NOTICE BY THE MINISTER Fees and Charges I, JOHN HILL, Minister for Health, hereby give notice pursuant to section 44 of the Health Care Act 2008, of the following fees to apply to a Medicare patient who is not a compensable patient: These charges will operate from 26 March 2009 to 30 June 2009 and will supersede the fees for a Medicare patient who is not a compensable patient outlined in the notice contained in pages 2437-2440 of the South Australian Government Gazette No. 35 of 2008 (Thursday, 26 June 2008). 1—Interpretation (1) unless the contrary intention appears— admitted patient means a patient of a public hospital site who has undergone the formal admission process of the public hospital site; Commonwealth benefit, in relation to a patient, means the aggregate of the following amounts: (a) the maximum amount (expressed on a daily basis) payable as an age pension under the Social Security Act 1991 of the Commonwealth to a person who is not a member of a couple within the meaning of that Act, excluding the amount of any pharmaceutical allowance payable under that Act; and (b) — (i) if the patient receives rent assistance under that Act—the amount (expressed on a daily basis) received; or (ii) if the patient is not entitled to an age pension or disability support pension under that Act—the maximum amount (expressed on a daily basis) payable as rent assistance under that Act; hospital in the home service, in relation to a public hospital site, means treatment or care provided by the public hospital site to a patient at a location outside of the public hospital site’s premises (being treatment or care provided as a direct substitute for treatment or care that would normally be provided as an inpatient service on the public hospital site’s premises); incorporated hospital means a hospital incorporated under the Health Care Act 2008; long stay patient means a patient who has been an admitted patient in a public hospital site for a continuous period exceeding 35 days; Medicare patient means a patient who is an eligible person for the purpose of receiving medical benefits under the Health Insurance Act 1973 of the Commonwealth; overnight stay patient means an admitted patient of a public hospital site who remains an admitted patient of the public hospital site until a day subsequent to the day of his or her admission; patient means a person to whom a public hospital site provides medical or diagnostic services or other treatment or care and includes a person to whom a public hospital site provides outreach services; private, in relation to a patient, connotes that the patient receives medical or diagnostic services from a medical practitioner selected by the patient; public, in relation to a patient, connotes that the patient receives medical or diagnostic services from a medical practitioner selected by the public hospital site; public hospital site means a hospital facility which is operated by and is part of an incorporated hospital and which can have buildings and facilities at more than one location in the State; 1084 THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE [26 March 2009

same day patient means an admitted patient of a public hospital site who, on the same day, is both admitted to and leaves the care of the public hospital site (whether on formal discharge by the public hospital site or voluntary discharge by the patient); single room, in relation to the accommodation of a patient, means the accommodation of the patient in a room in which he or she is the only patient. (2) a patient will be regarded as being acutely ill during a particular period if a medical practitioner has certified that the patient will require extensive medical treatment and supervision during that period. (3) A certificate referred to in subsection (2) remains in force for the period specified in the certificate (not exceeding 30 days) or, if no period is specified, for a period of 30 days. 1—Fees for services provided to Medicare patients (1) The fee to be charged by a public hospital site for a service of a kind set out in the Schedule provided to a Medicare patient who is not a compensable patient is as set out in the Schedule. (2) A person who is— (a) a resident of a State or Territory of the Commonwealth other than South Australia; or (b) a member of the armed forces of the Commonwealth; or (c) entitled to a benefit under the Veterans’ Entitlements Act 1986 of the Commonwealth, may, with the approval of the Minister, be released from liability to pay the fees contained in the schedule. Scale of charges – permanent impairment services

Preamble

Section 32 (11) (a) of the Workers Rehabilitation and Compensation Act 1986 provides that the Minister for Industrial Relations may, by notice in the Gazette, on the recommendation of the Corporation, publish “scales of charges for the purposes of this section (ensuring as far as practicable that the scales comprehensively cover the various kinds of services to which this section applies)”.

The scale of charges attached set out the fees payable in respect of permanent impairment assessment services provided pursuant to section 43A of the Workers Rehabilitation and Compensation Act 1986.

NOTICE 1. For the purpose of section 32 (11) (a) of the Workers Rehabilitation and Compensation Act 1986, I publish the following scales of charges for permanent impairment services at Appendix 1 and which will have effect from 1 April 2009.

4. Permanent impairment assessment reports must be requested in writing, specifying whether a standard, moderately complex, complex or supplementary report is required.

5. Reports are to be provided to the requestor within 10 business days of the examination unless the assessor believes there are reasonable grounds for an extension of time and has sought the requestor’s prior consent to an extension of time.

6. The examination and the preparation of a report must be in accordance with the WorkCover Guidelines.

7. ‘Specialist’ means a specialist in a surgical discipline or a consultant physician.

8. Reading fees are only payable where the material has been directly supplied by the report requestor. A fee is not payable for the reading of case notes, clinical material or any other material that is not directly supplied by the report requestor.

9. A fee for a cancellation with more than 48 hours notice (excluding weekends and public holidays) is not payable.

10. A fee for a cancellation or non-attendance does not apply if the appointment is subsequently filled with another earning activity.

11. If an interpreter is present at the examination, the additional fee payable (as per the fee schedule) is in addition to the fee payable directly to the interpreter by WorkCover.

12. Supplementary report fees are not payable if additional work is required as a result of an obvious error or omission on the part of the assessor.

13. The first 50 kilometres of any travel is not chargeable.

14. If an assessor is travelling for the purpose of conducting more than one permanent impairment assessment, the travel fees must be apportioned accordingly.

15. A ‘full day’ referred to in item PIA60 refers to a stay of more than five hours at the venue including travel time.

16. ATO rates means the rate, applicable to the type of motor vehicle in which the medical expert travelled, published by the Australian Taxation Office as the rate per kilometre that may be claimed as a deduction for business travel expenses incurred in the previous financial year.

17. Economy airfare means the amount determined by WorkCover to be the reasonable cost of under- taking the travel using a standard economy airfare.

RULE NINETEEN Referrals to Medical Panels (1) If the Corporation wishes to refer a medical question to a Medical Panel in respect of a matter pending in the Tribunal it shall complete the form titled ‘Certificate of Referral to a Medical Panel’ and advise the Registrar in writing as soon as reasonably practicable. Such advice shall include a copy of the Certificate. Upon receipt of this advice the Registrar shall, unless otherwise directed by the President, refer the matter to the member who had carriage of the matter prior to the referral for further directions. These may include: (a) referring the matter to the suspense list pending receipt of the Medical Panel’s opinion; (b) directing the parties to prepare for the consideration of the Medical Panel an agreed statement of facts and in default of agreement statements of the alleged facts underpinning their respective positions. (2) If a party wishes the Tribunal to refer a medical question to a Medical Panel the party shall file a request for referral to a Medical Panel. If the Tribunal resolves to make the referral the Tribunal shall issue the Certificate upon such terms as it considers appropriate. In determining such a request the Tribunal may issue such directions as are considered appropriate to the circumstances. These may include: (a) directing the parties to prepare an agreed statement of facts and in default of agreement statements of the alleged facts underpinning their respective positions; (b) deferring referral of the medical question until medical reports, witness statements or other eviden- tiary material have been obtained; (c) deferring referral of the medical question until: (i) oral evidence has been received; (ii) factual findings have been made; (d) issuing a statement of any relevant legal principle applicable to the medical question. The receipt of oral evidence, the making of factual findings and the issuing of a statement of legal principle may only be undertaken by a Presidential Member. (3) If the Tribunal of its own motion intends to refer a medical question to the Medical Panel it shall advise the parties and give them a reasonable opportunity to be heard on the making of and terms of the proposed referral. Such referral may be made with such directions as are considered appropriate to the circumstances. These may include a directions of the type referred to in subrule 2 hereof. (4) If subsequent to the referral of a medical question to a Medical Panel and prior to the receipt of the Medical Panel’s opinion, the parties resolve their dispute by agreement such that the Medical Panel’s opinion is no longer necessary the compensating authority shall complete the form titled ‘Notice of Withdrawal of Referral’ and serve it upon the Registrar and the Convenor of the Medical Panel.

1—Short title These regulations may be cited as the Rates and Land Tax Remission Regulations 2009. 2—Commencement These regulations will be taken to have come into operation on 1 July 2008. 3—Interpretation (1) In these regulations— Act means the Rates and Land Tax Remission Act 1986; approved aged persons housing scheme means a scheme, administered by an organisation or body approved by the Minister— (a) under which houses or residential units in a residential complex are made available for occupation predominantly by persons of or over a fixed qualifying age of at least 50 years; and (b) under which the occupiers of houses or residential units in the scheme are entitled to continue in occupation of those houses or residential units for life, subject only to conditions providing or allowing for termination of that entitlement approved by the Minister; council rates means general and separate rates under the Local Government Act 1999; domestic partner means a person who is a domestic partner within the meaning of the Family Relationships Act 1975, whether declared as such under that Act or not; land tax means land tax under the Land Tax Act 1936; Low Income Health Care Card means a Low Income Health Care Card issued by the Commonwealth Government; prescribed capacity—see subregulation (2); 1158 THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE [26 March 2009

prescribed card means— (a) a Pensioner Concession Card issued by the Commonwealth Government; or (b) a TPI Gold Repatriation Health Card issued by the Commonwealth Government; or (c) a War Widows Gold Repatriation Health Card issued by the Commonwealth Government; or (d) a Gold Repatriation Health Card (EDA) issued by the Commonwealth Government; or (e) a State Concession Card issued by the State Government; prescribed payments means— (a) any of the following payments under the Social Security Act 1991 of the Commonwealth: (i) an Austudy payment; (ii) a newstart allowance; (iii) a parenting payment; (iv) a partner allowance; (v) a sickness allowance; (vi) a special benefit; (vii) a widow allowance; (viii) a youth allowance; or (b) Abstudy payments from the Commonwealth Government; or (c) payments under the Community Development Employment Project established by the Commonwealth Government; or (d) payments under the New Enterprise Incentive Scheme established by the Commonwealth Government; or (e) a pension as a war widow under legislation of the United Kingdom or New Zealand; sewerage rates means— (a) rates under the Sewerage Act 1929; or (b) service rates, annual service charges, or other fees or charges, for the collection, treatment or disposal of wastewater or effluent under the Local Government Act 1999; spouse—a person is the spouse of another if they are legally married; water rates means— (a) rates under the Waterworks Act 1932; or (b) service rates and annual service charges for the treatment or provision of water under the Local Government Act 1999; or (c) rates under the Irrigation Act 1994; or (d) rates under the Renmark Irrigation Trust Act 1936; or (e) contributions payable to the Lyrup Village Association under Part 8 of the Crown Lands Act 1929. 26 March 2009] THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 1159

(2) For the purposes of these regulations, a person will be taken to occupy land as the person's principal place of residence in a prescribed capacity only if the person occupies the land as the person's principal place of residence— (a) as sole or joint proprietor of an estate in freehold in possession; or (b) as sole or joint proprietor of a Crown lease or Crown under lease; or (c) as the purchaser of an estate in fee simple under an agreement for sale and purchase where the purchase price is payable in more than 2 instalments; or (d) as the occupier under an agreement to occupy provided that— (i) no rent is payable; and (ii) the tenure is for the life of the occupier and not subject to earlier determination except by the occupier; and (iii) the occupier is liable for all rates and taxes; or (e) as— (i) joint proprietor with other persons who own; or (ii) a shareholder in a body corporate that owns, a block of home units or other group residential premises (the person to be regarded for the purposes of this paragraph as being the sole or joint proprietor of the home unit or residential premises he or she occupies); or (f) as a lessee or licensee of land other than Crown land under a lease or licence that extends for 5 or more years and under which the dwelling occupied by the person on that land remains the property of that person; or (g) as the occupier of a house or residential unit in an approved aged persons housing scheme; or (h) as the spouse or domestic partner of any of the persons referred to in paragraphs (a) to (g); or (i) as a beneficiary under an estate entitling the person to occupy the property in 1 of the capacities referred to in paragraphs (a) to (g). 4—Remission of water rates (1) Subject to subregulation (2), a ratepayer is entitled under the Act to a remission of water rates for land if— (a) on the relevant date— (i) the ratepayer holds a prescribed card or a Low Income Health Care Card or is in receipt of prescribed payments; and (ii) the ratepayer occupies the land as the ratepayer's principal place of residence in a prescribed capacity; or (b) on the relevant date— (i) the spouse or domestic partner of the ratepayer holds a prescribed card or a Low Income Health Care Card or is in receipt of prescribed payments; and (ii) the ratepayer and his or her spouse or domestic partner occupy the land as their principal place of residence in a prescribed capacity; or 1160 THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE [26 March 2009

(c) at the time of recovery of the rates— (i) the ratepayer satisfies the Minister, by submitting to a means test determined by the Minister, that the ratepayer is suffering exceptional circumstances of hardship; and (ii) the ratepayer occupies the land as the ratepayer's principal place of residence in a prescribed capacity. (2) A ratepayer who satisfies the conditions set out in subregulation (1)(a) or (b) on the date on which the rates are payable by the ratepayer but not on the date on which the ratepayer is billed with the rates must, in addition, have been entitled to a remission of water rates for the preceding rating period in respect of the same or different land. (3) If 2 or more persons own land jointly or as tenants in common, each of them who is entitled to a remission of water rates for the land is entitled to a proportion of the amount of the remission equal to the proportion of the person's interest in the land. (4) The amount of the remission of water rates for land for a financial year is 20% of the amount of the rates, subject to a minimum remission of $95 and a maximum remission of $200. (5) In this regulation— relevant date means— (a) the date on which the person is billed with the rates; or (b) the date on which the rates are payable by the person. 5—Remission of sewerage rates (1) Subject to subregulation (2), a ratepayer is entitled under the Act to a remission of sewerage rates for land if— (a) on the relevant date— (i) the ratepayer holds a prescribed card or is in receipt of prescribed payments; and (ii) the ratepayer occupies the land as the ratepayer's principal place of residence in a prescribed capacity; or (b) on the relevant date— (i) the spouse or domestic partner of the ratepayer holds a prescribed card or is in receipt of prescribed payments; and (ii) the ratepayer and his or her spouse or domestic partner occupy the land as their principal place of residence in a prescribed capacity; or (c) at the time of recovery of the rates— (i) the ratepayer satisfies the Minister, by submitting to a means test determined by the Minister, that the ratepayer is suffering exceptional circumstances of hardship; and (ii) the ratepayer occupies the land as the ratepayer's principal place of residence in a prescribed capacity. (2) A ratepayer who satisfies the conditions set out in subregulation (1)(a) or (b) on the date on which the rates are payable by the ratepayer but not on the date on which the ratepayer is billed with the rates must, in addition, have been entitled to a remission of sewerage rates for the preceding rating period in respect of the same or different land. 26 March 2009] THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 1161

(3) If 2 or more persons own land jointly or as tenants in common, each of them who is entitled to a remission of sewerage rates for the land is entitled to a proportion of the amount of the remission equal to the proportion of the person's interest in the land. (4) The amount of the remission of sewerage rates for land for a financial year is 60% of the amount of the rates, subject to a maximum remission of $95. (5) In this regulation— relevant date means— (a) the date on which the person is billed with the rates; or (b) the date on which the rates are payable by the person. 6—Remission of council rates (1) Subject to subregulation (2), a ratepayer is entitled under the Act to a remission of council rates for land if— (a) on the relevant date— (i) the ratepayer holds a prescribed card or a seniors card or is in receipt of prescribed payments; and (ii) the ratepayer occupies the land as the ratepayer's principal place of residence in a prescribed capacity; or (b) on the relevant date— (i) the spouse or domestic partner of the ratepayer holds a prescribed card or a seniors card or is in receipt of prescribed payments; and (ii) the ratepayer and his or her spouse or domestic partner occupy the land as their principal place of residence in a prescribed capacity; or (c) at the time of recovery of the rates— (i) the ratepayer satisfies the Minister, by submitting to a means test determined by the Minister, that the ratepayer is suffering exceptional circumstances of hardship; and (ii) the ratepayer occupies the land as the ratepayer's principal place of residence in a prescribed capacity. (2) A seniors card ratepayer is not entitled to a remission of council rates under subregulation (1)(a) or (b) if— (a) the ratepayer and his or her spouse or domestic partner occupy the land as their principal place of residence; and (b) the ratepayer or the spouse or domestic partner of the ratepayer works in paid employment at a rate that exceeds 20 hours per week. (3) If 2 or more persons own land jointly or as tenants in common, each of them who is entitled to a remission of council rates for the land is entitled to a proportion of the amount of the remission equal to the proportion of the person's interest in the land. (4) The amount of the remission of council rates for land for a financial year is 60% of the amount of the council rates, subject to a maximum remission of— (a) for a seniors card ratepayer—$100; and (b) for any other ratepayer—$190. 1162 THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE [26 March 2009

(5) In this regulation— relevant date means the due date for payment of the first or only rates account; seniors card means a Seniors Card issued by the State Government; seniors card ratepayer means a person who satisfies the conditions set out in subregulation (1)(a) or (b) but would not do so if the person or his or her spouse or domestic partner did not hold a seniors card. 7—Remission of land tax (1) A taxpayer is entitled under the Act to a remission of land tax for land if— (a) on the relevant date— (i) the taxpayer holds a prescribed card or is in receipt of prescribed payments; and (ii) the taxpayer occupies the land as the person's principal place of residence in a prescribed capacity; or (b) on the relevant date— (i) the spouse or domestic partner of the taxpayer holds a prescribed card or is in receipt of prescribed payments; and (ii) the taxpayer and his or her spouse or domestic partner occupy the land as their principal place of residence in a prescribed capacity; or (c) at the time of recovery of the land tax— (i) the taxpayer satisfies the Minister, by submitting to a means test determined by the Minister, that the taxpayer is suffering exceptional circumstances of hardship; and (ii) the taxpayer occupies the land as the taxpayer's principal place of residence in a prescribed capacity. (2) If 2 or more persons own land in respect of which land tax is payable, each of them who is entitled to a remission of the land tax is entitled to a proportion of the amount of the remission equal to the proportion of the person's interest in the land. (3) The amount of the remission of land tax for land for a financial year is 60% of the amount of the land tax, subject to a maximum remission of $150. (4) In this regulation— relevant date means— (a) for the purposes of determining whether a person holds a prescribed card or is in receipt of a prescribed payment—the date on which the person is billed with the tax; and (b) for the purposes of determining whether a person occupies the land as the person's principal place of residence in a prescribed capacity—30 June of the financial year preceding the financial year for which the tax is imposed. 26 March 2009] THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 1163

5—Variation of regulation 7—Costs (1) Regulation 7(1)—delete subregulation (1) and substitute: (1) Pursuant to section 95(1) of the Act, the costs awarded to a party who is represented in proceedings that take place under Part 6A of the Act (other than Division 6 of that Part) up to and including 31 December 2009 cannot exceed— (a) for assistance in the preparation and lodgement of a notice of dispute and participation in the initial reconsideration of a disputed decision and in the initial conciliation process, including attendance at a conciliation conference—$350; and (b) for participation in the conciliation/dispute resolution process (including the preparation of any necessary documentation)— (i) $650; or (ii) if the Tribunal determines, on application by the party, that the party is entitled to an award of costs of an amount greater than $650—$2 150. (1a) However, if the proceedings in respect of which a party is entitled to an award of costs involve more than 1 notice of dispute, the party and the relevant compensating authority may agree, or the Tribunal may order, that the party is not to be awarded costs up to the relevant limit for participation in the conciliation/dispute resolution process in respect of each separate notice of dispute. (1b) The relevant compensating authority is entitled to appear and be heard on an application under subregulation (1)(b)(ii). (2) Regulation 7(4)—delete subregulation (4) and substitute: (4) Pursuant to section 97C of the Act, the following limits on costs are fixed in relation to proceedings that take place under Part 6B of the Act up to and including 31 December 2009:

Part 2—Variation of Workers Rehabilitation and Compensation (General) Regulations 1999 4—Substitution of regulation 14 Regulation 14—delete the regulation and substitute: 14—Lump sum compensation (1) For the purposes of section 43(2) of the Act, the portion of the prescribed sum to which a worker is entitled will be calculated in accordance with the table set out in Schedule 1, based on the worker's whole of person impairment assessed under Division 5 of Part 4 of the Act. (2) Pursuant to section 43(8)(b) of the Act, the amount of $420 558 is prescribed for the purposes of the definition of prescribed sum under section 43 of the Act. (3) For the purposes of section 43(9)(b) of the Act, the amount prescribed by subregulation (2) will be indexed so that it is adjusted on 1 January in each year, beginning on 1 January 2010, by multiplying the stated amount by a proportion obtained by dividing the Consumer Price Index for the September quarter of the immediately preceding year by the Consumer Price Index for the September quarter, 2008 (with the amount so adjusted being rounded up to the nearest dollar). 5—Revocation of regulations 24 and 25 Regulations 24 and 25—delete the regulations 6—Variation of regulation 27—Transitional provision—Compensation payable on death—lump sums (1) Regulation 27(2)—delete "For the" and substitute: In relation to the (2) Regulation 27(2)—delete "section 43" and substitute: section 43(8)(a) (3) Regulation 27—after subregulation (2) insert: (3) To avoid doubt, the prescribed sum under section 45A of the principal Act in relation to the period between 1 January 2009 and the commencement of section 24 of the 2008 Amendment Act (disregarding any amount that must be deducted in a particular case) will be the prescribed sum applying under subregulation (2) on 1 January 2009, indexed from 1 January 2009 in accordance with the requirements of section 3(15) of the Act. 7—Insertion of regulation 31 After regulation 30 insert: 31—Transitional provision—lump sum compensation (1) In this regulation— principal Act means the Workers Rehabilitation and Compensation Act 1986; 26 March 2009] THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 1173

2008 Amendment Act means the Workers Rehabilitation and Compensation (Scheme Review) Amendment Act 2008. (2) The minimum amounts of compensation payable under Schedules 3 and 3A of the principal Act, as inserted by section 83 of the 2008 Amendment Act, will be taken to have been indexed from 1 January 2009 in the manner specified by section 3(15) of the principal Act. (3) For the purposes of clause 10 of Schedule 1 of the 2008 Amendment Act, the amount of compensation payable to a particular worker will be assessed as a proportion of— (a) in respect of a compensable disability occurring before 1 January 2009—$400 000 as the prescribed sum; (b) in respect of a compensable disability occurring on or after 1 January 2009 and before the commencement of section 24 of the 2008 Amendment Act—$400 000, indexed from 1 January 2009 in the manner specified by section 3(15) of the principal Act, as the prescribed sum. 8—Insertion of Schedule 1 After regulation 31 (as inserted by these regulations) insert:

Schedule 1—Scale of entitlements—section 43(2) Scale of entitlements For the purposes of this scale— (a) WPI degree is the worker's degree of whole of person impairment assessed under Division 5 of Part 4 of the Act; (b) the amounts set out in Column 2 apply in respect of compensable disabilities occurring before 1 January 2009; (c) the amounts set out in Column 3 apply in respect of compensable disabilities occurring during 2009; (d) the amounts set out in Column 4 apply in respect of compensable disabilities occurring on or after 1 January 2010 and the words (index adjusted) indicate that an amount will be indexed so that it is adjusted on 1 January in each year, beginning on 1 January 2010, by multiplying the stated amount by a proportion obtained by dividing the Consumer Price Index for the September quarter of the immediately preceding year by the Consumer Price Index for the September quarter, 2008 (with the amount so adjusted being rounded up to the nearest dollar).

Part 2—Variation of Workers Rehabilitation and Compensation (Claims and Registration) Regulations 1999 4—Insertion of regulation 16A After regulation 16 insert: 16A—Discontinuance fee (1) For the purposes of section 76AA(1)(a) of the Act, but subject to this regulation, in relation to an employer who ceases to be registered under section 59 of the Act, the fee to be paid by the employer will be calculated as follows: 1.1 x TEL ( GST exclusive ) DF ( GST inclusive )  x SUL TSL where— DF is the fee to be paid TEL is the total amount of levies paid or payable with respect to the relevant period by the employer TSL is the total amount of levies paid or payable with respect to the relevant period by all employers registered under section 59 of the Act, as shown in the relevant audited accounts of the Corporation SUL is the unfunded liability of the scheme under the Act, being the amount by which the total consolidated liabilities of the Corporation exceed the total consolidated assets of the Corporation, as shown in the most recently published audited accounts of the Corporation (as at the relevant day). (2) The Corporation may, as it thinks fit, waive the whole or a part of any fee payable under this regulation. (3) In this regulation— levy is levy payable under Division 4 of Part 5 of the Act; relevant day, in relation to an employer, is the day on which the employer ceases to be registered under section 59 of the Act; relevant period, in relation to an employer, is a period comprising the last 3 financial years for which audited accounts of the Corporation are available (as at the relevant day). Note— As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
