I. INTRODUCTION

1.1 General Introduction

This report is the first semi-annual resettlement report for the Nanjing Qinhuai River Environmental Improvement Project (the Project) for the second half of the year 2007. It is prepared by the Nanjing Project Management Office (NPMO) with the assistance of Black & Veatch International Company (B&V). B&V has been providing consulting services to NPMO who is the Executing Agency (EA) for the Project.

Contracts have progressively been awarded since Sep 2007, and construction of the first awarded contract also started in Sep 2007. This Report focuses on the baseline status of the resettlement management, and also describes the activities undertaken in 2007 with respect to the implementation of the resettlement plans (RPs) of the project components. This Report provides (i) a review of the resettlement impacts and compensation polices; (ii) the income restoration and housing relocation progress; (iii) the resettlement institutional structure and responsibilities; (iv) resettlement monitoring and evaluation arrangement; (v) social action plan implementation, and (vi) conclusions and suggestions.

1.2 Description of the Project

This Project has five components. Some components also have sub-components. These components and sub-components can be grouped into the five themes described below.

Component A - Inner Qinhuai River Sewerage and Water Replenishing Component

This component has two sub-components:

(i) Sub-component A1: Inner Qinhuai River Sewerage Sub-component. This consists of constructing 8.84 km of sewer pipelines in the central and southern areas of Inner Qinhuai River. Construction is planned to commence in Mar 2008, and to be completed in Feb 2009.

(ii) Sub-component A2: Inner Qinhuai River Water Replenishing Sub-component. This consists of (a) constructing the Qiqiaoweng river intake pumping station to divert river water from the Outer Qinhuai River to Hucheng River; (b) restoring the Yueya Lake water gate to divert river water to the Mingyu, Yudai, Qingxi and East Inner Qinhuai River; (c) constructing the east and west box culverts at Zhongshan East Road and constructing new water gates on Mingyu River to control the flow diversion direction. Construction commenced in Nov 2007, and is planned to be completed in Apr 2008.

Component B - City East Wastewater Treatment Plant, Sewerage, and River Improvement Component

This component has three sub-components:

(i) Sub-component B1: City East Sewerage Sub-component. This consists of constructing 14.771 km of sewer pipelines in the southern area of Qinhuai River and 10.136 km of sewer pipelines in the northern area. Construction commenced in May 2006, and is planned to be completed in Jun 2009. (The early start in May 2006 was because there is a separate but associated civil contract which is 100% locally financed. Its construction was completed in Nov 2007.)

(ii) Sub-component B2: City East Wastewater Treatment Plant (WWTP) Sub-component. The WWTP is located at the southeast of Nanjing City and has a total capacity of 200,000 cubic meters per day (m3/d). This sub-component is the Phase II work, extending the treatment capacity of the WWTP by 100,000 m3/d. Construction commenced in Dec 2007 and is planned to be completed in Dec 2008.

(iii) Sub-component B3: City East River Improvement Sub-component. This consists of (a) improving 18 km of the Upper Qinhuai River including embankment work, river training and strengthening, river dredging, water and soil conservation, and ecological restoration of revetment; (b) improving the South River with 9.8 km of embankment work, river dredging, water and soil conservation, ecological restoration, and river bank landscape improvement; and (c) improving Yunliang River by ecologically restoring 1.5 km of revetment and constructing a 33 ha wetland park at the confluence of Yunliang and Outer Qinhuai rivers.

Component C - He Xi North Sewerage, River Improvement, and Water Replenishing Component

This component has three sub-components:

(i) Sub-component C1: Sewerage Sub-component. This consists of building 24.18km of sewer pipelines, expanding the capacity of the South Lake No. 1 Sewage Pumping Station from 0.14 m3/s to 0.30 m3/s capacity, and sewer rehabilitation.

(ii) Sub-component C2: River Improvement Sub-component. This consists of dredging Longjiang and Longjiang East Rivers and the Qingjiang South Aqueduct, constructing a diverting pipeline and the Zhongbao Gate.

(iii) Sub-component C3: Water Replenishing Sub-component. This consists of building a 5.00 m3/s capacity South River pumping station at the confluence of the South and New Qinhuai rivers.

Construction commenced in Sep 2007, and is planned to be completed in Dec 2009.

Component D – Storm Water Drainage Component

This component consists of 56 drainage subcomponents by constructing 27 km of drainage pipelines in the districts of Gulou, Xuanwu, Xiaguan, Baixia, and Qinhuai to improve the flood control capacity of the Nanjing urban area. The total cost of this component is estimated at RMB 80 million. Construction commenced at the end of 2007, and will go on for three years.

Component E - Sludge Treatment and Disposal Component

In Jun 2007 the Jiangxinzhou sewage sludge treatment facility sub-component was deleted from Component E. This component now only consists of a new municipal sludge disposal facility at Mount Fenghuang, for disposing of sludge generated from maintaining pump stations, river dredging, and WWTPs in emergency. Construction is planned to commence in Jun 2008, and to be completed by Jun 2010.

Component F - Institutional Component

Although not part of the works components, this component is significant for the proper implementation of the Project. It includes policy dialogue and capacity building. It will satisfy the institutional development needs of the Nanjing Municipal Government (NMG) and appropriate agencies so that these organizations will have the capacity to manage, implement, and maintain all the Project’s components and subcomponents.

One important element in this component is institutional strengthening, capacity building, and training in resettlement management. The target trainees include the NPMO and implementing agencies (IAs) as well as contractors and external monitoring organization. The purpose is to build up the capacity of these entities so that they are able to effectively implement the RPs and resettlement monitoring.

At the time of this report, other than the sludge disposal component, preliminary design of the other components has been approved by the relevant government offices. The project implementation status is shown in Table 1-1 which also tabulates the areas where design changes have been adopted for some of the subcomponents that have an effect on the land acquisition and resettlement (LAR) activities

1.4 Resettlement Implementation

In order to mitigate the resettlement impact as much as possible, the original design has been reviewed. Optimization and adjustment has been made to the Qiqiaoweng water intake pumping station (PS), East Yudai River water gate and West Yudai River water gate. Besides, there are some changes in the actual LAR activities from the originally anticipated, as follows:

Component A - Inner Qinhuai River Sewerage and Water Replenishment

Since the proposed sites of the East Yudai River water gate and West Yudai River water gate have been changed to the east and west box culvert in the state owned river course at East Zhongshan Road, there is no longer a requirement for resettlement. The site of the Qiqiaoweng water intake PS has been shifted from Qiqiao Village in Honghua Sub-district, Qinhuai district to an area under the Yangzhuang residential committee in Guanghua Sub-district, Baixia district. The area now covers 3 mu of untenured state owned land. Such a change has resulted in avoiding the planned acquisition of 8.15 mu collective-owned land in Qiqiao village and 0.9 mu permanent state owned land; and impacting on 10 affected households (AHHs) with 30 affected persons (APs).

Component B - City East Wastewater Treatment Plant and Sewerage

In the river improvement under Sub-component B3, the adjustment of relocation scope has resulted in the avoidance of 300 m2 of land acquisition and resettlement of 6 AHHs with 17 APs. For the Yunliang River Wetland Park, land acquisition was completed by the end of December 2007. LAR has affected 190 AHHs and 292 APs, comparing to the scheduled 446.42 mu collective-owned land and 195 AHHs with 309 APs. The planned residential housing demolition area was originally 49,116.54 m2 with 230 AHHs and 355 APs, while the actual demolition area is 47,386 m2 with 303 AHHs and 6961 APs. 46,466 m2 of residential housing has been demolished and 291 AHHs with 670 APs have been relocated as at the end of December 2007. For enterprises, institutions and shops, it covers 55,210.08 m2 of relocation with 41 AHHs and 251 APs, which is different from the planned 47,925.3 m2 with 36 AHHs and 233 APs1.

Component C - North He Xi District Sewerage, River Improvement and Water Replenishment

For Sub-component C1, the planned temporary state owned land occupation was 193.14 mu, while the actual is 216.2 mu. The LAR activities have commenced. For Sub-component C3, 2.7 mu of untenured state owned land acquisition and 17.32 mu of temporary state owned land occupation was planned. However, due to the adjustment of the location of the South River water intake PS, now only 3.45 mu of untenured state owned land acquisition and 9.92 mu temporary state owned land occupation is needed. As at the end of December, 2007, there is 7.8 mu of temporary land occupation (TLO).

LAR of other components has not commenced. The detailed LAR status is contained in Appendices 1 and 2.

1 The reasons for an increase of APs are: (1) in the resettlement plan (RP), one residence booklet represents one household (HH). However, during demolition, sub-HHs under one residence booklet may have applied to the Notary Public Office for notarization such that they could be considered as an individual AHH and could have priority to apply for low cost housing; (2) In the RP, the AHH population was calculated according to the number of residents at that time. However, during demolition, ex-residents of the vacant houses who had already moved elsewhere, leaving the house as a property, may have also been counted.

II. RESETLEMENT AND REHABILITATION

2.1 Land Acquisition

In the Nanjing Qinhuai River Environmental Improvement Project, only the Qiqiaoweng water intake PS subproject under Sub-component A2 originally involved collective owned land acquisition. However, a change in the location of the PS has avoided such land acquisition, such that only the wetland park under Sub-component B3 is discussed below.

2.1.1 Land Acquisition Progress

The process of land acquisition under the Yunliang River wetland park is as follows:

¾ Land acquisition of this project was prepared in 2003. ¾ In Feb 2006, Qiqiao Village held a representatives’ meeting to confirm the extent of LAR. The affected units expressed no objection and a concurrence was reached. ¾ According to the approval No. 357 NJZ(2003) and Construction Land Permit regulated by No. 197 NGC(2003), in Feb 2006, the Nanjing Qinhuai River Construction Company (NQRCC) entrusted the Second Branch of the Nanjing National Land Resource Bureau to sign the LAR compensation contract with the Qiqiao Village and Honghua Sub-district Office. ¾ In May 2006, Nanjing Municipal Government (NMG) proclaimed the Land Acquisition Plan (No. 30 [2006]). ¾ From May to June 2006, the persons affected by LAR were registered, and the name list was publicized. ¾ The National Land Resource Department of Province, with the Assurance of No.52 SGZH[2004] and the Assurance of No. 241 SGZH[2005], approved NQRCC to acquire the land in Qiqiao Village. In June 2006, the name list of APs was confirmed. ¾ In July 2006, the Second Branch of the Nanjing National Land Resource Bureau publicized the Plan of Compensation and Resettlement for Land Acquisition (No. 004 EFJ[2006]). ¾ Since July 2006, the APs have started voluntarily applying for the basic living security from the employment security agents in Qinhuai district.

According to the RP, 446.42 mu of collective owned land in Honghua sub-district in Qinhuai district would be permanently acquired for the Yunliang River improvement sub-project. The actual land acquisition area is the same as planned. The LAR has been completed.

2.1.2 Compensation Standard

References for the collective owned land acquisition in this Project have been made to the “Decree of Land Acquisition and Relocation Compensation and Resettlement in Nanjing” (NZF[2004]93), and “Compensation and Resettlement Standard of Land Acquisition and Relocation in Nanjing” (NJF[2004]61, NGTZ[2004]92).The actual land acquisition compensation standard is in compliance with the RP, and is shown in Tables 2-1 and 2-2.

2.1.3 Fund Disbursement

The planned land acquisition compensation for the Project was RMB 27,493,900, while the actual paid out is RMB 40,837,274. The compensation has all been disbursed by the end of December 2007, including RMB 38,070,000 for land and attachments compensation, and RMB 2,767,242 services charge paid to the agents of the Nanjing National Sources Bureau.

The actual land compensation paid out generally complied with the RP. There is a discrepancy in the rehabilitation subsidy and the one-off living subsidy between those stipulated in the RP and the actual rates. This was mainly because of the change in number of APs in the various age groups. The actual categories and quantities of auxiliary items such as crops, trees and structures within the red line, that were entitled to compensation also increased. As such, there is a larger compensation paid out for auxiliaries than originally planned. The detailed compensation paid out is shown in Table 2-3:

The fund was made available by NQRCC to the Nanjing National Resources Bureau, who in turns released the funds to the Social Security Department of the Nanjing Finance Bureau, sub-district offices and AHHs. The basic living security allowance is part of the security system for APs who have lost their farm land. It has been transferred to the designated special account set up by the Social Security Department for the basic living security fund for the affected farmers by the National Resources Bureau. For the affected villagers, 30% of the land acquisition compensation rate has been set aside for public affairs expenses, and the remaining 70% and all the other resettlement subsidies, minus the payment of the basic living security allowance, have been distributed to the affected villagers. To date, all the eligible compensation has been allocated.

2.1.4 Land Acquisition and Resettlement

2.1.4.1 Living Security Resettlement

The resettlement of the affected farmers is implemented in accordance with the RP as a form of basic living security. APs who have signed the land acquisition agreement are entitled to the Nanjing Basic Living Security System for Land-lost Peasants. The Honghua Sub-district Agency would arrange for the APs to select the payment level of the basic living assurance at the Qinhuai Labor and Social Security Bureau. According to their selection, the Nanjing National Land Resources Bureau would utilize part of the 70% of the land compensation fund and other resettlement subsidies to help them contribute into the assurance funds, and pay the remainder to the APs. Upon retirement of the affected farmers, they would then receive the relevant basic living allowance from the Nanjing Social Security Bureau according to their selection. In 2007, the standard of the basic social security capital was increased by RMB 20 / month according to the price conditions of Nanjing. According to investigation, there are 254 APs affected by land acquisition and they are qualified for basic living security system. To-date, 248 people are entitled to the Nanjing Basic Living Security System for Land-lost Peasants. However, the remaining 6 APs are still considering the compensation package. The basic living security allowance standard of the affected farmers is in Table 2-4.

Living security and resettlement of the PLA farmers has been implemented in compliance of the compensation standard and resettlement policy. There have already been 248 PLA farmers who are entitled to the living security and receive a security allowance ranging from RMB 260 to RMB 440. A one-off living subsidy has also been paid to them in cash. The specific resettlement condition is shown in Table 2-5.

2.1.4.2 Employment Resettlement

According to the RP, some temporary and semi-permanent job opportunities would be provided to the APs during the construction stage. After Project completion, 20 jobs would be offered to the APs of which 5 jobs would be for women. At the same time, the relevant departments of village committees and sub-districts, and labor administration department of the municipal and district level would conduct training to assist employment for the PLA farmers.

Till now, the APs who are entitled to basic living security have been involved in the urban employment system. After registration, the employment management center under the Qinhuai District Labor and Social Security Bureau organized vocational skill trainings for the affected farmers, enabling them to find alternative jobs. The employment opportunities for the APs greatly improved through training (with certificate) for cleaners, security guards, and housekeepers. There is also follow-up assistance such as provision of small loans, and advice in running private business.

2.2 Residential Housing Relocation

Among all project components, only Sub-component B3 (River Improvement) involved demolition of houses. As the Upper Qinhuai River Improvement sub-project under B3 has not commenced, the associated demolition has also not commenced yet. Meanwhile, demolition is avoided in the South River Improvement sub-project. As such, only the resettlement and rehabilitation for the Yunliang River Wetland Improvement sub-project is involved.

2.2.1 Relocation Progress

The process for demolition of houses is as follows;

¾ According to the approval granted for the Project, licenses under land use planning and construction permits were issued, and a notice is served to put on hold of any buying or selling or properties within the project area ¾ A valuation of the houses to be demolished is undertaken. ¾ Disclosure of the market valuation of the affected houses. ¾ The demolition implementation agency distributes feedback forms to the AHHs of the privately owned houses. The APs have a choice of resettlement schemes in the feedback form. ¾ The demolition office distributes the demolition notices and survey questionnaires to the APs, followed by conducting the survey. ¾ Signing of the house resettlement compensation agreement between the demolition office and APs after investigation and consultation. ¾ AHHs moving out and completing the necessary procedures relating to house ownership. ¾ Demolition of houses by the demolition implementation agency.

According to the RP, 49,116.54 m2 of housing demolition area with 230 AHHs and 355 APs under Yunliang River wetland park subproject was planned. The actual demolition area was 47,386 m2, which is 1,730.54 m2 less than planned. There was 303 AHHs, which is 73 more than planned; and 696 APs which is 341 more than planned. As at the end of 2007, a total area of 46,466 m2 has been demolished, with 291 AHHs and 670 APs.

2.2.2 Compensation Standard

The compensation standard for the Yunliang River wetland park sub-project is in line with the “Decree of Land Acquisition and Relocation Compensation and Resettlement in Nanjing” (NZF[2004]93), “Compensation and Resettlement Standard of Land Acquisition and Relocation in Nanjing” (NJF[2004]61, NGTZ[2004]92), and “Notice on adjustment of award time limit and standard for those move before the deadline in urban house demolition in Nanjing”(NFJ[2006]101). Some adjustment of the compensation standard has been made during implementation in line with the RP. The rental and living subsidy during transition according to the original schedule is RMB 3,600 / household for a one year transition period. For cases where the transition period is over one

year, a RMB 300 / month subsidy has been allowed for in the relocation compensation. The total compensation amount would be calculated when the APs purchase a new house. The incentive to those APs who move before the deadline has increased to RMB 36,000 / household, compared to the planned RMB 6,000 / household. An additional Government subsidy has also been provided for purchasing new home. This additional subsidy is 10% of the sum of the demolition compensation, movin g allowance and attachments compensation. Details are shown in Table 2-6 below. 2.2.3 Fund Disbursement

As demonstrated in Table 2-6, RMB 123,602,207 of compensation for residential housing demolition has to date been paid out. The fund was made available to the Qinhuai District Housing Administration Bureau by NQRCC, then on to the AHHs and low cost housing development corporation. By now all the fund has been disbursed.

2.2.4 Construction of New House

The total land occupied by the Jiagang Low Cost Housing is 315,000 m2. The available land is 200,000 m2 and the built-in area is about 360,000 m2. It is located in the vicinity of the Shuanglong Street overpass and there are two supermarkets, B&Q and Metro. The housing thus offer convenient shopping and transportation, and developed infrastructure. It is close to Kazimen Avenue. When the housing is developed, there will be two new roads, one connecting the city ring road and Shuanglong Street overpass, and the other connecting Kazimen Avenue. There are bus stops just outside the development. A 120,000 m2 primary school and kindergarten will be established to meet the needs of the residents.

The construction of Jiagang Low Cost Housing began in 2006. Phase I has already been completed and the phase II work is anticipated to complete in April 2008. The AHHs are offered priority to rent shop fronts on the ground floor within the residential area. 1/3 of the AHHs have applied to be relocated there and chosen their apartments. It is anticipated that they would move to the new apartments after June 2008.

2.3 Relocation of Institutions, Enterprises and Shops

Among all project components, only Component E (Sludge Treatment and Disposal) and the Yunliang River wetland park sub-project under Sub-component B3 involve institutions, enterprises and shops relocation. As Component E has not commenced, demolition has also not commenced yet. As such only the status of enterprises, institutions and shops relocation of the Yunliang River Wetland Improvement Sub-project is summarized below.

2.3.1 Demolition Progress

According to the RP, 17 institutions and enterprises, and 193 shops with a total area of 47,925.3 m2 would be demolished in the Yunliang River wetlands park sub-project. However, the actual relocation involves 22 institutions and enterprises, and 194 shops with an area of 55.210.08 m2, The LAR works has been accomplished as at the end of Dec 2007.

2.3.2 Resettlement Measures

Relocation compensation of institutions, enterprises, and shops covers house compensation, compensation for affected facilities and fixtures which cannot be relocated, relocation and transportation allowance, and disruption in production and operation subsidy. The house demolition compensation complies with the replacement value. Compensation for affected facilities and fixtures which cannot be relocated is calculated according to their original scale and standard. Relocation and transportation allowance is calculated based on the transportation distance, quantity, and mode of transportation. Disruption in production and operation subsidy depends on the production capability, and the length of disruption. In the process of demolition, the operational

condition of the enterprises varied. As such, on the basis of the planned compensation standard, the compensation rate was determined after consultation between the demolition implementation agencies and the affected enterprises, taking the actual operation condition as a reference.

Through survey of the affected institutions and enterprises, 22 institutions and enterprises have to-date accepted their respective compensation and reached the demolition agreement, and the demolition work has since been completed.

The 4 institutions, which have closed, have been compensated in cash and the affected workers have been resettled. For example, a severance payment has been made to each affected workers of the Honghua sub-district institution depending on their length of service. Information on alternative employment opportunities has also been provided to them. Cash compensation has been paid to 11 enterprises to assist in their continued operation. Among them, 10 chose another site to re-establish their operation. For example, Tianbao Plastic plant has moved to an area under Xiangshuiqiao Residential Committee to continue its business. The remaining one enterprise, Nanjing Shuangjie Electrical Equipment Company, continues to operate at the same premises after receiving monetary compensation as the demolition only affected a temporary structure.

Cash compensation has been provided to the other 7 enterprises. In the RP, Liaoyuan Sofa Plant and Nanjing Jingtong Vehicle Repair intended to continue operation by renting another workshop. However in reality they have both closed their business before demolition and rented their workshops to others. At the time of demolition, the rental lease expired and the tenants have since moved.

The demolition agreements with the 19 shops have all been executed and the demolition has since been completed. The Qiqiao village committee owned all the 19 shops, which included 18 shops and 1 joint-defense post. The cash compensation has been invested by the Qiqiao village committee in a 14,000 m2 workshop. The joint-defense post has been relocated to somewhere else within the village.

Details of the institution, enterprise and shop relocation are contained in the No 2 Resettlement Monitoring and Evaluation Report for the Nanjing Qinhuai River Environmental Improvement Project.

2.3.3 Fund Disbursement

A compensation of RMB 96,397,793 has to date been disbursed. The fund is made available to the Qinhuai District Housing Administration Bureau by NQRCC, and then to the affected institutions, enterprises and shops. The fund has been fully disbursed.

2.4 Resettlement of Vulnerable Group

In the process of land acquisition and house demolition in this project, families who have special difficulties (eg with members with prolonged sickness or disability, etc) could apply for assistance. Individuals could apply to their respective village committees and the needy would be given a living allowance and employment arrangement after their difficult situations have been verified. If a village committee cannot handle the cases, the individuals could apply to the Honghua Sub-district office, which will offer the families assistance and subsidy. Alternatively, the village committee could apply for a special grant from the House Demolition and Resettlement Office, which has been established under the command of the Project’s House Demolition Headquarter. The House Demolition and Resettlement Office, together with the Civil Administration Department, have granted the subsidy to difficult families. The sick and disable groups were given priority in choosing low cost apartments on the ground floor.

Two vulnerable households have been resettled under this arrangement as shown in Table 2-7. The resettlement exercise has not been completed yet. More compensation and employment assistance will be provided to other vulnerable groups for them to achieve equal or better living standard.

III. RESTLEMENT ORGANIZATION

3.1 Institutional Arrangements

In order to ascertain a sound resettlement implementation, which is pursuant to the RP, a well organized resettlement system has been set up (see Chart 3-1). The resettlement organization is equipped with offices, office equipment, funds and advanced telecommunication facilities, as well as well qualified staff with high efficiency. These all play an important role in efficient resettlement implementation.

Besides, some other relevant documents should also be complied with during project implementation. These documents are summarized in Table 3.2.

3.2 Training

Professional quality of the staff under resettlement administration and implementation organizations has a direct and significant impact on the success of resettlement. Resettlement training to the resettlement administration and implementation staff was carried out on 4 December 2007 by the International Resettlement Consultant. 19 designated staff from all IAs who are responsible for resettlement administration and implementation, PMO and representatives of resettlement implementation agent, attended the training (the name list is included in Appendix 3).The content of the training is as follows:

¾ ADB Resettlement Policy and Experience ADB policy on social and resettlement was introduced. The definition and principle of resettlement and the RP was illustrated.

¾ Resettlement Monitoring and Evaluation (M&E) Definition, aspects and mythology of M&E, and the main contents of M&E reports were explained.

¾ Supervision and Management of LAR Awareness of responsibilities of the responsible persons in supervising and managing LAR activities.

¾ Communication and Feedback The International Resettlement Consultant communicated with the responsible persons on specific issues and provided detailed reply. This paved for future consultation and communications between the Consultant and the resettlement personnel.

IV. RSETTLEMENT MONITORING AND EVALUATION ARRANGEMENT

4.1 External Monitoring

Resettlement M&E mechanism has been established during project implementation to ensure the resettlement activities are consistent with the PRC and ADB policy and regulation on LAR, and comply with ADB’s approved RPs. The Research Center for Resettlement of , as an independent external monitoring organization, submits resettlement M&E reports every half a year. The first report has been completed and was dated July 2007. The second report was completed in January 2008.

4.2 Internal Monitoring

The internal monitoring mechanism has been adopted by the Project’s resettlement office to ensure a sound resettlement implementation. Under a self-supervision system throughout the overall process of resettlement, a well-organized internal resettlement monitoring system has been set up consisting of members form the NPMO and IAs. With the assistance of B&V, NPMO prepares a report every half a year to summarize the resettlement activities and submits to ADB. During the process of demolition, the NPMO, IAs and B&V would periodically examine the demolition progress, fund utilization, house reconstruction and income restoration of the APs. A feedback mechanism from the APs to the NPMO has been established. The system allows reporting to the NPMO promptly whenever there is a problem and addressing the problem by consultation with the APs.

V. SOCIAL ACTIONS

5.1 Employment Opportunities

There would be more employment opportunities after the completion of project construction, which would improve the employment condition in Nanjing. Furthermore, more jobs would be available for women, the floating population and poor. According to the projections, during project construction and operation, an additional 60,639 full time or temporary jobs are expected. 3/4 of which is construction related and is available for unskilled workers. By the end of 2007, the number of jobs created which were directly derived from the Project totaled 17,591, of which 3,724 jobs were for women and 4,523 were for the poor. The job creation details are shown in Table 5-1.

5.2 Preferential Policy towards the Poor

After the completion of the project, tariff will be increased due to the higher wastewater treatment cost. The tariff pricing agency has conducted an in-depth research and study, and considered the poor’s ability to pay. Public hearing on tariff increase has been adopted before deciding a reasonable tariff which is acceptable to the poor. In August 2006, the Nanjing Price Bureau held a “Proposed 5 Year Plan on Domestic Tariff Increase to RMB 3.25/ton (from Original RMB 2.3/ton)” hearing. According to the proposed plan, the wastewater treatment fee would increase by RMB 0.783/ton, and drinking water tariff would increase by RMB 0.838/ton. That would have meant a total increase of RMB 1.621/ton of domestic water tariff. The increase decided after the public hearing is RMB 0.95/ton. The poverty line of Nanjing is currently RMB 300/month per capita. Assuming an average 3 persons per household and 3 tons of water consumption per month, the water bill totals RMB 9.75 a month, accounting for 1.08% of the Minimum Standard of Living (MSL) subsidy for a MSL family. Such spending is considered acceptable to them. According to the “Notice on Tariff Adjustment in Nanjing in 2007” (NJG2007, No87), the Nanjing Municipal Water Company (NMWC) after tariff adjustment would provide tariff subsidy to the MSL families and employees of the very poor enterprises. A one-off subsidy of RMB 30 per household will be paid to them in the year when tariff is increased. Besides that, the Nanjing Civil Affairs Bureau provides other subsidies to the MSL families and employees of the very poor enterprises to assist them in overcoming their financial difficulties.

5.3 Improvement of Sanitation and Health

Lacking sufficient knowledge and public awareness in sanitation, Qinhuai River has been polluted by residents who discharge wastewater and solid waste into the water bodies. Seasonal flooding of the Qinhuai River basin has not only affected the economy and productivity, but the incidence of waterborne diseases has also greatly increased. The Qinhuai River Environmental Improvement Project would upgrade the ecological environment of Qinhuai River, and also reduce the incidence of waterborne diseases.

Through environmental and sanitation propagation and education, environmental awareness has increased, contributing to a sustainable improvement of environment of Qinhuai River. On 5 Sep 2007, the Yanhe residents committee of Nanhu sub-district in held a roundtable panel discussion on the improvement of water environment. By education of sanitation, the stakeholders are better aware of the disadvantage of water pollution, and the ways to protect water environment and to prevent water pollution. In addition, the Environmental Protection Bureau and Public Health Bureau conduct public education on good sanitation daily practices and periodically monitor the environmental impacts arising from project construction to minimize the adverse effects on the environment and public health.

VI. PBLIC PARTICIPATION

All the IAs pay attention to public participation in resettlement. Through discussions with the stakeholders, public opinions can be heard by the IAs. On 15 Sep 2007 NQRCC, the Qinhuai District Real Estate Bureau and Honghua Sub-district Office held a discussion with the stakeholders. Demolition compensation and other public opinions were discussed and enquiries on the demolition agreements, compensation standards, and resettlement of the vulnerable groups were addressed.

VII. GIEVANCES REDRESS MECHANISM

A grievances redress procedure and mechanism has been established and the avenue is open to the public. During project implementation, the APs may lodge complaints on the problems they face.

Should there be any grievances or doubts on the LAR policy, the APs may turn to the relevant agents directly for consultation or to complain. Those affected by demolition may first seek redress at the Demolition Office, then at the Qinhuai Bureau of Letters and Calls. If still unresolved they may then turn to the Nanjing Bureau of Letters and Calls. Details information is included in Table 7-1.

VIII. CONCLUSIONS AND RECOMMENDATIONS

8.1 Conclusions

The LAR activities of the Project have been implemented in compliance with the RPs approved by ADB. The APs participate actively throughout the process of land acquisition, demolition compensation and resettlement. The LAR activities go on smoothly and the APs have been satisfied with the results. The conclusion of work completed is summarized as follows:

¾ Design Optimization of Some Sub-components: The project site of Qiqiaoweng water intake PS under Component A has been changed to an area under the Yangzhuang residents committee of Guanghua sub-district in Baixia district. The project site of West Yudai River Watergate and East Yudai River Watergate has been changed to east and west box culvert in the state owned river reserve at East Zhongshan Road. The revised site of the South River water intake PS subcomponent under Component C is at the north of New Qinhuai River and the South River mouth. The Jiangxinzhou sludge treatment subcomponent under Component E has been canceled. Such design optimization and changes have resulted in a reduced LAR scope.

¾ Only Minor Changes in Resettlement Quantities, Not Requiring to Update RPs: The planned 8.15 mu collective-owned land acquisition and 10 AHHs with 30 APs have been avoided on account of the change of site of Qiqiaoweng PS. In Sub-component B3, the adjustment of the demolition scope of South River improvement sub-project has resulted in the avoidance of 300 m2 of land acquisition with 6 AHHs and 17 APs.

For the Yunliang River Wetland Park sub-project, there is a minor discrepancy in the number of APs by acquisition and demolition compared to the planned figure. The relocation affected 190 AHHs and 292 APs, comparing to the scheduled 446.42 mu collective-owned land acquisition, 195 AHHs and 309 APs. The residential housing demolition area was originally planned to be 49,116.54 m2 with 230 AHHs and 355 APs, whereas the actual demolition area was 47,386 m2

with 303 AHHs and 696 APs. 46,466 m2 of residential housing has been demolished and 291 AHHs with 670 APs have been relocated as at the end of December 2007. For enterprises, institutions and shops, 55,210.08 m2 relocation area with 41 AHHs and 251 APs has been involved, which is different from the planned 47,925.3 m2 relocation area with 36 AHHs and 233 APs. The changes are minor and no updating of the RPs is considered necessary.

¾ Higher Compensation Standard: During resettlement, the stipulated standard was strictly implemented. On the basis of that, some housing demolition standard has been raised or lowered according to the actual situation. The rental and living subsidy during transition according to the original schedule is RMB 3,600 / household for a one year transition period. For cases where the transition period is over one year, a RMB 300 / month subsidy has been allowed for in the relocation compensation. The incentive to those APs who move before the deadline has increased to RMB 36,000 / household, compared to the planned RMB 6,000 / household. An additional Government subsidy has also been provided for purchasing new home. This additional subsidy is 10% of the sum of the demolition compensation, moving allowance and attachments compensation.

¾ Active Social Action: Employment opportunities for the poor, women, and floating population have been induced from the Project. Besides monetary compensation, income restoration such as security for farmers losing their land, vocational training and job information have been provided to assist the APs to achieve an equal or better living standard in a sustainable manner. Preferential policy has been adopted in tariff setting with due consideration for the poor. Propagation and public education in environmental protection have been reinforced to improve public awareness.

¾ Full Public Participation: Particular attention has been paid to public participation in the Project. In terms of the compensation standard and resettlement planning, the opinions and suggestions from the APs have been considered through regular communication. Those reasonable suggestions have been accepted and improvement and adjustment measures have been made to satisfy the need of APs.

¾ Resettlement Organization: The resettlement organization is adequately set up with defined responsibilities. High efficiency with the support of qualified staff has been achieved. These have all contributed to an orderly and efficient relocation and resettlement program. Training to the staff of the resettlement organizations on professional knowledge of resettlement has reinforced the sound resettlement work.

¾ Smooth Grievances Redress Mechanism: Feedback on APs’ complaints and appeals has been acted upon in a timely manner, and most favorable resolution has been worked out.

It is concluded that the LAR activities for the Project have to date well proceeded. LAR for some sub-components has not commenced. The NPMO determines to continue with the LAR activities with the same diligence.

8.2 Recommendations

¾ Continued Improvement in Capacity Building: More training is planned to reinforce the capacity building and improve the professional knowledge of the staff of the resettlement organizations. The responsibility and work scope of the relevant departments will, where necessary, be clarified and better identified to enhance continual cooperation and efficiency.

¾ Continued Improvement in Information Disclosure and Sharing: The APs would be better informed of the applicable compensation standards and resettlement types through information transparency in the form of public notices and distribution of resettlement information booklet. During LAR implementation, there would be sound coordination and communication between the EA and IAs to ensure information sharing.

¾ Continued Improvement in Record Keeping and Data Management: Classification and

recording of project date is present weak. As a result some data has been lost. Therefore, relevant LAR data should be kept and properly recorded. This would then provide basic data for monitoring and evaluation. Training on this aspect will be provided.

¾ Acceleration of the Low Cost Housing Construction Program: The construction program of the low cost housing would be accelerated, so that the APs can be relocated as soon as possible. Meanwhile, the progress of construction will be periodically disclosed.

¾ Fund Utilization Plan in Village Level and Income Restoration Plan: With the assistance and monitoring of the independent external M&E agency, and through the participation of the affected villagers, a feasible fund utilization plan and income restoration plan would be developed to better ensure the income restoration of the affected villagers and that they would enjoy an equal or better living standard. The Fund Utilization Plan in Village Level and Income Restoration Plan are expected to be included in the July 2008 external M&E report.
