M Describe the steps you intend to take to promote the four licensing objectives:

a) General – all four licensing objectives (b, c, d and e) (please read guidance note 9) Calling is an established festival which is successfully operated under proven licence conditions. This application proposes that the existing conditions for the promotion of the licensing objectives which appear in the existing premises licence (as amended by the minor variation) will be retained in the new licence (if granted) save for neccesary changes proposed later in this application.

The changes proposed are as follows:

1.The licence currently held is for 19,999. It is proposed to increase capacity to 34,999 by gradual expansion of the festival over three years. In 2015, a capacity of 24,999 is proposed, in 2016 a capacity of 29,999 is proposed and from 2017 a capacity of 34,999 is proposed. In 2016 and 2017 the increase will only be implemented provided it has first been approved at the planning stage by the Safety Advisory Group (SAG) and approved in writing by the Licensing Authority.

To accommodate the increased capacity, the licensed area will be increased providing additional areas for the arena, camp site and car park. The event safety plan will be revised to take into account the additional capacity by increasing facilities, security, medical provision etc for the larger event.

2. It is proposed to provide regulated entertainment beginning at midday on the first day of each event (Thursday). The outdoor stages will cease at 23:00 hours. The majority of indoor stages will cease at 03:00 hours. We wish to operate one small indoor stage until 05:00 hours on the Friday, Saturday, Sunday and Monday mornings. We propose that (a) the existing noise conditions are amended to control sound levels until 05:00 hours (b) the existing condition 92 relating to low frequency noise is amended so that it begins with the words "Between the hours of 23:00 and 05:00…" (c) conditions 89 and 91 have been amended by the deletion of paragraphs referring to the Thursday so that the noise conditions applicable to the Thursday of the event shall be the same as other days of the event.

3. It is proposed that an amendment is made to the admission policy so that this policy no longer descriminates against young families by requiring parents/guardians of children to be over 30. The existing conditions 109-113 should be deleted and instead condition 108 be amended to read as follows "Each year there will be in place an under 18's admissions/ticketing policy which must be approved by the SAG and implemented by the Premises Licence Holder".

The festival will be managed by the existing management team who will continue to work with Eden District Council in order to satisfy the four licensing objectives.

Kendal Calling will continue to be a single annual event. The licensing authority will be notified of the dates at least 3 months prior to the first day of each event. The dates for 2015 will be 30th July - 2nd August.

Tickets will be sold in advance through an established ticketing agency and have fraud prevention measures e.g printed holograms. Entrance to the event will be strictly managed by the issuing of a non transferable wristband upon arrival. There will be a box office onsite to deal with any ticketing queries and to issue guestlist wristbands.

The site perimeter has existing walls and fences and a heras type fenceline will be added. The security plan will include staff patrolling the event perimeter.

The event will have pitches for professional caterers to provide food for audience members.

Relevant safety and insurance documentation for all caterers will be supplied to Eden DC Environmental Health Officers as required in advance of the event and a schedule for onsite inspection agreed.

At least 2 months prior to the first day of each event the licence holder must provide the Licensing Authority with a copy of the Event Site Plan and Event Safety Plan including the operational management structure for the event, setting out the key role and responsibilities of the various duty holders including identfying who has overall responsibility for complying with the Health and Safety at Work Act 1974. The information provided must include all the site risk assesments for the event.

The event management team will hold a meeting in Eden no later than two months prior to each Event to discuss intended activity to ensure any agreed additional measures are incorporated into the event safety plan.

The event management team will hold a review meeting within six weeks of each event to be held in Eden and to which all relevant responsible authorities will be invited to discuss any issues arising from the event and consider any appropriate additional measures which will promote the licensing objectives.

b) The prevention of crime and disorder Policing arrangements will be reviewed annually with Cumbria Constabulary at least 2 months prior to the first day of the event.

A professional event security team will be appointed and be supported by volunteer festival stewards. The operation will be overseen by the Event Director and Head of Security who will be able to liaise with Cumbria Police. The interior and periphery of the site will be carefully controlled to prevent disorderly and violent behaviour. The physical layout of the site will be planned with crowd management and audience flow in mind and the security team briefed to prevent overcrowding in audience areas.

Conditions of entry will be advertised on the event website, issued with tickets and displayed at the event entrance. These conditions will be applied consistently and fairly.

The level of professional security personnel, approved in relation to each event by the licensing authority, will have a designated responsibility to maintain a safe environment for members of the public attending the event. SIA registered staff will be positioned at the entrance gates, bars, and stages and will patrol during the event. Additional stewarding staff will provide support, monitoring other areas and patrolling the event. All staff will be encouraged to be vigilant, identify suspicious behaviour and take appropriate action in the prevention of crime and disorder.

An undercover security team will be employed in order to target drug dealing, theft from tents and persons or other areas as required.

At all times when the premises are open to the public the Event Director shall be aware of the number of persons on the premises and shall if requested give this information to an Authorised Officer of the Council, a Fire Officers or a Polie Constable.

The Event Director will keep a record of all incidents relating to entry, disruptive behaviour and controlled weapons and substances. The incident records will be available to be viewed by any relevant authority.

Careful planning of the supply of alcohol in conjunction with Cumbria Police will include controls to prevent excessive drinking and the supply of alcohol to minors. While there will

17 be bars throughout the festival site the sale of alcohol is not the main focus of activity, A 'Challenge 21' policy will be implemented. Anyone who appears to be under 21 will be asked to produce a passport, drivers licence ID or an accredited proof of age card in order to purchase alcohol.

An alcohol management plan will be agreed with police at least two months before the start of the event and will form part of the event safety plan.

Ticket holders over 18 will be permitted to bring a reasonable amount of alcohol into the campsite areas only for personal consumption.

Sufficient numbers of bar staff will be employed in order to keep down the number of people waiting at any bar area. Staff can be moved between bars or shifts altered during the event if required in response to demand.

No glass may be brought onto site by ticket holders. No glass will be served at any bars. Any broken glass onsite will be cleared up immediately on being seen or reported to a member of staff.

The DPS will keep a record of all incidents occuring in relation to the bars and sale of alcohol on site.

Bar staff will be trained to recognise drunkeness and those under the influence of drugs and will refuse service to customers who have consumed excessive alcohol and will be trained to handle potential trouble makers and diffuse difficult situations. Each bar supervisor will have a radio in order to report incidents to the event control centre.

SIA security staff will be briefed to be on the lookout for minors consuming alcohol. Notices will be clearly displayed at bars indicating that it is unlawful for person under 18 to purchase alcohol or for another person to purchase alcohol on behalf of a person under the age of 18.

A zero tolerance drugs policy will be operated. Details of this policy will be agreed with Cumbria Police two months before the first day of the event. c) Public safety Adequate temporary lighting will be used onsite, in particular on main walking routes through the arena and campsite areas.

The licence holders must appoint a suitably competent and appropriately qualified person(s), experienced in the specific nature of the event, to co-ordinate the management of the health and safety. Any such person(s) should be involved with and available to officers of the council and site employees during the prevent planning, site build, throughout the duration of the event and during the site de rig and clearance. The licence holders may wish to refer to the Occupational Safety and Health Consultants Register for further guidance in determining competency of persons to take on such Health and Safety Functions.

There should be a clear division between the completion of the site build and access by the public at commencement of the event, such that heavy plant and equipment must have left public areas of the site and construction tasks are no longer being carried out.

The Licence Holder shall prepare an Emergency Plan to respond to all foreseeable major incidents occurring on the site. The plan, which shall include evacuation procedures, will be prepared in consultation with the emergency services to enable quick and effective action to be implemented by the Licence Holder and the Emergency Services in the event of a major incident.

The Licensee shall ensure that all temporary demountable structures including all stages,

18 marquees, barriers, grandstands, towers and any other structure listed in the industry guide conform to The Institution of Structural Engineers "Temporary Demountable Structures - Guidance on Design, Procurement and Use" - Third Edition 2007 (ISBN 1 874266 45 X) or to any guidance that supercedes this.

The Licence Holder must ensure that the design concept statements for marquees and large tents include the following; - Design - Wind Loads - Foundation and Anchorage Requirements - An erection schedule - Protection to be provided to structural support columns to prevent the public climbing on these structures. - Protection to be provided to guy ropes and anchoring stakes in areas likely to experience heavy pedestrain traffic -Details of any flooring structure

The Licence Holder must ensure that prior to the public being permitted on to the site, a signed statement is received in respect of each temporary structure, which certifies that they have been inspected and where appropriate, tested by a competent person following completion and to confirm structures have been constructed in accordance with the design specifications. The Licence Holder must make these statements available to the Licensing Authority if requested.

Vehicle movement within the festival site must be managed to ensure that pedestrians are appropriately segregated from site vehicles during the site build, during the event and load out. Vehicle movements must be strictly controlled by following a Workplace Transport Plan. A copy of the Workplace Transport Plan must be submitted to the Licensing Authority at least 2 months prior to the event.

Vehicular movement while ticket holders are on the licensed site shall be limited to essential journeys and shall be controlled in the interests of safety of the ticket holders and staff. The onsite traffic plan shall be available in the Event Safety Plan that is provided to the Licensing Authority. This document shall focus on vehicle and pedestrian movements on site. Its thrust shall be to reduce and / or manage potential areas of conflict between vehicles and pedestrians. The need for large vehicles to manoeuvre and reverse around any areas where ticket holders are present shall be eliminated wherever possible. Where not possible, appropriate safety rules shall be in place and shall be implemented and contractors shall be advised accordingly. Banksmen or chaperones shall be used where vehicle movements in areas where there are pedestrians is unavoidable. They shall be adequately trained and provided with personal protective equipment. Any drivers found driving carelessly or dangerously shall be disciplined.

Only fully certified workers shall use the appropriate site plant supplied. Their certification shall be checked by the site office / event safety co-ordinator before any keys are distributed.

Event contractors must comply with site rules and regulations as set by the Licence Holder. These site rules and regulations must be made available to event contractors and employees prior to site build and there should be a consequence for breach of site rules.

Due to the presence of overhead powerlines at the festival site on Lowther Deer Park, Hackthorpe the Licence Holder must comply with General Guidance Notes GS6 Avoidance of danger from overhead electric power lines or any guidance that supersedes this.

Residual current devices must be used on all electrical power outlets for use by performers on and around the stages.

The Licensee shall ensure that only premised that are already registered under the Food Safety & Hygiene (England) Regulations 2013 shall be allowed to provide food and drink at Kendal .

Concession, Traders and Sponsors must ensure they comply with the Eden DC Outdoor event Food Safety Requirements and Checklist provided prior to the event.

There shall be provided suitable containers for the storage and disposal of waste foods and other refuse from the site. Those containers shall be constructed, maintained and located so that access to them by vermin and unauthorised persons is prevented and arrangements shall be made for the regular lawful disposal of their contents.

Cattle and other farmed animals shall be excluded from grazing on any part of the Festival site that is to be used for camping or entertainment (excluding car park areas) for a minimum of 21 days prior to the traders being admitted onto the site and up until camping has ceased on site.

All event activity within the premises will be controlled with specific reference to the capacity, the nature of the cultural content and in compliance with with the standards for the provision of services as outlined by the relevant guidance. In the event of conflict between the licence conditions, the event safety plan, and the relevant guidance, the licence conditions and event safety plan will take precedence.

The event management team will seek the approval of the licensing authority during the consultation and planning stages of the event to ensure that the safety of the general public, contractors and artists, to minimise hazards and prevent accidents. This will be done through a series of SAG (Safety Advisory Group) meetings, ongoing consulation with responsible bodies, proof of public liability insurance and relevant risk assesments. All event activity will make provision for the management of access and egress to the site taking into account the maximum specified capacity.

All marquees onsite shall comply with fire safety code BS 7837 Specifications for Flammability Performance for Textiles used in the Constructions of Marquees and Similar Textile Structures.

All event contractors will comply with all relevant health and safety legislation and follow the control measures documented in their own risk assessments and method statements and be responsible for ensuring safe systems of work.

No temporary electrical wiring or distribution system will be installed in the premises unless the installation is carried out by a suitably qualified and competent person. The Site Manager shall obtain a certificate from that person stating that the installation is fit for purpose and complies with BS 7671 and, where applicable, BS709 or any subsequent British Standard. A copy of that certificate will be produced by the event management team if requested to do so by an authorised officers of the Council or an officer of the Cumbria Fire and Rescue Service.

Provision will be made to allow communication of emergency procedures and issues relating to health, safety and welfare of people with the premises. This will be done through signage, PA systems and event staff face to face. Emergency evacuation plans and blue routes for emergency vehicles will be detailed in the event safety plan.

All exits and escape routes (including external escape routes) from the premises will be free from all obstructions when the public are on the premises.

All exit gates from the premises or enclosures will be capable of being opened by any

20 person without the use of a key card, code or similar means and will be kept free from all fastening devices when the premises is open to the public. In addition, all fire exits will be correctly signed with high visability signage.

All exit routes shall be checked on every occasion before the premises opens and on regualar occasions during the event to ensure they are free from defect, obstruction, trip hazards and surfaces are not slippery.

The layout of marquees an other temporary structures or furniture will be such so that it does not obstruct any exit, route to any exit or to any facility within the premises.

St John Ambulance or a similar competent organisation will have an active presence onsite throughout each event providing medical support. In addition to an onsite treatment centre staffed by doctors, nurses and paramedics, there will be ambulances onsite to transport patients to hospital if required. The medical contractor will keep records of incidents which will be available to view by any relevant authority.

There will be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials. An appropriate level of first aid cover will be maintained on site during build and break periods.

Firefighting equipment will be provided throughout the premises at suitable locations and comply with BS 5306 part 8, selection and installation of portable fire extinguishers or subsquent fire regs.

All members of security staff, caterers and production staff will be familiar with the operation of fire fighting equipment.

Catering concessions are responsible for providing their own fire fighting equipment.

Adequate temporary toilet facilities for the scale and duration of the event will be provided in line or above and beyond the guidelines in the Event Safety Guide.

Loudhailers will be provided in order to address the crowd in the case of the failure of one or multiple sound systems or loss of power.

Two months before the event, a water safety plan along with a map of the site with the complete water supply / distribution network clearly shown shall be supplied to the Environmental Protection Team. This should also show the location of the point at which the distribution system is connected to the mains supply.

d) The prevention of public nuisance A cleansing plan will be agreed between the event management team and the Lowther Estate in order to manage the litter and refuse during the build, live event and de rig phases. A cleansing contractor will be employed.

There will be no emissions from the premises of any offensive smells which are likely to cause a nuisance.

Provided at the premises there will be containers for the storage of disposal of waste foods and other waste from the premises. These containers will be constructed, maintained and located so that access to them by vermin or unauthorised persons is prevented and arrangements will be made for regular lawful disposal of their contents.

A traffic management contractor will be procured and work with the Kendal Calling

21 management team to develop a traffic management plan to ensure the smooth arrival of festival attendees and minimise the disruption to the local area. This plan will be shared with the SAG group for approval at least 1 month prior to each event.

It is proposed that the Noise Management conditions from the minor variation are incorporated into the new licence with appropriate changes:

67. A Noise Management Plan shall be submitted to the Licensing Authority at least 8 weeks prior to the first day of each event. This shall take account of all regulated entertainment which will be provided during each event, including the number of stages and the location, orientation, nature of the entertainment and operational times of each stage. The noise assessment and noise management plan shall include: a) noise predictions to assess noise levels at noise sensitive properties surrounding the event site. These shall be supported by details of the methodology used in deriving the predicted noise levels and shall clearly specify any assumptions made: b) details of the sound control and monitoring scheme that will be put into place to minimise noise levels to achieve compliance with the licence; c) an offsite noise monitoring strategy which demonstrates an adequate level of monitoring at all noise sensitive villages/properties identified in a) above.

68 The contents of the Noise Management Plan shall be subject to written approval of the Licensing Authority prior to the event taking place. The event shall be operated in accordance with these documents. No noise sources shall operate during the event, other than those included in the Noise Management Plan, without the prior written agreement of the Licensing Authority.

69. The Premises Licence holder shall provide assistance to authorised officers of the Responsible Authority for Environmental Health (Environmental Protection) where it is considered that there is a need for officers to monitor the event either to satisfy themselves of compliance with the noise conditions in this Licence, complaint investigation or for enforcement purposes.

70. The Premises Licence holder shall appoint a suitably qualified and experienced noise control consultant, to the approval of the Licensing Authority, no later than eight weeks prior to each event. This consultant shall liaise between all parties including the Premises Licence holder, promoter, sound system supplier, sound engineers (both house and visiting), artists Licensing Authority and, authorised officers of the Responsible Authority for Environmental Health (Environmental Protection) on all matters relating to noise control prior to and during the event.

71. At least eight weeks prior to the event, the licence holder shall provide the Responsible Authority for Environmental Health (Environmental Protection) with the names and contact details for individuals responsible for ensuring compliance with the licence conditions 67 and 70.

72. At least two weeks prior to each event either: a) a letter shall be circulated to local residents within a 3km radius of the licensed premises detailing the start and finish times of the event and the time(s) of any sound checks and a dedicated telephone number for noise complaints; or b) a notice shall be placed in a local newspaper containing the information referred to in paragraph a). The notice shall be repeated in the local newspaper current at the weekend of the event. The wording and format of either the letter or notice shall be agreed by the Licencing Authority and shall be submitted for approval at least 14 days before delivery or publication.

74. The dedicated telephone complaints line referred to in Condition 72 shall be available and attended by a nominated person (the “call handler”) for the duration of each event. Should any noise complaints be received, the complaint shall be investigated by the noise consultants and, if the noise levels are above those specified in the licence conditions, immediate action shall be taken to reduce the noise source. The complaints hotline shall be tested to ensure that it is operational at least three times during each day of the event. These tests shall be made at least once during each of the following times; 1400hrs to 1800hrs; 1800hrs to 2300hrs and 2300hrs to 0500hrs. The results of these tests, including the times that they are undertaken shall be recorded in a log and the log submitted to the Licencing Authority within 28 days after the event. In the event that the test shows the hotline is not functioning, this shall be investigated and remedied immediately. A record of the failure and corrective action taken shall be included in the log.

75. In the event of a complaint being received by the hotline or by any other means of communication as it may arise, the noise consultant shall attend the complainant’s property to commence an investigation within 20 minutes of him/her being notified of a complaint and within 30 minutes of the complaint being received by the nominated call handler. A complaints log shall be maintained throughout the event, detailing addresses of complainants, telephone numbers, times of complaint, details and findings of the investigation and action taken to resolve the complaint (if required). A copy of the complaints log (even if it is a nil return) shall be submitted to Licencing Authority within seven days of the end of the event.

77. No amplified regulated entertainment from any part of the event site shall be permitted outside the hours agreed apart from the testing of amplified equipment and sound checks which shall only be undertaken with the prior agreement of the Licencing Authority

78. The sound systems for each stage/music producing venue shall be set up as detailed in the Noise Management Plan required by condition 67.

80. During each event, communication shall be set up and tested between the complaints hotline call handler, the noise control consultant and the Premises Licence holder. Radios shall be provided by the Premises Licence holder (mobile telephone coverage is very limited in the area and therefore not suitable). Radios shall be provided to authorised officers of the Responsible Authority for Environmental Health for the purpose of compliance monitoring at their request when in attendance.

81. The Premises Licence holder shall ensure that the promoter, sound system supplier and all sound engineers are aware of the limits in this Licence, and any instruction from the noise control consultant shall be implemented immediately.

82. The noise control consultant shall have full control over the sound amplification equipment and the volume shall be adjusted to meet the noise levels specified in Condition 91. [or as otherwise requested by an authorised officer of the Responsible Authority for Environmental Health (Environmental Protection) .

83. Sound levels at the mixing desk positions shall be monitored and controlled in accordance with the Noise Management Plan.

84. Through the use of appropriate sound level meters (Type 2 or better), the appointed noise control consultant or his/her representatives shall continuously monitor and log sound levels at the sound mixer positions during each event. The logged data shall be submitted to the Licensing Authority 28 days of the last day of the event.

85. Authorised officers of the Responsible Authority for Environmental Health shall have access to the results of all noise monitoring at any time, including during the event.

86. The Premises Licence holder shall effect full control over traders or other organisations on site where there is amplified music being played. At the request of an authorised officer of the Responsible Authority for Environmental Health, the Premises Licence holder shall arrange for the volume to be reduced or the playing to cease.

87. Music from such sources (eg food traders) other than those listed in the Noise Management Plan shall will be limited from 1200 noon to 2300 hours daily.

88. Unrestricted access to the front of house position and backstage areas shall be allowed at all times to authorised officers of the Responsible Authority for Environmental Health (Environmental Protection) for the purpose of sound level measurements, communication with the nominated noise consultant/sound engineer and for the monitoring of licence conditions.

89. The Premises Licence holder shall ensure that they have sufficient competent staff to allow for proactive and reactive monitoring of noise levels to take place both on-site and at noise sensitive premises around the site. In the case of multiple noise complaints, this will ensure they are able to address the complaints in a timely and efficient manner. There shall be a competent person monitoring off-site noise levels at the locations identified in the Condition 67c from time to time throughout the day. From 2200hrs to the end of each day’s entertainment, a competent person shall be permanently based off-site monitoring for compliance with the noise levels in condition 91 at the locations identified in condition 67c. All monitoring points shall be monitored at least twice between 2300hrs and 0500hrs, once between 2300hrs and 0000hrs, and once after 0100hrs. In addition to this, monitoring should be predominantly focussed at the locations with the highest noise levels and any locations where complaints have been received. Monitoring shall include recording the sound level in dB(A) and octave bands. The sound levels shall be measured over an appropriate time period to be certain that a breach of the noise levels in condition 91 are not being exceeded. The noise consultant shall have discretion to take shorter period sound level readings (than the15 minute level (1200hrs to 2300hrs); 5 minute level (2300hrs to 0500hrs)) when the noise level is well below the condition limit. However, when a Noise Level reading is within 3 dB of the conditioned noise level, the relevant full 15-minute or 5 minute reading shall be taken.

NB The locations with the highest sound level readings are likely to vary from one night to the next and within the same night when weather conditions or on-site sources are variable.

In this and all subsequent conditions, the term Music Noise Level shall have the meaning as that defined in the Noise Council Code of Practice on Environmental Noise at Concerts

90. Sound Level measurements outside of the site shall be taken in accordance with the agreed Noise Monitoring Strategy forming part of the Noise Management Plan required by Condition 67. In the event of complaints being received offsite, monitoring shall be increased in line with the Plan required by condition 67c

91. The Music Noise Level resulting from each event shall not exceed 65dB LAeq, 15 min, between the hours of 12.00 noon and 23.00 and 45dB LAeq 5 min, between the hours of 23.00 and 05.00 when measured one metre from the facade of any residential properties.

The measurement of the Music Noise Level to demonstrate compliance with Condition 91 above shall be undertaken in such a manner that it relates to the condition ie at 1-metre from the façade of a dwelling unless an alternative noise level and measurement position (ie free

24 field) is agreed in writing with the Licensing Authority. Agreement to vary this condition shall be obtained at least 8 weeks before the event.

92. Between the hours of 23:00 and 05:00 Low Frequency Noise shall be limited to an external level at a noise-sensitive premises, of 62dB in any 1/3 Octave Band between 25 and 160 Hz. Measurements to demonstrate compliance shall be taken at the same time as given in Condition 89.

93. The Music Noise Levels during each event shall be measured using a calibrated integrating-averaging sound level meter complying with Type 2 or better, of BS6698. Time weighting F (fast response). In addition, octave-band or third octave sound level readings shall be measured and recorded.

94. Low frequency noise from the event needs to be controlled because of its ability to cause disturbance and nuisance at significant distance.

94. Measured levels taken outside of the site shall be manually logged or logged using the sound level meter. The levels shall be available to the Responsible Authority for Environmental Health (Environmental Protection) on request during the event and shall be submitted to the Licensing Authority within 28 days of the final day of the event.

95. Action necessary to ensure that the above noise limit is not exceeded shall be transmitted by radio through to an appointed person on site and immediate instructions issued to the sound engineers to resolve any potential or actual problems.

96. No sound systems other than those detailed in the Noise Management Plan required by Condition 67 shall be operated. The licence holder shall ensure implement controls through the security checkpoints to prevent any other sound systems from entering the site and shall ensure that campsite managers are aware of and enforce this condition.

97. Deliveries of all equipment, staging, plant, waste collection, traders etc to and from the site shall not take place outside the hours of 8.00am to 6.00pm daily. NB this list does not include artists.

e) The protection of children from harm Kendal Calling is a family friendly event with features such as separate family camping, entertainment areas for children and nappy changing facilities. Provision of the health, safety and welfare of children will be part of the event planning and organisation process and where necessary lost children facilities will be stipulated and, in the case of performers or participants interacting with children the event management team will be responsible for any required DBS checks.

The existing conditions 109 - 113 should be deleted and condition 108 to be amended as follows:

"Each year there will be in place an under 18's admissions/ticketing policy which must be approved by the SAG and implemented by the Premises Licence Holder."

Comments: I am appalled that Kendal calling have applied to extend the length of their festival. I have this year purchased a static caravan at Highgate caravan park, Morland. I had never heard of the Kendal calling festival until I arrived one weekend this summer. We had to endure a whole weekend of noise and loud unpleasant music which resonated through out the caravan. Our caravan site was unusually quite that weekend and on further enquires to the residents it became apparent that no one comes anywhere near that weekend because of the noise!. I am appalled that so many people are affected and an extension of the festival could possibly be being considered. Why should I or many other people not be able to attend their caravan at anytime and not expect peace and quite during the whole day never mind the night!. We contribute to the income of the area all year round and hopefully for many years to come and therefore our views and opinions should count for more than the people who float in once a year cause upset and then disappear. I'm writing to you in my capacity as the Event Director and license applicant for Kendal Calling. I have been sent a copy of your representation that you have made to Eden District Council, with regard to the new license application, and I would like to take this opportunity to address some of concerns that you have raised.

If I may give some background on Kendal Calling. Next year marks the 10th anniversary of the festival and as the name suggests it started out actually based in Kendal; it was founded by 2 local Cumbrian music promoters, and in its first year was just a 1 day 1000 capacity event. It has seen steady growth since year one with the festival expanding and moving location to meet the demand. It moved to its current home; the historic Lowther Deer Park in 2010, where we enjoy a very good, close working relationship with The Lowther Estate and family. The festival currently has a premises license for a capacity 19,999 and we have applied for an increase to 34,999 in order to allow the festival to grow over the coming years.

Kendal Calling is not just a music festival, although a wide range of music from Indie, to Jazz to Folk does form an important part; it also has a large children's area, film screenings, book readings, poetry recitals, art installations, sports activities and a fair ground. This is supported with wide range of food and drink vendors. The festival attracts a wide audience mix with 27% coming in family groups, 33% of the audience are aged 29-37 and 20% 38 -45.

20% of the audience comes from Cumbria, 40% from the North West of England, 10% from the North East, 5% from Scotland and the remainder from the rest of the UK.

95% of our audience considers Kendal Calling to be a family friendly festival.

Kendal Calling has been recognised nationally winning a large number of awards, such as Best Medium Size Festival at the 2013 UK Festival Awards,

It's estimated that the festival generates a direct economic benefit of £3.25 Million for the Cumbrian economy with secondary benefits from the marketing reach and developing tourism - for instance 77% of this years audience said they would come back and visit the Lake District. In addition the festival is committed to helping local charities and this year £56,000.00 was raised and distributed to charities and organisations such as Mountain Rescue and Penrith Lions. We also try and use local companies and suppliers where possible and we recruit a large number of staff from the local area.

We take our responsibilities as festival organisers very seriously and work with both The County Council as well as Eden District Council; the latter take the lead on the Safety Advisory Group which is a monthly meeting where we develop the event plans with partners agencies including Cumbria Constabulary, Eden DC Environmental Health Office, Cumbria Fire & Rescue, North West Ambulance Service, The Environment Agency and The Health & Safety Executive. I benefit from a very experienced management team here at Ground Control, which we compliment with a number of consultants including Health & Safety, Acoustic, Traffic Management and Security.

I am very sorry to hear that you suffered from noise nuisance from the festival, we work very hard with our acoustic consultants to ensure that we comply with the conditions laid down in the premises license. But our view is that it's not just about complying with conditions, our performance indicator is also the number of complaints received, and this year between us and Eden DC we received a total of 3 complaints, which is very good for a festival of this scale.

We have a very good relationship with local residents and businesses who see the huge benefit the festival brings to the area and we engage with those residents with residents letter's and community engagement meetings. To make the wider are aware we place advertisements in The Cumberland Westmorland Herald advising people that the festival is taking place and gives our residents hotline phone number which is manned 24 hours a day, I'm sorry that you haven't seen this. If we are aware of an issue we can normally do something to address the problem, such as reconfigure the soundsystem, place baffles or just reduce the level, and I'm afraid we have not record of any complaints coming in from Morland. We have received a complaint from Center Parcs in the past but once we were aware of the problem we met with their management and a dressed the issue. I like to think we have a very proactive approach in dealing with complaints. Now that I'm aware that you suffered last year I will be visiting Moreland with our acoustic consultants next week to try and understand what was causing the problem and to see what we can do about it.

I would hope that with this in mind you would consider withdrawing your representation on the basis that I will give you an undertaking to ensure we are not creating a noise nuisance at your property, and perhaps you may also consider joining us at the festival, so you can see what it has to offer. On behalf of Penrith Lions Club I would like to support this application for a new licence for the above event.

I understand that Kendal Calling wishes to grow the Festival over the next few years in order to make it one of the premiere events in the music festival world. The festivals appear to have been very well organised with numerous awards and very good feedback from festival goers.

The event has brought in a substantial amount of money to the area and has donated substantial sums of money to local charities over recent years.

Penrith Lions Club have been recipients of monies from Kendal Calling over the last few years. We have used some of the funds to further our Message in a Bottle and Message in a Wallet schemes that have been very successful in the Eden Valley area. These schemes help the Emergency Services when they go into homes by providing, in their fridge, details of medicines taken by the individual. We also help disadvantaged people in the area using these funds.

If the application were approved this would undoubtedly result in more cash for local charities at a time when it is becoming more difficult for charities to raise funds.
