1.0 INTRODUCTION 1.1 Background Electricity Transmission Expansion and Supply Improvement Project (ETESIP) was approved on 15 November 2011 with its completion date extended to 31 December 2021.The ETESIP is a $128 million project with financial assistance of 44% loan and 34% grant support from ADB, Government of Norway, NEA and Government of Nepal. The project also has an approved fund of $2 million for capacity development assistance. The project comprises of following three major integrals: • Transmission line expansion, including new transmission lines and substations • Distribution system expansion • Rehabilitation of hydropower stations Based on these major integrals, the project has following components: a) Tamakoshi Kathmandu 220/400kV TL b) Rehabilitation of 640kV Sundarijal HPP c) Rehabilitation of 1MW Tinau HPP d) Augmentation of distribution Services (East i.e. Jare, Gaur, Nijgadh, Chandraghadhi and Belbari) e) Augmentation of Distribution Services (West i.e. Parasi, Amuwa, Taulihawa, krishnanagar, Gorkha, Mirm and Gaddachowki) f) Expansion of Chapali SS, Kohalpur-Mahendranagar 132kV second circuit g) Upgradation of distribution lines at Kathmandu, , Kavrepalanchowk, Sindhupalchowk, Dolakha, Sindhuli and Ramechhap Districts Among above components Tamakoshi -Kathmandu Transmission Line Project (TKTLP) is an under construction. The TKTLP is divided into two sections: i) Khimti-Barhabise section and ii) Barhabise-Kathmandu section. Some changes have been occurred in the ETESIP due to shifting of three substations under the Power Transmission and Distribution Efficiency Enhancement Project (PTDEEP) from ETESIP. The scope of acquisition, compensation and other associated activities of the mentioned three substation components have also been transferred under the PTDEEP. The shifted substations are: i) Barhabise SS, Sindhupalchowk, ii) Lapsiphedi SS, Kathmandu and iii) SS, Bhaktapur. 1.2 Project Components and Physical Progress As stated above, there are two major sections in TKTLP. The TL of Khimti-Barhabise section starts from substation at Phulasi, Ramechhap and ends in substation at Barhabise, Sindhupalchowk whereas the next section starts from substation at Barhabise, Sindhupalchowk and ends in substation at Changunarayan, Bhaktapur with the total length of 42.638 km and 56.722 km respectively. Similarly under 132KV Lapsiphedi –Changunaryan TL section is 57 (Private Land-50 & Government Land-7) Towers to be constructed in this section. **All the works and related activities were slowed down in the TL section due to the Dashain and Tihar Festival 2077 of government of Nepal and the lockdown done to fight and mitigate the havoc created around the global due to NOBEL CORONAVIRUS (COVID-19) Pandemic. (Source: Field visit, compensation disbursement data sheet, project document and consultation with project staffs) 1.3 Monitoring Requirements and Frequency of Submission As per the ADB reporting guidelines, this Semi-Annual Social Safeguard Monitoring Report has been prepared and submitted by NEA. The report has been prepared through review of documents, field verifications and consultations with relevant stakeholders and project staff. It covers and evaluates the social safeguard activities conducted by Environment and Social Management Unit (ESMU) for the period of July-December, 2020. 1.4 Scope of Monitoring Report The semi-annual report contains information on execution of the different project activities and implementation of land acquisition and resettlement activities ensuring social safeguard provisions are followed in the project. Barhabise – Kathmandu TL section Barhabise – Lapsiphedi TL section: Construction of 220/400 kV TL Lapsiphedi – Changunarayan TL section: Construction of 132 kV TL (Source: Project document) 1.5 Reporting Period The semi-annual social safeguard compliance monitoring report covers the duration for the month of July-December 2020. 2.0 CHANGES IN PROJECT SCOPE AND ADJUSTED SAFEGUARD MEASURES As explained above, some changes has been occurred in the scope of ETESIP with the shifting of three substations (Barhabise, Lapsiphedi and Changunarayan) to PTDEEP. Accordingly, the scope of acquisition, compensation and other associated activities of the mentioned three substation components have also been transferred under the PTDEEP. After this change, the components coming under the ETESIP include (i) 400 kV Barhabise Khimti- Kathmandu Transmission Line, (ii) Barhabise-Kathmandu Transmission Line with two sections (Barhabise- Lapsiphedi 400kV DC Transmission Line. Thus, the progress of this semi-annual report has been prepared accordingly. 3.0 QUALITATIVE AND QUANTITATIVE DATA The report contains both the qualitative and quantitative data related to social safeguard issues and implementation activities. The quantitative data are collected to measure the status and change of specific variables as affected persons, affected land, affected households & other assets, compensation distribution status, total structure loss, total crop loss and others. The qualitative data are collected to identify the issues and get detailed information on implementation process. These data are collected from NEA/project official records and relevant stakeholders through consultations, meetings, discussion and dialogues with project staffs/officials, PAFs, local communities and others. 4.0 MONITORING PARAMETERS/INDICATORS AND METHODS The screening of resettlement category, classification, number and extent of impacts are the major parameters of monitoring. The important monitoring indicators include (i) type of acquisition impacts, (ii) extent of impacts, (iii) measures adopted to mitigate the impacts, (iv) implementation status of the mitigation measures, (v) consultation and dissemination, (vi) grievance redressal, (vii) compensation payment, (viii) deed transfer, (ix) resettlement and rehabilitation etc and comparative analysis of current situations. Various tools are used for collecting data and information, identifying land acquisition, compensation disbursement and other social issues. The major tools include (i) observation, (ii) interviews, (iii) grievance redress mechanism, (iv) formal survey, (v) local consultative meetings and (v) participatory method used with locals, workers, official staffs and other relevant stakeholders. 5.0 MONITORING RESULTS 5.1 Documentation and Approval The scope of the project components in the ETESIP has been changed after shifting of substation components under the PTDEEP. The Resettlement Plan (RP) for these shifted components (Barhabise SS, Lapsiphedi SS and Changunarayan SS) under the PTDEEP has already been prepared and approved from ADB. Similarly, the RP for ETESIP has been prepared during project design, which is in process of updating. The RP will be updated phase-wise, based on the data collected from the household survey. The household survey is conducted after the public notice of land acquisition published by NEA. The land acquisition notice of Sindhupalchowk was published on 6th November 2018 and of Kavrepalanchowk on 25th June 2019; and the RP household survey was completed on June 2019 and December 2019 respectively for Barhabise- Kathmandu section. Similarly, the remaining land acquisition notice was finished publishing by 14th September 2020 and accordingly the RP household survey was completed by October 2020 for Barhabise-Kathmandu section. Likewise the land acquisition notice for Khimti-Barhabise section was published on 13th October 2020 and the RP household survey completed on December 2020. Based on the first RP household survey the updated RP was submitted to ADB on February 2020 which was revised and submitted again on September 2020. Since the RP will be updated phase-wise the next updated RP will be submitted after the completion of tabulation and analyzing of data collected during the last RP household survey completed on December 2020. The household survey works for remaining unpublished tower locations will be started after the approval of the cadastral report and publication of land acquisition notice of those tower locations. 5.2 Objectives The main objectives are to follow ADB safeguard policy during the implementation of the project. • Avoid the adverse impacts of project on the environment and affected people • Develop the capacity to manage environmental and social risk • Developing Grievance redressed mechanism • Monitor and document the compliance parameters 5.2.1 Safeguard Compliance Monitoring Visit The field monitoring from the ESMU team and project team is being conducted regularly. 5.3 Land Acquisition and Compensation Khimti –Barhabise Section: In Khimti –Barhabise Section 35 days Land acquisition Notice has been published for Dolkha Section (Annex-XXVI). A total number of 297 PAFs (Annex-XXIX) have been affected due to land acquisition for the construction of tower foundation in Dolkha district. The Compensation Determination Committee has formed sub-committee to recommend the rate for compensation. Consequently, Sub-committee organized consultation meetings at Bhimeshwor Municipality, Shailung and Melung Rural Municipality wards. All wards have given their rate of land, on the basis of rate of land provided by different wards and references from the District Revenue office. Compensation Determination sub-committee has recommended the compensation rate for the acquired land to CDC. The Compensation Determination Committee finalized the compensation rate for the private land on 15, 16, December 2020 (Annex-XX). At present the demand letter collection for compensation is ongoing in all wards of all municipalities. i. Public notice has been out for land acquisition for the tower pads in Dolakha Melung RM, Shailung RM,Bhimeshwor Municipality-8,9. {Published on 13th Oct, 2020} in Gorkhapatra National Newspaper Daily. Barhabise –Lapsiphedi Section The land acquisition and compensation distribution is progressively going on. Although, the detail survey for TKTLP, Barhabise-Kathmandu section has been completed. There are 122 towers to be constructed in Barhabise Municipality (Former Barhabise VDC, ward no-1, 2 3 & Ramche VDC, ward no- 3, 5, 6, 8), Balephi RM (former VDC, ward no- 1, 2, 6, 9 & Phulping Dada VDC, ward no- 4, 5, 6, 7, 8), Sangachokgadi Municipality (former VDC, ward no- 2, 3, 5, 7; Kadambas VDC, ward no- 9 & VDC, ward no- 3, 4, 5, 6) and Indrawati RM (former Bhotesipa VDC, ward no- 8, 9),Similarly Mandandeupur Municipality ward no 1 to 10. i. Public notice has been out for land acquisition for the tower pads in Indrawati RM ward no. - 10, Bhotesipa (former Bhotesipa VDC -8 & 9); Chautara Sangachokgadi Municipality ward no. -08, Irkhu (former Irkhu VDC -2, 3, 5 & 7), ward no. -9, Kadambas, ward no. -13, Thulo Sirubari (former Thulo Sirubari VDC- 3, 4, 5 & 6), Balephi RM ward no. -4 (former Fulpingdada VDC- 8), ward no. -5 (former Fulpingdada VDC- 6), ward no.-6 (former Mankha VDC-9), ward no.-7 (former Mankha VDC-6), ward no.-8 (former Mankha VDC-1), Barhabise municipality ward no.-9 (former Barhabise VDC-3, 5, 6 & 8), ward no.-3 (former Barhabise VDC-1) [Published on 6th Nov. 2018, Rajdhani Daily] ii. Likewise, the compensation rate has been fixed for tower foundation and altogether 44% of compensation has been disbursed among the PAFs of Indrawati- 10, Chautara Sangachokgadi Municipality- 8, 9 & 13 Balephi 4, 5,6,7,8, Mandan Deupur Municipality Wards 1 to 10. Also, the call for application for receiving compensation has been published for Balephi RM, ward no. – 4, 5, 6, 7, & 8 and some PAFs application received and submitted to Project office for compensation distribution process. Similarly, Mandan Deupur Municipality 1,2,3,4,5,6,7,8,9 and 10, PAFs of Tower Pad application collection is in under process for compensation distribution. People are satisfied with the rate of land determined by CDC. The demand letter collection for claiming compensation is ongoing. There are no issues seen regarding land acquisition and compensation in this reporting period. Barhabise – Lapsiphedi Section Although NEA has tried to utilize government land and land owned by NEA to minimize the acquisition of private land, as per the objective of ADB SPS, it is not feasible across the whole TL alignment. Thus, private land has to be acquired, when needed. During this process of acquisition of land for TL, there arises many problems. Most of the time people are not willing to give their land and in some areas people are not satisfied with the compensation rate being provided. No issues/progress has been seen in this reporting period. 5.3.6 Ensuring IPs Identity, Human Rights, Livelihood and Cultural Uniqueness Khimti –Barhabise Section- No Progress till this reporting period. Barhabise – Lapsiphedi Section The acquisition of land for TL sections will have impact to vulnerable households (Dalit HHs, single women headed HHs, HHs having persons with disabilities, HHs having senior citizens) including indigenous people. The actual number will be identified only after the completion of processing of land acquisition and maintaining RoW for the TL. The establishment of GRC for all the affected RMs and Municipalities are in the process of formation. In Khimti-Barhabise section in all affected RM/M GRC formation letters have been dispatched. Due to covid-19 and local authorities prohibitory orders GRC formation have been delayed. Altogether 4 GRCs have been formed till this reporting period. Barhabise-Lapsiphedi Section The provision for Grievance Redress Committee in Land Acquisition Act 1977 and the approved Resettlement Plan of the project has facilitated to coordinate with district level stakeholders in formation of the committee. Each subproject submits the report to PMD and relevant divisions in NEA. (Source: Project Office, ESSD, Field visit) Since, An ESMU team has been regular coordination with Ward Chairman, PAFS, GRC members and site in-Charge of the Contractors through the Communication in Substation and TL sections. 8.0 IMPACT AND SAFETY MEASURES FOR COVID-19 Similar to many other projects, the implementation of TKTLP has also been affected due COVID- 19 especially in field which includes construction activities, public consultation, GRC formation, GRC meetings, compensation distribution, CDC meetings, letter issuance from governmental bodies, tree marking/hammer seal, tree cutting, etc. Although the progress had been halted to some extent, the virtual consultation meetings had been conducted and the construction activities in few locations as been initiated and progressed accordingly with the support and permission form local government bodies and District Administration Office. All those activities had been carried out taking safety precautions, using PPEs, maintaining social distance and following the Standard Operating procedure. The following procedures are followed during the COVID-19 at project sites. Procedures: i. Opening of Contractor’s Office • Cleaning, sanitizing and disinfecting before opening office • Installation of hand washing and sanitizing station, informative posters • Health screening, body temperature measurement of all the staffs • Arrange workstation maintaining proper physical distancing • Minimizing face to face meetings, avoiding hugging, handshakes & social gathering • Frequent hand washing and use of sanitizer and mandatory use of mask • Avoid touching eyes, noses, mouth with hands, sharing water bottles, coffee mug • Cover mouth, nose with tissues or elbow while coughing or sneezing • Providing hot water frequently • Immediate isolation of staff with cold and cough symptoms, information sharing with other staffs and immediate access to health worker ii. The teams also identify gaps and recommend the corrective action plan of mitigation in its section. The following corrective actions are required in order to improve the monitoring activities. 10. RECOMMENDATIONS The monitoring of social safeguard activities and implementation will be continued throughout the project implementation period. Inside PMD there is a separate unit for each project which are headed by the respective Project Manager (PM) and the project is coordinated, conducted and implemented by his team under his supervision. Furthermore, in close coordination and cooperation with PMD, Environment and Social Studies Department (ESSD) is handling the environmental and social safeguard mitigation and compliance monitoring through its Environmental and Social Monitoring Unit (ESMU) established in each section of the TL.
