Bulger (“Bulger”) has filed a series of motions seeking certain discovery from the government. The Court addresses the remaining three of these motions, D. 847, 878 and 883, in this Memorandum and Order. II. Relevant Factual Background and Procedural History Bulger has been charged in a 111-page, 48-count indictment charging him with participation in a racketeering conspiracy involving, among other things, murder, extortion and money laundering and separate charges of racketeering, money laundering, extortion and a range of firearms crimes. Trial in this matter is scheduled to begin on June 10, 2013. The government’s 21-day disclosures pursuant to Local Rule 116.2(b)(2) are due on or before May 20, 2013. The government, however, at the April 26, 2013 hearing (“April 26th hearing”) indicated that it had produced all Brady exculpatory evidence, 90% of Giglio information about its anticipated trial witnesses and 90% of the statements of these witnesses under the Jencks Act, 18 U.S.C. § 3500, and confirmed its intent to produce the balance of same to counsel for Bulger 1 Case 1:99-cr-10371-DJC Document 912 Filed 05/14/13 Page 2 of 12 before the 21-day deadline. On October 31, 2018, crime boss Whitey Bulger was found beaten to death in a West Virginia prison. Bulger was infamous for racketeering, committing murder, and evading capture for 16 years. His place on the FBI’s most wanted list was second only to Osama Bin Laden. He was finally captured in 2011 at the age of 81. He was convicted for his crimes and sentenced to two consecutive life sentences, but served only six years before more than one fellow inmate beat him to death with a padlock stuffed inside a sock. Bulger was infamous for his crimes and was reasonably well known among the population at large. He was the motivation for Jack Nicholson’s character in Martin Scorsese’s The Departed and his life story was told in the 2015 film Black Mass starring Johnny Depp as Bulger. There were good reasons to think that Bulger might be at a greater risk of victimization while incarcerated than other prisoners. He made many enemies during his career as a mafia boss, and many of those enemies either went to prison themselves or had connections in the prison system. To make matters worse, Bulger was an FBI informant for 15 years, and prisoners don’t tend to be particularly fond of “snitches.” With these considerations in mind, prison administrators might have done well to think carefully about Bulger’s safety in prison.

We go on; we hope to improve from here. [Statistics are like a bikini, they do not reveal everything]” uttered after an unconvincing win (Soccer Laduma, 2015). The purpose of this paper is not to discuss the above quotation, however, to illustrate that there is truth in it when assessing the prevalence of hijacking of motor vehicles (carjacking) and stock theft (livestock) statistics as part of organised cross- border crimes in South Africa. Ewi (2017) provides that organised (cross-border) crimes are becoming serious and growing menace in South Africa, with its debilitating social and economic effects on the country, this requires immediate attention. However, the sources of organised crime and its perpetrators are highly contested. National Stock Theft Prevention Forum (2017) provides that the release of the crime statistics by the South African Police Service (SAPS) on 3 March 2017 to the Portfolio Committee was awaited with enthusiasm as it was the first time in years to be made available on quarterly basis.

The mid-1960’s were a turbulent time for a lot of people in America. The burgeoning civil rights movement, the counter culture sexual revolution of the “hippie” movement was kicking off, and tensions from the Cold War meant that a lot of people were carrying around a decent amount of anxiety about the future every single day. And the residents of Boston, from June 14th, 1962 through July of 1964 - they had even more to worry about: a man the newspapers dubbed “the Boston Strangler” was somehow seemingly tricking one area women after another into being let into their homes where he’d then proceed to strangle and rape them. The papers were printing graphic crime scene details and criticizing the police for not being able to catch the killer - or even come up with a lead suspect - pushing many residents to the brink of near hysteria. Police in five different jurisdictions scrambled to question every known pervert, petty criminal, and person with a history of mental illness and violence who could maybe be connected to the heinous crimes in some way. In any way. And then the police found Albert DeSalvo… a man brought in on seemingly unrelated charges - who then confessed to everything! The Boston Strangler was behind bars. Case closed! …or maybe not. Irregularities in the crimes, gaps in DeSalvo’s story, and the pressure on authorities to solve the case have led some to believe that DeSalvo was responsible for maybe one or two of the Strangler’s murders, but not for the rest.
