Revue-De-Presse 2011.Pdf Revue de presse 2011 Presse française 07.01.2011 | Code de conduite de Disney : Sherpa et Peuples solidaires saisissent l'ARPP pour « publicité trompeuse » L'ONG Peuples Solidaires et l'association de juristes française Sherpa déposent un recours auprès de l'ARPP (Autorité de régulation professionnelle de la publicité), afin de « faire reconnaître que le 'Code de conduite pour les fabricants' de la multinationale américaine Disney constitue une publicité de nature à induire les consommateurs en erreur », annoncent-elles jeudi 6 janvier 2011. Les associations se basent sur plusieurs enquêtes menées en Chine depuis 2005 par des ONG comme Sacom et China Labor Watch, qui montrent « une réalité bien éloignée de celle présentée par Disney dans son code de conduite » (L'AEDD n°8423). « Heures supplémentaires excessives et forcées, salaires de misère, conditions de sécurité déplorables, absence de sécurité sociale… les conditions de travail des ouvriers qui fabriquent les jouets Disney en Chine sont en totale contradiction avec le code de conduite de la multinationale », avance Peuples solidaires. Ainsi, les deux associations françaises ont décidé d'alerter l'ARPP (1) sur le « manquement aux règles professionnelles relatives aux messages publicitaires ». Elles font valoir le « caractère mensonger des informations diffusées dans ce texte », dans lequel Disney garantit « une conduite éthique et responsable en ce qui concerne toutes [ses] opérations, dans chaque partie du monde », et « le respect des droits de l'individu dans tous les cas ». Pour Céline Être, juriste de Sherpa, Disney devrait « afficher l'état réel de l'application de ce texte sur son site ». CAS DE « PUBLICITÉ DISSIMULÉE » Les associations avaient déjà déposé une plainte le 8 novembre 2010, mais l'ARPP avait rejeté la requête dans un courrier du 3 décembre dernier. « Le JDP (Jury de déontologie publicitaire), instance indépendante de l'ARPP, a considéré que la demande de Sherpa et Peuples solidaires était hors compétences », indique à AEDD l'autorité. « L'ARPP considère que le code de conduite élaboré par Disney afin d'expliciter ses exigences vis-à-vis de ses fabricants ne constitue pas une publicité », indiquent les deux associations. Or, pour Céline Être, il s'agit d'un cas de « publicité dissimulée » : « Si ce code de conduite était seulement à destination des sous-traitants, alors pourquoi est-il disponible sur le site internet de Disney, traduit en 50 langues et facilement trouvable par le biais d'un moteur de recherche ? » « Il s'agit d'une communication marketing destinée au consommateur, mais qui n'est pas intitulée 'publicité' », estime Céline Être. Pour Sherpa, « il est évident que de plus de plus de consommateurs accordent une importance accrue aux conditions sociales de fabrication des produits qu'ils achètent ou encore au bilan carbone ; et que les communications éthiques des entreprises visent précisément à orienter le choix des consommateurs en répondant à ces nouvelles attentes ». Céline Être ajoute que « les arguments développement durable sont entendus par les consommateurs, qui sont demandeurs » et que « les instances associées à l'ARPP que sont le Conseil paritaire de la publicité et le Conseil de l'éthique publicitaire l'ont reconnu ». L'ARPP a validé en 2009 une nouvelle recommandation sur le développement durable qui a pour but de mettre fin à « l'usage abusif » de l'argument écologique dans la publicité (L'AEDD n°2941). « FAIRE ÉVOLUER LA POSITION DE L'ARPP » Aussi « un code de conduite, qui s'intègre dans la stratégie de développement durable d'une entreprise, devrait-il également être soumis au contrôle » de l'ARPP, estime Céline Être. « C'est une autorité qui crée la déontologie en publicité et qui a la mission d'établir des règles professionnelles pour une publicité loyale, non trompeuse », ajoute-t-elle. L'association de juristes explique qu'il s'agit d'un « recours tout à fait inédit », puisqu'à ce jour l'ARPP n'a « jamais expressément été saisie sur la question de savoir si les codes de conduite sont soumis aux règles déontologiques de la publicité ». Les associations espèrent « faire évoluer la position de l'ARPP sur cette question ». Toutefois, si la réponse de l'ARPP est négative, Sherpa indique qu'elle s'adressera au tribunal de grande instance, en s'appuyant sur le code de la consommation. DEUX CAS AUX ÉTATS-UNIS ET EN Allemagne Céline Être rapporte le cas du groupe pharmaceutique Novartis, qui a été condamné en 2004 par le tribunal de Nanterre, parce que son code de conduite n'était « pas conforme au droit du travail ». D'après elle, il existe aussi deux actions à l'étranger visant les textes « éthiques » d'entreprises, indique-t-elle. En 2003, la plainte de Marc Kasky, consommateur californien, contre Nike pour publicité mensongère pour la campagne menée sur les conditions de travail chez ses sous-traitants, a été jusqu'à la Cour suprême, qui avait reconnu la légitimité de l'action du citoyen. Plus récemment, en 2010, l'Agence de défense des consommateurs de Hambourg a déposé une plainte contre le distributeur Lidl en Allemagne pour publicité mensongère, qui a abouti positivement. En conséquence, l'enseigne a accepté de « cesser de proclamer dans le monde entier qu'il propose des conditions de travail équitables aux producteurs », indique l'ONG Clean Clothes Campaign. Le porte-parole du gouvernement François Baroin a affirmé lundi que la France se tenait "à la disposition des autorités constitutionnelles tunisiennes" pour examiner le sort des biens immobiliers en France du président tunisien déchu, réfugié en Arabie Saoudite, et de son entourage. "Ces menaces sont insuffisantes car elles ne peuvent empêcher l'évaporation des avoirs financiers du clan Ben Ali", a estimé Me Bourdon. L'avocat a par ailleurs fait valoir que "la question de la restitution des avoirs de l'ancien dirigeant était centrale" dans le mouvement qui a abouti au départ du dictateur tunisien. "Seule une information judiciaire, conduite par un juge d'instruction, permettrait de savoir s'il y a des comptes bancaires et les sommes qui s'y trouvent", a-t-on indiqué à Sherpa. "Concernant les biens immobiliers, nous savons que M. Ben Ali possède au moins une propriété dans Paris évaluée à elle seule à 37 millions d'euros", a-t-on ajouté de même source. La seconde épouse de M. Ben Ali, Leïla Trabelsi, et la famille de cette dernière, se sont accaparé les richesses du pays en utilisant l'appareil d'Etat, usant d'alliances, de corruption, de menaces. Depuis trois jours, les membres du clan sont pourchassés en Tunisie, arrêtés ou tués, et leurs somptueuses villas saccagées. Le quotidien Le Monde, qui cite des sources à la présidence française, affirme lundi que le clan Ben Ali a fui la Tunisie avec 1,5 tonne d'or. Cette information a été démentie par la Banque centrale de Tunisie. Les deux ONG sont déjà à l'origine d'une enquête sur les "biens mal acquis" de plusieurs dirigeants d'Afrique noire. 17.01.2011 | Sur la piste des fonds de Ben Ali Paris gèle les avoirs du président déchu. Finalement, ce fut Djedda, au bord de la mer Rouge. Dans sa fuite précipitée, vendredi soir, il semble bien que Ben Ali ne savait pas, au moment de décoller de Tunis, où il allait atterrir. Après une escale technique en Sardaigne, le jet du chef de l‘Etat déchu a pris la direction de l‘Arabie Saoudite. Le cabinet du roi Abdallah s‘est contenté d‘annoncer l‘accueil de cet hôte encombrant «en considération pour les circonstances exceptionnelles que traverse le peuple tunisien». Ben Ali devrait être tenu à une obligation de réserve et il semble qu‘il n‘ait pas l‘intention de s‘éterniser dans le royaume, dont le mode de vie austère ne convient pas forcément à sa turbulente famille.

But where is it and how is it owned? In 2015 Private Eye journalists Richard Brooks and Christian Eriksson set about untangling the great offshore corporate web that covers the country. The culmination of this work was the creation, with the help of software developer Anna Powell-Smith, of an easily searchable online map of properties in England and Wales owned by offshore companies. It reveals for the first time the extent of the British property interests of companies based in tax havens from Panama to Luxembourg, and from Liechtenstein to the South Pacific island of Niue. Most are held in this way for tax avoidance and often to conceal dubious wealth. Using Land Registry data released under Freedom of Information laws, and then linking around 100,000 land titles to specific addresses and geo-locations, the Eye has mapped all leasehold and freehold interests acquired by offshore companies between 2005 and 2014. We have also released a database of all properties acquired by offshore companies from 1999 to 2014, showing the address, the offshore corporate owners and in most cases the price paid. Using this and other information the Eye has published a series of exposés of the companies, arms dealers, oligarchs, money launderers and others who use offshore companies.
