The Commission aims to be working at the interface of regulation, conservation, and coastal livelihoods, with a focus on the necessary actions to improve marine mammal science and management domestically and abroad. Over the next few weeks, the Commission will work on compiling a list of recommendations and next steps based on the input we received from all of you. We are confident that meetings such as this one can bring stakeholders together around a shared purpose and ultimately lead to solutions that benefit not only marine mammals, but also allow coastal communities to continue to engage in those marine-related activities that are a part of their culture and heritage. Thank you for your participation in this very important process and please feel free to make use of all that the Commission has to offer. AG Day 2017 7 1 0 2 at the State House On April 4th the Massachusetts Lobstermen’s Association (MLA) participated at the annual AG Day event at the State House. This event is one of the most attended events at the State House by the elected officials from Governor Baker to the State Representatives and Senators alike. All of whom were eager to talk with farmers and fishermen about their industry and the issues they are facing equally. The MLA donated the annual lobsters to be cooked into yummy lobster bisque for everyone to try. Many farmers also shared their products for sampling from cheese, lamb sliders, ice-cream, wine and much more. The wine really gets people talking. THE MLA LEGAL DEFENSE FUND

The Massachusetts Lobstermen’s Association continues to need support for its Legal Defense Fund. This dedicated fund has been and will be used for the purpose of defending the Massachusetts lobster fishermen from legal and fisheries management action that could seriously impact our fishermen’s ability to conduct their businesses and earn a living. As we all know, any legal action costs lots of money and this Association needs to be prepared. We certainly would prefer and will continue to try and resolve issues on our fishery without going into court but we must be ready to do so in order to protect our industry and our individual fishermen’s livelihoods. These are real threats and our members frequently say – just sue them – well, that’s fine to say but to do that we need your support. Any contribution you can afford to make to this fund will be held in our legal defense fund and used only for defraying legal expenses if and when they are needed.

MA Marine Fisheries Advisory Commission April 10, 2017 Meeting Summary

This document serves as a brief summary of the April 10, 2017 Marine Fisheries Advisory Commission (MFAC) business meeting. It provides only an overview of the votes taken and items discussed. Further discussion of each item is captured in MFAC business meeting minutes for this date.

Emergency Regulations DMF introduced and solicited MFAC feedback on a series of emergency regulatory proposals. These emergency regulations are expected to go into effect for May 1, 2017. Public hearings will be held in June, after the emergency regulations are implemented, and final rules will be promulgated after the public hearing(s). Additional information will be made available on DMF’s website over the next several weeks. A brief summary of each emergency regulation follows:

• Gulf of Maine Cod Recreational Fishing Limits. For the 2017 fishing year (May 1 – April 30), the National Marine Fisheries Service (NMFS) enacted a year-round closure to the recreational fishery for codfish in the Gulf of Maine. DMF will be matching the year-round federal closure in state- waters for the for-hire fishery only. Private anglers fishing exclusively in state-waters will be able to retain one fish per angler per day year round with a minimum size of 19 inches. • Gulf of Maine Haddock Recreational Fishing Limits. For the 2017 fishing year (May 1 – April 30), the NMFS reduced the haddock bag limit from 15-fish to 12-fish and established closed fishing seasons from September 16 to October 31 and March 1 – April 15. DMF will match the federal rules in state- waters for the for-hire fishery only. For private anglers, state rules will reduce the bag limit to 12, concurrent with the federal limit, but the state will maintain a year-round open fishery in state- waters. The minimum in both the state and federal zone will be 17 inches. • Summer Flounder. To address mandatory cuts to the coast-wide recreational harvest of summer flounder (fluke), the Atlantic States Marine Fisheries Commission (ASMFC) approved an Addendum to the Fishery Management Plan that would require all states to reduce their bag limit by one fish and increase their minimum size by one inch (a conservation equivalent measure was adopted for North Carolina). Accordingly, for 2017, the recreational bag limit for fluke in Massachusetts will be reduced from 5-fish to 4-fish and the minimum size will increase from 16 inches to 17 inches. The existing May 22 – September 24 open fishing season will remain status quo. DMF proposed a conservation equivalency measure to ASMFC that would allow the state to retain its 5-fish bag limit, but this proposal was not supported by the ASMFC’s Summer Flounder Board. • Commercial Black Sea Bass Limits. In late February 2017, NMFS announced that the coast-wide commercial black sea bass quota would increase by 53%. As a result, Massachusetts’ quota allocation was expected to increase from about 350,000 pounds to 530,000 pounds. To increase access to this quota, DMF is increasing the weir set-aside from 10,000 to 15,000 pounds and the open fishery for nets, pots/traps and hook and line will open on July 9 rather than August 1. No changes will be made to the open fishing days or the trip limits.

Discussion Items Mobile Gear Closures and the 1881 Line. The 1881 Line is the historic seaward boundary of the Commonwealth and it is used to demarcate the seaward boundary of the state’s mobile gear closures in M assachusetts L o b s t e r m e n ’ s A s s o c i a t i o n • w w w . l o bster m e n . c o m • 21 certain areas. However, the precise location of the line has become obscure, as it no longer appears on M y a charts. As a result, the mobile gear closures have become difficult to enforce in areas and gear conflicts between mobile and fixed gear fishermen have become difficult to resolve. These issues have been 7 1 0 2 particularly problematic north of Boston in the state-waters portion of Massachusetts Bay.

DMF is in the process of researching and mapping the 1881 line. However, this project and the complementary regulatory change are not expected to be complete until 2018. To more immediately resolve the burgeoning gear conflicts in Massachusetts Bay, DMF mapped the coordinates of the seaward mobile gear closure boundary using the current municipal boundaries as a proxy for the 1881 Line. Permit conditions have been issued to mobile gear fishermen establishing this boundary as the mobile gear closure boundary.

Recreational Black Sea Bass. DMF expects that recreational black sea bass regulations will remain status quo in Massachusetts for 2017. This will result in a May 21 – August 31 open fishing season with a 5-fish bag limit and 15 inch minimum size. However, at the end of April, the ASMFC will hold a conference call to further discuss recreational black sea bass. More details about any potential changes to the 2017 recreational black sea bass limits will be better understood after this meeting. The MFAC heard from several charter boat captains who expressed concerns regarding the negative impact that status quo regulations are expected have on their businesses.

Future Meetings Spring 2017 meetings have been scheduled for May 4th and June 15th. All meetings are held at 10:30 AM at the MA Division of Fish and Wildlife’s Headquarters, 1 Rabbit Hill Road, Westborough. The MFAC business meeting schedule is published on the Division’s website and agendas are made available approximately 1-week before the scheduled meeting. Meeting dates for the second half of 2017 will be announced in the near future.

The human impacts along the coastline continue to introduce pollutants into the ocean through storm drains, septic systems, treatment plants, power plants and the green lawns through use of fertilizers. These ALL contribute the overall decline in health of the ecosystem all fishermen depend upon to earn their living. When will ALL of this be factored into the assessment and threshold models?

The fishing industry continues to be managed using the “Best Available Science” and the unfortunate conundrum here is that the studies currently being done are in 200’ of water or less when 80% of the SNE fleet are fishing waters greater than 200’. We are asking the ASMFC to reevaluate the future stock assessment processes for SNE as there are a tremendous amount of variables impacting the SNE stock and the only one facet paying the price is the commercial fishing industry. The MLA recommends the following: remodel when trawl surveys are done i.e., no days with water temperature greater than 70 degrees F, remove Buzzards Bay and Area 6 from future stock assessments and increase ventless trap survey in Area 2 and Area 3.

Another unrealistic theory presented in Addendum XXV is that the fishing industry will increase their effort to compensate for the reductions in traps, gauge increases or seasonal closures. This is so untrue given the economics of running a lobster business today. As everything from bait, fuel, gear and other essentials continues to increase it is cost prohibitive to haul the gear more frequently. It is the exact opposite in that fishermen are allowing the post to soak for 3-5 nights. Fishermen are not going to spend their money on changing the water in the pots. Also, in a research paper by D. McKiernan and B. Estrella ’89 figure 2, Catch per Trap Haul the optimal soak time for efficiency of a trap is 4-5 days and averages the maximum catch per unit.

We are also concerned that the single species approach for fisheries management is NOT working. The increase in predation in SNE is staggering and the lobster industry is yet again at the bottom of this food chain. When a fishery is managed without consideration to the impacts on another, you have a perfect storm for the imbalance of predator vs. prey just like what SNE is currently enduring now with Sea Bass and Tautog. While some Subcommittee members questioned the ability to maintain the GOM/GBK stock at its current level of abundance, others commented that proactive management action could promote continued high biomass.  Are there any deficiencies in the current management plan? The current reference points for GOM/GBK trigger management when stock abundance falls to the 25th percentile. While this may be an appropriate threshold to maintain the population at levels seen during the reference time period (1982‐2003), the Subcommittee agreed that waiting until this point to initiate management action would be economically devastating given abundance levels have continued to increase since that time period. Lessons Learned from SNE Next, the Subcommittee discussed lessons learned from the SNE stock. Subcommittee members from the SNE states provided the following recommendations.  Be proactive. Given the rapid decline in the SNE stock as well as the time needed to develop, comment on, and implement regulatory changes, initiating action after landings have started to decline will be too late.  Address excess in the system. This could include latent effort (i.e. unused traps or inactive permits) or the continued purchase of faster and larger boats.  Standardized management measures. While several SNE addenda allow LCMAs to create their own proposals to achieve a target specified by the Board, the lack of standardization can create enforcement challenges and can lessen the expected biological benefits of the management tools.  Implement 100% harvester reporting. If management measures are ever considered which require information on historic participation in the fishery, harvester data from all fishermen will be necessary.

Preliminary Recommendations Moving Forward At the end of the meeting, the Subcommittee put together a list of preliminary recommendations for the GOM/GBK stock. Subcommittee members did request another meeting to further develop these recommendations.  Conduct additional research. In particular, a coastwide study is needed to evaluate changes in size‐at‐maturity and growth given much of the data currently used in the stock assessment may be out of date. In addition, specific larval surveys are needed to understand changing dynamics between Stage I and Stage IV lobsters as well as their relationship to environmental factors such as predation, zooplankton availability, and wind drift. Socio‐economic studies are also needed to understand changing input costs (such as the cost of bait) and the dispersion of revenue between small, medium, and large lobster vessels. This will help forecast expected economic consequences of potential reductions in lobster landings.

A dataset with an appropriate time series will need to be identified.  Develop an economic indicator and trigger. Given the primary concern is the potential economic impacts of a stock decline, economic indicators and triggers should be assessed and developed to determine when Board action is necessary. A trigger could prompt management action if landings or other defined economic indicators decline by a certain percentage over a specified time period. An economic trigger will also set clear expectations for industry of what will happen under various scenarios.  Modify current reference points. Under the current reference points, action is not triggered until abundance falls to the 25th percentile. The Subcommittee supports the TC’s recommendation that management action be triggered at the 50th percentile.

The amendment covers: • The inshore Gulf of Maine – Outer Schoodic Ridge and Mt. Desert Rock; • The offshore Gulf of Maine – Jordan Basin and Lindenkohl Knoll on the edge of Georges Basin; and • South of Georges Bank – Continental Slope and canyons region.

Gulf of Maine Boundary Alternatives

For the Gulf of Maine, the Council is considering multiple boundary alternatives for coral protection zones. • The Council previously adopted the larger red boundaries in the map at left for inclusion in the amendment. • On April 18 at its meeting in Mystic, CT, the Council directed the Habitat Plan Development Team to analyze the smaller black boundaries as an alternative to send to public hearings. • The Council has not yet identified preferences between the larger vs. smaller areas. South of Georges Bank – Continental Slope/Canyons Region Preferred Alternative The Council selected a broad coral protection zone boundary of 600 meters minimum depth, equivalent to roughly 325 fathoms, as its preferred alternative for the Continental Slope/canyons region, which is south of Georges Bank. The use of all bottom-tending gear would be prohibited within the zone. However, the Council’s preferred alternative provides a pot gear exemption for the deep-sea red crab fishery, which is the only fishery using bottom-tending gear known to take place deeper than 600 meters. The amendment also contains 300-, 400-, 500-, and 900-meter broad zone alternatives, which will be included in the public hearing document.

The Council will announce the public hearing schedule, including dates and locations, in early May. Late-May public hearings are anticipated.

The Council recognizes the importance of additional scientific research to understand the distribution and ecological importance of coral habitats.

As such, the amendment will include a detailed list of research priorities, as well as a provision to help the Council and National Marine Fisheries Service track coral-related research projects occurring within and around the designated management zones.

FOR IMMEDIATE RELEASE PRESS CONTACT: Janice Plante April 18, 2017 (607) 592-4817, [email protected] Council Considers Adjusting Skate Bait Trigger, Possession Limit The New England Fishery Management Council has initiated a framework adjustment to the Northeast Skate Complex Fishery Management Plan (FMP) to consider alternatives for adjusting the skate bait threshold trigger and possession limit. The Council’s Skate Committee recommended the action, and the National Marine Fisheries Service’s (NMFS) Greater Atlantic Regional Fisheries Office (GARFO) will provide assistance in developing the document. The framework will be narrowly focused, addressing only the trigger/possession limit issues. The Council anticipates taking final action at its June meeting and, if all stays on schedule, NMFS is aiming to implement the new measures in December. Complications with this winter’s fishery led the Council to pursue a framework adjustment. On January 30, NMFS reduced the commercial per-trip possession limits for both the skate wing and skate bait fisheries to the following “incidental” levels: • Wings – 500 pounds, down from 4,100 pounds; and • Bait – 1,135 pounds (the whole weight equivalent of 500 pounds), down from 25,000 pounds. Under current regulations, the two limits are tied together, so the bait fishery’s incidental possession limit always is set at the whole weight equivalent of the wing fishery limit. This winter, during skate wing Season 2 and bait Season 3 of the 2016 fishing year, total allowable landings (TALs) reached their respective 85% and 90% thresholds, triggering NMFS to conduct landings projections. Based on the results, the agency reduced possession limits to incidental levels to “prevent the seasonal skate wing and skate bait commercial quotas from being exceeded.” The lower possession limits, however, were preventing the TALs from being attained, partly because fishermen found it uneconomical to fish at such low levels, especially for skate bait. The new framework, which will become “Framework Adjustment 4,” will explore options that potentially allow possession limits for the bait fishery to be independent of the wing fishery.

Skate Amendment 5 – Limited Access The Council held six scoping hearings and accepted public comment through March 6 on Amendment 5 to the Skate FMP, which is considering developing a limited access program for both the skate bait and skate wing/non-bait fisheries. No clear consensus emerged from the hearings. While some supported limited access, others did not. Many members of the public were neither for nor against limited access, saying they wanted to see more specifics before formulating an opinion. Others preferred to address issues related to the skate wing and bait fisheries without developing a limited access program at all. Consequently, the Council’s Skate Committee and Skate Plan Development Team will continue working on the amendment to, among other things:

• Analyze the feasibility and/or practicality of dividing the two skate fisheries to develop independent limited access programs for each one; and • Further investigate whether or not limited access is justified for either fishery at this point in time.
