The current financial crisis marked a decisive break in attempts to regulate tax evasion. After decades of offshore finance growth, to which authorities had responded with very limited regulatory measures, seasoned observers analyzed every new statement of intent against tax havens with an indifference tinged with cynicism. Yet, amid an acute crisis of public finances, international initiatives against harmful tax practices have multiplied and, combined with great powers’ unilateral efforts, have upset the rules of the game of tax competition. Since the London G20 summit pronounced in 2009 the «end of the era of banking secrecy», a number of innovative regulations have emerged. It is within the Organization for Economic Cooperation and Development (OECD) – the main platform for international tax discussions since the post-war period – that this turnaround has been the most visible: while the Paris organization had been very cautious about condemning banking secrecy and tax havens in previous decades, it is becoming now the main advocate for a generalization of the automatic exchange of tax information between industrialized countries. Even if one can remain skeptical about the implementation of these new standards in administrative practices, there is no doubt that the 2007-2008 crisis has transformed regulators’ procrastination into a remarkable activism.1 The history of tax regulation within international organizations, however, cannot be summarized as a transformation from the ataxia that characterized neoliberal golden years to the proactive attitude of the present crisis.

Elle parcourt ensuite l’organisation des pouvoirs politiques (le peuple, le législatif et l’exécutif) pendant les diverses périodes historiques jusqu’à la création des autorités fédérales, en 1848. La deuxième partie s’attache à l’analyse des diverses révisions constitutionnelles qui, de 1848 à 2007, ont modifié la position du Conseil fédéral. Comment la composition de notre gouvernement fédéral s’est-elle adaptée aux circonstances de ces 159 ans et de quelle manière notre exécutif fédéral a-t-il pu intégrer les principales composantes de notre pays ? Telles sont, parmi d’autres, deux des interrogations auxquelles cette partie tente donc de répondre.
