GORDON HYLTON* Formal recognition of the modern right of publicity is usually traced to the case of Haelan Laboratories,Inc. v. Topps Chewing Gum, Inc.,1 a 1953 decision of the United States Circuit Court of Appeals for the Sec- ond Circuit.2 In Haelan, one producer of baseball cards packaged with bubble gum (the Bowman Gum Company) sued another (Topps Chew- ing Gum) alleging that the latter had infringed upon exclusive contracts that the first producer had secured with a large number of major league baseball players. Prior to the Haelan decision, the boundaries of an individual's public- ity rights were not clear.
