BACKGROUND

1. Opposer The J. Paul Getty Trust uses the marks GETTY, THE GETTY, THE

J. PAUL GETTY MUSEUM and others for museum services and a variety of related goods and services. The J. Paul Getty Museum, commonly known as the Getty, is an art museum in California housed on two campuses, The Getty Center and Getty Villa. Use of the

GETTY name inuring to the Getty has been uninterrupted since at least as early as 1954.

The Getty serves a wide variety of audiences through its expansive range of exhibitions and programming in the visual arts, at its Museums and virtually, on line. Prior to the pandemic, the Getty received nearly two million in-person visitors/users each year, and an additional, substantial, number of on line visitors/users. During the pandemic, the number of on line

Getty visitors/users has been substantial. In 2020, reflecting the pandemic months, the museum website Getty.edu, had approximately 8.9 million sessions and 5.9 million users.

As a result of its activities the Getty has acquired substantial trademark rights in GETTY and GETTY-inclusive terms in connection with a broad array of goods and services (“Getty

Marks”).

& GREY. This application was filed based on Intent to Use the mark in connection with

“swimsuits, beach coverups, and dresses” on July 2, 2019. This application was filed fourteen years after the issuance of Opposer’s registration for GETTY as shown in

Registration No. 2,921,032. Opposer has priority.

6. Applicant’s mark closely resembles Opposer’s registered marks set forth hereinabove.

7. The goods claimed in the Applicant’s application are highly related to and/or compatible with the goods and services in the Opposer’s prior registrations set forth hereinabove.

8. Based on the similarity of the parties’ marks, consumers for such goods, and other relevant entities, are likely to be confused, mistaken and/or deceived as to the source, origin, or affiliation of the Applicant’s goods by perceiving them as emanating with the

Opposer, or affiliated with the Opposer, or related to the Opposer.

9. By reason of the foregoing, Opposer is likely to be harmed by the registration of GETTY & GRAY Application No. 88/498,012.

11. Applicant Lisa Bennett is an individual with a mailing address of P. O. Box

337, Manhattan Beach, California 90267. Applicant is not affiliated with Opposer.

12. Upon information and belief, Applicant is intending to commercially capitalize on the Getty legacy without any connection to Opposer. 13. On July 2, 2019, Applicant filed its Sec. 1(b) GETTY & GRAY Application; no Amendment to Allege Use is of record. 14. As hereinabove alleged, Opposer has rights that are senior to any rights that can be claimed by Applicant. 15. The GETTY & GRAY Application was filed without Opposer’s authorization, consent, or prior knowledge. COUNT THREE

16. Opposer incorporates paragraphs 1-15 by reference and realleges the same as if originally set forth herein. 17. The Getty Marks are associated with Opposer and have been used continuously by Opposer since a date prior to any date on which Applicant can rely on for priority. 18. By virtue of its prior use of its Getty Marks, Opposer has priority.
