End of Session Report 2009

During this year’s legislative session, almost 7,000 bills were introduced. In the end, over 700 pieces of legislation were adopted by the House and Senate and sent to the Governor for his signature. Major highlights of the session include passage of a capital bill, a rewrite of the Freedom of Information Act, State Ethics and Procurement Reform, expanded notice requirements to tenants of foreclosed properties, and measures to address the proper disposal of pharmaceuticals in order to protect public water supplies.

This report summarizes bills of interest to county governments that have been either signed into law by the Governor (as noted by a Public Act Number) or vetoed:

Jeffrey Schoenberg Synopsis Amends the Election Code to establish yearly campaign contribution limits for persons, corporations, labor organizations, associations, and political committees. Although the legislation imposes some limits on campaign contributions, it also contains major exceptions including the transfer of up to $90,000 from other campaign funds and a provision to permit lawmakers to create special Constituent Services Committees to raise funds to supplement the state funding of their local offices. The high limits and broad definitions contained in the bill caused members of the Governor’s Reform Commission to oppose the legislation. Dan Cronin Synopsis Requires the State (Department of Central Management Services) to establish and maintain a website known as the Illinois Transparency & Accountability Portal. The website will provide direct access to information concerning State employees and individual consultants, State expenditures, State tax credits, State contracts plus revocations and suspensions of occupation and use tax certificates of registration and professional licenses. Requires that CMS establish the portal within 12 months after the bill's effective date of January 1, 2010. Public Act 96-225

Jeffrey Schoenberg Synopsis Provides that the Capital Development Board, in consultation with the Department of Public Health, establish the Community Health Center Construction Grant Program to make grants to eligible community providers (subject to appropriations). Provides that grants are for the purpose of constructing or renovating new community health center sites, renovating existing community health center sites, and/or purchasing equipment to provide primary health care services to certain populations or areas. This program could potentially help finance the county’s fourth Federally Qualified Health Center facility planned for Westmont. Governor Vetoed (stated this bill was identical to Article 10 of HB 2424, now Public Act 96-37)

Deanna Demuzio – Sen. Toi Hutchinson – Sen. – Sen. Jeffrey Schoenberg – Sen. Michael Noland Synopsis This legislation provides that specific bills approved for payment for goods and services submitted under Article V of the Illinois Public Aid Code, must be paid within 60 days after the receipt of a proper bill or invoice. If payment is not issued to the payee within this 60-day period, an interest penalty of 2.0% of any amount approved and unpaid shall be added for each month or fraction thereof until final payment is made. Although the DuPage Convalescent Center is on an expedited Medicaid payment system for room and board charges, state reimbursement for other items such as oxygen and transportation for instance, are months overdue. Governor Amendatory Veto – deleted all of the language except for a provision adding community-based providers offering prevention, intervention, and treatment for those with developmental disabilities, psychological challenges, and substance abuse issues under the Prompt Payment Act

Bill HB 255 Title Video Gaming House Sponsor Rep. Lou Lang Senate Sponsors Sen. John Cullerton – Sen. Donne Trotter Synopsis Creates the Video Gaming Act to allow licensed retail establishments where alcoholic liquor is served for consumption, licensed fraternal establishments, and licensed veterans establishments (and truck stops) to conduct video gaming by placing up to (5) terminals per establishment. Among other items, also authorizes a pilot program that allows an individual to purchase Illinois lottery tickets on the Internet. Public Act 96-0034

James Clayborne Jr. Synopsis Provides that, if the county board of any county has levied a tax for a detention home and cannot adequately support the facility, the county board may expend the tax receipts for detention services purchased through agreements with other governmental units. Synopsis As amended, authorizes counties (in addition to municipalities) to adopt the Illinois Vehicle Code as part of their code. A DuPage initiative, this provision will help coordinate violations issued by different law enforcement agencies, ease administrative efforts by ensuring consistency of fines and other enforcement measures across jurisdictions, and permit county boards to set minimum fine levels. Public Act 96-0655

Chris Lauzen Synopsis Authorizes State purchasing officers under the jurisdiction of the Director of the Department of Central Management Services to use an electronic reverse auction procurement method for purchases of supplies and services other than professional and artistic services (excludes construction contracts). As amended in committee, the bill adds authority

3 for units of local governments to participate in the program. Several other states have adopted this system which has resulted in considerable taxpayer savings. Public Act 96-0588

Michael Bond Synopsis Amends the Build Illinois Bond Act to provide that certain bonds that may currently be used for loans or grants to units of local government for wastewater facilities may also be used for grants to serve unincorporated areas. Amends the Environmental Protection Act to authorize the EPA to distribute grants to units of local government for financing and construction of wastewater facilities in both incorporated and unincorporated areas. Effective immediately. Public Act 96-0503

Bill HB 585 Title Competitive Bidding in Counties House Sponsors Rep. Jim Sacia – Rep. Jerry Mitchell Senate Sponsor Sen. Pamela Althoff Synopsis Increases the competitive bid threshold (for counties with fewer than 2,000,000 inhabitants) on county contracts from $20,000 to $30,000 and from $25,000 to $35,000 for data processing, telecommunications, and software contracts. Public Act 96-170

Bill HB 658 Title Pharmaceutical Task Force House Sponsors Rep. Paul Froehlich – Rep. Patricia Bellock – Rep. Karen May Senate Sponsors Sen. Susan Garrett – Sen. Don Harmon Synopsis Creates the Medication Education Disposal Solutions (MEDS) collaborative for the purpose of encouraging the environmentally responsible disposal of pharmaceuticals. Requires the EPA and MEDS to focus on the development of an organization that will, among other duties, provide information regarding best practices for the disposal of pharmaceuticals. Requires the MEDS collaborative to submit a report on its program development activities by December 31, 2010. Public Act 96-0369

Toi Hutchinson Synopsis The legislation as amended transfers the administration of the Low-Income Home Energy Assistance Program (LIHEAP) and the weatherization assistance program from the Department of Healthcare & Family Services back to the Illinois Department of Commerce & Economic Opportunity (DCEO) but more importantly, permits DCEO to expand the income eligibility guidelines for these programs up to 200% of the federal poverty level until federal stimulus monies are expended. Under the recently enacted federal stimulus package, DuPage County alone will receive a 500% increase in weatherization funds that would be difficult to fully utilize unless the eligibility criteria was expanded. Future energy savings documented under weatherization programs are significant and may keep many seniors and disabled homeowners in their homes by reducing their monthly utility bills. Michael Noland Synopsis As introduced, the legislation provided that public notice of a special meeting of a county board must be provided in the same manner as regular meetings as prescribed under the Open Meetings Act however as amended by the Senate, this language was deleted and language to delete the requirement that test wind towers be dismantled within 3 years of installation was inserted instead. Public Act 96-0566

Bill HB 1322 Title Transportation Development Partnership Trust Fund House Sponsors Rep. Michael Tryon – Rep. Kathleen Ryg – Rep. Sidney Mathias – Rep. Jack Franks – Rep. Patricia Bellock Senate Sponsor Sen. Pamela Althoff Synopsis A McHenry County initiative that would authorize local governments to pick up the state match for federal transportation projects (in order to move the projects forward more expeditiously). Creates the Transportation Development Partnership Act and establishes the Transportation Development Partnership Trust Fund. Requires the Department of Transportation (IDOT) to administer the Fund and provides that monies in the Fund be used as matching funds for transportation-related projects. Provides that IDOT and a county or entity may, at the Secretary's discretion, enter into an intergovernmental agreement to participate in the Transportation Development Partnership Trust Fund. Provides that a county may, by ordinance, direct that the taxes and penalties collected for specified purposes in the Counties Code (the County Option Motor Fuel Tax and the Special County Retailers' Occupation Tax for Public Safety or Transportation) be deposited into the Transportation Development Partnership Trust Fund. Governor Amendatory Veto: (“this legislation allows local units of government to pay for road construction out of a newly created fund that generates revenues through the County Option Motor Fuel Tax or the Special County Retailers Occupation Tax, and later reimbursed by the State. Only a third of Illinois counties collect either of these taxes and even fewer will generate enough revenue to participate in the program. That means less than one third of the counties in Illinois will be able to fund road construction projects through this program, yet it will place them ahead in getting funding of almost every other county, without authorization from the Secretary of Transportation, the General Assembly, or the Governor).”

In provisions concerning specified telecommunication and AM broadcast facilities in any county with a population of 180,000 or more, adds that a county board may grant variations after one public hearing held at a zoning or other appropriate committee meeting with proper notice. 5 Provides that the homeowner notice attached to the summons in a residential mortgage foreclosure action shall include directions concerning giving written notice to any tenants about the foreclosure and the tenant's right to remain on the premises no later than 21 days after the confirmation of the sale. Also requires the holder of the certificate of sale or deed, a purchaser, a mortgagee in possession, and a receiver to: provide a notice of rights and information about the new ownership advising where inquiries about rent or property repairs may be made; maintain utility services that had been the owner's obligation; and maintain the property. Requires local election authorities to comply with provisions of the Local Records Act when destroying or disposing of public records. Effective immediately. Public Act 96-0475

Bill SB 51 Title Procurement Reform Senate Sponsors Sen. Jeffrey Schoenberg – Sen. Susan Garrett – Sen. Christine Radogno – Sen. Toi Hutchinson – Sen. Louis Viverito House Sponsors Rep. Michael Madigan – Rep. Al Riley – Rep. John Fritchey – Rep. David Miller – Rep. Synopsis Makes significant changes to the Illinois Procurement Code in order to reform the process by which state contracts and leases are awarded to include: providing for compliance monitors; insulating top procurement officers from political influence; expanded disclosure of financial information and making documents reviewed in a procurement decision publicly accessible; requiring full disclosure of all subcontracts; and documenting ex parte communications between state employees, lobbyists, vendors and other parties regarding state procurements, among other items. Creates an Executive Procurement Officer under the Governor’s Office and changes the goal for the award of minority contracts from not less than 12% of the total dollar amount of State contracts to not less than 20%. Also includes identical language to HB 379 allowing local governments and the State to procure supplies or services through a competitive electronic auction bidding process. Effective immediately. Monique Davis Synopsis Sets forth a number of Ethics Act and Lobbyist Act reforms including: expanded authority for the Attorney General to investigate violations under the Ethics Act; revises the “Revolving Door” policy to prohibit certain officials and state employees from accepting employment or compensation for one year; mandates weekly lobbying reports when the General Assembly is in session disclosing all expenditures; expands “Whistleblower Protection” and grants circuit courts jurisdiction to hear cases; and authorizes Inspector Generals to self-initiate investigations and expands their executive branch authority to review agency compliance with State hiring laws. 6 Synopsis Provides that the Illinois Commerce Commission, in cooperation with a local law enforcement agency, may establish in any county or municipality a system for automated enforcement of railroad crossing violations. Establishes requirements for the system among other changes. Provides that local authorities must initiate the process by enacting a local ordinance requesting the creation of such a system. Provides that local authorities and the Commission must agree to a plan for obtaining, from any combination of federal, State, and local funding sources, the dollars required for the purchase and installation of any necessary equipment. Public Act 96-0478

Jack Franks Synopsis The bill as amended, authorizes but does not require, EPA to adopt regulations governing the operation of household waste drop-off points and sets minimum requirements. Household waste is defined as personal care products and defined pharmaceuticals generated from a single residence or multiple residences. Authorizes, but does not require, the EPA to approve the operation of one-day household waste collection events. The dangers associated with the current disposal method for unused pharmaceuticals continues to be a major concern to the public. Public Act 96-0121

Jack Franks – Rep. Linda Chapa LaVia – Rep. Daniel Beiser – Rep. Lou Lang Synopsis A major rewrite of the Freedom of Information Act (FOIA) that emphasizes the obligation of public bodies to provide access to public records regardless of the cost and further states that all records are presumed to be open unless the public body proves an exemption is required. Imposes criminal penalties and civil fines and reduces fees to free for the first 25 pages of information copied then 15 cents for each additonal page. Creates the new position of Public Access Counselor in the Attorney General’s Office to hear appeals (instead of the head of the public body); requires public bodies to provide a list of employees who will handle FOIA requests and requires these individuals complete an electronic training course; shortens the time for an initial response to FOIA requests from 5 business days to 7 calendar days and shortens the timeframe for a final response to 5 additional business days versus 7 additional calendar days; allows public bodies to require FOIA requests to be in writing but cannot require the request be submitted on a standard form; and broadens the definition of public record to include electronic communications among many other items. Kay Hatcher Synopsis For counties under 3,000,000 inhabitants, sets forth specific items that must be included in the notice sent to taxpayers whose assessment has changed. Requires disclosure of information concerning access to databases containing the physical characteristics of the property. Requires the Board of Review in those counties to make its rules and procedures publicly available, and requires the Chief County Assessment Officer to provide a plain-English explanation of equalization factors. Patricia Bellock – Elizabeth Coulson Synopsis An initiative of the DuPage County Health Department, the legislation implements the CDCs strategy to slow the spread of sexually transmitted diseases. Provides that a health care professional who makes a clinical diagnosis of chlamydia or gonorrhea may prescribe, dispense, furnish, or otherwise provide prescription antibiotic drugs to the infected person's sexual partner or partners without physical examination of the partner or partners, if in the judgment of the health care professional, the partner is unlikely or unable to present for comprehensive health care. Provides that the health care professional shall provide counseling for the patient and written materials to be given by the patient to the partner or partners. Public Act 96-0613

Elaine Nekritz Synopsis Amends the Regional Transportation Authority Act to direct that the Commuter Rail Board (Metra) allow passengers to purchase fares by credit card (i) through an Internet website operated by the Board, (ii) at its LaSalle Street Station, Union Station, Ogilvie Transportation Center, and Millennium Station, (iii) at stations with agents, and (iv) from vending machines capable of providing fares by credit card at the 14 largest stations on the Metra Electric Line. Provides that the Metra Board may not require a passenger who chooses to purchase a fare by credit card to pay an additional fee. Public Act 96-0621

Joseph Lyons Synopsis Increases the additional fee for court supervision from $20 to $29 with the additional $9 being deposited into the Drivers Education Fund. If not waived by the court, increases the additional court supervision fee from $5 to $6 with the additional dollar being deposited into the Circuit Court Clerk Operation and Administrative Fund. 8 House Sponsor Rep. Frank Mautino Synopsis Authorizes the transfer from hundreds of various special funds to the State’s General Revenue Fund in order to balance the fiscal year 2010 budget. As a result, numerous programs will be significantly reduced or eliminated including solid waste programs, mental health and substance abuse treatment, child abuse prevention, law enforcement, and West Nile Virus programs among many others. Deborah Mell Synopsis As introduced, the legislation required the Illinois Environmental Protection Agency (EPA) to adopt comprehensive storm water management rules and to implement a storm water permit fee program as well as establish a Statewide standard for storm water management programs in order to transition toward the use of green infrastructure as the predominant storm water management strategy. As amended however, the legislation only creates the Green Infrastructure for Clean Water Act and requires the EPA, in consultation with other agencies and entities, to submit a report to the General Assembly and Governor that reviews the latest available scientific research and institutional knowledge relating to storm water management. Sara Feigenholtz – Rep. Linda Chapa LaVia Synopsis Creates the Safe Pharmaceutical Disposal Act. Provides that except for medications contained in intravenous fluids, syringes, or transdermal patches, no health care institution, nor any employee, staff person, contractor, or other person acting under the direction or supervision of a health care institution, may discharge, dispose of, flush, pour, or empty any unused medication into a public wastewater collection system or septic system. Defines health care institution (includes hospitals, nursing homes and other specified facilities), public wastewater collection system, and unused medication. Provides that a violation of the Act is a petty offense subject to a fine of $500. Public Act 96-221

Provides that the State agrees to several specified terms and guarantees and provides for State indemnification of any net financial deficit, limited to $250,000,000, after other resources are exhausted. HB 001 – Motor Fuel Tax-Surcharge; Provides an additional 8 cents per gallon tax on fuel, which would be deposited into the GROW Illinois Fund to be used for debt service and capital improvements.

HB 24 – Illinois Reform Commission; Includes a number of recommendations from the Governor’s Commission related to campaign finance, including limits on campaign contributions and committees.

HB 270 – CMAP Board Changes; Adds two additional appointments (to be made by the Governor) to the Metropolitan Agency for Planning (CMAP) Board, thereby altering the current balance between the collar counties and Cook County and Chicago.

HB 277 – Prescription Drug Repository Program Act; A Health Department initiative that was adopted by the House but stalled in the Senate, the legislation establishes a mechanism whereby a healthcare facility could donate unopened prescription drugs (that tend to be very costly, end-of life medications) or related supplies to programs that benefit the uninsured. The legislation was supported by Access DuPage and other community based programs that provide medical services to the uninsured and that spend a considerable portion of their administrative budgets purchasing prescription drugs for program participants.

HB 593/SB 1352 – Landlord Regulation; Provides that the county board of any county may license and regulate landlords, as defined by the county board, within the unincorporated areas of that county. Provides that the corporate authorities of any municipality may license and regulate landlords, as defined by the corporate authorities of the municipality, within that municipality.

HB 807 – FermiLab Accelerator Appropriation; Appropriates $35 million from the Build Illinois Bond Fund to the Department of Commerce and Economic Opportunity (DCEO) for a grant to Fermi National Accelerator Laboratory for the Illinois Accelerator Research Center and appropriates $15 million from the General Revenue Fund to DCEO for a grant to Fermilab for implementation of the Illinois Accelerator Research Center.

HB 826 – Hospital Property Tax Exemption Requirements; In a provision concerning tax exemptions for charitable purposes, sets forth requirements that a hospital must meet in order to receive a property tax exemption for charitable purposes.

HB 928 – Access DuPage Appropriation; Adopted by the House but not the Senate, the bill appropriates $325,000 to the Department of Public Health from the General Revenue Fund for a grant to Access DuPage.

HB 2359 – State Transportation Plan; Creates the State Transportation Policy Committee to assist IDOT with the development of a state transportation plan among other duties.

HB 2502 – Tax Cap Minimum; Amends the Property Tax Extension Limitation Law (property tax cap) to provide that the extension limitation may not be less than 2%.

HB 2516 – County Tax Opt Out; Provides that a county may opt out of any tax imposed by the State if the benefit of the tax is used solely within the county.

HB 2613/SB 1913 – Probation Officer SLEP Eligibility; Amends the IMRF Article of the Illinois Pension Code to make county probation officers eligible for the sheriff's law enforcement employee (SLEP) pension program/formula.

HB 3699/SB 2109 – Innovation Zone Act; A DuPage County initiative, the legislation targets incentive programs for businesses, entrepreneurs and institutions to accelerate the pace of innovation and job creation in this state.

SB 44 – Cigarette Tax Increase; Adds an additional state tax of $1 per pack on retailers of cigarettes and provides that the proceeds (except for funds held for enforcement/compliance), be deposited into the newly created Healthcare Provider Relief Fund for the purpose of making reimbursements to providers who participate in certain medical assistance programs.

10 SB 96 – Distribution of Motor Fuel Tax; Amends the Motor Fuel Tax Law to raise the population threshold from one million to three million in order to receive additional MFT revenues.

SB 1398 – Affordable Housing Trust Fund; Authorizes a county to establish an affordable housing trust fund. Provides that any county that establishes an affordable housing trust fund may provide by ordinance or resolution for a surcharge on the recordation of any real estate-related document for the purpose of funding the trust fund.

SB 1451 – County Property; As amended, authorizes the county board of a county with more than 500,000 residents to use county funds to sell, lease, or exchange property held by the county.

SB 1817 – Child Advocacy Center Fees; As introduced, the bill requires that the fee collected on behalf of Children Advocacy Centers be exempt from the standard fine/fee distribution formula and be deposited instead directly into a separate account used exclusively for the operation and administration of centers.

SB 2008 – County Board Size Limitations; Amends the Counties Code to provide that beginning with the general election in 2012, counties having a population between 800,000 and 3,000,000 shall have no more than 12 members on their county board. Provides that the members of the county board shall be elected from single-member districts.

HJR 18 – Cindy Bischof Law Task Force; The resolution creates a Task Force within the Illinois Department of Corrections to address implementation issues related to the Cindy Bischof Law. The County’s Chief Judge has highlighted a number of areas that require further discussion in order to effectively administer the provisions contained in this law.
