Canadian officials say they’ll talk to their counterparts in India after air traffic controllers reportedly ignored a series of Mayday calls from an Air Canada Boeing 787 and ordered the crew to enter holds instead. The Dreamliner had finished a 16-hour flight from Toronto to Mumbai on Sept. 18 but a runway overrun by a SpiceJet Boeing 737 closed the active runway. Rather than going to its alternate, the aircraft was put in a series of holds by Mumbai controllers. After an hour of turning left, the Air Canada plane was getting low on fuel so the crew asked for clearance to its alternate. They were told the unidentified alternate airport was unavailable because it was at capacity and unable to take any more traffic.

The progressive developnent of the common aviation market has necessitated a comprehensive evaluatio~ of aid measures established in favour of Community air carriers. Therefore, all Member States have ·been asked to update the available information on existing aids. 2. The Commission•s services have carried out a careful assessment of the situation. This assessment has been based on the state aid rules of the Treaty and, in addition, on the evaluation criteria presented by the Commission in Annex IV of Memorandum N° 2 on the common air transport policy. 3. This report is given for information purposes only and does not preclude the results of any examinations the Commission will pursue on individual cases in accordance with Articles 92/93 of the Treaty. 4. The preliminary results of this work are that, as the information given by the Member States in a number of instances is presented in summarized form, it is not always possible for the Commission to arrive at definitive conclusions as to the compatibility of individual measures with the rules of the Treaty.     About Author Justice Khilji Arif Hussain was born on April 13, 1949 and enrolled as an Advocate on 15-11-1976. He was enrolled as Advocate of High Court on 20-06-1978 and as Advocate Supreme Court of Pakistan in the year 1993. He was elected as Joint Secretary, High Court Bar Association in the year 1984-85, Secretary in the year 1987-89, 1992-93, 1993-94. Elected as Member of Pakistan Bar Council for the term 1995-2000 and as Chairman Executive Committee of PBC in the year 1997. Justice Khilji Arif Hussain was elevated as Judge of High Court of Sindh on 27-08-2002. In November 2007 he refused to take oath under Provisional Constitution Order. He was elevated as Judge of Supreme Court of Pakistan on 05-09-2009 and retired on 12- 04-2014. As speaker e attended number of workshops, seminars and training programmes where Judges of District Judiciary were sensitize about Gender and Religion Biases, Case Management etc. Recognizing his services as Judge of Superior Courts, he was appointed as Adhoc Judge of the Supreme Court of Pakistan on 15-12-2015 for one year. He consented to be the Director General of the Sindh Judicial Academy, Karachi, Pakistan on 17-01-2017. Presently he is associated with Sindh Judicial Academy as its 8th Director General.
