20a. How does the Committee accomplish its purpose? The Council provided 11 significant numbering recommendations to the FCC. To ensure impartial administration of numbering resources consistent with the requirements of the 1996 Act, the Council has taken the following actions:(1) February 15, 2005. North American Numbering Council (NANC) Recommendation Letter and Report to the Chief, Wireline Competition Bureau, Re: Recommendation for Process Flow Change Based on INC Issue 407. At the May 2004 NANC meeting, the INC requested input from the NANC concerning the existing process flow used by service providers to request dedicated central office codes for a single customer in pooling rate centers. Specifically, the INC recommended a process change so that requests by service providers for dedicated codes to be assigned to a single customer in mandatory pooling rate centers could be processed directly through the NANPA rather than through the PA. The INC explained that this specific process change would be more efficient and expedient to both service providers and to the single customer receiving the dedicated code. However, due to wording in the Fourth Report and Order in CC Docket 99-200 (NRO IV), the INC cannot adopt the process change without regulatory approval. The NANC recommended that the Commission take whatever steps are necessary so that the process for assigning a central office code in a specific circumstance can be modified.(2) March 15, 2005. NANC Report and Recommendation Regarding the Safety Valve Process. At the November 4, 2004 NANC meeting, Qwest made a presentation concerning an issue that it was having with the safety valve process. Qwest reported that the process was taking significantly longer than the 10 days that had been identified as a reasonable time period by the FCC in the Third Report and Order (FCC-01-362, paragraph 58-66). The average time was 35 days, with a minimum of 3 days and a maximum of 313 days. The Safety Valve IMG (IMG) was created to address this issue. The IMG was able to reach consensus on some items. Both carriers and state commission IMG participants do not propose to take away the FCC-delegated authority from states to handle safety valve cases. The IMG did agree that incremental improvements in the process would be made possible without the need to change the FCC Rules. The approach will be that these incremental changes that are being proposed will help shorten the overall interval for Safety Valves. If that does not happen, the IMG will revisit the issue and potentially look at a rule change for the FCC’s consideration.(3) April 13, 2005. NANC Advisory Letter to the Deputy Chief, Wireline Competition Bureau, Re: NeuStar Notice of the Addition of Two New Members to the NeuStar Board of Directors. On January 28, 2005, NeuStar notified the Wireline Competition Bureau that two new members had joined NeuStar's Board of Directors. The NANC's Numbering Oversight Working Group (NOWG) conducted a review to determine whether these new members satisfied the requirements that they be neutral and independent. The NOWG report was discussed at the NANC's March 15, 2005 meeting, and the consensus of the NANC was that the candidates are acceptable.(4) June 14, 2005. NANC Recommendation Letter to the Chief, Wireline Competition Bureau, Re: Request for FCC Endorsement of Two Administration Working Group (LNPA WG) Position Papers. At the May 17, 2005 NANC meeting, the LNPA WG presented two Postiion Papers addressing issues brought before the LNPA WG related to the following: 1. In some cases, an end user's Old Local Service Provider is requiring the end user's Social Security Number (SSN) to be included on the Local Service Request (LSR) submitted by the end user's New Local Service Provider for identification before the Old provider will agree to port-out the end user's telephone number. 2. In some cases, an end user's Old Local Service Provider is requiring a physical copy of the evidence of authorization, e.g., a Letter of Authorization, for each port request submitted by the end user's New Local Provider Service Provider before the Old provider will agree to port-out the end user's telephone number. The LNPA WG proposes that: 1. The consumer's Social Security Number/Tax Identification Number should not be required on a Local Service Request (LSR)/Wireless Port Request (WPR) to port that consumer's telephone number if the consumer's Account Number associated with the Old Local Service Provider is provided on the LSR/WPR for identification. 2. Firm Order Confirmation (FOC) of a port request should not be predicated on the Old Local Service Provider obtaining a physical copy of the evidence of authorization from the New Local Service Provider. In the event of an end user allegation of an unauthorized change, the New Local Service Provider shall, upon request and in accordance with all applicable laws and rules, provide the evidence to the Old Local Service Provider. At the May 17, 2005 NANC meeting, the LNPA WG received the NANC's endorsement of both stated positions. The NANC recommended that the Commission endorse these recommendations and take any other steps that may be necessary to encourage service providers to abide by them. (5) July 5, 2005. NANC Recommendation Letter and Report to the Chief, Wireline Competition Bureau, Re: NANC Change Orders 399 and 400. The FCC directed the North American Number Portability Management (NAPM) LLC to hold in abeyance two proposed changes (LNPA Change Orders 399 and 400) to the software utilized by the Number Portability Administration Center (NPAC) until it had the opportunity to consider the implications of the proposed changes. To assist the FCC in this consideration, the FCC asked the NANC to identify and analyze the policy, regulatory and consumer issues associated with the proposed changes. The NANC directed the Future of Numbering Working Group (FoN WG) to conduct the requested review. Change Order 399: The FoN WG determined that Change Order 399 did not have any policy, regulatory or consumer impacts and recommended that it should be implemented. The full NANC agreed with the FoNWG recommendation. Change Order 400: The FoN WG was unable to reach a consensus recommendation with respect to Change Order 400. The NANC asked the FoN WG and other interested parties to expand the report to provide more extensive arguments in favor of and opposing the proposed Change Order. The FoN WG submitted a revised report dated June 10, 2005 to the NANC, and the NANC had a telephonic meeting on June 28, 2005 to consider the revised report. The FoN WG nor the NANC was able to reach a consensus recommendation with respect to Change Order 400. The NANC Chair reiterated his understanding that the Commission's previous directive to hold Change Order 400 in abeyance continues to apply until the Commission directs otherwise. This understanding was confirmed by the FCC's Designated Federal Officer participating in the meeting. On August 11, 2005, the NANC received a letter from the Chief, Wireline Competition Bureau (Bureau), stating that the Bureau has reviewed the NANC's report and authorizes the NANC to proceed with its plan to have Change Order 399 included in the next NPAC software release. (6) July 25, 2005. NANC Letter to the Chief, Wireline Competition Bureau, Requesting FCC Endorsement of the LNPA N-1 Architecture Recommendations. The LNPA WG had been working on extensive guidelines for the overall N-1 Architecture when the FCC staff specifically requested the NANC to review the N-1 process for Extended Area Service (EAS) calls. The NANC recommended that the FCC endorse all of the LNPA WG's recommendations for determining which service provider is responsible for querying number portability databases, particularly with respect to Extended Area Service (EAS) calls. Such an endorsement should eliminate or at least substantialy mitigate confusion and disputes over this responsibility. The LNPA WG also recommended that the FCC take any other steps that may be necssary to encourage service providers to abide by them.(7) August 3, 2005. NANC Letter and Report to Chief, Wireline Competition Bureau, Re: VoIP Provider's Access to NANP Numbering Resources. On February 1, 2005, the FCC granted a waiver sought by SBC Internet Services, Inc. (SBCIS). The waiver allows SBCIS to obtain numbering resources directly from the NANPA and the PA. The Commission's waiver order also asked the NANC to determine what changes in the numbering rules would be required to make numbering resources generally available to IP-enabled service providers. The NANC's FoN WG presented its report and recommendations at the NANC's July 19, 2005 meeting. The NANC fully endorsed and adopted the FoN WG's report and recommendations. The NANC urged the FCC to take whatever action is required to implement the recommendations contained in the FoN WG's report.(8) August 3, 2005. NANC Transmittal Letter and Report to the Chief, Wireline Competition Bureau, Re: NANC Recommended Upgraded PA Technical Requirements Document. The PA Technical Requirements Document was prepared by the NANC's NOWG and endorsed by the NANC. The purpose of the Technical Requirements Document is to define the technical and operational requirements, the system requirements, and the functions of the pooling administrator contractor. It also serves as an umbrella document for industry guidelines, regulatory requirement, technical standards, and technical requirements that support thousands-block number pooling so that the contractor will be able to ascertain the full functionality required of the designated national contractor. (9) August 8, 2005. NANC Transmittal Letter to the Chief, Wireline Competition Bureau Re: Report and Recommendation Regarding The Alliance for Telecommunications Industry Solution's (ATIS) Ordering and Billing Forum (OBF) SMS/800 Number Administration Committee (SNAC) Proposal for Changes to the Industry Guidelines for Toll Free Number Administration. In June 2004, the OBF SNAC completed a process improvement proposal to diminish the potential of service outages for toll free service customers resulting from unauthorized or inadvertent porting of toll free numbers. On October 29, 2004, the OBF/SNAC via ATIS Ex Parte correspondence to the FCC submitted the proposed changes to the Industry Guidelines for Toll Free Number Administration. The FCC then asked the NANC to review this proposal and the NANC, in turn, established a Toll-Free Issues Management Group (Toll-Free IMG) to conduct the review. The Toll-Free IMG submitted the Report and Recommendation at the NANC's July 19, 2005 meeting. The NANC adopted the Report and Recommendation. (10) September 8, 2005. NANC Advisory Letter Re: pseudo Automatic Number Identification (pANI) Recommendation for VoIP E911. The NANC advised the FCC of a solution developed by the telecommunications industry and other stakeholders to satisfy the Commission's requirement that VoIP service providers must supply their customers with enhanced 9-1-1 service by November 28, 2005. (11) September 20, 2005. Final Evaluation Report of the NANPA and the PA Performance in 2004. The NANC is responsible for the annual evaluation of the North American Numbering Plan Administrator (NANPA) and the Thousands-Block Pooling Administrator (PA). The NANC's annual evaluations help the FCC to determine whether the NANPA and the PA are satisfying their contractual obligations. The annual evaluations identify areas where the NANPA and the PA could improve their performance. The reports conclude that the performance of the NANPA and the PA were both judged to be More Than Met performance standards. Users had a high level of satisfaction and significant praise for the NANPA and PA staff in the survey responses. Cooperation by the PA and the NANPA with the NANC, NOWG, the FCC, and State Regulators has been exceptional. Both Administrators displayed leadership, initiative, outstanding professionalism, and expertise.

20b. How does the Committee balance its membership? The North American Numbering Council has achieved a well-balanced membership by including representatives from every sector of the telecommunications industry, as well as members representing the North American Numbering Plan member countries, state regulators, and consumers. Competitive local exchange carriers (CLECS), Incumbent local exchange carriers (ILECS), Wireless carriers,Manufacturers of switches, Cable services, Wireless Associations, and Wireline Associations.

20c. How frequent and relevant are the Committee Meetings? Meetings are bi-monthly. In addition, interim conference call meetings are held as necessary. Meetings address current numbering issues that have competitive significance to the telecommunications industry.

20d. Why can't the advice or information this committee provides be obtained elsewhere? The Commission needs consensus advice from the industry on numbering issues so that it can make timely, informed decisions on numbering issues affecting competition in the telecommunications industry. NANC is essential to this process by facilitating industry consensus on complex numbering matters and providing initial dispute resolution. The Council's technical and operational expertise is based on day-to-day industry experience that the Commission lacks. By developing a reliable technical record on difficult numbering problems, the Council can greatly expedite the Commission's rulemaking functions.

20e. Why is it necessary to close and/or partially closed committee meetings? The portion of a meeting which involves the disclosure of trade secrets and commercial or financial information obtained from a person that is privileged or confidential, is subject to the Government in Sunshine Act's (GISA) which permits closure of meetings. Otherwise, all NANC meetings are open to the public. See GISA Section 552b(c)(4).

21. Remarks The NANC is supported by 12 major working groups or issue management groups and their related task forces. Their work is critical to the NANC recommendation process to assist the Commission with its goals as outlined in the Administration of the North American Numbering Plan, Report and Order, CC Docket 92-237 and Local Number Portability, CC Docket 95-116, Second Report and Order. Steering Group; Numbering Oversight Working Group; Legal Expertise Working Group; Numbering Resource Optimization Working Group; Local Number Portability Working Group; Billing and Collection Working Group; Industry Numbering Committee; North American Portability Management (NAPM) LLC; Future of Numbering Working Group; Safety Valve IMG; SMS/800 Number Administration Committee; pseudo Automatic Number Identification IMG. The NANC charter was approved for renewal by the General Services Administration (GSA) on September 26, 2005. Letters were mailed to the appropriate congressional officials on September 26, 2005, informing them of the committee's new charter termination date of September 27, 2007.

Narrative Description The FCC is responsible to Congress and the American people for ensuring that an orderly framework exists within which communications products and services can be quickly and reasonably provided to consumers and businesses. In support of this mission, one of the FCC's goals for the next five years is Competition, and specifically to: Support the Nation's economy by ensuring that there is a comprehensive and sound competitive framework for communications services. Such a framework should foster innovation and offer consumers meaningful choices in services. Such a pro-competitive framework should be promoted domestically and overseas. The NANP is the basic numbering scheme that permits interoperable telecommunications service within the United States, Canada, Bermuda, and most of the Caribbean. The NANP provides a framework for assigning the telephone numbers upon which those services depend for permitting calls throughout the U.S. and international calls between member countries to be completed without the need to dial international access codes and international country codes. These numbers are a public resource, and are not the property of the carriers. Access to numbering resources is critical to entities desiring to participate in the telecommunications industry. Adequate telephone numbers, available through a uniform numbering plan, are essential to provide consumers efficient access to new telecommunications services and technologies and to support continued growth of an economy increasingly dependent upon those services and technologies. Telephone numbers are the means by which businesses and consumers gain access to, and reap the benefits of, the public switched telephone network. These benefits cannot be fully realized, however, unless numbering resources of the NANP are administered in a fair and efficient manner. The purpose of the North American Numbering Council (NANC) is to advise the Federal Communications Commission (Commission) and to make recommendations, reached through consensus, that foster efficient and impartial North American Numbering Plan (NANP) administration. The NANC will advise the Commission on numbering policy and technical issues, initially resolve disputes as directed by the Commission, and provide guidance to the North American Numbering Plan Administrator (NANPA), the Local Number Portability Administrator (LNPA), and the Pooling Administrator (PA) as directed by the Commission. In carrying out its responsibilities, the Council shall assure that NANP administration supports the following policy objectives: (1) that the NANP facilitates entry into the communications marketplace by making numbering resources available on an efficient, timely basis to communications service providers; (2) that the NANP does not unduly favor or disfavor any particular industry segment or group of consumers; (3) that the NANP does not unduly favor one technology over another; (4) that the NANP gives consumers easy access to the public switched telephone network; and (5) that the NANP ensures that the interests of all NANP member countries are addressed fairly and efficiently, fostering continued integration of the NANP across NANP member countries.
