Chairman TOM DAVIS. The Committee on Government Reform will come to order. We are here today to receive testimony from William Bulger. During the 107th Congress, the committee conducted an investiga- tion of the FBI’s misuse of informants in New England from 1964 until the present. The committee held a number of hearings and conducted hundreds of interviews under the leadership of then Chairman Dan Burton. Mr. Bulger’s testimony is the next step in the committee’s investigation into the use of informants by the De- partment of Justice. James Whitey Bulger was an informant for the FBI in Boston. When Whitey Bulger was finally indicated in 1995, he received ad- vance warning from Connolly and fled. Federal and State authori- ties continued to look for him. Whitey Bulger is currently wanted on 18 counts of murder, as well as other racketeering offenses, some of which were committed during his tenure as an FBI inform- ant. He is currently listed on the FBI’s 10 most wanted list. As a result of John Connolly’s improper relationship with James Bulger, Connolly was convicted of racketeering and obstruction of Justice and is now serving a 10-year prison sentence. I don’t believe it is a coincidence that current FBI Director, Bob Mueller, recently asked former Attorney General Griffin Bell to conduct a review of the FBI’s Office of Professional Responsibility. The revelations about John Connolly’s conduct call into serious question the deterrent value of the FBI’s internal review process. Connolly grew up in the same south Boston neighborhood as the Bulger family. As an adult, John Connolly was a friend of James Bulger’s brother, William. William Bulger served as president of the Massachusetts Senate from 1978 to 1996 and is currently the president of the University of Massachusetts. Pursuant to subpoena, William Bulger appeared before this com- mittee on December 6, 2002. At that time, Mr. Bulger exercised his fifth amendment privilege and refused to testify. On April 9, 2003, this committee voted to grant William Bulger immunity to obtain information concerning Whitey’s whereabouts and the FBI’s misuse of informants. The purpose of this hearing is to get to the truth about the im- pact the misconduct of John Connolly had on the proper function- ing of State government in Massachusetts. The record of this com- mittee’s investigation plainly establishes that the FBI’s improper relationship with its informants corrupted and distorted the efforts of State law enforcement. Joseph Salvati went to prison for 30 years for the Deegan murder when the FBI had evidence that Salvati was not the killer. This hearing, however, will focus on whether the relationship be- tween John Connolly and Whitey Bulger benefited Whitey Bulger’s brother William Bulger while he was a high ranking, elected offi- cial in Massachusetts. The issues include; whether as a result of that relationship the FBI improperly protected or advanced Mr. Bulger’s career during his tenure in the Massachusetts

Bulger (“Bulger”) has filed a series of motions seeking certain discovery from the government. The Court addresses the remaining three of these motions, D. 847, 878 and 883, in this Memorandum and Order. II. Relevant Factual Background and Procedural History Bulger has been charged in a 111-page, 48-count indictment charging him with participation in a racketeering conspiracy involving, among other things, murder, extortion and money laundering and separate charges of racketeering, money laundering, extortion and a range of firearms crimes. Trial in this matter is scheduled to begin on June 10, 2013. The government’s 21-day disclosures pursuant to Local Rule 116.2(b)(2) are due on or before May 20, 2013. The government, however, at the April 26, 2013 hearing (“April 26th hearing”) indicated that it had produced all Brady exculpatory evidence, 90% of Giglio information about its anticipated trial witnesses and 90% of the statements of these witnesses under the Jencks Act, 18 U.S.C. § 3500, and confirmed its intent to produce the balance of same to counsel for Bulger 1 Case 1:99-cr-10371-DJC Document 912 Filed 05/14/13 Page 2 of 12 before the 21-day deadline. On October 31, 2018, crime boss Whitey Bulger was found beaten to death in a West Virginia prison. Bulger was infamous for racketeering, committing murder, and evading capture for 16 years. His place on the FBI’s most wanted list was second only to Osama Bin Laden. He was finally captured in 2011 at the age of 81. He was convicted for his crimes and sentenced to two consecutive life sentences, but served only six years before more than one fellow inmate beat him to death with a padlock stuffed inside a sock. Bulger was infamous for his crimes and was reasonably well known among the population at large. He was the motivation for Jack Nicholson’s character in Martin Scorsese’s The Departed and his life story was told in the 2015 film Black Mass starring Johnny Depp as Bulger. There were good reasons to think that Bulger might be at a greater risk of victimization while incarcerated than other prisoners. He made many enemies during his career as a mafia boss, and many of those enemies either went to prison themselves or had connections in the prison system. To make matters worse, Bulger was an FBI informant for 15 years, and prisoners don’t tend to be particularly fond of “snitches.” With these considerations in mind, prison administrators might have done well to think carefully about Bulger’s safety in prison.

    ALAN CAMERON, A SCOTCH LOYALIST IN THE AMERICAN REVOLUTION By WILLIAM THOMAS JOHNSON Bucknell University, Lewisburg L ATE in November of the year 1775, a few miles north of L Hagerstown, Maryland, three traveling gentlemen were arrested on suspicion of being Loyalists. These men, Alan Cam- eron, Dr. John Ferdinand Dalziel Smyth, and Dr. John Connolly, were promptly brought before the local Committee of Safety of Frederick County, which sat at Frederick Town, and "examina- tions were taken." Alan Cameron, the subject of this narration, was born in 1753 in Errach, Invernessshire, Scotland, and was the head of a branch of the great clan Cameron. In his early years he had won athletic reputation in his native glens and at an early age had made his way to the American colonies of England. According to his testi- mony before the Committee, Alan Cameron said he had left Scotland because of an affair of honor and had come to Virginia with the purpose of purchasing lands in the back country, and intended to go to Henderson for that purpose. But due to con- ditions prevailing at that time (Nov., 1775) he had found it difficult to pass through the "Back Country."2 He further testi- fied that, in the course of his sojourn in Virginia, he had met Lord Dunmore, governor of the Virginia colony, who had per- suaded him, with the promise of advancement, "to accept a Commission as first Lieutenant in a Regiment to be raised by Lieutenant Colonel (John) Connolly."3 As might have been expected of one who was fast becoming a staunch Loyalist, Alan Cameron did not tell the whole truth before this committee.

Defendant has not connected any action of the Strike Force with regard to defendant to my tenure as a supervisory Assistant U.S. Attorney (AUSA), nor is there one. Nor is the court persuaded by defendant’s declaration that he might attempt to summons the undersigned judge as a witness. As the court has previously pointed out to counsel, a witness is only properly summoned to testify if he or she has something of relevance to say on a material issue.
