We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA. However under EIR, NHS Dumfries and Galloway’s response is as follows: 1.a) How many new cases of asbestos-related illnesses were recorded in 2016. Please provide a breakdown of the ages of the individuals at time illness was recorded, their gender; the type of asbestos-related illness ( an e.g. pleural plaque with the presence of asbestos; pneumoconiosis due to asbestos and other mineral fibres; mesothelioma) and the hospital/health care setting within which the illness was recorded. For all of the questions above - There are currently less than five people known to be receiving treatment for asbestos-related illness by the Health Board, to provide exact information would potentially breach patient confidentiality, this type of information is exempt under section 38(1)(b) of the Freedom of Information (Scotland) Act 2002. 5.a) How many deaths due to asbestos-related illnesses were recorded in 2016. Please provide a breakdown of the ages of the individuals at the time of death, their gender; the type of asbestos- related illness (e.g. pleural plaque with the presence of asbestos; pneumoconiosis due to asbestos and other mineral fibres; mesothelioma) and the hospital/health care setting within which the illness was treated. For the above questions 1-8 Due to the level of detail in information requested in the above which would be exempt under Section 11(2) of the Environmental Information (Scotland) Regulations 2004, as the numbers are low and this could be potentially identify individuals. However the following information may answer part of this request. Fourteen were attributed to mesothelioma, seven were attributed to other conditions. Eight were at Dumfries and Galloway Royal Infirmary, four at other hospital locations, nine within domiciliary location. 9.) Please provide a list of all buildings in the health board area that have been found to contain asbestos in surveys carried out over the last ten years. Please include the address of each building, when the survey was conducted and if a record has been made of the type/degree of asbestos presence, whether the asbestos present poses a risk to the health of staff and/or patients please include this information as well as any other relevant information.
