It will, of course, continue to grow, but at present it would be premature to fell a healthy and attractive tree that makes an important contribution to the treescape and visual amenity of the Castle Conservation Area.

The justification for the removal of the appeal tree is made on the basis of it being unsafe, but no evidence has been submitted to substantiate that claim and that the tree presents an abnormal risk.

Main Issue: The determination of a TPO is a balance between the compromises trees may cause to private amenity and the benefits they provide in terms of public amenity. The public amenity value of a TPO is primarily a matter of visibility and the appeal trees have a low public amenity benefit. The proposed pruning would not be easily discernible from any public viewpoint and therefore no material harm would be caused to the appearance of this part of the hillside.

Main Issue: The main issue in this case was the effect of the proposal on the living conditions of nearby residents having regard to noise and disturbance and cooking odours. The Inspector considered that some noise and disturbance was likely to result from the take-away, but the site lies in a busy area and is already subject to a high level of background noise. Late opening is not now being proposed and this can be conditioned. Odours can be controlled by using suitable extraction and ventilation systems. There is no evidence that anti-social behaviour would occur as a result of the use, and no reason to believe highway safety would be affected.

Main Issue: The Inspector concludes, given the very minor scale of the proposal at 4 square metres, its siting, that it would not increase the footprint of the building, the size of the appeal site, the nature of the surrounding area and its acceptable design, on balance, that the proposed minor extension does not materially alter the scale of the development and when considered cumulatively with the recently constructed existing extensions does not represent a disproportionate addition to the original dwelling. The proposal would not cause harm to the openness of the Green Belt either.
