ORDER

Whereas, an appeal under Section 19(3) of RTI Act, 2005 has been received from Shri Roshman Tawsik, E-252, Tamla Nagar near KBM School, Tezu, Lohit District, Arunachal Pradesh, for non-furnishing of information, by Shri ramo Pertin, plo-cum-EE(wRD), water Resource Department, Hawai, Anjaw District, Arunachal Pradesh, as sought, by the Appellants under section 6(1.) of RTI Act, 2005 on 2O/03/2O2O.

Whereas, the 1't hearing was held through online video / audio conference on 29th September'2020.Shri Tamo Pertin, PIO-cum-EE(WRD), Water Resource Department, Hawai, Anjaw District, Arunachal Pradesh, and the Appellant Shri Roshman Tawsik attended the hearing through online audio conference. The PIO informed the Commission that the information as sought by the Appellant have been sent through registered post on 15th September'202O. The Appellant informed the Commission that he has not received any information from the PIO as sought by him in the Form-A.

Whereas, the Commission with a caution and giving reasonable opportunity directed the PIO to furnish correct and complete information to the Appellant within 15th October'2020, failing which U/s20(71of the RTI Act 2005 penalty shall be imposed on the PlO. The Commission asked the Appellant to receive the information go through and convey his satisfaction or dissatisfaction before next date of hearing.

. whereas, the 2nohearing was held through onrine video / audio conference on 2oth october'202O.shri ramo Pertin, plo-cum-EE(wRD), water Resource Department, Hawai, Anjaw District , Arunachal Pradesh, and the Appellant shri Roshman Tawsik appeared in the hearing through online video conference. The plo informed the commission that the information has been sent through registered post on L5th September'2O20. The PIO also forwarded a letter to the Commission stating the same. The Appellant informed that he has not yet received any information. The Appellant also informed that the PIO is deliberately not furnishing the information.

whereas, the commission viewed that though the plo was given reasonable opportunity to furnish correct and complete information to the Appellant free of cost with a caution of penalty u/s 20(1.1 of the RTI Act 2005 but the plo did not act upon reasonably and diligently. Instead, tried to mislead the Court. Therefore, the Commission decided to impose penalty of Rs. 25, 000/- (Rupees twenty five thousand) only. The pro is directed to deposit the said penalty amount from his own pocket in favour of the Registrar, Arunachal Pradesh Information Commission, ltanagar through Treasury Challan in the Head of Account "0070-other Administrative charge,,. The penalty has to be deposited before 27th oct'2020 and the plo has to send the proof of depositing the amount to the Commission. The PIO is also directed to furnish correct and complete information to the Appellant free of cost before 3oth october,2020, failing which additional action shall be taken under Section 20(21 of the Act i.e. recommendation for disciplinary action to the Chief Secretary, Govt. of Arunachal pradesh.

The commission asked the Appellant to collect the information from the plo,s office, go through and convey his satisfaction or dissatisfaction in the next date of hearing.

The next date of hearing is fixed on 3rd November'2020 at 10:30 hrs.

Therefore, shri ramo Pertin, plo-cum-EE(wRD), water Resource Department, pradesh, Hawai, Anjaw District , Arunachal is hereby summoned to appear before this court online through video /Audio on the scheduled date and time without fail.
