Please provide an update on the situation for gay men in New Delhi, with particular reference to the recent High Court decision on discrimination against homosexuals. Summary On 2 July 2009, the High Court of Delhi handed down a decision which, in the National Capital Territory of Delhi, may decriminalise consensual sexual activity between adults of any gender. According to a 3 July 2009 report in the New York Times, the trial judges found that the existing Section 377 “law violates Article 14 of the Constitution, which guarantees all people ‘equality before the law;’ Article 15, which prohibits discrimination ‘on grounds of religion, race, caste, sex or place of birth;’ and Article 21, which guarantees ‘protection of life and personal liberty,’ the judges said”.
