THE LOAN SHARK PROBLEM IN THE SOUTHEASTERN STATES WILLIAM HAYS SIMPSON* Because of the increase in problems associated with the business of money lending in the United States many of the states passed regulatory acts. The movement ex- tended to the Southeastern area where all states, including Alabama, Florida, Georgia, Louisiana, Mississippi, Maryland, North Carolina, South Carolina, Tennessee, Vir- ginia, and West Virginia, enacted legislation which established legal interest rates. " These rates varied slightly, with all states now limiting the annual rate to 6 per cent except Georgia and Florida where interest rates were set at 7 and 8 per cent re- spectively. While 6 per cent per annum is the maximum contract rate in Maryland, North Carolina, Tennessee, Virginia, and West Virginia, the rate in writing is 7 per cent in South Carolina, 8 in Alabama, Georgia, Louisiana, and Mississippi, and io per cent in Florida. The civil penalties imposed in actions on usurious contracts of course vary in the -different states. Louisiana law contains no provision for civil penalties but in West Virginia, Virginia, Tennessee, and Maryland forfeiture of excess over legal rate may be had through legal action while forfeiture of all interest is provided for in the laws of Alabama, Florida, Georgia, Mississippi, South Carolina, and North Carolina. The laws of the latter state also provide for the forfeiture of double interest paid on loans made on household and kitchen furniture. No criminal penalties are provided for violation of the usury laws in Alabama, Louisiana, Mississippi, Maryland, Tennessee, Virginia, and West Virginia, but in Florida, Georgia, and North Carolina it is, under various circumstances, a mis- demeanor to make usurious charges. -

Paper presented at the 96th Annual Conference of the National Tax Association Drake Hotel Chicago, IL November, 2003 Abstract – This paper argues that widening income inequality contributes to the propensity to evade by both reducing the probability of detection and increasing compliance opportunity costs. Lower detection probability occurs as rising inequality gradually alters the composition of income from being employment-based (i.e., matchable) to investment-based (i.e., non-matchable). Greater economic polarization also increases the financial strain on many former middle-class taxpayers, thus raising their opportunity cost of compliance. In addition, the compliance opportunity costs for wealthy taxpayers also could increase if they perceive a growing exchange inequity between their tax burdens and public sector benefits. This paper tests the hypothesis that rising income inequality contributes to tax evasion in the United States. Empirical analysis for the period 1947-2000 finds a positive correlation between the underreporting rate for wage and salary income and the top decile wage share. This finding suggests that enforcement policies aimed at reducing income tax evasion may lose some effectiveness in an environment of increasing inequality. MCO -09 - 2010 AN ORDINANCE AMENDING CHAPTER 31 ENTITLED, “BUSINESS LICENSING, REGULATION AND REGISTRATION” OF THE MUNICIPAL CODE OF THE CITY OF ELMHURST BY ADDING ARTICLE XVII ENTITLED “PAWNSHOPS AND PAWNBROKERS” WHEREAS, the City of Elmhurst is a home rule unit of government, pursuant to Article VII, Section 6 of the Illinois Constitution of 1970; and WHEREAS, as a home rule unit of government, the City is expressly authorized to exercise any power and perform any function pertaining to its government and affairs including, but not limited to, the power to regulate for the protection of the public health, safety, morals and welfare; and WHEREAS, the corporate authority of the City of Elmhurst has determined that it is proper, necessary and in the best interest of the City of Elmhurst to adopt this legislation regulating and licensing the business of Pawnshops and Pawnbrokers; and WHEREAS, this legislation is the act of the corporate authority of the City of Elmhurst, pursuant to his home rule powers as granted by Article VII, Section 6 of the Illinois Constitution of 1970. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Elmhurst, DuPage and Cook Counties, Illinois, as follows: Section 1. That the foregoing recitals are adopted as the findings of the corporate authority of the Village as if fully recited herein. Section 2. That Chapter 31, entitled “Business Licensing, Regulation and Registration” as amended, is further amended by adding thereto Article XVII, entitled, “Pawnshops and Pawnbrokers”, to read as follows: -

6 Pawnbroking and the survival strategies of the urban poor in 1770s York Alannah Tomkins The poor in England Pawnbroking and the urban poor Introduction On 9 June 1778 a woman called Ann Moyser visited George Fettes’s pawnbroker’s shop in York to pledge a checked apron, for which she received a shilling.1 On 14 October in the same year, the pawnbroker received a business call from the overseers of St Mary Castlegate parish in York. They claimed that the apron did not belong to Ann but to a parishioner of theirs called Sarah Wood. It is not clear whether the overseers considered the item to have been stolen, lent or pawned by Ann on Sarah’s behalf, but they redeemed the apron for Sarah’s use without producing the duplicate or ticket which had been issued to Ann in June. Despite this evidence and the sporadic entries in overseers’ ac- counts about pledges redeemed with parish money, pawning by paupers was the exception rather than the rule; the pawnshop was the resort of a large number of people in York, predominantly the labouring poor in times of difficulty, but was rarely used by paupers. Nevertheless a close examination of the pawning practices of customers in general, and a comparison of customer names with the identities of city paupers, illuminates the range of ways pawning was employed and the interplay between pawnshop credit and parish relief in poor household economies. The aims of the chapter are ambitious, particularly given the difficulty of defining or characterising ‘paupers’. Problems seen by Citizens Advice have fallen from over 10,000 a quarter at their peak to just over 4,000 now. That is partly because the market is different; there are fewer lenders and fewer customers. But it is also because the market is delivering better outcomes. Between January 2015 and April 2016 the number of loans which incurred default charges halved, from 16% to 8%, and the proportion in arrears for more than seven days fell by a quarter, from 16% to 12%. Consumers are also paying less to borrow. In 2014, the average consumer paid £100 in interest and charges to their payday lender. They now pay £60, despite the average loan amount remaining relatively stable at £250. That has not led to equal detriment in other areas Tougher regulation of high-cost short-term credit (HCSTC) has not led to negative unintended consequences: ● Access to credit - We found around 8% of customers who had previously used a payday loan had been declined following the cap. -

I represent the four Catholic Bishops of Kansas and their dioceses. On their behalf, I would like to express our gratitude for this opportunity to offer information concerning financial products sold in Kansas that we believe contribute to destabilization of family financial health and the overall destabilization of the family. The family is the building block and foundation of all human society. It has always been at the heart of the Church’s pastoral mission. For this reason, everything that impacts the spiritual, mental and physical wellbeing of families is of deep concern for the Catholic Bishops of Kansas. Family financial stability has the potential, for better or worse, to deeply impact each of those critical three facets of family life and health. We believe current payday loan industry practices unfairly target the financially vulnerable in times of crisis. For many years, the Catholic Bishops of Kansas have fought this often-lonely campaign to inform legislators and urge them to engage in effective legislative action that would, at least, bring some improvements to this industry.
