointment and shall remain certified real estate appraisers throughout their terms. Two members shall have at least five years’ experience in real estate lending as employees of financial institutions. Two members may not be engaged in the practice of real estate appraisal, real estate brokerage or sales or have any financial interest in these practices. One member shall be a representative from an appraisal management company registered under the provisions of West Virginia Code, Chapter 30-38A. No member of the Board may concurrently be a member of the West Virginia Real Estate Commission. Not more than two appraiser members may be appointed from each congressional district.
