Minutes of the 105 th Meeting of the NLCPR Committee held at 1100 Hrs on 17.5.2012 under the Chairmanship of Secretary, M/o DoNER in Committee Room No.243, Vigyan Bhavan Annexe New Delhi.

In the beginning, representatives of Government of (including officers from Bodo Territorial Council (BTC) and Karbi Anglong Autonomous Council) made presentations on ongoing projects under NLCPR Scheme in Assam, Special BTC Package and Priority List 2012-13 of their States. List of State representatives is at Annexure. After presentations by State Government officials and representatives of BTC and KAAC the Committee deliberated on Agenda items. Following observations and recommendations were made by the Committee:

General observations:

1. State representatives informed that in most of the projects, in which completion is delayed, Completion Certificates can not be submitted since some financial liabilities are still unsettled. Provision is being made for clearing these liabilities after which Completion Certificates, of such projects shall be submitted.

2. It was noted that the main cause of delay, in sanction of projects is due to clarifications/ modifications required in DPR by line Ministries, submitted by State Governments. The State representatives informed that they are in process of empanelling reputed agencies for DPR preparation to address issue of faulty/defective DPRs.

3. Representatives of informed that they have modified procedure of issue of Administrative approval at State level which is expected to reduce time lag for transfer of funds from State Government to Implementing Agencies.

4. State representatives were requested to take up independent monitoring of NLCPR projects immediately as suggested by this Ministry for which provision of reimbursement up to maximum Rs. 50 thousand per project exists.

5. Committee was apprised of MIS of NLCPR projects of M/o DoNER. It was stated that “State Module” for entry of UCs, physical & financial progress, etc. by State Government was introduced and State officials were trained by NIC. However, due to lack of response from NE States, State Module could not be operationalised. On request of State Representatives Committee advised that NIC may again be requested for arranging training of officers of Government of Assam. It may be ensured that MIS have provision for “date of transfer funds by State Government to Implementing Agency’’.

6. On request of Secretary, BTC, Assam it was decided that copy of Administrative and Financial Approval of projects in BTC areas may also be sent to him.

7. It is decided that Agenda Notes of Committee meetings may be circulated at least 7 day before meeting so that representatives of D/o Expenditure, M/o Finance and Planning Commission gets sufficient time to cross check duplication of funding, if any.

Item No.1 : Confirmation of the Minutes of 103 rd Meeting of the NLCPR Committee held on 06.03.2012.

Minutes of 103 rd Meeting of NLCPR Committee were confirmed. Regarding observation of Director (PF-I), D/o Expenditure, M/o Finance on Minutes of Item No. 4, it was observed that matter is already referred to State Government for clarifications. Observation of M/o Finance may be examined and appropriate action may be taken after receipt of report from State Government.

Item No.2 : Confirmation of the Minutes of 104 th Meeting of the NLCPR Committee held on 14.03.2012

The minutes of 103 rd Meeting of the NLCPR Committee were confirmed.

Item No. 3: Action taken report of decisions / recommendations made by NLCPR Committee in the 103 rd Meeting held on 06.03.2012.

The Committee noted that Minutes of 103 rd Meeting of NLCPR Committee Meeting were circulated on 14.03.2012 and action has been taken by Ministry of DoNER on decisions/ recommendations made by NLCPR Committee in that meeting. The Committee desired that the item No.22 regarding “Draft Guidelines for release of funds to the Karbi Anglong Autonomous Territorial Council (KAATC)” deferred in 103 rd meeting may be resubmitted for consideration of the Committee in its next meeting.

Item No. 4: Action taken report of decisions / recommendations made by NLCPR Committee in the 104 th Meeting held on 14.03.2012.

The Committee noted that Minutes of 104 TH Meeting of NLCPR Committee Meeting were circulated on 19.03.2012 and action has been taken by the Ministry of DoNER on decisions/ recommendations made by the NLCPR Committee in that meeting.

Item No.5: Project – “Construction of RCC Bridges and Slab Culverts by Replacing Old Bridge and Slab Culverts on Kamarbondha Road upto 22 nd Km. in the State of Assam”.

The Committee noted that DPR of the project has been vetted by M/o MoRT&H with estimated cost of Rs. 744.78 lac.

2. After detailed deliberations, Committee recommended sanction of the project at a cost of Rs. 735.78 lac (including 1% contingency charges amounting to Rs. 7.28 lac) after deducting cost of sub- soil investigation, cost of preparation of DPR and Labour Cess. 3. The Project has been recommended for sanction with the following conditions :

i. State Government/Implementing Department will comply with observations made by M/o RT&H. ii. Contingency charges may be reimbursed on submission of documents on actual contingent expenditure excluding cost of establishment, audit and accounts, O&M, departmental charges, quality control, agency and purchase of vehicle. iii. Transparency should be maintained in tendering process and State Government should ensure that tender has been called on competitive basis by giving wide publicity in print media and website etc. and works have been awarded within 3 months of its sanction, without waiting for release of funds from State Government to implementing agency. iv. State Government should follow all codal formalities and strictly adhere to project implementation schedule and physical targets given in DPR. v. Project implementation by State Government will be governed by rules/conditions stipulated in the guidelines of NLCPR.

The Committee deliberated upon Priority List submitted by Government of Assam in accordance of para 4.1 of the Revised Guidelines. Item No. 7: Allocation for notional distribution of NLCPR funds amongst North Eastern States

The Committee noted that allocation for notional distribution of NLCPR funds amongst North Eastern States for retention of projects from priority list 2011-12 approved in 93 rd Meeting held on 13.04.2011 has been updated on basis of latest information available on following parameters;

1. Human Development Index 2004-05 – The Ministry of DoNER published Human Development Report in December, 2011 2. Percentage of census (2001) updated as on 31.08.2010 as available on the Ministry of Power’s website 3. Completion of NLCPR projects as on 31.03.2012

The committee considered revised/ updated allocation for notional distribution of NLCPR funds, given in table below, for retention of projects and recommended for its acceptance for Priority List 2012-13.
