Dear Delegates,

The Cadwallader lectures have a long tradition of addressing issues of immediate and long‑ term significance in international maritime law and regulation to guide those interested in making and applying good law.

In line with this, the subject chosen for the 11th Cad debate takes the theme of the 10th event ‘Lawmaking and Implementation in international shipping’ a step further.

In all industries, consultation and constructive communications between regulators, politicians, and industry leaders prior to regulatory and legislative changes are vital. It is especially so in shipping, given its complex nature and international environment.

The structure, quality and timing of communications between politicians, regulators, the European Commission and the shipping industry are of immense significance in creating laws and regulations which are internationally acceptable, effective and well founded.

Our panel at this event will debate whether the present state of communications is satisfactory and if not, what is the missing link and the best way forward.

We hope that the discussions tonight will mark the beginning of a move towards enhanced and comprehensive co‑operation in the future over regulation.

The core of the Centre’s raison d’être is to encourage, facilitate and reinforce high quality in maritime services for all sectors of the shipping industry through continuing professional education. The Centre:

• Delivers monthly lectures, seminars and annual events of the highest standard in all aspects of maritime law, international conventions, insurance, finance, regulation and related subjects • Informs and advises on current legal issues and global problems affecting maritime commerce and the practice of maritime law • Brings together at its seminar and lecture events experts from multidisciplinary areas in the commercial and legal practice of shipping, whose knowledge is essential to the development of maritime law • Challenges unworkable law and regulation and thereby promotes their reform • Promotes dialogue between the industry and regulatory bodies at a neutral forum by highlighting the concerns of the industry about impractical regulation

The Centre has pursued these objectives since its inception in 1995. In 2009, it moved from the academic environment of University College to the City of London at International House, 1 St. Katharine’s Way, with sponsorship from RTI Ltd. This has helped to strengthen its Maritime Business Forum role.

The Centre has nurtured excellent relationships with the International Maritime Organization, the European Commission, academic institutions and the London and international shipping communities. It will continue to play a pivotal role in the advancement of knowledge of industry sectors.

Coinciding with the 11th Cadwallader event, the Centre is pleased to announce the formation of its ‘Young LSLC group’ to encourage younger maritime practitioners in all sectors to stage their own educational events under the Centre’s auspices. The aim is to give opportunities to the younger generation of shipping to show their talents by taking the lead in panels for discussion of practical and legal issues in maritime commerce, thereby promoting their career advancement and cross-fertilization of knowledge, which is essential in our multi-disciplinary industry.

Further, the Centre’s events will become available from now on to our overseas members and the maritime community worldwide through a multimedia online platform (www.lslclectures.com), where the filmed events can be viewed together with presentations and research material, including legislation, media reports and educational tests.

5 In honour of cad’s contribution to maritime education

Professor Francis J J Cadwallader, known as ‘Cad’ to those who knew him well, taught at University College, London from 1963 to 1982 and continued at Cardiff University until 1992 when he sadly passed away. He was appointed to the Chair of Shipping Law at Cardiff University in 1976 and set up a Centre of Excellence with Professor Edward Brown in Maritime Law and Policy. He is remembered as a scholar for challenging the law and as a teacher for his enthusiasm in teaching and understanding the needs of students. He made a major contribution to the elevation of maritime law as an essential and legitimate part of contemporary legal education. These lectures are a tribute to his contribution.

THE RT. HON. THE LORD HOFFMANN

Leonard Hoffman was born in South Africa; studied law at Oxford as a Rhodes Scholar; taught at University College, Oxford from 1961 to 1973; was called to the bar in 1964; became a QC in 1977; appointed as a High Court Judge in 1985; promoted to the Court of Appeal in 1992 and to the House of Lords in 1995. He retired from the Appellate Committee in 2009 but continues to sit as a Judge of the Hong Kong Court of Final Appeal and to practice as an arbitrator and mediator from chambers in the Temple.

Lord Hoffmann enjoys a reputation of an outstanding and, at times, controversial Judge challenging the law as well as European institutions when they go beyond their remit by laying down a "federal law of Europe".

JAN KOPERNICKI

Jan Kopernicki is a member of the Shell Trading Executive Committee and a Director of Shell International Trading and Shipping Company.

Mr Kopernicki is responsible for Shell’s international shipping activities. His global team manages Shell’s oil tanker, LPG and LNG vessel portfolio, provides maritime services to all Shell businesses, advises on safety and environmental aspects of shipping, provides ship management for the Shell fleet and joint ventures, and manages nautical, offshore and LNG technical developments - including the design and construction of vessels and floating structures.

His 38-year career with Shell has included assignments in International Chemicals, Supply, Life Sciences, Finance, Marine, Corporate Planning, Total Quality/Change Management and e-business. Before joining Shell Trading he headed the shipping activity of Shell Oil Company, based in Houston.

Mr Kopernicki is active in a variety of shipping industry bodies. He is Chairman of the Oil Companies International Marine Forum (appointed in 2002), President of the UK Chamber of Shipping, and a Board member of the International Tanker Owners Pollution Federation and the UK P&I Club (both since 1998). He was recently appointed as Chair of Maritime UK.

In the OCIMF role he has fostered improvements in the safety of the international tanker trade and the protection of the marine environment working with governments, industry and in the framework of the International Maritime Organisation, a specialised agency of the United Nations.

10 In the last two years he has driven the coordination of navy/industry coordination to combat the pirate threat. This has involved national and international integration involving not only the FCO and MOD, but also NATO and allies. Prior to his nomination for the Presidency of the UK Chamber of Shipping he served on the Chamber Board from 1998 and has been a key proponent of steps to improve the reduction of greenhouse gases by the shipping industry. His Chamber role has encompassed significant support to Royal Navy activities and British shipping interests.

He is joint Chair of the UK Shipping Defence Advisory Committee together with the Assistant Chief of the Naval Staff, Royal Navy. This Committee coordinates defence aspects of commercial shipping with the RN and government departments. He is Trustee of the Board and Member of the Classification Committee of Lloyd’s Register. He has recently been appointed as Chair of the Executive Board of the World Maritime University, established under the auspices of the International Maritime Organisation.

A Freeman of the City of London, he is a Trustee of the Board of the National Maritime Museum at Greenwich (since 2003) and a Younger Brother of Trinity House.

Mr Kopernicki was born in the UK in 1948 and educated at King Edward's School in Birmingham and the University of Leicester, where he graduated in Biological Sciences. He is a Fellow of the Society of Biology, a Chartered Biologist, and holds the Certified Diploma in Accounting and Finance of the Chartered Association of Certified Accountants.

SPYROS M. POLEMIS

Mr Polemis was born in Greece and educated in Athens, London and the United States of America. He attended Stevens Institute of Technology, Hoboken, New Jersey, USA where he obtained a Degree in Mechanical Engineering, majoring in Naval Architecture. After college, he did his National Service with the Greek Coast Guard as an Officer/Ships’ Inspector. Thereafter, he worked for the family business until 1970, when he formed his own Company. He is Chairman and Managing Director of Seacrest Shipping Company Ltd., international shipbrokers, in London.

****** MICHAEL GREY MBE

Michael Grey is a columnist and correspondent and has been associated with the maritime industry for the whole of his working life, joining his first ship in 1956 in what is now the car park for London City Airport. At sea for twelve years with the Port Line of London and the holder of a British Foreign Going Master’s certificate, he came ashore to work in the safety and technical department of the UK Chamber of Shipping, before moving into maritime journalism.

He has been Technical Editor of Shipbuilding and Shipping Record, Editor of both Fairplay International Shipping Weekly and Lloyd’s List, where he continues to write a twice-weekly column. He is the London Correspondent of BIMCO and contributes to a large number of maritime publications around the world. He is the author of a number of maritime books and broadcasts on shipping matters. He is a Fellow of the Nautical Institute, an Honorary Fellow of the Institute of Marine Engineering, Science and Technology and a Companion of the Royal Institution of Naval Architects. He lectures at the World Maritime University and the Greenwich Maritime Institute. He was made MBE in the Millennium Honours for services to maritime safety and was awarded the Merchant Navy Medal in 2008.

12 FOTIS KARAMITSOS

Mr Karamitsos is a Director within the Directorate General for Mobility and Transport (DG MOVE) of the European Commission.

His Directorate is responsible for the development and follow-up of the implementation of Maritime transport policy, maritime safety and maritime security and environmental protection, as well as inland waterway transport.

Recently he has also been responsible for the setting up the European Satellite Navigation System GALILEO as regards policy, infrastructure and applications, and for setting the Regulatory framework for the Intelligent Transport Systems.

He is with the European Commission for over 30 years, where he has worked on various Transport issues, as well on Telecommunications, Information society, Environment, Tourism and Research and Development.

Before joining the Commission he worked with the World Health Organisation's programme on Greater Athens Pollution Control and on the Greek Academic and Public Sectors.

He holds degrees in Civil Engineering and Transportation planning from the Technical University of Athens and from Leeds University.

****** LEE SCOTT MP

Lee was elected to Parliament in the General Election of May 2005 for the Ilford North constituency with a majority of 1653. He was re-elected in the 2010 General Election with a majority of 5404.

Born in Stratford East in 1956, Lee has lived in Redbridge for most of his life and was educated locally as were his children. He is married to Estelle. He worked for a time as a sales executive for a number of firms. His interests range from supporting local charitable and sporting events to listening to music.

Before election to Parliament he worked raising money for various national and international charities. Elected to Redbridge Council for Fairlop ward in 1998 he was appointed Cabinet member with responsibility for regeneration. He contested the parliamentary seat of Waveney in 2001.

Lee’s voluntary service has included working for Victim Support, the Barkingside Youth Centre Committee and the Acorns appeals committee at Whipps Cross Hospital and being a governor of local schools.

He is active on all-party groups on autism, kidney and the Tamils. Lee served as a member of the Commons Health Select Committee from 2005 to 2008. In 2007 he was appointed to the Transport Select Committee and served until 2010. He is PPS to Philip Hammond the Secretary of State for Transport.
