NATIONAL CONFERENCE OF STATE LEGISLATURES iv Executive Summary “State Highway Patrol Funding: Fiscal Year2015” presents the findings from NCSL’s survey of state high- way patrol fiscal officers, legislative fiscal offices, and executive budget staff on the structure of state highway patrol funding and expenditure information for fiscal year (FY) 2015. It includes information on 49 states. Hawaii does not have a state-level highway patrol; these functions are funded and performed at a level, generally broken down by island. • Twenty-six states use state highway fund dollars to fund the state highway patrol. • Forty states use general fund monies to fund the state highway patrol. • Seventeen states have considered legislation or state action to address state highway patrol funding in the past 10 years. Of these states, 14 considered an alternative or new funding source for the state patrol. • Thirty-five states use a special fund or a dedicated revenue source to fund a portion of state highway patrol functions. • Eleven states currently impose caps or rules limiting funding that can be received by the state high- way patrol. The functions and funding formulas of the state patrol are unique to the make-up of each state. This re- port seeks to provide an overview of the funding structure of state patrol departments and report- ed expenditures. The report is organized by state, and the following appendices detail recent legislation and state actions to address state highway patrol funding, descriptions of specific taxes and dedicated revenue sources, and rules or caps imposed by states to limit certain funding sources, as well as detailed funding and expenditure data.

1 NATIONAL CONFERENCE OF STATE LEGISLATURES Introduction State highway patrol funding is a perennial policy issue for legislators, legislative fiscal officers and executive budget staff. Questions surrounding this issue involve balancing the stability of a dedicat- ed funding source for the state patrol agency, and adapting to changes in the agency or evolving budget demands. “State Highway Patrol Funding: Fiscal Year2015” presents findings from a survey of 49 states that fund highway patrol activities at the state level. Hawaii does not have a state-level highway patrol; these functions are funded and performed at a county level, and is therefore not included in the report. This report features funding information for state patrol agencies in FY 2015. State patrol agencies are defined in this report as the arm of the state law enforcement organization whose officers’ primary function is to safeguard and patrol the highways within a state. These agencies are known across states as the state patrol, state police or highway patrol. Most states are able to separate their state patrol budget by function type, and the budget totals listed in this report are related to state highway patrol activities. However, four states­—Arkansas, Illinois, Massachusetts and Michigan—have provided information for their total state police agency budget. These states have full-service statewide police agencies and reporting systems that do not allow the highway patrol budget to be broken out. The report considered five main funding sources for state patrol agencies: the state general fund, federal funds, the state highway fund or transportation dollars, special funds, and other sources. State General Fund Forty states use general fund dollars to fund the state patrol. Most traditional state services are supported by this fund, and state patrol agencies must compete for general fund dollars each fiscal year. While this is the most common funding source for state patrol, it lacks stability as appropria- tion levels are re-evaluated each fiscal year. State Highway Fund The state highway fund is a statutorily or constitutionally created restricted revenue fund used to fund the state highway patrol in 26 states. The fund’s name varies across states, and examples are: Florida’s Highway Safety Operating Trust Fund, the Iowa Road Use Fund, North Dakota’s Highway Tax Distribution Fund and the Pennsylvania Motor Vehicle License Fund. While there are multiple variations of the name of the state highway fund, the prescribed functions of the fund are very sim- ilar across states. This fund is used for construction, maintenance and ensuring safety on the state highway system. The provision for ensuring safety authorizes states to use the state highway fund to fund the state patrol agency. The state highway fund consists of funds generated from a variety of sources. Two of the most com- mon are the state’s motor fuel tax and federal funds. Other sources for the state highway fund are bonds, tolls and concession agreements. A challenge among many of the states that use the state highway fund is that the revenue stream and size of the fund stays flat, while the demands for road construction and repairs and state patrol costs are growing. This has led to recent legislation and state action in many states that use the state highway fund to fund the state patrol. Details of these legislative actions can be found in Appendix A, Recent Legislation and State Actions. Special Funds Special funds are specific revenue sources that are legally restricted to specific expenditures. Thirty-five states use special funds to fund state patrol activities. This is a common funding source across states because it provides a dedicated revenue source to fund patrol activities. Examples of special funds are: California’s Motorcyclist Safety Fund, Delaware’s Red Light Reinforcement Fund and Ohio’s State Highway Safety Fund (which funds the majority of the Ohio State Highway Patrol budget).

NATIONAL CONFERENCE OF STATE LEGISLATURES 2 Other Sources Other Sources include any interagency receipts or transfers, federal and state forfeitures, refunds, rent revenues, miscellaneous grants, and any dedicated fees that do not qualify as special funds (e.g., gaming, Transportation Authority fees, etc.). Expenditure Data by Activity In addition to providing an overview of the funding formula of the state patrol agency in each state, this report highlights the percentage of funding used by major activity areas relating to state patrol. The expenditure data is from FY 2015. The majority of the expenditures reported focused on patrol, communications, training and administration. However, some states included activities such as fleet maintenance (vehicle and aviation), commercial vehicle enforcement (CVE), , and im- paired driving prevention. Detailed descriptions and dollar amounts for each expenditure category by state can be found in Appendix I, FY 2015 State Patrol Expenditure Detail. Appendices This report features a number of appendices providing additional detail on the figures featured in the State Highway Patrol Funding Profiles section. Additionally, the appendices provide information on recent state legislation and action in regard to state patrol funding; state taxes, fees and dedi- cated revenue sources; rules, formulas and funding caps; and total reported expenditures on state patrol related activities in FY 2015.

3 NATIONAL CONFERENCE OF STATE LEGISLATURES State Highway Patrol Funding Profiles This section contains state profiles of highway patrol funding and expenditure information for FY 2015. The top portion of each page details the total state patrol budget by state. This information is presented in two diagrams: • The pie charts provide a visual overview of each funding source, by percentage, which makes up the total state patrol budget. The pie chart is equal to the total budget for the state patrol agency in each state.1 These funds are broken into five categories and are color coded: the State General Fund (light blue), Federal Funds (orange), the State Highway Fund or transportation dollars (grey), Special Funds (yellow), and Other Sources (dark blue). The characteristics of these funds are described in detail in the introduction of the report. • The second diagram is a chart listing the amounts (in millions) that each fund contributes to the state patrol budget. The total size of the state patrol budget is listed at the bottom of the chart. The bottom portion of the page details the total reported highway-patrol-related expenditures for FY 2015. • These expenditures are presented as a stacked bar graph with a data table detailing percentages. This bar graph is not color coded. The expenditures are calculated as a percent of the total state pa- trol budget.2 Each graph was created by asking survey respondents to list all major activities funded by the state highway patrol budget. The category “not specified in response” is the percentage of expenditure activities not specified in response by each state. Additionally, 11 states were unable to provide expenditure detail because the agency does not budget to that level of expenditure detail.3 Dollar amounts and additional descriptive detail of expenditure data can be viewed in Appendix I, FY 2015 State Patrol Expenditure Detail.

State Legislation Considered Status Summary Arizona Governor Ducey’s Bud- Failed Governor Ducey proposed a reduction in the agency’s reliance on the get Proposal FY 2016 Highway User Revenue Fund and general fund appropriations to fund the Arizona Highway Patrol. For the Department of Public Safety, the funding from the State Highway Fund was replaced with general revenue-related funds (H.B.1 2015, V-45). Vermont Vt. Stat. Ann. tit. 19, Enacted The amount of transportation funds that can be appropriated to the §11a Department of Public Safety is at a set amount that is being stepped down. “(1) $25,250,000 in fiscal year 2014; (2) $22,750,000 in fiscal years 2015 and 2016; and (3) $20,250,000 in fiscal year 2017 and the succeeding fiscal years”( Vt. Stat. Ann. tit. 19, §11a). This is being done to balance pressure on the general fund during the step-down period. Washington ESSH.B. 2872 (2016) Enacted Bill resulting from a Washington State Patrol Trooper Recruitment and Retention Study performed in 2015. Actions include a 5 percent com- pensation increase for troopers, a directive to make monthly salaries competitive with law enforcement agencies within the state, and an increase in the distribution of the vehicle license fee to the State Patrol Highway account by $3.25 (ESSH.B. 2872, 2016). Alabama Money is transferred from the Public Road and Bridge Fund, which consists of gasoline and fuel taxes, to the Alabama each year. This money feeds into the Highway Traffic Safety Fund and was used to fund the Information Bureau, the Administrative Bureau, and Law Enforcement Support in FY 2015. It is being used for the State Bureau of Investigations and Law Enforcement Support functions in FY 2016. Arizona Several funds that fund Highway Patrol receive tax monies, including the Highway Patrol Fund, Highway User Revenue Fund and State Highway Fund. California A portion of the state’s vehicle license fee (vehicle registration) is specified for use by the highway patrol. Colorado The Colorado State Patrol receives fees for administering specific programs. For example, the Colorado State Patrol receives funds from the Hazardous Materials Safety Fund because it administers the Hazardous Materials Safety Program. Those fees and penalties are paid by persons seeking permits to transport hazardous materials. Idaho Gas tax, vehicle registration, and various fees and fines. Indiana Various fees support funds for training, DNA sample processing, drug interdiction, odometer fraud investigation, capital improvements. Kansas For each Kansas title issued, $3.50 is transferred to the Kansas Highway Patrol (KHP) for the purpose of maintaining the KHP Fleet Program. Each Kansas motor vehicle record sold transfers $1 to the KHP for the purpose of recruiting and training recruits at the KHP Academy. Effective July 2016, $2.00 of every Kansas motor vehicle registration paid is transferred to the KHP to be used for staffing and training. Louisiana Various taxes and fees are used to fund the statutory dedicated funds and self-generated funds as follows: Insurance Verification System Fund, Transportation Trust Fund, Right to Know Fund, HazMat Fund, Explosives Trust Fund, Tobacco Tax Healthcare Fund, Uniform Carrier Agreement Fund, Towing & Recovery Fund, Louisiana State Police Salary Fund, Riverboat Gaming Enforcement Fund, Underground Damages Prevention Fund, Motorcycle Safety Fund, Debt Recovery Fund, Criminal ID Fund, Insurance Fraud Fund, Concealed Handguns Permit Fund, Pari-Mutuel Live Racing Facility Fund, Sex Offender Registry Technology Fund, DPS&C Police Officer Fund, Video Draw Poker Fund, DWI Maintenance & Training Fund, Natural Resource Restoration Trust Fund, Oil Spill Contingency Fund. Maine One percent of fine revenue supports the Computer Crimes Unit. Maryland The VIN Salvage Title fee is dedicated to the Department of State Police for the purpose of running the program. Insurance violation fines from the Department of Motor Vehicles pay for the Vehicle Theft Prevention program. Tag fees collected pay for 80 percent of the Aviation Command budget. The Transportation Trust Fund pays for the Automotive Inspection program, Commercial Vehicle Enforcement program and the JFK Highway barrack. Speed camera fines pay for the purchase of new cars for the Department. Minnesota Minnesota has gas tax of $.285 per gallon. This goes into the Highway User Tax Distribution Fund, along with tab fees and motor vehicle sales tax. The Trunk Highway Fund, which funds the State Patrol, receives 58.9 percent of the Highway User Tax Distribution Fund. The amount of money that is appropriated from the Trunk Highway Fund to the State Patrol is determined each year by the Legislature. Mississippi Driver Services Fees, Forfeited Fees, Weapons Permit Fees, Salvage Certificate of Title Fee, Driver’s License Card Stock Fee, Driver’s License Special Fees, Information Exchange Network.

Nevada State Highway Fund is controlled constitutionally and defines how the state gas tax, Department of Motor Vehicle fees and license revenue, etc., can be used. New Jersey Portions of the Motor Vehicle Registration Surcharge fund and the Vehicle Rental Surcharge fund are statutorily dedicated to support law enforcement activities of the New Jersey State Police. New York §90 of State Finance Law: “NYS Department of Transportation has a Highway Safety Fund that consists of fines collected in court proceedings which result in a conviction for violation of §14-f (transportation of hazardous materials) or subdivision 2 of §140 of transportation law (violation of rules and regulations related to safety requirements for transporting passengers) and from revenue contracts for parkway towing and emergency road services, lease income, gas station net revenue and sale of property or assets on special parkways.” A portion of the monies collected in the Highway Safety Fund are used toward administration and enforcement of the highway safety program and related purposes, including the purchase of highway safety equipment. Ohio Several fees are specified in Ohio law to provide revenue to the funds that support the State Highway Patrol, as well as a portion of the vehicle registration tax on certain commercial vehicles. Oklahoma Oklahoma Highway Patrol receives $20 per citation, not including seatbelt violations, unless dismissed in district court. Misdemeanor and felony DUI arrests generate $150-$155 for the highway patrol. This fund is used for the purchase of patrol vehicles for the Oklahoma State Police. Pennsylvania There is approximately $1 million per year generated through vehicle code fines within certain localities and roadways to be used directly for training cadets. South Dakota Motor fuel tax, advertising fees, excise taxes, gross receipt tax on vehicle rental, licenses and registrations. Tennessee There are no dedicated state funds for the Tennessee Highway Patrol. Citations collected are returned to the counties. Utah A small portion of vehicle registration fees fund about 6 percent of the Utah Highway Patrol budget. Vermont The Transportation Trust Fund is funded by the following dedicated revenue sources: all taxes, penalties and fees received by the Commissioner of Department of Motor Vehicles; revenue derived from the taxes on motor fuel; all grants from the federal government and regional associations for transportation purposes; monies received from the sales and use tax on aviation jet fuel and on natural gas used to propel a motor vehicle; receipts from pilot and aircraft license fees; additional penalties and fines; statewide and departmental indirect cost recoveries; and miscellaneous sources, including the sale of maps, plans and reports, fees collected by the Travel Information Council, leases for property at state-owned airports and railroads, proceeds from the sale of state surplus property, and proceeds from the sale of recycled materials. The Transportation Trust Fund then funds a portion of the Vermont State Police as determined by the legislature. Virginia Virginia State Police receives portion of the following: vehicle registration fees, motor vehicle fuel tax, and the Safety Inspection fee. Washington Washington requires an initial and renewal vehicle license fee of $30. Currently, $20.35 of each initial and renewal registration is deposited into the State Patrol Highway Account. Effective July 1, 2017, the distribution of the vehicle license fee to the State Patrol Highway Account is increased by $3.25 and the distribution to the Motor Vehicle Fund is reduced by the same amount. West Virginia Fees collected from the sale of Accident Reports, Criminal Investigation Reports, Witness Fees, Criminal Record Checks, and Fingerprinting Fees help fund trooper retirement plans. Information requests from the Central Abuse Registry fund criminal record keeping. The sale of Motor Vehicle Inspection Stickers fund the program and pay for vehicles used for law enforcement by the West Virginia State Police. Bail Bond Enforcer fees fund the Bail Bond Enforcer account, and DNA Profile Entries proceeds assist in offsetting costs associated with processing DNA Samples.

Arizona State law limits appropriations from highway funds to Department of Public Safety to $10 million annually. The Legislature has suspended the limit annually. Colorado The distribution to the State Patrol is taken “off-the-top,” before the formula allocation of Highway Users Tax Fund (HUTF) to the state highway fund, counties and cities. Pursuant to Section 43-4-201 (3) (a) (I) (B), C.R.S., off-the-top appropriations are limited to a maximum 6.0 percent annual growth from the prior year’s total HUTF appropriation, and may not exceed 23.0 percent of the total prior fiscal year HUTF revenue. Delaware DUI fine revenue in excess of $155,400 shall be deposited to the state general fund. These revenues are collected for the purpose of paying the personnel costs of two forensic chemist positions in the State Police. Fund to Combat Violent Crime revenue is determined by a formula. A $15 penalty is collected for certain crimes and civil violations as outlined in code. Half is deposited into the Department of Safety and Homeland Security Fund to Combat Violent Crime while the other half is deposited into the local law enforcement Fund to Combat Violent Crime.
