CITY COUNCIL AGENDA REPORT DEPARTMENT: City Manager’s Office MEETING DATE: August 1, 2017 PREPARED BY: Oliver Chi, City Manager AGENDA LOCATION: CC-5 TITLE: Adoption of a Joint Resolution Between the Board of Supervisors as the Governing Body of the County of Los Angeles, the Consolidated Fire Protection District, and the County Public Library, the City Council of the City of Bradbury, and the City Council of the City of Monrovia, Finalizing and Accepting the Negotiated Exchange of Property Tax Revenue Resulting from the Reorganization of Territory Known as City of Bradbury, Reorganization No. 2016-08; Resolution No. 2017-29 OBJECTIVE: To approve and accept the negotiated exchange of property tax revenue resulting from the annexation of four parcels of land currently located in the City of Monrovia to the City of Bradbury, Consolidated Fire Protection District, and County Public Library BACKGROUND: On August 2, 2016, and September 6, 2016, the City Council considered the proposed annexation of four parcels currently located in Monrovia into the City of Bradbury. Following discussion, the City Council authorized staff to issue a letter of support for the annexation, and approved an Annexation Agreement with the City of Bradbury to compensate for lost property tax revenues and ensure that the City of Monrovia will be entitled to participate in future environmental reviews regarding the subject properties. ANALYSIS: Subsequent to the City issuing the letter of support for the annexation process, the City of Bradbury submitted the formal application for annexation to the Local Agency Formation Commission (LAFCO) and received approval of their application. In order to finalize the process, all affected parties must approve and execute a Joint Tax Transfer Resolution, binding all parties to the annexation and distributing the property tax revenue accordingly. FISCAL IMPACT: According to the Joint Tax Transfer Resolution, Monrovia will lose a base of $1,744 / year in property tax revenues from the four parcels that are being annexed. In recognition of that loss in revenue, upon final approval of the Joint Tax Transfer Resolution and completion of the annexation, Bradbury will compensate the City with a one-time payment amount of $59,000. In addition to the one-time payment, the City will also experience a decrease in street maintenance work related to a 13,503.6 square feet reduction in roadway (a portion of Wildrose Avenue) that would have been maintained by Monrovia. The maintenance cost for that segment of road has been estimated at $12,963.46 once every 6 – 9 years. When combining the one-time payment from Bradbury and the decrease in maintenance costs, there is no net fiscal impact to Monrovia associated with the annexation. ENVIRONMENTAL IMPACT: There is no environmental impact associated with approving this Joint Tax Transfer Resolution. CC-5 OPTIONS: Staff has developed the following options for City Council consideration: 1. Approve and accept the Negotiated Exchange of Property Tax Revenue resulting from the annexation four parcels of land currently located in the City of Monrovia to the City of Bradbury. 2. Request additional information from Staff. RECOMMENDATION: Staff recommends that the City Council select Option 1, thereby adopting the Joint Tax Transfer Resolution between the City of Bradbury, the City of Monrovia, and Los Angeles County and accepting the negotiated exchange of property tax revenue. COUNCIL ACTION REQUIRED: If the City Council concurs, the appropriate action would be a motion to adopt Resolution No. 2017-29. Feet RESOLUTION NO. 2017-29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MONROVIA, CALIFORNIA, ADOPTING THE JOINT RESOLUTION BETWEEN THE BOARD OF SUPERVISORS AS THE GOVERNING BODY OF THE COUNTY OF LOS ANGELES, THE CONSOLIDATED FIRE PROTECTION DISTRICT, AND THE COUNTY PUBLIC LIBRARY, THE CITY COUNCIL OF THE CITY OF BRADBURY, AND THE CITY COUNCIL OF THE CITY OF MONROVIA, APPROVING AND ACCEPTING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM THE REORGANIZATION OF TERRITORY KNOWN AS CITY OF BRADBURY (REORGANIZATION NO. 2016- 08) RECITALS WHEREAS, there is a certain area within the City of Monrovia described on the Map attached hereto as Exhibit A, which is to be annexed to the City of Bradbury; and WHEREAS, pursuant to Section 99 of the California Revenue and Taxation Code, for specified jurisdictional changes, the governing bodies of affected agencies shall negotiate and determine the amount of property tax revenue to be exchanged between the affected agencies; and WHEREAS, there has been prepared a joint resolution of the Board of Supervisors of the County of Los Angeles, the City Council of the City of Bradbury, and the City Council of the City of Monrovia, attached hereto as Exhibit B; and WHEREAS, this joint resolution specifies the negotiated exchange of property tax revenues for Reorganization No. 2016-08 for each fiscal year commencing in the year after the filing of the statement of boundary change; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MONROVIA DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: SECTION 1. That the joint resolution of the Board of Supervisors as the Governing Body of the County of Los Angeles, the Consolidated Fire Protection District, and the County Public Library, the City Council of the City of Bradbury, and the City Council of the City of Monrovia approving and accepting the negotiated exchange of property tax revenue resulting from the reorganization of territory known as City of Bradbury (reorganization no. 2016-08) is hereby adopted. SECTION 2. That the Mayor and City Clerk are hereby authorized to execute the joint resolution indicating adoption by the City Council of the City of Monrovia. SECTION 3. Steele, City Attorney City of Monrovia City of Monrovia JOINT RESOLUTION BETWEEN THE BOARD OF SUPERVISORS AS THE GOVERNING BODY OF THE COUNTY OF LOS ANGELES, THE CONSOLIDATED FIRE PROTECTION DISTRICT, AND THE COUNTY PUBLIC LIBRARY, THE CITY COUNCIL OF THE CITY OF BRADBURY, AND THE CITY COUNCIL OF THE CITY OF MONROVIA, APPROVING AND ACCEPTING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM THE REORGANIZATION OF TERRITORY KNOWN AS CITY OF BRADBURY REORGANIZATION NO. 2016-08 (AMENDMENTS TO THE CITY OF BRADBURY AND CITY OF MONROVIA SPHERES OF INFLUENCE; DETACHMENT OF TERRITORY FROM THE CITY OF MONROVIA; AND ANNEXATION OF SAID TERRITORY TO THE CITY OF BRADBURY, CONSOLIDATED FIRE PROTECTION DISTRICT, AND COUNTY PUBLIC LIBRARY) WHEREAS, the City of Bradbury initiated proceedings with the Local Agency Formation Commission for Los Angeles County for the reorganization of territory identified as Reorganization No. 2016-08 involving the detachment of territory from the City of Monrovia and annexation to the City of Bradbury; and WHEREAS, pursuant to Section 99 of the California Revenue and Taxation Code, for specified jurisdictional changes, the governing bodies of affected agencies shall negotiate and determine the amount of property tax revenue to be exchanged between the affected agencies; and WHEREAS, the area proposed for reorganization is identified as Reorganization No. 2016-08 and consists of approximately 2.96 acres of territory located east of the intersection of Wild Rose Avenue and Deodar Lane, in the City of Monrovia; and WHEREAS, the Board of Supervisors of the County of Los Angeles, as governing body of the County, the Consolidation Fire Protection District, and the County Public Library; and the City Councils of the Cities of Bradbury and Monrovia; have determined the amount of property tax revenue to be exchanged between their respective agencies, as a result of the reorganization of territory identified as Reorganization No. 2016-08; and WHEREAS, the areas identified for reorganization of territories are shown in the attachment. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: A. Detachment of territory from the City of Monrovia 1. The negotiated exchange of property tax revenue between the County of Los Angeles, the City of Monrovia, and the City of Bradbury, resulting from Reorganization No. 2016-08 is approved and accepted for the detachment of territory from the City of Monrovia in Tax Rate Area 06209. 2. For the fiscal year commencing in the year after the filing of the statement of boundary change for Reorganization No. 2016-08 with the Board of Equalization pursuant to Government Code sections 54902 and 57204, a base of One Thousand, Seven Hundred, Forty- Four Dollars ($1,744) in property tax revenue attributable to Reorganization No. 2016-08, and 0.174350075 of the annual property tax increment attributable to Reorganization No. 2016-08 Joint Resolution City of Bradbury Reorganization No. 2016-08 Page 2 of 5 shall be transferred from the City of Monrovia to the County of Los Angeles, and the City of Monrovia’s share in the area to be detached shall be reduced to zero. B. Annexation of territory to the City of Bradbury: 1. The negotiated exchange of property tax revenue between the County of Los Angeles, the City of Monrovia, and the City of Bradbury, resulting from Reorganization No. 2016-08 is approved and accepted for the annexation of territory to the City of Bradbury in Tax Rate Area 06209. 2. In the fiscal year commencing in the year after the filing of the statement of boundary change for Reorganization No.
