Full text: "This is a little more complex than you'd find in most markets." David Amy CFO of Sinclair Broadcast, which already owns the local Fox affiliate WHAM-TV (Channel 13) has a new owner, sort of. Sinclair Broadcast Group said Monday it had picked up the non-license assets of the Rochester ABC and CW affiliate from Newport Television LLC for $54 million. Sinclair already owns local Fox affiliate WUHF-TV (Channel 31), as well as stations in Buffalo, Syracuse and Albany. But don't expect to see WHAM news anchor Don Alhart doing Fox's 10 p.m. newscast anytime soon. In the deal, Sinclair picked up all the physical property of the business, such as WHAM's studio equipment, the building and the vehicles. Sinclair also has an option to purchase the assets regulated by the Federal Communications Commission, such as the ABC and CW affiliation agreements and the syndicated programming contracts. But for now, Newport still owns the FCC-licensed assets. And FCC regulations set fairly high hurdles for ownership of two television stations in the same market. Sinclair Chief Financial Officer David Amy said the Maryland-based television station giant, with more than 70 TV stations scattered across some two dozen states, still has to figure out its end goal for the Rochester market.

    ENGINEERING STATEMENT SUPPORTING A PETITION FOR RECONSIDERATION prepared for United Communications Corporation KEYC-DT Mankato, Minnesota Facility ID: 68853 Ch. 12 15.2 kW (MAX-DA) 317 m United Communications Corporation (“United”) is the licensee of analog television station KEYC-TV Channel 12 and digital station KEYC-DT Channel 38, Facility ID: 68853, Mankato, Minnesota. United elected, for KEYC-TV’s post-transition facility, to operate on KEYC’s current analog Channel 12 in place of the 1998 allotted Channel 38. However, as a result of the channel election process, the actual coverage “foot-print” served by KEYC will be reduced from what it presently serves. Further, KEYC-TV Channel 12 currently operates using a non-directional antenna system. The final antenna pattern allotted by the Commission cannot be easily constructed with a real-world antenna. Using the existing non-directional antenna system forces KEYC to operate with a further reduction in power resulting in serious loss of coverage. The instant engineering statement has been prepared to support a request for a change in the station’s “certification” to permit replication of the authorized analog Grade B contour and to provide a practical implementation using station’s existing non-directional Channel 12 antenna. Background Appendix B of the Second Memorandum Opinion And Order On Reconsideration Of The Fifth And Sixth Report And Orders 1 (“MO&O”) clearly indicates that the KEYC Channel 38 allotment achieved the DTV/NTSC area match. Figure 1, attached hereto, provides a graphical comparison of the analog Grade B contour with the allotted Channel 38 facility.

(USA Broadcasting), to Univision Communications, Inc. (Univision).1 On March 2, 2001, Theodore M. White, Chief Executive Officer and sole voting shareholder of Urban Broadcasting Corporation (Urban), the permittee of WTMW(TV), Arlington, Virginia, filed a petition to deny.2 USA Broadcasting has a nonvoting stock interest in and contractual relationship with Urban, the substance of which the Commission addressed in Roy M. Speer, 11 FCC Rcd 18393 (1996) (Speer III). Although Univision challenges Urban’s standing, we will consider Urban’s arguments. 47 C.F.R. §73.3587. In connection with the transaction, Univision requests a continued satellite exception pursuant to Note 5 of the television duopoly rule, 47 C.F.R. §73.3555(b), in the New York, New York DMA. 1 A complete list of the applications filed and the licenses to be transferred is attached as Exhibit A.
