1 I, Ani S. Sarich, declare as follows: 2 1. I am a Senior Case Manager for CPT Group, Inc. (“CPT”), the Settlement 3 Administrator jointly agreed upon by the Parties and approved by the Court for the Broomfield, et 4 al. v. Craft Brew Alliance, Inc. Settlement. I have personal knowledge of the facts set forth in this 5 declaration and, if called upon to testify, I could and would testify competently to such facts. 6 2. CPT has extensive experience in providing notice of class actions and administering 7 class action settlements. In the past 30-plus years, we have provided notification and/or settlement 8 administration services in thousands of class action cases. A true and correct copy of CPT’s 9 company resume, which provides further information regarding CPT’s experience, was attached 10 to the Declaration of Julie N. Green (ECF No. 115-4) filed in support of Plaintiffs’ Motion for 11 Preliminary Approval. 12 3. As the Settlement Administrator, CPT is responsible for the following: 13 a. preparing, printing, and mailing the Summary Notice to Settlement Class 14 Members for whom Defendant had a valid mailing address; 15 b. establishing a website that includes Court-approved documents, allows 16 online submission of claims and opt outs, and provides up-to-date 17 information regarding the case; 18 c. answering questions from Settlement Class Members; 19 d. reviewing and determining the validity of submitted Claim Forms, and 20 requesting additional information if warranted; 21 e. following up with claimants who have deficient Claim Forms; and 22 f. preparing reports and summaries regarding the notice process for the Parties 23 and the Court; 24 g. distributing payments under the Settlement; 25 h. providing a post-distribution accounting declaration; and 26 i. all other tasks mutually agreed to by the Parties or requested by the Court. 27 28 -1- DECLARATION OF ANI S. 1 DATA ANALYSIS 2 4. On May 23, 2019, CPT received data files from Defendant containing names and 3 mailing addresses of known potential Settlement Class Members. No email addresses were 4 provided in the data. CPT reviewed the data files, removed duplicates, and removed disqualified 5 Settlement Class Members (e.g., distributors, retailers or re-sellers of Kona Beers). 6 5. After completion of the above-mentioned steps, CPT prepared a master list of the 7 identified Settlement Class Members. In summary, there were 742 valid mailing addresses. 8 TOLL-FREE TELEPHONE NUMBER 9 6. CPT established and has maintained a case-specific 24-hour, toll free, IVR 10 telephone support line (1-888-332-0551) that went live on July 3, 2019, to coincide with the live 11 date of the Settlement Website. Through this number, callers were provided the FAQs and 12 answers as well as the case-specific email address in the event they had additional questions. This 13 toll-free telephone number was listed at the top of the Settlement Website. As of the date of this 14 declaration, there have been 168 calls to the case telephone support line. 15 CASE-SPECIFIC EMAIL ADDRESS 16 7. CPT established and has maintained a dedicated email address 17 ([email protected]) that Settlement Class Members can use to communicate 18 with CPT regarding details of the case. This case-specific email address was listed at the top of 19 the Settlement Website. As of the date of this declaration, there have been 228 email submissions 20 to this email address and CPT promptly responded to all of them. 21 SETTLEMENT WEBSITE 22 8. On July 3, 2019, the Settlement Website (www.KonaBeerSettlement.com) went live 23 and began the activation of the Notice Plan. The website contains copies of relevant settlement 24 documents (e.g., the Settlement Agreement, Summary Notice, Long Form Class Notice, and 25 Claim Form) and other relevant documents filed in the case (e.g., the operative complaint, the 26 answer to the complaint, Order Granting Class Certification, Plaintiffs’ Motion for Preliminary 27 Approval and filings in support, Order Granting Preliminary Approval, and Plaintiffs’ Motion for 28 Attorneys’ Fees and Costs and Class Representative Service Awards). 1 documents were promptly uploaded after the Settlement Website became active as they became 2 available. For example, Plaintiffs’ Motion for Attorneys’ Fees was filed on September 2, 2019 3 (Labor Day) and uploaded to the Settlement Website on September 3, 2019. All these documents 4 are accessible for download. 5 9. True and correct copies of the Summary Notice, Claim Form, and Long Form Class 6 Notice are attached hereto as Exhibits A, B, and C respectively. 7 10. The Settlement Website also contains a Frequently Asked Questions page and case 8 timeline, which reflects important dates and deadlines regarding the Settlement. As of the date of 9 this declaration, in aggregate there have been approximately 815,900 views of the Settlement 10 Website’s pages. 11 11. The Settlement Website contains an Accessibility Menu widget from UserWay.org. 12 This application is compliant with WCAG 2.1, ATAG 2.0, ADA and Section 508 requirements, 13 and allows individuals the ability to change font size, adjust contrast, have content on each page 14 read aloud, amongst other items. 15 12. CPT shall continue to maintain and update the Settlement Website with relevant 16 documents as they become available, in addition to any other updates requested by the Parties or 17 required by the Court. 18 PRESS RELEASE 19 13. On July 8, 2019, the approved PR Newswire’s National Network notice was 20 published. As of the date of this declaration, the notice has been picked up by 154 outlets with a 21 total potential audience of 131,723,000. The press release included the Settlement Website 22 address so that Settlement Class Members could easily access information about the Action and 23 Settlement. Attached hereto as Exhibit D is a true and correct copy of the National Press Release 24 and reporting. 25 DIGITAL BANNER ADVERTISEMENTS 26 14. On July 8, 2019, CPT implemented a 10-week programmatic digital banner 27 advertising campaign on the Google Display Network (GDN), general programmatic ad 28 exchanges, as well as ad placements on the following social media platforms: Facebook Audience -3- DECLARATION OF ANI S. 1 Exchange Ad Network, Instagram, and Twitter. These hyperlinks allowed access to the 2 Settlement Website through an embedded hyperlink contained within the banner notice ad. As of 3 the date of this declaration, the digital media portion of the notice program was designed to reach 4 the target audience, on average, 2.24 times by serving a total of 39,203,265 gross ad impressions. 5 Ad unit sizes were placed using the standard IAB sizes: Leaderboard (728x90) and Medium 6 Rectangle (300x250). Over the course of the paid campaign, the campaign ad(s) appeared on 7 mobile, tablet, laptop, or desktop screens. Attached hereto as Exhibit E is a true and correct copy 8 of the online and mobile media banner ads, with links or references to the Settlement Website, 9 and reporting. 10 PUBLICATION 11 15. CPT caused the Summary Notice to be published in the San Jose Mercury News 12 Newspaper on four consecutive Sundays, pursuant to the Settlement Agreement and in compliance 13 with the CLRA, Cal. Civ. Code § 1781(d) and (e). Attached hereto as Exhibit F are the tear- 14 sheets from the aforementioned publication. The notice was published on the following dates: 15 a) Sunday, July 7, 2019 b) Sunday, July 14, 2019 16 c) Sunday, July 21, 2019 d) Sunday, July 28, 2019 17 18 16. In addition, CPT caused the Summary Notice to be published in the National 19 Geographic Magazine, pursuant to the Settlement Agreement. Attached hereto as Exhibit G is 20 the tear-sheet from the aforementioned publication. National Geographic Magazine is a national 21 magazine with an estimated circulation of 2,648,853 individuals. A one-time publication in the 22 September 2019 Nationwide Edition of National Geographic Magazine began in-home delivery 23 on August 24, 2019 and on-sale in US newsstands from August 27, 2019 through September 23, 24 2019. CPT’s selection to place the Summary Notice in National Geographic was based upon GfK 1 25 MediaMark Research & Intelligence, LLC (MRI) data which aids in understanding the socio- 26 1 GfK MRI’s Survey of the American Consumer® is the largest and most authoritative study of adult consumers in the United States. All 27 information collected in the Survey comes from a single set of respondents, ensuring data integrity and reliability. GfK MRI interviews approximately 25,000 consumers every year in towns, cities and counties across the contiguous 48 states. Crucial to the Survey’s success is the 28

1 economic characteristics, interests and practices of a target group which guides the proper 2 selection of media relative to reach and circulation for the most economical price. This 3 advertisement resulted in an estimated reach of 16.42% of the Target Audience. 4 DIRECT NOTICE VIA U.S. MAIL 5 17. On July 5, 2019, CPT conducted a National Change of Address (NCOA) search to 6 update the class list of addresses as accurately as possible. A search of this database provides 7 updated addresses for any individual who has moved in the previous four years and notified the 8 U.S. Postal Service of their change of address. As a result of the NCOA, CPT was able to locate 9 72 new addresses. 10 18. On July 8, 2019, Summary Notice postcards were mailed via U.S. First-Class mail to 11 742 potential Class Members. Attached hereto as Exhibit H is a true and correct copy of the 12 Summary Notice that was mailed. 13 19. As of the date of this declaration, no Summary Notices have been forwarded by the 14 Post Office. Of the 742 postcards, three have been returned as undeliverable. 15 SUMMARY OF CLASS NOTICE 16 20. To best reach the unidentified class members through a notice program, CPT 17 Group utilized GfK MediaMark Research & Intelligence, LLC (MRI) data. The data CPT 18 gathered was based off a study released in Spring 2018 among adults over 21 within the United 19 States who identify with the MRI Cross Tab statement “Regular Domestic Beer/Ale Total Users:

20 relationship GfK MRI develops with respondents. Interviews are conducted in consumers’ homes, face-to-face, and followed up with a 21 comprehensive self-administered survey. In a national probability study such as the Survey of the American Consumer, the higher the response rate the more reliable the data. GfK MRI’s highly trained interviewers consistently generate the highest response rates in the industry. The Survey of the 22 American Consumer is fully projectable to the entire adult population of the U.S. It can quantify and qualify nearly every dimension of the 23 consumer and media experience. Demographics - a full range of personal, family and household data. Lifestyles - personal and business travel, leisure activities, business responsibility, public and civic involvement. Consumption - detailed purchase and volumetric data for 6,500 consumer 24 products and services in 550 categories. Psychographics - opinions and attitudes across a wide range of interests and categories, covering thousands of data points. The Survey provides the marketing currency for national print advertising in the U.S. and delivers detailed usage and exposure data 25 for all other media: Consumer magazines and national newspapers - extensive readership data for over 200 titles with print and digital information. Selected local newspapers - average issue and frequency of reading in print. Television - programs watched, services used, time and place of 26 viewing. Radio - AM, FM, satellite and internet. Internet - type of connection, place of usage and time spent, devices used, sites visited. 1 Drank in the Last 6 Months 1x: Defined Beer Brand as: “Other Small/Regional.” Gfk MediaMark 2 Research & Intelligence study concluded that our potential nationwide target audience was 3 approximately 7,796,000. 4 21. To reach these potential class members, numerous targeting layers were 5 implemented, including Facebook targeting, Instagram targeting, Twitter targeting, demographic 6 targeting, search targeting, interest-based targeting, category contextual targeting, purchase data 7 targeting, keyword contextual targeting, and website re-targeting. In addition, ads were geo- 8 targeted on a nationwide basis. Search terms were relevant to the class member defined in the 9 Settlement Agreement and based upon the demographics of the target audience as identified by 10 GfK MRI consumer research. This helped qualify the impressions to ensure the message was 11 served to the most relevant audience. CPT’s digital media portion of this notice program was 12 designed to reach 75% of the target audience with print publication advertisement reaching 13 approximately 16.43% of the target audience, for a total reach of 91.43%. As set forth in 14 paragraphs 12 through 22 of the Declaration of Julie N. Green (ECF No. 115-4), CPT estimated 15 that there were approximately 7,800,000 potential Class Members and that the Notice Plan would 16 reach 90% of the Class. 17 22. In summary, the Notice Plan was successfully and timely implemented on July 3, 18 2019 and completed on September 16, 2019, in compliance with the Settlement Agreement and 19 the Order Granting Preliminary Approval of Class Action Settlement. 20 RESPONSE OF THE CLASS 21 23. The deadline for Class Members to exclude themselves from the Settlement Class, 22 object to Settlement, or submit a Claim Form was October 7, 2019. 23 24. The response of the Class is summarized as follows: two Class Members submitted 24 Objections, two persons timely and validly excluded themselves from the Settlement Class, and 25 159,065 Class Members submitted Claim Forms. 1 A. Objections 2 25. Both the Long Form Notice and Summary Notice stated that Class Members who 3 wish to object to the Settlement must do so by filing an objection with the Court by on or before 4 October 7, 2019. CPT has not received any objections or communications that could be construed 5 as objections to the Settlement. As of the date of this declaration, CPT has been informed that two 6 objections have been filed with the Court. I further understand that Plaintiffs will be filing 7 responses to these two objections, and CPT will provide additional information pertinent to those 8 responses as may be necessary. 9 B. Exclusions/Opt-Outs 10 26. Both the Long Form Notice and Summary Notice stated that Class Members who 11 wish to exclude themselves from the Settlement must do so by submitting a request for exclusion 12 to CPT by on or before October 7, 2019, either by U.S. Mail or electronically through the 13 Settlement Website. As of the date of this declaration, CPT has received 19 requests to be 14 excluded from the Settlement Class. Of these, two have been deemed to be valid and timely. The 15 remaining 17 have ultimately been deemed invalid, pursuant to the Settlement Agreement. A true 16 and correct list of the individuals who have validly excluded themselves from the Settlement is 17 attached hereto as Exhibit I. 18 C. Claim Forms 19 27. Both the Long Form Notice and Summary Notice stated that Class Members who 20 wish to participate in the Settlement must do so by submitting a Claim Form to CPT on or before 21 October 7, 2019, either by U.S. Mail or electronically through the Settlement Website. Upon 22 request, individuals who were unable to complete the Claim Form online, or unable to print and 23 mail a form, were mailed a paper Claim Form. CPT has thus far mailed 10 Claim Forms pursuant 24 to request by potential Settlement Class Members. 25 28. As of the date of this declaration, CPT has received a total of 159,065 Claim Forms 26 from potential Settlement Class Members. 27 28 -7- DECLARATION OF ANI S. SARICH ON BEHALF OF CPT GROUP, INC. 1 CLAIM FORM VALIDATION 2 29. Upon receipt of each Claim Form, CPT was tasked with determining whether it was 3 valid or deficient. If deemed deficient, a letter was sent with instructions to the potential 4 Settlement Class Members as to how the claim could be cured and the deadline by which a 5 response must be received. 6 30. CPT is still in the process of verifying some of the Claim Forms (e.g., removing 7 duplicative and fraudulent claims). CPT will provide a supplemental declaration once this process 8 is completed, and in no event later than December 12, 2019 (one week before the Final Approval 9 Hearing). This supplemental declaration will include information regarding the total number of 10 valid Claim Forms received, a breakdown of the amounts claimed (e.g., up to $10 without proof 11 of purchase (Option A) and up to $20 with proof of purchase (Option B)), and the total aggregate 12 dollar value claimed. 13 DISTRIBUTION PROCESS 14 31. Once the finalized distribution list has been prepared, and if the Court approves the 15 Settlement, CPT will pay all Settlement Benefits to Settlement Class Members who submitted 16 valid Claim Forms. Payment will be in the form of a check, e-check, or direct deposit, whichever 17 option Settlement Class Members chose at the time of submission. 18 32. CPT will provide the Court with a post-distribution accounting within 21 days of the 19 distribution of settlement funds and payment of attorneys’ fees. This post-distribution accounting 20 will also be posted to the Settlement Website, along with any other documents, such as the 21 Court’s Final Approval Order and Final Judgment. 22 SETTLEMENT ADMINISTRATION COSTS 23 33. As of the date of this declaration, CPT has invoiced and collected $180,950.00 in 24 postage costs and publication expenses. In total, the costs paid to CPT by Defendant will not 25 exceed $395,000, the amount that Defendant has agreed to pay to CPT under the Settlement 26 Agreement. If the Court approves the Settlement, CPT understands it will be paid $395,000 from 27 Defendant. Based on CPT’s experience, the outreach efforts described above reflect a 3 particularly appropriate, highly targeted and contemporary way to employ notice to this Class. 4 This multi-media channel approach to notice, which employed direct notice, digital, social and 5 mobile media, reached an estimated 91.43% percent of targeted Class Members. Further, the 6 efforts used in this Notice Plan were of the highest modern communication standards, were 7 reasonably calculated to provide notice to the Class, and were consistent with best practicable 8 court-approved notice programs in similar matters and the Federal Judicial Center’s guidelines 9 concerning appropriate reach. 10 11 I declare under penalty of perjury under the laws of the United States and the State of 12 California that the foregoing is true and correct. The Court has tentatively approved a proposed settlement in Broomfield v. Craft Brew Alliance, Inc., No. 5:17-cv-01027-BLF, a class action alleging Craft Brew Alliance, Inc. (“CBA”)’s packaging and marketing of its Kona Beer products portrayed the beer as being brewed in Hawaii, when Plaintiffs claimed they were not. If you purchased Kona Beer between February 28, 2013 through June 14, 2019, you may be entitled to a cash payment as part of the settlement up to $20 with proof of purchase or up to $10 without proof of purchase. To receive a monetary payment, you must submit a Claim Form by October 7, 2019. Claim Forms can be found at www.konabeersettlement.com or can be requested by calling 1-888-332-0551. BASIC INFORMATION

1. Why did I get this notice? If you purchased any 4-pack, 6-pack, 12-pack, or 24-pack variety of Kona Beer from February 28, 2013 through June 14, 2019, you may be a Class Member and have a right to know about the Settlement and your options. If you have received word of this Notice by e-mail, you have been identified from available records as a possible purchaser of the Kona Beer at issue in the lawsuit. You also may have received this Notice because you requested more information after reading the Settlement Website. If the Court approves the Settlement, and if objections and all appeals are resolved in favor of settlement approval, a settlement administrator approved by the Court will oversee the distribution of the Settlement Benefits that the proposed Settlement allows. 2. What is this class action lawsuit about?

The persons who sued are called the Plaintiffs, and the company they sued, Craft Brew Alliance, Inc., is called the Defendant or “CBA.” Plaintiffs and CBA are collectively referred to as “the Parties.” Plaintiffs brought this lawsuit on behalf of all other consumers who similarly purchased Kona Beers during the time period of February 28, 2013 through June 14, 2019 (“Class Members”). This lawsuit alleges that Kona Beers were deceptively advertised as being brewed in Hawaii when they are actually brewed in the continental United States. CBA denies the allegations and has included on all Kona labels the mainland locations where Kona Beers are brewed throughout the time period. The Court has not determined which side is right. Rather, the Parties have agreed to settle the lawsuit to avoid the uncertainties, expenses and expenditure of resources associated with ongoing litigation.

3. Am I part of the Class? If you purchased any 4-pack, 6-pack, 12-pack, or 24-pack variety of Kona Beer from February 28, 2013 through June 14, 2019, you may be a Class Member.

Eligible varieties of Kona Beers include Longboard Island Lager, Hanalei IPA, Castaway IPA, Big Wave Golden Ale, Lemongrass Luau, Wailua Wheat, Fire Rock Pale Ale, Pipeline Porter, Lavaman Red Ale, Koko Brown Ale, Kua Bay IPA, Gold Cliff IPA, Kanaha Blonde Ale, Liquid Aloha Variety Pack, Island Hopper Variety Pack, Happy Mahalo Variety Pack, and Wave Rider Tandem Pack. You are not a member of the Class if: (a) you have timely and properly excluded yourself from the Settlement, explained in Question 8 below, (b) you are a retailer or distributor of Kona Beer or purchased Kona Beer for the purpose of re-selling the beer, (c) you are an employee of CBA

THE SETTLEMENT BENEFITS

4. What does the Settlement provide?

The Settlement provides the following benefits: (1) monetary compensation to Class Members who submit valid and timely Claim Forms; and (2) injunctive relief whereby CBA will make certain changes to its business practices with respect to Kona Beers. Each is summarized below. Monetary Relief. The Settlement allows Class Members who submit timely and valid Claim Forms, without proof of purchase, to recover up to $10 per household, depending on the number of eligible Kona Beers purchased. Class Members who submit timely and valid Claim Forms, with proof of purchase, can recover up to $20 per household, depending on the number of eligible Kona Beers purchased. The following payments can be claimed for each eligible Kona Beer: i. 4-pack Kona Beers: $1.25 per unit. ii. 6-pack Kona Beers: $1.25 per unit. iii. 12-pack Kona Beers: $2.00 per unit. iv. 24-pack Kona Beers: $2.75 per unit Injunctive Relief. Under the Settlement, CBA has implemented as a result of this lawsuit, or will implement, the following practices with respect to the Kona Beers: i. To the extent permitted by law and/or regulation, CBA shall include a conspicuous statement on all consumer-facing Kona Beer packaging on a panel other than the bottom of the package that lists each location where the Kona Beers are brewed or lists the location or locations at which a particular Kona Beer is brewed, for a minimum of four years after the Effective Date. ii. CBA’s General Counsel or his designee will conduct yearly meetings with CBA’s marketing department to review and comply with the injunctive terms of this Settlement, for a minimum of four years after the Effective Date of the Settlement. CBA will pay the costs to administer this Settlement, reasonable attorneys’ fees, costs and expenses, and a payment to the Plaintiffs (see question 12 below). 5. When will I get my monetary payment?

The hearing to consider the fairness of the Settlement is scheduled for December 19, 2019 at 1:30 p.m. If the Court approves the Settlement, and you submit a Claim Form that is approved by the Settlement Administrator, you will receive payment within approximately 30 days after the Settlement has been finally approved and/or after any appeals process is complete approving the Settlement. The payment will be made in the form of a check or via electronic payment,

HOW TO GET THE SETTLEMENT BENEFITS

6. How do I get my monetary payment?

If you are a Class Member and want to receive a payment under the Settlement, you must complete and submit a Claim Form. Claims Forms can be found and submitted through the Settlement Website: www.konabeersettlement.com by no later than October 7, 2019 or they can be mailed and postmarked to Broomfield v. Craft Brew Alliance, Inc. c/o CPT Group, Inc. 50 Corporate Park, Irvine, CA 92606 by no later than October 7, 2019. YOUR RIGHTS AND OPTIONS

7. What happens if I do nothing at all?

If you do nothing, then you will remain in the Class and will not receive any payment from this Settlement. If the Court approves the Settlement, you will be bound by its terms, you will no longer have the ability to sue with respect to the claims being resolved by the Settlement, and your claims will be released and dismissed. The Settlement Agreement describes the released claims in more detail, so please read it carefully. If you have any questions, you can contact the lawyers listed in question 16 for free to discuss, or you can talk to another lawyer of your own choosing if you have questions about what this means.

8. How do I exclude myself from the Settlement?

If you exclude yourself from the Settlement – which is sometimes called “opting-out” – you will not get any money from the Settlement. However, you may then be able to separately sue or continue to sue CBA for the legal claims that are the subject of the lawsuit. To exclude yourself from the Settlement, you must submit a valid and timely Request for Exclusion to the Settlement Administrator. In order to be valid, your Request for Exclusion must state that you “want to be excluded from the Settlement in Broomfield v. Craft Brew Alliance, Inc., Case No. 5:17-cv-01027-BLF” or words to similar effect that make clear your intention to be excluded from the Settlement. Your written Request for Exclusion must also include your name, current address, and telephone number. The request must also be signed and dated by you. In order to be timely, your request for exclusion must be submitted by October 7, 2019 at www.konabeersettlement.com or by U.S. Mail, postmarked on or before that date.

9. How do I object to the Settlement?

If you are a Class Member, you can object to the Settlement if you do not think it is fair. The Court will consider your views. However, you cannot ask the Court to order a different settlement; the Court can only approve or reject the Settlement. Craft Brew Alliance, Inc., No. 5:17-cv-01027-BLF” that identifies all the reasons for your objections and any legal and factual support for those reasons. Your written objection must also include (1) your name, address, telephone number, email address if available, and if represented by counsel, the foregoing information for your counsel; (2) whether you or your counsel intend on appearing at the Final Approval Hearing; (3) whether the objection applies only to you, to a specific subset of the Class, or the entire Class; (4) information/documents showing that you are a Class Member (i.e. Proof of Purchase or a verification under penalty of perjury as to purchase of Kona Beer during the Class Period). You must submit your written objection to the Court, either by (1) mailing them to the Class Action Clerk, United States District Court for the Northern District of California, 280 South 1st Street, Courtroom 3, San Jose, CA 95113, or (2) filing them in person at any location of the United States District Court for the Northern District of California or via the ECF electronic filing system. 10. What is the difference between objecting and excluding myself from the Settlement?

Objecting means telling the Court that you do not like something about the Settlement. You can object only if you stay in the Class. Excluding yourself from the Settlement means that you do not want to be part of the Class. If you exclude yourself, then you have no basis to object to the Settlement.

THE LAWYERS REPRESENTING YOU

11. Do I have a lawyer in this case?

The Court appointed the law firms of Faruqi & Faruqi, LLP and the Wand Law Firm, P.C. to represent Class Members as “Class Counsel.” Class Counsel believe, after conducting an extensive investigation, that the Settlement is fair, reasonable, and in the best interests of the Class Members. You will not be charged for these lawyers. If you want to be represented by a different lawyer in this case, you may hire one at your own expense. If you have any questions about the Settlement, you can contact Class Counsel at the contact information listed in Question 16.

12. How will the lawyers be paid?

In addition to the monetary benefit to be paid to the Class Members, CBA has agreed to pay Class Counsel’s fees and costs in an amount to be determined by the Court not to exceed $2,900,000. The Court may award less than this amount. Any fees, costs, and expenses that are awarded to Class Counsel will be paid by CBA separately and in addition to the monetary

THE COURT’S FINAL APPROVAL HEARING FOR THE SETTLEMENT

13. Where and when will the Court decide whether to approve the Settlement?

The Court will hold the Final Approval at 1:30 p.m. on December 19, 2019 in Courtroom 3 at the Robert F. Peckham Federal Building, located at 280 South 1st Street, Courtroom 3 San Jose, CA 95113. The purpose of the hearing will be for the Court to determine whether to approve the Settlement as fair, reasonable, adequate, and in the best interests of the Class; to consider Class Counsel’s request for attorneys’ fees and costs; and to consider the request for the Services Awards to the Plaintiffs. At that hearing, the Court will be available to hear any Objections and arguments concerning the fairness of the Settlement. The hearing may be postponed to a different date or time without notice, so please check www.konabeersettlement.com or call 1-888-332-0551 from time to time. If, however, you timely objected to the Settlement and advised the Court that you intend to appear and speak at the Final Approval Hearing, you will receive notice of any change in the time and date of such hearing.

14. Do I have to come to the Final Approval Hearing?

No. You do not need to attend the Final Approval Hearing in order to receive payment under the Settlement. Class Counsel will answer any questions the Court may have on behalf of the Class Members. But, you are welcome to attend the Final Approval Hearing at your own expense. If you submit an Objection, you do not have to come to Court to talk about it. If you submitted your Objection on time, the Court will consider it. You may also pay to have another lawyer attend on your behalf, but that is not required.

15. May I speak at the Final Approval Hearing?

Yes. You, or any lawyer you retain, may ask the Court for permission to speak at the Final Approval Hearing. The Court has tentatively approved a proposed settlement in Broomfield v. Craft Brew Alliance, Inc., No. 5:17-cv-01027-BLF, a class action alleging Craft Brew Alliance, Inc. (“CBA”)’s packaging and marketing of its Kona Beer products portrayed the beer as being brewed in Hawaii, when Plaintiffs claimed they were not.

If you purchased Kona Beer between February 28, 2013 through June 14, 2019, you may be entitled to a cash payment as part of the settlement up to $20 with proof of purchase or up to $10 without proof of purchase.

To receive a monetary payment, you must submit a Claim Form by October 7, 2019. Claim Forms can be found at www.konabeersettlement.com or can be requested by calling 1-888-332-0551.

If you do not want to be bound by the Settlement, you must submit a written Request for Exclusion.
