Your client now proposes, pursuant to Section 5 of the PSIP Standard, that its commonly owned full power station WNEU, Merrimack, NH, also use virtual channel 8 for two of the four program services that it airs – 8.2 for NBC Boston and 8.4 for Cozi. WNEU, however, has significant contour overlap with WMTW, Portland, ME (See Attached) , which is using virtual channel 8. Before WNEU begins using virtual channel 8, we will first require that your client obtain the written consent of Hearst Properties, the licensee of WMTW, to WNEU’s use of the same virtual channel. We also note that under Section 5 of the PSIP Standard, there can be no duplication of the two-part channel number in overlap areas, and it appears that WMTW is already using 8.2. Alternatively, your client can request a different virtual channel for WBTS-LD.
