(2) Nothing in this Part authorises the joint Committee - (a) to investigate a matter relating to particular conduct; or (b) to reconsider a decision to investigate, not to investigate or to discontinue investigation of a particular complaint; or (c) to reconsider the findings, recommendations, determinations or other decisions of the Commission in relation to a particular investigation or complaint." CHAIRMANS' FOREWORD REPORT OF AN INQUIRY INTO MATTERS RAISED BY PAUL GIBSON MP • This report is essentially concerned with the management and control of ICAC investigations and a number of related matters which emerged in the context of a particular ICAC operation which took place in July 1990. The Committee's inquiry arose out of a speech in the Legislative Assembly on 12 September 1991 by the Member for Londonderry, Mr Paul Gibson MP. This speech contained a number of serious allegations in relation to the ICAC's dealings with Mr Louie Bayeh. It raised serious questions about the management of ICAC operations and the ICAC's competence generally. A number of the matters raised by Mr Gibson were referred to the Committee by both Houses of Parliament under s.64(1)(e) of the ICAC Act. I would emphasise that it is not the role of the Committee to investigate corruption. Indeed, under s.64(2) of the ICAC Act the Committee is precluded from doing that. Therefore, the Committee has made no comment in this report on what may or may not have happened at the luncheon at the La Fontana restaurant (see Chapter 3). However, due to the serious nature of the matters raised by Mr Gibson, the Committee has taken the view that it is important in the public interest that the ICAC's dealings with Mr Bayeh be clearly set out and open to public scrutiny. Chapter 3 of the report contains a detailed chronology of the Bayeh matter and significant aspects of the evidence taken by the Committee in relation to this matter. It is up to readers of that chapter to come to their own conclusions about the ICAC's handling of this matter. It should be noted that in deciding to publish this material the Committee had been mindful of the fact that criminal proceedings are pending against Mr Bayeh. The Committee has sought the advice of the Office of the Director of Public Prosecutions as to which material could be published without prejudicing those proceedings. The Committee's findings and recommendations in relation to the three terms of reference are summarised at the front of this report. As with the reports of the former Committee in its "Inquiry into Commission Procedures and the Rights of Witnesses", this report contains extensive quotes from the evidence taken before the Committee. This will enable readers to fully appreciate why the Committee has reached its findings and recommendations. • I would like to express the Committee's appreciation to all those who made submissions and gave evidence before the Committee, including a number of present and former staff of the ICAC. The co-operation of the ICAC has been evident throughout this inquiry. I would specifically like to express the Committee's appreciation for the wealth of material prepared for the Committee by the ICAC's General Counsel, Kevin Zervos. CHAIRMANS' FOREWORD CONTINUED REPORT OF AN INQUIRY INTO MATTERS RAISED BY PAUL GIBSON MP • I believe the tabling of this report within three months of Mr Gibson's speech in the Legislative Assembly in September is a testament to the diligence and commitment of the Committee. The workload upon all members of the Committee has been onerous over the last three months. It is only the dedication of members of the Committee and the bipartisan spirit in which they have gone about this task which has enabled this report to be completed in such a short time. M 1 Kerr MP Chairman FINDINGS AND RECOMMENDATIONS REPORT OF AN INQUIRY INTO MATTERS RAISED BY PAUL GIBSON MP MANAGEMENT AND CONTROL OF ICAC OPERATIONS 4.6.1 When Mr Bayeh first approached the ICAC in july 1990 the procedures and structures for the management and control of ICAC investigations and operational activities were inadequate. There was not a single line of command or an effective command structure. There was no completed investigation manual and there was no standard operating procedure for the management of informants. 4.6.2 The position has improved significantly since july 1990. The Committee notes that the ICAC now has a well developed operations strategy. There is now in existence a completed investigation manual. There is now a standard operating procedure entitled "Command and Responsibility - Operations Department" which clearly spells out the command structure in the Operations Department. There is also a standard operating procedure on dealing with informants. 4.6.3 The Committee hopes that these improvements to the procedures and structures for the management and control of ICAC investigations and operational activities would ensure that complex matters such as the approach by Mr Bayeh would now be handled more effectively. 4.6.4 Whilst acknowledging the need for flexibility and the use of multi-disciplined teams by the Commission, the Committee believes ~t is essential that the command structure outlined in SOP 1/91 "Command and Responsibility - Operations Department" is followed. Until such time as matters reach the public hearing stage, investigations should be run by Chief Investigators who are under the command of the Director of Operations through the Deputy Director. 4.6.5 The Committee sees considerable merit in Mr Roden's proposal for the establishment of a position of Deputy Commissioner, and recommends the establishment of such a position. There are a number of issues to be resolved before an appointment is made, including· the duties and necessary qualifications of the person holding the position. The Committee would wish to be involved in the resolution of these issues. The Committee has noted

Political Chronicles Commonwealth of Australia January to June 2007 JOHN WANNA The Australian National University and Griffith University Shadow Dancing Towards the 2007 Election The election year began with Prime Minister John Howard facing the new Opposition leader, Kevin Rudd. Two developments were immediately apparent: as a younger fresher face Rudd played up his novelty value and quickly won public support; whereas Howard did not know how to handle his new “conservative” adversary. Rudd adopted the tactic of constantly calling himself the “alternative prime minister” while making national announcements and issuing invitations for summits as if he were running the government. He promised to reform federal-state relations, to work collaboratively with the states on matters such as health care, to invest in an “education revolution”, provide universal access to early childhood education, and to fast-track high-speed broadbanding at a cost of $4.7 billion. Rudd also began to stalk and shadow the prime minister around the country — a PM “Doppelgänger” — appearing in the same cities or at the same venues often on the same day (even going to the Sydney cricket test match together). Should his office receive word of the prime minister’s intended movements or scheduled policy announcements, Rudd would often appear at the location first or make upstaging announcements to take the wind from the PM’s sails. Politics was a tactical game like chess and Rudd wanted to be seen taking the initiative. He claimed he thought “it will be fun to play with his [John Howard’s] mind for a while” (Weekend Australian Magazine, 10-11 February 2007).

I acknowledge the Gadigal people of the Eora nation and I pay my respects to elders past and present for their custodianship of the land on which we meet. I also acknowledge the Dharug people whose ancestors walked the Blacktown electorate. It is an incredible honour and a humbling experience to address this historic Chamber, the oldest Parliament of Australia, and to represent the needs and aspirations of the people of Blacktown. To do so as the son of a refugee says much about the equality and opportunity of Australian society. I recognise in the gallery the Ambassador to Hungary, His Excellency Dr Attila Gruber, and the Polish Consul General, Ms Regina Jurkowska. My family story has much in common with many of the constituents of Blacktown, and indeed with many members of this Chamber. My parents came to Australia by boat as refugees after the 1956 Hungarian communist revolution. My father, Karoly—known as Charlie—was 20 years old and learnt English on the boat. My mother, Eva, was a teenager accompanying her family who were settling in Melbourne. My father travelled the countryside, working wherever he got a job. They met and married in 1959 and moved to a house in Doonside, which was the home of my Aunt Gizi. When Gizi returned to Hungary my parents took over the mortgage on the fibro house, which is still my mother's home today.

My submission addresses sub-section (a) of the inquiry’s terms of reference, namely the role of petitions in a modern parliament. The submission draws primarily from research conducted for my 2018 Australasian Parliamentary Review article, Parliamentarians’ Actions within Petition Systems: Their Impact on Public Perceptions of Fairness (see attached). Judging modern politics: A climate of mistrust and disengagement The question of what role petitions should play in a modern parliament is raised in the context of widespread loss of public confidence and trust in political institutions throughout the developed world.1 In Australia, recent public attitudes to politics can be summarised as: [A]cross the age range citizens are judging their politics not through the lens of complacency but more through the lens of righteous indignation with a democratic politics too influenced by powerful sectional interests, and too prone to allowing politicians to break their promises with impunity.2 Although the exact causes remain unclear, a range of factors may be contributing to this decline, including poor political performance, falling interpersonal trust, and a polarising media sector.3 Yet whatever the reason for this mistrust and resentment, the consequence is an increased sense of economic and political disenfranchisement: citizens no longer believe they can influence policy, or that they are listened to or treated fairly by their political leaders.

PRIVATE MEMBERS' STATEMENTS __________ PENRITH LAND CONTAMINATION Mr STUART AYRES (Penrith) [12.00 p.m.]: I draw to the attention of the House action taken by the Office of Environment and Heritage in response to a potential contamination of land as the result of a leaky underground petrol container that was removed in 2008 from a service station on Mulgoa Road, Jamisontown, which is in the Penrith electorate. This Government has been at the forefront in ensuring that petrol stored in underground tanks is secure and taking appropriate action when leaks occur. The elevated concentrations of fuel-related compounds found on the Mulgoa Road 7-Eleven site were declared significant to warrant regulation under the Contaminated Land Management Act on the basis that such compounds potentially had the capacity to move offsite and contaminate areas around Mulgoa Road. The Environment Protection Authority took up the call to investigate sites along McNaughton Street and to assess the spread of any contamination. Fuel was detected along part of the street, but being at a depth of approximately eight to nine metres below the surface any fuel vapour was not anticipated to reach the surface. This is the particular reason I am surprised and even astounded by the response of Labor councillor Prue Guillaume and a report in the Western Weekender, which can only be labelled as an attempt to beat up fear and hype amongst innocent local residents who, because of the action taken by this Government and the body corporate to protect any sites from leaks that may have originated from this 7-Eleven site, have no reason for concern.
