No. 08-248 (JR) v. ) ) FEC Response to Plaintiffs’ FEDERAL ELECTION COMMISSION, ) Proposed Findings of Fact ) Defendant. ) ____________________________________) DEFENDANT FEDERAL ELECTION COMMISSION’S RESPONSE TO PLAINTIFFS’ PROPOSED FINDINGS OF FACT The Federal Election Commission (“Commission”) hereby submits the following response to the Proposed Findings of Fact filed by plaintiffs SpeechNow.org (“SpeechNow”), David Keating, Edward Crane, Fred Young, Brad Russo and Scott Burkhardt (collectively “plaintiffs”). The Commission incorporates by reference its Memorandum In Support of Response to Plaintiffs’ Proposed Findings of Fact (“FEC Resp. Mem.”). Set forth below are additional specific objections and responses, as well as references to the Memorandum in order to note the portions of the Memorandum that are particularly responsive to specific facts. “I. SpeechNow.org” 1. Plaintiff SpeechNow.org is an independent group of citizens whose mission is to engage in express advocacy in favor of candidates who support the First Amendment and against those who do not. Declaration of David Keating in Support of Proposed Findings of Fact (hereinafter, “Keating Decl.”) at ¶¶ 2, 3; Keating Decl. Ex. H, Bylaws of SpeechNow.org (hereinafter, “Bylaws”), Art. II. Toward that end, SpeechNow.org planned to run television advertisements during the 2008 election cycle in the states and districts of political candidates whose records demonstrate that they do not support full protections for First Amendment rights. Keating Decl. at ¶ 15.     Slippery University Rock Magazine Fall 2016 “All chalked up” View from the ROCK Dear Friends, I love this time of year when warm evenings melt into cool nights, and the aroma of autumn is in the air; but it’s also hard to say goodbye to summer. The summer of 2016 will be remembered as one of the busiest construction seasons on record at Slippery Rock University. Jackhammers, excavators and demolition crews were a common sight as crews worked diligently to renovate academic buildings, athletic fields and residence halls prior to the start of the fall semester. All of the work was scheduled with an eye toward modernizing academic learning environments and improving the appearance and function of buildings and campus. By the time classes resumed Aug. 29, $6.5 million in improvements had been completed. Major projects included a new entryway for Rhoads Hall; the demolition and reconstruction of the south wall at Spotts World Culture Building; the removal and resurfacing of the outdoor track at Mihalik-Thompson Stadium; and a pair of projects at Morrow Field House that included refinishing the basketball/ volleyball court and a roof replacement. In a continuing effort to extend our commitment to diversity, equality and inclusion, we converted more than 70 single- occupancy restrooms to all-gender restrooms. If I'm not sleeping, eating or spending time with my family, I'm preparing for that Sunday's game. “And when I first work with a particular analyst, researching their career is definitely a big part of it,” Albert added. “With (Daryl Johnston) ‘Moose,’ for example, there are various anecdotes from his years with the Dallas Cowboys that pertain to our games. When I work local Knicks telecasts with Walt ‘Clyde’ Frazier on MSG, a percentage of our viewers were avid fans of Clyde during the Knicks’ championship runs in 1970 and 1973, so we weave some of those stories into the broadcasts.” As the 2016 NFL season gets underway, Albert once again teams with longtime broadcast partner Johnston, with whom he has paired for 10 seasons, sideline reporter Laura Okmin and producer Barry Landis.
