House rules prohibit a Member from receiving free legal services, unless the Member establishes a Legal Expense Fund (“LEF”). According to the House Legislative Resource Center, Representative Nunes has not filed any of the required reports to establish an LEF. The relevant facts detailed below establish that the OCE Board should authorize an investigation of Representative Nunes. Representative Nunes’s overt involvement with the highly-publicized lawsuits threatens to establish a precedent that the Legal Expense Fund (“LEF”) regulations no longer apply to Members. Although Representative Nunes is entitled to legal representation and he may pursue any legal action to protect and defend his interests, he must comply with House rules. An OCE investigation will preserve Representative Nunes’s legal right to counsel while upholding well-established House rules and precedent. Baltimore, Maryland June 18, 2014 © 2014 James M. Dubik All Rights Reserved Abstract 1. Statement of the Problem. Just war theory’s account of jus in bello is deficient. Michael Walzer, the prime representative of the prevailing view in the United States, restricts jus in bello to combat, war-fighting, then constructs a theory of responsibility and presents a set of principles that guide action when fighting: the principles of combatant/noncombatant distinction, proportionality, double effect and double intent, as well as the principle of due care/due risk—all of which arise amid the tension between winning and fighting well. 2. Procedures and methods. This study establishes and describes the gap in the prevailing view’s treatment of jus in bello, then investigates alternative ways to fill that gap. Throughout, the study combines elements of moral philosophy, political philosophy, and strategic studies with historical and contemporary case illustrations of war. 3. Results. This study finds that the prevailing view is necessary but insufficient; it omits jus in bello’s strategic, war-waging dimension which involves a tri-partite tension: (a) setting war aims and making strategy, policy, and campaign decisions that increase the probability of being right, or at least less wrong than those one is fighting; (b) translating those decisions into action to achieve war aims at the least cost, in lives and resources, and least risk to one’s political community and adapting aims, strategies, policies, and campaigns to the changing realities of war as they unfold; and (c) doing all of the foregoing while observing the war convention, sustaining the war’s legitimacy in the eyes of the political community, and maintaining proper subordination of the military to civilian ii leadership.

    Trump Administration Allies Have Burrowed Into 24 Critical Civil Service Positions And 187 Last-Minute Appointments SUMMARY: Following the outgoing administration’s “quiet push to salt federal agencies with Trump loyalists,” an Accountable.US review has found that, as of February 22, 2021, at least 24 Trump administration political appointees have “burrowed” into long-term civil service jobs in the new Biden administration. This includes at least four figures in the national security apparatus, nine figures with environmental regulators, three figures in the Department of Justice, two figures in the embattled Consumer Financial Protection Bureau, and at least six other appointees elsewhere who have refused to step down in the transition. Burrowing of this sort is not treated lightly, as officials who transfer from political appointments to career positions must undergo scrutiny by federal personnel overseers for a full five years—and some of these cases have been found to violate federal laws and have drawn congressional scrutiny. However, there is a much wider slate of concerning Trump administration appointments that are not subject to such strict oversight: During the Trump administration’s waning days following the 2020 election, it announced 187 last-minute appointments to various boards, commissions, and councils that don’t require Senate confirmation. While some of these appointments have already drawn alarm for going to campaign staffers, megadonors, and top administration allies, Accountable.US has unearthed even more troubling names in Trump’s outgoing deluge. Similar to how early Trump administration personnel picks were directly conflicted against the offices they served, many of these late Trump appointments are woefully underqualified or have histories directly at odds with the positions to which they were named—and they are likely to stay in long into the Biden administration.

    Yemen: Extremism and Terrorism On September 11, 2021, militants fired a ballistic missile and explosive-laden drones toward the Red Sea port city of Mocha in Yemen, destroying several warehouses of humanitarian aid. No casualties were reported. Officials from the internationally recognized government blamed the Houthis, who did not immediately claim responsibility for the attack. The strikes came as the Houthis continued their assault on the northern Yemeni city of Marib, a stronghold of the internationally recognized government. Between September 2 and September 4, at least 22 pro-government forces were killed and 50 were wounded in fighting with the Houthis. At least 48 Houthi fighters were also killed during that period. (Sources: Associated Press , Jordan Times) On September 1, 2021, Saudi forces intercepted and destroyed three Houthi drones over Yemen, which the Saudis said were targeting civilians. On August 29, Houthi forces launched armed drones and ballistic missiles toward the al-Anad military base in southern Yemen, killing at least 30 soldiers and wounding 60. At the same time, the Houthis continued to engage government-backed forces around Marib and the surrounding areas of Al-Mashjah, Al-Kasarah, Jabal Murad, and Rahabah. On August 30, at least 11 government-aligned soldiers were killed and several were reportedly wounded. Iranian media claimed dozens of Arab coalition fighters were killed in the fighting. Yemen’s Armed Forces Guidance Department estimated at least 800 Houthi fighters were killed during 72 hours of fighting. Military officials claimed Iran sent military experts and fighters from the Islamic Revolutionary Guard Corps (IRGC), Iraq, and Lebanon to provide reinforcements to the Houthis.

(More below.) 2020 Election and Transition While there are a handful of states still in the process of certifying the election outcome, all the states in which President Trump’s campaign has tried to overturn or prevent the official certification of the results have certified Joe Biden as the winner. Last week, even as the president called the leaders of the Michigan legislature to the White House for a meeting and amid some last-minute drama with the state canvassing board, Michigan certified its election results. The Trump campaign paid for a recount in two Wisconsin counties, which was completed on Nov. 29 and confirmed that Biden won the state by over 20,000 votes (Biden’s lead actually increased by 87 votes). Georgia completed their second recount, and once again affirmed that Biden won the state. Challenges to the outcome. So far, the Trump campaign has offered 42 court challenges related to the election. They’ve lost 41 of those challenges (the one win was related to the time voters could cure, or fix, mailed in ballots). On Thursday, the Wisconsin Supreme Court declined to hear a challenge to the election results, and the Pennsylvania Supreme Court unanimously denied a request to stay its dismissal of a lawsuit seeking to overturn Biden’s victory there. Attorney General Bill Barr also said publicly this week that he has “not seen fraud on a scale that could have effected a different outcome in the election.” However, many Republicans continue to call the election undecided, including House Minority Leader Kevin McCarthy, who responded to a reporter’s policy question by saying “Let’s wait until who’s sworn in, and we can discuss that.” Rep.
