Review of the Total Smoking Ban at the Leisure Venues under the Management of the Leisure and Cultural Services Department

Purpose

This paper aims to inform Members of the regular review of the smoking ban implemented at the leisure venues under the management of the Leisure and Cultural Services Department (LCSD). We now propose that the total smoking ban at the leisure venues of the LCSD in the C&W District should be maintained and would like to consult Members on the proposal.

Background

2. The Smoking (Public Health) (Amendment) Ordinance 2006 came into operation on 1 January 2007. The LCSD consulted Members on the proposal of designating some areas as “smoking areas” at all leisure venues, including sports centres, squash centres, public swimming pools and public pleasure grounds, in the district at the meeting of the Culture, Leisure & Social Affairs Committee (CLSAC) of the Central and Western District Council (C&W DC) on 14 December 2006. The final decision of the CLSAC was that a total smoking ban should be implemented at all leisure venues in the district. Six months after the amendment ordinance had come into operation, the LCSD consulted Members on whether the ban should be maintained at the leisure venues in the district at the CLSAC meeting held on 19 July 2007. The CLSAC resolved that the ban should be maintained at the leisure venues.

Subsequently, the LCSD submitted papers again to the CLSAC meetings held on 19 June 2008, 18 June 2009, 17 June 2010, 14 July 2011 and 14 June 2012 respectively to review the implementation of the smoking ban at its leisure venues. After discussion, the CLSAC decided that the ban should be maintained as Members considered that the total smoking ban at the leisure venues in the district had already been widely accepted by the local community.

Details of the Proposal

4. The Ordinance came into operation in January 2007 and since then, the LCSD has been reviewing the implementation of the smoking ban at its leisure venues on an annual basis. When discussing the naming of the Central and Western District Promenade－Central Section and Mount Davis Service Reservoir Temporary Garden, the new venues opened to the public successively last year, the LCSD also consulted the C&W DC on the implementation of a total smoking ban at the venues. As the total smoking ban at the leisure venues in the district has already been widely accepted by the public, we now propose to the C&W DC that the ban should be maintained at the 125 leisure venues, including sports centres, squash centres, public swimming pools and public pleasure grounds, in the district. A list of the leisure venues with the total smoking ban in the district is at the Annex.

Advice Sought

5. This paper is for Members’ discussion at the 27 June 2013 meeting of the CLSAC of the C&W DC. Members are welcome to give their views on the proposal to maintain the total smoking ban at the leisure venues in the district.
