Democracy in the United States
Democracy in the United States The United States is a representative democracy. This means that our government is elected by citizens. Here, citizens vote for their government officials. These officials represent the citizens’ ideas and concerns in government. Voting is one way to participate in our democracy. Citizens can also contact their officials when they want to support or change a law. The process required to become a citizen is called naturalization. To become a U.S. citizen, you must meet legal requirements. You must complete an interview with a USCIS officer. You must also pass an English and Civics test. Then, you take the Oath of Allegiance. This means that you promise loyalty to the United States. Religion and the Courts 1790-1947 Leslie C. Griffin* When the Framers drafted the United States Constitution in 1787, the only mention of religion was the remarkable text of Article VI, which states “no Religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.” That groundbreaking language marked a shift from prior practice in Europe and the states. At the time of the Constitution’s drafting, most states had religious qualifications for government officials, following the pattern in Britain, where the monarch was required to be a member of the Church of England. In Europe the guiding principle was cuius regio, eius religio: the religion of the people is determined by the religion of the ruler. Many of the Framers, especially James Madison, believed that the new Constitution protected liberty of conscience by creating a government of enumerated and separate powers that gave Congress no authority over religion. During the ratification process, however, constitutional critics demanded greater protection of individuals from the power of the government. In order to secure the Constitution’s ratification, the new Congress drafted a Bill of Rights that protected religious freedom in the following language: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.” Upon ratification by the states in 1791, the language about religion became the First Amendment to the United States Constitution.1 The two Religion Clauses of the First Amendment are known as the Establishment Clause and the Free Exercise Clause. Although Madison suggested that the standard protecting liberty of conscience should apply to state as well as federal governments, the language of the First Amendment—“Congress 1 shall”—applied only to the federal government. -

The Parliament
The Parliament is composed of 3 distinct elements,the Queen1 the Senate and the House of Representatives.2 These 3 elements together characterise the nation as being a constitutional monarchy, a parliamentary democracy and a federation. The Constitution vests in the Parliament the legislative power of the Common- wealth. The legislature is bicameral, which is the term commoniy used to indicate a Par- liament of 2 Houses. Although the Queen is nominally a constituent part of the Parliament the Consti- tution immediately provides that she appoint a Governor-General to be her representa- tive in the Commonwealth.3 The Queen's role is little more than titular as the legislative and executive powers and functions of the Head of State are vested in the Governor- General by virtue of the Constitution4, and by Letters Patent constituting the Office of Governor-General.5 However, while in Australia, the Sovereign has performed duties of the Governor-General in person6, and in the event of the Queen being present to open Parliament, references to the Governor-General in the relevant standing orders7 are to the extent necessary read as references to the Queen.s The Royal Style and Titles Act provides that the Queen shall be known in Australia and its Territories as: Elizabeth the Second, by the Grace of God Queen of Australia and Her other Realms and Territories, Head of the Commonwealth.* There have been 19 Governors-General of Australia10 since the establishment of the Commonwealth, 6 of whom (including the last 4) have been Australian born. The Letters Patent, of 29 October 1900, constituting the office of Governor- General, 'constitute, order, and declare that there shall be a Governor-General and Commander-in-Chief in and over' the Commonwealth. -

The President of India.—There shall be a President of India. * * * * * 54. Election of President.—The President shall be elected by the members of an electoral college consisting of— (a) the elected members of both Houses of Parliament; and (b) the elected members of the Legislative Assemblies of the States. 1[Explanation.—In this article and in article 55, "State" includes the National Capital Territory of Delhi and the Union territory of 2[Puducherry].] 55. Manner of election of President.—(1) As far as practicable, there shall be uniformity in the scale of representation of the different States at the election of the President. (2) For the purpose of securing such uniformity among the States inter se as well as parity between the States as a whole and the Union, the number of votes which each elected member of Parliament and of the Legislative Assembly of each State is entitled to cast at such election shall be determined in the following manner:— (a) every elected member of the legislative Assembly of a State shall have as many votes as there are multiples of one thousand in the quotient obtained by dividing the population of the State by the total number of the elected members of the Assembly; (b) if, after taking the said multiples of one thousand, the remainder is not less than five hundred, then the vote of each member referred to in sub-clause (a) shall be further increased by one; (c) each elected member of either House of Parliament shall have such number of votes as may be obtained by dividing the total number of votes assigned to the members of the Legislative Assemblies of the States under sub-clauses (a) and (b) by the total number of the elected members of both Houses of Parliament, fractions exceeding one-half being counted as one and other fractions being disregarded. -

Case Study Women in Politics: Reflections from Malaysia Wan Azizah Women constitute half of humanity, and it follows that any decision-making, whether at the personal, family, societal or public levels, should be mindful of and involve the participation of women in the making of those decisions. Women’s political, social and economic rights are an integral and inseparable part of their human rights. Democracy is an inclusive process, and therefore in a functioning democracy, the points of view of different interest groups must be taken into account in formulating any decision. The interest and opinions of men, women and minorities must be part of that decision-making process. Yet far from being included in the decision-making process, women find themselves under-represented in political institutions. Numerous challenges confront women entering politics. Among them are lack of party support, family support and the "masculine model" of political life. Many feel that Malaysian society is still male dominated, and men are threatened by the idea of women holding senior posts. In the political sphere this is compounded by the high premium placed on political power. This makes some men even less willing to share power with women. -

The South Carolina Legislature consists of two bodies—the Senate and the House of Rep - resentatives. There are 170 members—46 Sena - tors and 124 Representatives representing dis tricts based on population. When these two bodies are referred to collectively, the Senate and House are together called the General Assembly. To be eligible to be a Representative, a person must be at least 21 years old, and Senators must be at least 25 years old. Members of the House serve for two years; Senators serve for four years. The terms of office begin on the Monday following the General Election which is held in even num - bered years on the first Tuesday after the first Monday in November. -

The European Parliament and environmental legislation: The case of chemicals GEORGE TSEBELIS & ANASTASSIOS KALANDRAKIS University of California, Los Angeles, USA Abstract. The paper studies the impact of the EP on legislation on chemical pollutants in- troduced under the Cooperation procedure. A series of formal and informal analyses have predicted from significant impact of the EP, to limited impact (only in the second round) to no impact at all. Through the analysis of Parliamentary debates as well as Commission and Parliamentary committee documents, we are able to assess the significance of different amendments, as well as the degree to which they were introduced in the final decision of the Council. Our analysis indicates first that less than 30% of EP amendments are insignificant, while 15% are important or very important; second, that the probability of acceptance of an amendment is the same regardless of its significance. Further analysis indicates two sources of bias of aggregate EP statistics: several amendments are complementary (deal with the same issue in different places of the legal document), and a series of amendments that are rejected as inadmissible (because they violate the legal basis of the document or the germainess require- ment) are included in subsequent pieces of legislation. We calculate the effect of these biases in our sample, and find that official statistics underestimate Parliamentary influence by more than 6 percentage points (49% instead of 56% in our sample). Finally, we compare a series of observed strategic behaviors of different actors (rapporteurs, committees, floor, Commission) to different expectations generated by the literature.
