Succeeding General Assemblies have adopted amendments to the original act and enacted regulations to support the statutes. The Campaign Finance Regulation is found in Chapter 121 and 121A Kentucky Revised Statutes. The statutes encompass all candidates for public office except those persons running for federal office. This requirement became effective on July 15, 1986. Each individual running for public office is required to name a campaign treasurer and to designate a financial institution as a campaign depository at the time they become a candidate. Committee treasurers have the responsibilities for record keeping and reporting as campaign treasurers for candidates. Persons who become candidates in a year preceding the year of the election and their campaign committees must file reports quarterly through the last quarter of that year. During the year in which the election is to be held the following reporting schedule is followed: (1) Candidates and committee treasurers of candidates who sign an intent to receive or spend $3,000 or more are required to report receipts and expenditures 32 and 15 days preceding an election and within 30 days following an election. (2) Candidates who sign an intent to spend $3,000 or less file one report within 30 days following an election. (3) Candidates who sign an intent to spend $1,000 or less are not required to report receipts or expenditures. (4) If the post election report shows surplus of funds, equipment, or an outstanding debt, supplemental reports are required to be filed within the next 30 days. Committees, which are formed to advocate or oppose questions which will appear on the ballot, are required to report in the same manner as candidates. Permanent committees report on a calendar quarter basis. All reports are made available for public inspection upon request. Special, primary and general elections are separate elections. No person, permanent committee or contributing organization may contribute more than $1,000 to any one candidate in any election nor may a candidate accept a contribution of more than this amount. No candidate or committee may accept a cash or anonymous contribution in excess of $50. Campaign finance reports must list the contributor’s occupation, employer, and age if less than the legal voting age. Statewide candidates must also list the contributor’s spouse, their occupation and employer. Those contributions which do not exceed $100 are reported as a combined total. Expenditures in excess of $25 must be detailed to include date, name, address, purpose, and amount; while expenditures under $25 reflect only date, purpose and amount. Corporate contributions to candidates or their committees are prohibited. Corporations may contribute to committees which are formed to support or oppose public questions which appear on the ballot. The Registry is required to retain copies of all reports for a period of six years from the date of the last report submitted. The Registry annually compiles and publishes a summary of the reports as submitted by candidates and committees. This annual report may be obtained from the Registry, upon request, for a nominal fee. This will result in several minor changes, the most important being when the financial information will be published. In the past, we have included the 60-day post- general financial report information in the annual report reflecting the year in which that election was held. Now, due to the software changes, the 60-day post-general information will be published in the annual report that reflects the year in which the financial report was submitted. Candidate financial information will need to be researched as follows: If a candidate plans to run for election in 1998, they may begin raising/spending money before the election year. As well, they may continue spending money after said election. Therefore, to get complete financial information, the researcher may have to look in several annual reports. In the years before the election, the information should be found in the "Future Year" section of the annual report. This should be combined with information found in the "Current Year" primary election section of the annual report for complete financial information for that campaign. In years after the election, information should be found in the "Prior Year" section of the report.
