The enclosed report documents findings of the inspections that were performed at the Lepage Subdivision – Moise Gendron, Clarence-Rockland Municipal Garage, Highway 17 Northern Subdivision & Clarence-Rockland Arena, Event and Training Stormwater Management Facilities October 6 & 8, 2015.

Two sections of the report, namely “Actions Required” and “Recommended Actions” cite due dates for the submission of information or plans to my attention.

Please note that “Actions Required” are linked to incidents of non-compliance with regulatory requirements contained within an Act, a Regulation, or site-specific approvals, licenses, permits, orders, or instructions. Such violations could result in the issuance of mandatory abatement instruments including orders, tickets, penalties, or referrals to the ministry’s Investigations and Enforcement Branch.

“Recommended Actions” convey information that the owner or operating authority should consider implementing in order to advance efforts already in place to address such issues as emergency preparedness, the fulsome availability of information to consumers, and conformance with existing and emerging industry standards. Site (Name): Lepage Subdivision - Moise Gendron Street Type: Stormwater Management Works Sub Type: Treatment Facility Comments: The Lepage Subdivision – Moise-Gendron Street Storm Water Management Facility (SWMF) is located on Lot 18, 19, Concession 5, Hamlet of Bourget, City of Clarence-Rockland, United Counties of Prescott and Russell. The Lepage Subdivision is a residential development. It’s located south west of Moise-Gendron Street, north of the abandoned railway line now used as a bicycle path. According to surface elevation OBM Spot Height on the MOECC GIS system, surface water flows SE. The SWMF facility discharges to a wetland that ultimately discharges to Bear Brook and then the Nation River.

The SWMF comprises of:

• Two 15 m long, 900 mm dia. inlets discharging into a 70 X 9.25 X 1 m SWD pond;

• A permanent pond with a volume of 3,008 m3 below water table and a 977 m3 above water table.

• The active storage is 2,117 m3;

• A reverse sloped 200 mm dia. pipe emptying into a catchbasin outlet fitted with a 100 mm dia. orifice with its invert set at 1.55 m above the bottom of the pond;

• The catchbasin empties into a rip-rap area via a 15.52 m by 450 mm dia. pipe to the ditch;

• A weir with of 3.0 m bottom width and a crested top width of 9.0 m 2.2 m above the bottom. A previous ECA, NUMBER 5586-6RNQGFconsisted of: • A permanent pool with a 277 m3 capacity and active storage of 1,532 m3;

• A 5m broad crested weir with a crest at 2.08 m over the bottom of the pool with a flow control structure;

Site (Name): Clarence Creek Municipal Garage Type: Stormwater Management Works Sub Type: Treatment Facility Comments: The Clarence Creek Municipal Garage SWMF is located at 417 Lemay Street, City of Clarence- Rockland, United Counties of Prescott and Russell. It serves a small drainage area of 0.06 ha. The oil/grit separation unit is manufactured by AquaShield.

The SWMF comprises of:

• A model Aqua-Swirl AS-4;

• A sediment capacity 914L

• An oil capacity 719 L;

• A total holding capacity of 1,633 L;

• A maximum treatment flow rate of 91 L/s

• A 400 mm dia. concrete pipe outlet.

Site (Name): Highway 17 Northern Subdivision Type: Stormwater Management Works Sub Type: Treatment Facility Comments: The Highway 17 Northern Subdivision SWMF is located on North Chamberland and Catherine Streets on Lot 28-30, Concession 1, Old Survey, City of Clarence-Rockland, United Counties of Prescott and Russell.

The SWMF comprises of:

• Storm and sanitary sewers;

• 1 oil/grit interceptor in manhole ‘#701’ & #702 on Catherine Street;

• 3 oil/grit interceptors in manholes ‘#703’, ‘#704’ and ‘#705’;

• All are rated at 18 L/s with a capacity of 4,000 L.

Site (Name): Clarence-Rockland Arena, Event and Training Centre Type: Stormwater Management Works Sub Type: Treatment Facility Comments: The Clarence-Rockland Arena, Event and Training Centre SWMF serves an area of approximately 6.9 ha. It discharge to the ditch north of County Road 17. The ditch drainage is split between two outlets, one east to Clarence Creek, the other to a box culvert crossing County Road 17 to a provincially significant wetland.

The SWMF comprises of:

• A wet pond with a 1,104 m3 pool;

• A detention volume of 367 m3;

• A total volume of 1,471 m3 at depth of 1.2 m;

• A 1,675 mm dia. inlet with concrete headwall;

• A 2,400 mm by 2,400 mm baffled OCS;

• A 102 mm dia. orifice and a 650 mm by 550 mm rectangular weir discharging through a 600 mm dia. outlet pipe to the County Road I 7 north ditch;

• A geotextile overlain earth berm flow splitter perpendicular to the ditch discharges to the 600 mm dia. outlet pipe at the OCS;

• A 5 m by 300 mm trapezoidal overflow weir discharging eastward to Clarence Creek.

INSPECTION SUMMARY

INTRODUCTION

* The primary focus of this inspection is to confirm compliance with Ministry of the Environment and Climate Change (MOECC) legislation and control documents, as well as conformance with Ministry related policies for the inspection period.

This stormwater management system is subject to the legislative requirements of the Ontario Water Resources Act (OWRA) and the Environmental Protection Act (EPA) and regulations made therein. This inspection has been conducted pursuant to Section 15 of the OWRA and Section 156 of the EPA.

This inspection does not in any way suggest that all applicable legislation and regulations were evaluated. It is, and remains the responsibility of the owner, to ensure compliance with all applicable legislative and regulatory requirements.

On October 6 & 8, 2015 MOECC Water Inspector Jean Veilleux (referred to as “the inspector”) conducted an announced inspection of the Corporation of the City of Clarence - Rockland’s Lepage Subdivision - Moise Gendron SWMF, Clarence Creek Municipal Garage SWMF, the Highway 17 Northern Subdivision Storm and Oil/Grit Separator SWMFand the Clarence - Rockland Arena, Event and Training Centre SWMF (Herein known as “the facility (ies)”). The inspector was accompanied by Mr.Denis Longpré, Manager of Environment and Water/Gestionnaire de l'environnement et de l'eau, Mr. Yves Russelle, Manager, Engineering and Operations/Gestionnaire de l'ingénierie et des operations and Mr. Jonathan Samson, Engineer/Ingénieur, all from the City of Clarence-Rockland. The inspector conducted a review of engineering drawings and Environmental Compliance Approvals (ECA) for the facilities. All the above were interviewed by the inspector using the LWIS SWMF inspection protocol worksheets.

No final effluent samples were collected from the facilities.

No previous inspections were undertaken by the MOECC at these facilities. The present inspection report’s requirements are noted in the sections "Non– Compliance with Regulatory Requirements/Actions Required" and/or "Summary of Best Practice Issues/Recommended Actions."

The inspection included a review and assessment of operating practices using the following documents:

• Ontario Water Resources Act (OWRA);

• Environmental Protection Act (EPA);

Clarence Creek Municipal Garage SWMF:

• Environmental Compliance Approval NUMBER 9053-87HNAG Issue Date: March 5, 2010; Highway 17 Northern Subdivision Storm and Oil/Grit Separator: • Environmental Compliance Approval NUMBER 8274-6DSK47 Issue Date: June 29, 2005; Clarence -Rockland Arena, Event and Training Centre SWMF: • Environmental Compliance Approval NUMBER 0770-8BSLSF Issue Date: January 21, 2011. TREATMENT PROCESSES

* The stormwater facility appeared to be constructed in accordance with the Environmental Compliance Approval/Certificate of Approval.

All the facilities ECAs were reviewed and all the facilities corresponded to the ECA descriptions.

* The stormwater facility was not being operated and maintained in accordance with a condition(s) of the Environmental Compliance Approval/Certificate of Approval.

The facilities listed below seemed maintained, however according to the owner, no logbooks nor records are kept. The owner informed the inspector they were in the process of developing Operation Manuals (O & M) for all the SWMF for which the City of Clarence-Rockland is responsible.

Lepage Subdivision - Moise Gendron SWMF – ECA NUMBER 0064-8M6QWQ contains the following conditions:

4. OPERATION AND MAINTENANCE.

(1) The Owner shall ensure that the design minimum liquid retention volume of 277 m3 is maintained at all times.

(2) The Owner shall inspect the Works at least once a year and, if necessary, clean and maintain the Works to prevent the excessive build-up of sediments and/or vegetation.

(3) The Owner shall maintain a logbook to record the results of these inspections and any cleaning and maintenance operations undertaken, and make the logbook available for inspection by the Ministry. The logbook shall include the following:

(a) the name of the Works ; and

(b) the date and results of each inspection, maintenance and cleaning, including an estimate of the quantity of any materials removed.

In addition, Condition 5 requires retention of the records for 5 years.

Clarence Creek Municipal Garage SWMF - ECA NUMBER 9053-87HNAG contains the following conditioins:

3.2 The Owner shall carry out and maintain an annual inspection and maintenance program on the operation of the oil/grit interceptor in accordance with the manufacturer's recommendation.

3.3 After a two (2) year period, the District Manager of the MOE District Office may alter the frequency of inspection of the oil/grit interceptor if he/she is requested to do so by the Owner and considers it acceptable upon review of information submitted in support of the request.

Highway 17 Northern Subdivision Storm and Oil/Grit Separator SWMF - ECA NUMBER 8274- 6DSK47 contains the following conditioins:

(I) The Owner shall ensure that the design minimum liquid retention volume(s) is maintained at all times.

(2) The Owner shall inspect the Works at least once a year and, if necessary, clean and maintain the Works to prevent the excessive build-up of sediments and/or vegetation.

In addition, Condition 5 requires the retention of records for 5 years.During the physical inspection, the inspector observed the following:

Lepage Subdivision - Moise Gendron SWMF

• Bullrushes were not overwhelming the ponds;

• The shore and bottom of the forebay was covered with vegetation such as bladderworts and hornworts;

• The water was somewhat turbid;

• Vegetation on the pond’s berm is plentiful up to the access roads;

• Variety of native plants grow in the perimeter zone;

TREATMENT PROCESSES

• Shrubs and small trees are growing on the upper embankment;

• The outfall area was relatively free of vegetation with the exception of some thistles and weeds;

• Water levels were not excessive;

• Overflow accesses were uncovered;

• Some inlets and outlets were free of vegetation or other debris but some were partially obstructed by plants;

• An access road surrounded the facility.

Clarence Creek Municipal Garage SWMF & Highway 17 Northern Subdivision Storm Oil/Grit Separators

• Grade around the units were appropriate;

• Once the covers were removed, no oil nor sheen were observed on the water;

• Water levels were appropriate;

• Outfalls were clean of oil or sheens.

Clarence - Rockland Arena, Event and Training Centre SWMF

• Pond inlet contained water;

• Water was clear;

• Lawn was cut to the edge of the pond;

• The pond outlet was dry;

• The pond was overwhelmed by bullrushes;

• The outlet ditch was full of vegetation.

The inspector strongly urges the owner to use the methods described in the Stormwater Management Planning and Design Manual, Section 6., March 2003, by MOECC to develop its O & M manuals. This item may be found at the following site:

This section provides a summary of all non-compliance with regulatory requirements identified during the inspection period, as well as actions required to address these issues. Further details pertaining to these items can be found in the body of the inspection report.

1. The stormwater facility was not being operated and maintained in accordance with a condition(s) of the Environmental Compliance Approval/Certificate of Approval.

The facilities were not operated and maintained in accordance with their ECAs.

Action(s) Required: Actions Required:

1) The owner shall by March 31, 2016 provide in writing (may be in electronic format) to the undersigned Provincial Officer assurance that Operation and Maintenance Manuals will be, at a minimum, developed according to the facilities’ ECA.

2) The owner shall by June 30, 2016 provide in writing (may be in electronic format) to the undersigned Provincial Officer, copies of the inspected facilities’ completed O & M manuals.

(1) Except as otherwise provided by these Conditions, the Owner shall design, build, install, operate and maintain the Works in accordance with the description given in this Certificate , the application for approval of the works and the submitted supporting documents and plans and specifications as listed in this Certificate .

(2) Where there is a conflict between a provision of any submitted document referred to in this Certificate and the Conditions of this Certificate , the Conditions in this Certificate shall take precedence, and where there is a conflict between the listed submitted documents, the document bearing the most recent date shall prevail.

(3) Where there is a conflict between the listed submitted documents, and the application, the application shall take precedence unless it is clear that the purpose of the document was to amend the application.

2. EXPIRY OF APPROVAL

The approval issued by this Certificate will cease to apply to those parts of the Works which have not been constructed within five (5) years of the date of this Certificate .

The Owner shall notify the District Manager and the Director , in writing, of any of the following changes within thirty (30) days of the change occurring:

(a) change of Owner ;

(b) change of address of the Owner ;

(c) change of partners where the Owner is or at any time becomes a partnership, and a copy of the most recent declaration filed under the Business Names Act, R.S.O. 1990, c.B17 shall be included in the notification to the District Manager ; and

(d) change of name of the corporation where the Owner is or at any time becomes a corporation, and a copy of the most current information filed under the Corporations Information Act, R.S.O. 1990, c. C39 shall be included in the notification to the District Manager .

4. OPERATION AND MAINTENANCE.

(1) The Owner shall ensure that the design minimum liquid retention volume of 277 cubic metres is maintained at all times.

(2) The Owner shall inspect the Works at least once a year and, if necessary, clean and maintain the Works to prevent the excessive build-up of sediments and/or vegetation.

(3) The Owner shall maintain a logbook to record the results of these inspections and any cleaning and maintenance operations undertaken, and make the logbook available for inspection by the Ministry . The logbook shall include the following:

(a) the name of the Works ; and

(b) the date and results of each inspection, maintenance and cleaning, including an estimate of the quantity of any materials removed.

5. RECORD KEEPING

The Owner shall retain for a minimum of five (5) years from the date of their creation, all records and information related to or resulting from the operation and maintenance activities required by this Certificate .

The reasons for the imposition of these terms and conditions are as follows:

1. Condition 1 is imposed to ensure that the Works are built and operated in the manner in which they were described for review and upon which approval was granted. This condition is also

3. Condition 3 is included to ensure that the Ministry records are kept accurate and current with respect to approved works and to ensure that subsequent owners of the works are made aware of the certificate and continue to operate the works in compliance with it.

4. Condition 4 is included to require that the Works be properly operated and maintained such that the environment is protected .

5. Condition 5 is included to require that all records are retained for a sufficient time period to adequately evaluate the long-term operation and maintenance of the Work .

3.2 The Owner shall carry out and maintain an annual inspection and maintenance program on the operation of the oil/grit interceptor in accordance with the manufacturer's recommendation.

3.3 After a two (2) year period, the District Manager of the MOE District Office may alter the frequency of inspection of the oil/grit interceptor if he/she is requested to do so by the Owner and considers it acceptable upon review of information submitted in support of the request.
