MINUTES OF THE PARISH COUNCIL MEETING HELD AT THE HILL COURT COMMUNITY CENTRE, MAIN STREET, BUSHBY, ON MONDAY 9 JANUARY 2017, AT 7.00 P.M.

PRESENT Members: Mrs P Chamberlain (Chair), Mr S Brown, Mrs A Burrell, Mr N Garner, Mr H Gopsill, Mr I Harris and Mr J King District and County Councillor: Mr S Galton District Councillor: Mr P Elliott Clerk: Mrs S Bloy Members of the Public: There were four members of the public present ACTION 17/01 APOLOGIES FOR ABSENCE Apologies for absence were received and accepted from Mrs E Derrick and Mrs S Johnstone. 17/02 REQUESTS FOR DISPENSATION FROM MEMBERS ON MATTERS IN WHICH THEY HAVE A DISCLOSABLE PECUNIARY INTEREST No requests had been received. 17/03 MINUTES OF THE MEETING HELD ON MONDAY 12 DECEMBER 2016 The minutes of the above meeting were approved and signed as a true record. 17/04 MATTERS ARISING FOR INFORMATION The invitation from the Trustees of the Memorial Hall to visit the Hall on Thursday 12 January 2017 at 18:15 was noted (Minutes 16/282 refers). Mrs A Burrell and Mr N Garner confirmed their attendance and Mrs P Chamberlain agreed to check her availability. 17/05 MATTERS RAISED BY MEMBERS OF THE PUBLIC Members of the public stated that they wished to speak in relation to agenda item 13, (HDC Public Path Diversion Order No 2 2016: Diversion of Public Footpath D19). The residents also raised the matter of the removal of section of mature hedgerow and trees on the eastern boundary of properties on Pulford Drive, and the impact on privacy and security. It was reported that an officer is to visit the residents regarding this which is a matter for Enforcement and is separate from the Diversion Order.

With regard to the Public Footpath D19, residents expressed concerns that the footpath had been moved without planning permission; had been raised by approximately 2ft resulting in it being higher than the back gardens of some properties on Pulford Drive; and, the new hard surface meant that there were drainage issues and a consequent likelihood of flooding. It was noted that the process in relation to a Public Path Diversion Order means that if valid objections are submitted, the Planning Authority (HDC) has to refer the matter to the Secretary of State for a decision. While it was noted that the Parish Council would make its own representation, it was also important for residents to submit their own representations by the deadline of 25 January 2017. The Chair thanked residents for their input.

17/06 GENERAL PURPOSES COMMITTEE It was agreed that there was no need for a meeting of the GPC. 17/07 CLERK’S REPORT The Clerk reported the following: a) Planning Enforcement – an officer had raised the issue of the display of advertisements at junctions for the sale of Christmas trees at Oadby Lodge Farm. As the signs were temporary, no action was being taken, but the OLF manager had been given guidance on the siting of advertisements in the future. b) Planning Applications 16/01475/FUL – single storey front and rear extension and 2 storey side extension (18 Anthony Drive, Thurnby). Approved. 16/01733/TCA – works to trees (65/67 Main Street, Bushby). Approved. 16/01788/NOT – proposed rear extension (46 Forrest Rise, Thurnby). Refused. 16/01729/FUL – 2 storey side extension, first floor extension above existing garage and garage conversion (52 Hollies Way, Thurnby). Refused. 16/01845/FUL – removal of existing portakabin and 2 poly tunnels and erection of new single storey office building with associated parking (revised scheme of 16/00157/FUL), (Coles Nurseries, 624 Uppingham Road, Thurnby). Approved. c) Environmental Matters – the overgrown vegetation at properties on Court Road had been cut back by the owner of Hill Court. The Clerk had written to a resident regarding an overhanging tree on Sedgefield Drive. 17/08 COUNCILLORS’ REPORTS a) TABSASA – it was reported that a Committee meeting has been arranged. b) Other matters for report – there were no other matters. 17/09 GRANT APPLICATION FROM TABSASA Consideration was given to the annual grant application received from TABSASA for £3,000. It was noted that the application gave an overall membership figure, rather than a breakdown showing the number of residents and those coming from outside the parish. It was agreed that a decision be deferred to the next meeting, pending further detail of membership as a demonstration of benefit to the community. 17/10 FINANCIAL MATTERS It was proposed by Mr S Brown and seconded by Mr H Gopsill that the following be approved. This was RESOLVED. In considering the precept for 2017/18, the following were noted for clarification: . The Tax Base reflects the number of Band D equivalent properties which HDC identifies as liable to pay Council Tax. This has increased in Thurnby and Bushby by 39.1 from 2016/17. . The Precept is set by the Parish Council and is the amount that HDC will collect on behalf of the Parish Council. . The Precept element of the total Council Tax collected per household was £46.31 in 2016/17. . Maintaining the Precept element per household at £46.31 would result in an increase of £1,815.00 (3%) on the total budget collected for the parish due to the increase in Band D properties.

It was proposed by Mr I Harris and seconded by Mrs P Chamberlain that the Precept for 2017/18 be £61,690.00. This was RESOLVED. 17/12 PLANNING APPLICATIONS a) 16/01817/FUL – erection of first floor side extension (Hill Court, Court Road, Thurnby). It was agreed to submit a NEUTRAL response with no comments. b) 16/01958/FUL – erection of single storey side extension (west elevation); single storey side extension (east elevation); and, 4 column front canopy (676 Uppingham Road, Thurnby). It was agreed to submit a NEUTRAL response with no comments. It was proposed by Mr I Harris and seconded by Mr J King that the above be agreed. This was RESOLVED. 17/13 HDC PUBLIC PATH DIVERSION ORDER NO 2 2016: DIVERSION OF PUBLIC FOOTPATH D19 AT LAND EAST OF PULFORD DRIVE, THURNBY Following representations made by members of the public earlier in the meeting consideration was given to the above and it was agreed to OBJECT on the following grounds: . While noting that the original line of the path was always to be moved to the west, the actual position of the path, which has already been constructed, is considerably closer to the rear gardens of properties on Pulford Drive than indicated on the site plans. . The diverted path, which previously was a field path, is now above the level of the back gardens of properties on Pulford Drive, creating a hard surface from which water has nowhere to drain and also a risk of flooding to properties on Pulford Drive. In addition, consideration was given to the removal of hedgerow and trees to rear of two properties on Pulford Drive. Whilst noting that this was separate to the Public Path Diversion Order, it was agreed that representation be made to HDC Enforcement that: . the original appeal decision had stipulated that there should be a buffer zone Clerk between the footpath and properties on Pulford Drive; . the Developer be required to reinstate and where necessary reinforce/supplement the hedgerow with mature shrubs and trees. It was proposed by Mrs P Chamberlain and seconded by Mr J King that the above matters be approved. This was RESOLVED. 17/14 RESOLUTION OF APPLICATION FOR S106 FUNDING FOR A MUGA AT MANOR FIELD A draft s106 bid was considered. It was reported that 84 responses to the questionnaire distributed to residents had been received, of which 88% were in favour of the proposal. In addition, extremely positive support had been received from: the two primary schools; TABSASA; TABS; Thurnby Girl Guides; and, the 3

Houghton Football U13 Football Club. It was proposed by Mr H Gopsill and seconded Cllrs SB, by Mr I Harris that the bid be approved, subject to the agreement of final content by AB & PC Cllrs Brown, Burrell and Chamberlain. This was RESOLVED. & Clerk 17/15 UPDATE ON 747 BUS SERVICE It was reported that and Rutland County Councils have agreed £60,000 of emergency funding to ensure that the 747 bus service operates for a further year. This was welcomed, noting that there is currently no intention to fund the service beyond January 2018. It was agreed that the Parish Council looks forward to the Leicestershire County Council taking the lead in discussions with affected parishes regarding a way forward, and that a copy of the minute be sent to LCC. Clerk 17/16 THURNBY AND BUSHBY NEIGHBOURHOOD PLAN STEERING GROUP a) Minutes of the meeting held on 9 November 2016 – these were received and it was noted that the next meeting is scheduled for 26 January 2017. b) Written Ministerial Statement (WMS) – it was noted that the WMS outlines certain conditions under which housing policies within a Neighbourhood Plan should not be considered ‘out of date’ when Local Planning Authorities are determining applications. Concerns received from Mrs E Derrick regarding the implied need for a Neighbourhood Plan to be kept under review, potentially every two years were noted. 17/17 CONSULTATION ON HUNGARTON NEIGHBOURHOOD PLAN It was noted that the Hungarton Neighbourhood Plan has been submitted to Council for examination and that the consultation period runs to 8 February 2017. It was agreed that the Parish Council supports the plan but had no comments to make. Clerk 17/18 HIGHWAYS MATTTERS As previously reported, advice has been obtained from the Parish Council’s insurance broker and the Legal Department of the National Association of Local Councils, regarding the requirement for the Parish Council to indemnify the County Council against claims associated with the third party funded scheme for Grange Lane. A letter drafted by the Clerk to Mr P Crossland, Director of Environment and Transport, LCC was considered. It was proposed by Mr I Harris and seconded by Mrs P Chamberlain that the letter be approved. This was RESOLVED. Clerk 17/19 LCC CONSULTATION ON A MEDIUM TERM FINANCIAL STRATEGY 2017-2021 The above was noted. 17/20 PARISH COUNCIL’S APPLICATION FOR A COMMUNITY DEFIBRILLATOR It was reported that an application has been submitted which is awaiting the endorsement of the Ambulance Service NHS Trust. It was further reported that M C Haye, Facilities Manager, EMH Group had given permission for a defibrillator to be installed on the external wall to the Hill Court Community Centre. 17/21 FULL ELECTORAL REGISTER FOR 2016-17 It was agreed that the registers would be made available to Councillors electronically. Clerk 17/22 INVOLVEMENT IN THE GREAT BRITISH SPRING CLEAN 3-5 MARCH 2017 It was agreed that the Parish and District Councillors would organise a Parish Spring Clean later in the Spring, possibly during the school Easter holidays. This would mean that an article could be placed in the next issue of the TABS newsletter, due to be distributed in March, seeking interest from residents. It was agreed to invite the Girl Guides and Scouts to be involved. 17/23 ENVIRONMENTAL MATTERS a) Tree Wardens report – the dramatic improvement to the hedgerow along Jubilee 4

Walk at Wadkins was noted. Mr N Garner confirmed that he would continue to look after the Jubilee Oak, with a view to it being planted in the Autumn. b) Litter – Mr N Garner reported that he had collected litter along the A47 from Main Street eastwards. c) Other matters – It was agreed that the Clerk should seek permission from LCC Highways for the replenishment of the gravel on the footpath leading from the end of Main Street Extension to the beginning of the D11 field path to Houghton-on-the-Hill. Clerk 17/24 AGENDA ITEMS FOR NEXT MEETING There were no items identified. 17/25 DATE OF NEXT MEETING The next meeting will be held on Monday 13 February 2017, commencing at 7.00 pm, at the Hill Court Community Centre.
