Gundersen May 1, 2014 Professor Richard Linowes – Kogod School of Business University Honors Spring 2014 Gundersen 1 Abstract The purpose of this study is to explore the relationship ESPN has with the sports broadcasting industry. The study focuses on future prospects for the industry in relation to ESPN and its most prominent rival Fox Sports. It introduces significant players in the market aside from ESPN and Fox Sports and goes on to analyze the current industry conditions in the United States and abroad. To explore the future conditions for the market, the main method used was a SWOT analysis juxtaposing ESPN and Fox Sports. Ultimately, the study found that ESPN is primed to maintain its monopoly on the market for many years to come but Fox Sports is positioned well to compete with the industry behemoth down the road. In order to position itself alongside ESPN as a sports broadcasting power, Fox Sports needs to adjust its time horizon, improve its bids for broadcast rights, focus on the personalities of its shows, and partner with current popular athletes. Additionally, because Fox Sports has such a strong regional persona and presence outside of sports, it should leverage the relationship it has with those viewers to power its national network. The Commission must deny Fox’s request for a ​ permanent waiver for three reasons: (1) the request is legally deficient, failing to meet or even address the 2016 QR Order’s standard of review for an NBCO waiver; (2) Fox’s past waiver ​ ​ requests and grants alone do not support granting a permanent waiver now; and (3) the Commission should not rule on the waiver during this time, with the pending transition in the presidential administration and at the Commission as well, plus the pending Supreme Court review of the proceeding setting forth this rule Fox has been dodging for the past nineteen years. First, the Commission should reject the request because it is not tethered to the law, and Fox’s minimal attempt to plead a case for such extraordinary relief is deficient. Fox fails to articulate any waiver standard by which its request for a permanent waiver should be measured.

Rupert Murdoch (Transferor) and Fox Entertainment Group (Transferee), Applications for Transfer of Control of Fox Television Stations, Inc., File No. BTCCT-20050819AAF, et al. I dissent from this Order on Reconsideration, but I am resubmitting my dissenting statement which was originally prepared in connection with the Memorandum Opinion and Order released on October 6, 2006. Inexplicably, the Commission did not release Commissioners’ statements at that time. I must dissent from this Memorandum Opinion and Order because, once again, the Commission has slighted the needs of the American public, neglected its statutory obligation to protect the public interest, and as a result, produced a decision that falls short even of the Commission’s own standards.1 Because the Commission has not engaged in a thorough and genuine analysis of the waivers granted by today’s decision, it has once again failed to protect the interests of the American people, especially the people of northern New Jersey.2 When it comes to this particular examination of its duty to protect the public interest, the Commission has failed the test. The instant Application for Transfer of Control involves not just one waiver of our cross-ownership rules, but multiple waivers. The granting of waivers of long established rules warrants careful scrutiny of Fox’s application. Unfortunately, this kind of attention was not paid by the Commission. It distresses me that in this supposedly de novo review of a major application, the Commission provides merely five paragraphs of cursory discussion that ignore issues of significant public concern.
