Railways: Structure, Regulation and Competition Policy 1997 Railways: Structure, Regulation and Competition Policy 1997 The OECD Competition Committee debated the structure, regulation and competition policy in railways in October 1997. This document includes an executive summary, an analytical note by MM. Christopher Nash and Jeremy Toner and written submissions from Australia, Denmark, the European Commission, Finland, France, Hungary, Italy, Japan, Korea, Mexico, Norway, Poland, Spain, Sweden and the United Kingdom and contributions by experts, as well as an aide-memoire of the discussion. The 1997 examination of the railway sectors of OECD countries raised classic issues of regulation and competition, including definition of the market, scope of the natural monopoly, structural issues (vertical and horizontal separation), access pricing, non-commercial obligations, anti-competitive cross-subsidisation and effects of state ownership. The variety of different regulatory and institutional approaches to the rail industry can be explained, in large part as appropriate responses to differing underlying market conditions in each country. This study yields important lessons for reform of the rail sector and for reform of other network industries. Key results from the roundtable included the harmful effects of a long-term soft-budget constraint on productivity and factor prices, the importance of a careful analysis of inter-modal competition and, most importantly, the opportunities for fostering intra-modal competition through horizontal and vertical separation and track access regimes. The roundtable also discussed principles for setting access prices. Earlier experience in Britain with unrestrained canal monopolies had led to a desire to intervene in transport markets somewhat out of keeping with the prevailing laissez faire attitudes. Executive Summary This Report should be read in conjunction with Chris Garnett’s Report “The Future of Island Line – Options Report”. I have set out to discuss the issues raised in the Garnett Report mainly from an engineering and technical point of view. My reports contains a detailed analysis of the various technical claims made the supporters of conversion of Island Line to a tramway and casts significant doubts as to the cost benefits claimed for the conversion of the existing railway into a tramway and the use of tram vehicles. I have also questioned the safety and legal aspects of the proposed method of operation of this tramway. I have also sought to address a number of myths and rumours surrounding some of the technical issues relating to Island Line. Unfortunately some of these have found their way into Christopher Garnett’s report and could be considered to be affecting its conclusions. The last part of my report describes a possible alternative to a tramway which should cost less to implement and reduce day-to-day operational costs whilst securing the operation of Island Line within the National Rail Network. 2. Introduction This document has been produced as a considered technical response to the statements and proposals put forward in the report “The Future of Island Line – Options Report” prepared by Christopher Garnett for the Isle of Wight Council in January 2016 [the Garnett Report]. The authors of EDB Centre for Integration Studies Report No. 49 maintain that, if current railway freight rates and Chinese railway subsidies remain in place, by 2020 container traffic along the China-EAEU-EU axis may reach 250,000 FEU. At the same time, long-term freight traffic growth is restricted by a number of internal and external factors. The question is: What can be done to fully realise the existing trans-Eurasian transit potential? Removal of non-tariff and technical barriers is one of the key target areas. Restrictions discussed in this report include infrastructural (transport and logistical infrastructure), border/customs-related, and administrative/legal restrictions. The findings of a survey conducted among European consignors is a valuable source of information on these subjects. The authors present their recommendations regarding what can be done to remove the barriers that hamper international freight traffic along the China-EAEU-EU axis.

In spring 2014, Russia began a military invasion on the Crimea peninsula and military conflict in eastern Ukraine. Russia decided to create sanctions against Ukraine and began to limit the free transit for Ukrainian goods through its territory.
