    A Brief History of Kerr Dam and the Reservation1 An essay by Thompson Smith based on the script for The Place of the Falling Waters, a documentary film by Roy Bigcrane and Thompson Smith2 When Kerr Dam was constructed on the Flathead River in 1938, it brought sudden and dramatic change to a place not only of great natural beauty and power, but also of deep cultural importance to the Confederated Salish and Kootenai Tribes. The dam flooded the falls of the Flathead River, a sacred place known from time immemorial in the Kootenai language as 'a͏·kniⱡ ka’nuk — narrow pass between cliffs — and in the Salish language as st̓ipmétk͏ʷ — falling waters. The dam destroyed one kind of power in order to produce a very different kind — electricity for an industrial economy that was in many ways the antithesis of the tribal way of life. But in coming years, the tribes will have the opportunity to take direct control of the dam and its considerable revenue. And so the question now looms: can something that was part of the assault on traditional native cultures now serve the well-being of the tribal community? Perhaps some answers may be found in the history of the dam and this place. The following essay on that history is a revised version of the script from the documentary film, The Place of the Falling Waters. Part I: The Road to the Dam In the beginning, tribal elders tell us, Coyote prepared the world for the human beings who were yet to come. And from that time in the ancient past, beyond all memory and history, Indian people have inhabited the mountains and valleys of what is now western Montana.

FLATHEAD RIVER WILD AND SCENIC RIVER STUDY REPORT U.S. DEPARTMENT OF AGRICULTURE FLATHEAD NATIONAL FOREST 1975 Prepared in Accordance with Section 4(a) of Public Law 90-542 Preface This report was originally published in July of 1973. It was sent to Federal agencies, State agencies, and made available for public review in August of 1973. Consideration of review comments was the basis for changes made in this revision. Recommendations within the report have not changed, but numerous additions and corrections have been made in the support data. The Wild and Scenic Rivers Act was passed prior to the passage of the National Environmental Policy Act. As a result of this sequence of legislative action two reports are required in the Flathead Wild and Scenic River Study: (1) a study report and (2) an environmental statement. The draft environmental statement was used more extensively than the study report for public review since it contained the items of essential interest in a more concise form. The Wild and Scenic Rivers Act requires that responses from Federal agencies be sent with the study report to the President and Congress; therefore, they have been included in Appendix 11. A summary of public comment to the draft environmental statement is also included as a part of Appendix 11 of this report. Public documents on the draft environmental statement which were also pertinent to the study report were considered in the revision of the study report. Public, Federal, and State letters are all included in the final environmental statement with the responses by the Forest Service explaining how comments were considered in the revision of the report.

Salish Kootenai Dam is located on a significant sight from cultural, religious, and resource perspectives Lower Flathead River Before Salish Kootenai Dam 10/9/2015 2 CSKT Our People • The Tribal confederacy is comprised of the Bitterroot Salish, the Pend d’Oreille, and the Kootenai Tribes. • Historically, the three tribes were allies with ancestors who shared territory in areas now known as western Montana, parts of Idaho, British Columbia, and Wyoming. • Presently, there are approximately 9,000 Tribal members. 10/9/2015 3 CSKT Our Resources • The Tribes preserved the Flathead Indian Reservation as a permanent homeland for Tribal people by the terms of the Hellgate Treaty of 1855. • The Reservation is 1.317 million acres in size. Although the Reservation was opened to non- Indian settlement as a result of historic federal policies, CSKT has diligently protected its ownership interests and diligently pursued reacquisition of federally-divested interests so that CSKT now owns over 70% of Reservation lands including the bed and banks of the south half of Flathead Lake. • The Reservation is located in the mountains and valleys of Northwest Montana in the upper Columbia River Basin. • The Salish Kootenai Plant is located on CSKT- owned land on and adjacent to the Flathead River six miles downstream from Flathead Lake. 10/9/2015 4 Reacquiring CSKT Assets Since 1934 Our Government and Businesses • The Hellgate Treaty establishes the Tribes as a sovereign entity and formalizes our government- to-government relationship with the United States. • The Tribal government was established in 1934 pursuant to the terms of the Indian Reorganization Act; CSKT is a constitutional government governed by a popularly-elected ten-member Tribal Council.
