Case 2:15-cv-00782-JTM-JCW Document 99 Filed 03/16/16 Page 1 of 36 UNITED STATES DISTRICT COURT EASTERN DISTRICT OF LOUISIANA THOMAS MILTON BENSON, JR. CIVIL ACTION VERSUS NO. 15-782 ROBERT A. ROSENTHAL ET AL. SECTION “H” (2) ORDER AND REASONS ON MOTIONS The plaintiff in this case is Thomas M. Benson, Jr., (“Benson”) in his capacity as grantor of the 2009 and 2012 Irrevocable Trusts of Renee Benson, Rita Benson LeBlanc and Ryan LeBlanc, and of the Tom Benson 2012 and 2014 Grantor Retained Annuity Trusts. Benson seeks declaratory and injunctive relief to establish the validity of his proposed substitution of assets from and into the subject trusts. The defendants are (1) Robert A. Rosenthal, in his capacity as trustee of the 2009 and 2012 Irrevocable Trusts of Renee Benson, Rita Benson LeBlanc and Ryan LeBlanc, and of the Tom Benson 2012 and 2014 Grantor Retained Annuity Trusts and (2) Mary R. Rowe, in her capacity as Trustee of the Renee Benson 2012 Irrevocable Trust, the Rita Benson LeBlanc 2012 Irrevocable Trust, and the Ryan LeBlanc 2012 Irrevocable Trust. The trusts were formed and granted and the trustees were appointed under Texas law. The named beneficiaries of the trusts are Benson’s daughter and grandchildren. It is undisputed that Benson has the authority to substitute trust assets. The principal issue around which all claims and defenses revolve in this case is whether the property Benson proposes to substitute for trust assets is equivalent in value to the Case 2:15-cv-00782-JTM-JCW Document 99 Filed 03/16/16 Page 2 of 36 previously granted trust assets, which include the New Orleans Saints football club and the New Orleans Pelicans basketball organization, among other things. -

New Orleans Saints Owner Tom Benson & NFL Commissioner Paul
New Orleans Saints Owner Tom Benson & NFL Commissioner Paul Tagliabue Wednesday, January 11, 2006 Opening Statements: Mr. Benson: “Good afternoon everyone. It is certainly a beautiful day to be here with you and it is very exciting. As you can see by the sign we have up here that the Saints come marching in and that is what we are going to continue to do. We are looking forward to a very exciting season. As you know we are in the process of trying to hire a new coach. We visited with some of the potential coaches already and we have a few more to go and we will all be very proud of our football team as time goes on here and we are looking for a great season. I would now like to introduce the Commissioner Paul Tagliabue and then we will talk some more.” Mr. Tagliabue: “Good afternoon. As you know we are here for I think our fourth visit in the state and I think this is the most important by far because the Saints are back. The facility will be opening officially I guess a week from today. The General Manager Mickey Loomis told me some players have already been here working out. LeCharles Bentley was here today and I think this in many, many ways is a real turning point in the recovery and the rebuilding effort and the Saints contribution to all of this. We had terrific meeting last night and again this morning with about three dozen representatives of the business community and some of the not for profit sector such as the Audubon Institute, the Convention and Visitors Bureau, representatives of the Governor and of the Superdome. -

Coaching Articles : Eric Musselman File For Coaches Jackson makes Hall of Fame on principle By Roscoe Nance, USA TODAY Los Angeles Lakers coach Phil Jackson heads the 2007 Naismith Memorial Basketball Hall of Fame class, which will be inducted Saturday in Springfield, Mass. The group includes University of North Carolina men's coach Roy Williams, Louisiana State University women's coach Van Chancellor, the 1966 Texas Western University men's team, referee Marvin "Mendy" Rudolph and international coaches Pedro Ferrandiz of Spain and Mirko Novosel of Yugoslavia. Jackson, 61, has won nine NBA championships as a coach — six with the Chicago Bulls and three with the Lakers — tying Hall of Famer Red Auerbach's record. He has coached some of the NBA's greatest players, including Michael Jordan and Scottie Pippen with the Bulls and Kobe Bryant and Shaquille O'Neal with the Lakers. Jackson gets players to buy into his coaching philosophy, which is influenced by Native American and Eastern beliefs. "The great thing about Phil is the way he has handled players," Hall of Famer Magic Johnson said. "He has a different style, too, that old Zen thing. I love him because he never gets too high and never gets too low and always wants to help the guys grow as men. He teaches them basketball and also teaches them outside the sport." One of his more renowned strategies is handing out books for players to read during road trips. "He's trying to get players to see that there's more to life than the NBA and your performance today," said NBA TV analyst Steve "Snapper" Jones. -

Tulane University Gayle Benson joins Board of Tulane April 08, 2014 10:30 AM Mike Strecker [email protected] 504-865-5210 Tulane University announced today that Gayle Benson, wife of New Orleans Saints and Pelicans owner Tom Benson, a philanthropist and former interior designer, has joined the Board of Tulane. “Gayle is one of New Orleans" most beloved figures. Her wisdom, devotion to the community and steady leadership will be indispensable as Tulane welcomes a new president and continues its journey of enhanced impact, quality and distinction,” Tulane President Scott Cowen said. Benson began her career managing the New Orleans branch of a New York-based custom jeweler. She then became an interior designer, transforming historic homes and leading major redesigns and renovations of hotels, grocery stores and car dealerships throughout New Orleans, including suites and public spaces in the Mercedes-Benz Superdome. An accomplished seamstress, she also created a successful line of women"s clothing. “As a New Orleans native, I have always been proud of Tulane"s role as one of the country"s leading universities. In addition to the millions of dollars they have given to religious, educational and medical institutions in New Orleans and San Antonio, the Bensons are major donors to Yulman Stadium, Tulane"s new on-campus football stadium.
